State ex rel. Stith v. Department of Rehabilitation & Correction

The Supreme Court affirmed the dismissal of the petition for a writ of mandamus that Appellant filed against Appellees, Ohio Department of Rehabilitation and Correction and related parties. In his petition, Appellant alleged that he was denied “fair and meaningful consideration” of his parole application. Appellees filed a motion to dismiss, and a court of appeals magistrate recommended dismissal on the grounds that the petition failed to state a claim. The court of appeals granted the motion to dismiss. The Supreme Court affirmed, holding that Appellant failed to establish that he was entitled to a writ of mandamus in this matter.
