NTCH, Inc. v. FCC

The DC Circuit dismissed NTCH's petition for review of an Enforcement Bureau order based on lack of jurisdiction. The court held that it had no jurisdiction to entertain NTCH's challenge to the order issued by the Bureau because NTCH did not first seek review with the Commission as a condition precedent to judicial review. The court further held that, even if NTCH's claim fell within the compass of 47 U.S.C. 208(b), the court still did not have jurisdiction to address it.
