Image's job was to manage a processing center for incoming mail related to Medicaid and other benefits programs. The agreement between the parties stated that HHSC would compensate Image using its “retrospective cost settlement model”. In 2016, HHSC notified Image that an independent external firm would conduct an audit of Image’s performance and billing for the years 2010 and 2011. The audit concluded that HHSC had overpaid Image approximately $440,000 in costs relating to bonuses, holiday pay, overtime, and other unauthorized labor expenses. HHSC then sought to recoup the overpayments by deducting from payments on Image’s invoices.The trial court granted HHSC’s motion for summary judgment and signed a final judgment for the commissioner. The court of appeals reversed the trial court’s judgment and dismissed Image’s entire suit for want of jurisdiction. Image sought review.The Supreme Court of Texas held that Image is a Medicaid contractor under Section 32.0705(a), and that the deadline in Section 32.0705(d) for auditing HHSC’s Medicaid contractors is mandatory. However, the court ruled that HHSC’s failure to meet the deadline does not preclude it from using the result of the audit or pursuing recoupment of overcharges found in the audit. The court affirmed the part of the court of appeals’ judgment dismissing Image’s claims arising from the 2016 audit for lack of jurisdiction, reversed the part of the judgment dismissing the remainder of Image’s suit, and remanded to the trial court for further proceedings. The judge denied her requests for expert funding, finding them broad and theoretical, and Harris failed to articulate concrete reasons how these proposed independent experts would specifically assist her defense.In Mississippi, the discretion to grant or deny an indigent defendant funds to retain an independent expert lies with the trial court. The court found that Harris failed to articulate how her own experts would actually assist her defense. Furthermore, the State’s case did not rely exclusively on these two experts and her BAC. The State called additional witnesses who established the patrol car was clearly visible with its blue lights flashing, and multiple other vehicles successfully passed the patrol car before Harris slammed into it. Witnesses also testified Harris smelled like alcohol, failed a field sobriety test, admitted she had been drinking, and tested positive for alcohol on a portable breathalyzer at the scene.The Supreme Court of Mississippi affirmed Harris’s conviction and sentence, discerning no abuse of discretion in the judge’s denial of Harris’s request for expert funds. Based on the overwhelming evidence supporting Harris’s aggravated DUI conviction, the judge’s discretionary denial, even if erroneous, was not so prejudicial as to render her trial fundamentally unfair. In May 2020, several days of historic rainfall raised the water level three feet above its previous maximum, triggering the dam's failure and causing extensive damage to properties downstream.The district court granted summary judgment to the counties, concluding that their efforts to maintain the water levels did not show that they intended to flood the downstream properties and "take" their land. The landowners appealed this decision.The United States Court of Appeals for the Sixth Circuit affirmed the district court's decision. The court found that the counties' petition to maintain the lake depth at the same level that had existed for roughly a century did not show that they intended to flood the downstream properties. The court also noted that the counties played no part in regulating or controlling the dam's infrastructure. Various parties, including MMK Maui, LP, Hui o Nā Wai ‘Ehā, the Maui Tomorrow Foundation, the Office of Hawaiian Affairs, Mahi Pono, LLC, and Wailuku Water Company, LLC, appealed from the Commission on Water Resource Management's decision regarding water use permits and instream flow standards.The Commission had designated Nā Wai ‘Ehā as a Surface Water Management Area, requiring existing and new water users to file surface water use permit applications. Over 140 applicants filed applications, including MMK, which operates two golf courses in the area, and Mahi Pono, which engages in agricultural operations on former sugar plantation lands.In 2016, the last remaining sugar plantation on Maui announced its closure. In response, the Hui/MTF filed a petition with the Commission to amend Nā Wai ‘Ehā’s Interim Instream Flow Standards. The Commission consolidated the permit and flow standards proceedings. In 2021, the Commission issued a decision amending the flow standards and granting various applicants surface water use permits.The parties appealed the Commission's decision to the Supreme Court of the State of Hawaii. The Supreme Court vacated the Commission’s decision and order with respect to the instream flow standards and the delegation of the Commission’s public trust duties, and remanded for further proceedings.
