In an original proceeding filed to the Colorado Supreme Court, at issue were the final legislative redistricting plans for the Colorado Senate and House of Representatives, adopted and submitted to the Court by the Colorado Independent Legislative Redistricting Commission (the “Commission”). Under article V, section 48.3, the Court's jurisdiction was limited to whether the Plans complied with the criteria listed in section 48.1 of article V, and the Court had to approve those Plans unless the it concluded the Commission abused its discretion in applying or failing to apply those criteria in light of the record before it. Finding no such abuse of discretion here, the Colorado Court approved the Plans and ordered the Commission to file those Plans with the Colorado Secretary of State as required by article V, section 48.3(5). This case concerns OSHA's November 5, 2021 Emergency Temporary Standard requiring employees of covered employers to undergo COVID-19 vaccination or take weekly COVID-19 tests and wear a mask.The Fifth Circuit granted petitioners' motion for a stay pending review, holding that the Nken factors favored a stay. The court concluded that petitioners' challenges to the Mandate are likely to succeed on the merits. The court stated that, on the dubious assumption that the Mandate does pass constitutional muster, it is nonetheless fatally flawed on its own terms. The court wrote that the Mandate's strained prescriptions combine to make it the rare government pronouncement that is both overinclusive (applying to employers and employees in virtually all industries and workplaces in America, with little attempt to account for the obvious differences between the risks facing, say, a security guard on a lonely night shift, and a meatpacker working shoulder to shoulder in a cramped warehouse) and underinclusive (purporting to save employees with 99 or more coworkers from a "grave danger" in the workplace, while making no attempt to shield employees with 98 or fewer coworkers from the very same. The court found that promulgation of the Mandate grossly exceeds OSHA's statutory authority and found arguments to the contrary unavailing.The court also concluded that it is clear that denial of petitioners' proposed stay would do them irreparable harm where the Mandate threatens to substantially burden the liberty interests of reluctant individuals, companies, and the States. In contrast, the court stated that a stay will do OSHA no harm whatsoever. Finally, the court concluded that a stay is firmly in the public interest. View "BST Holdings, LLC v. The primary issue in this case was whether imposing sales tax on in-state lessors of business equipment to a title insurer violated Article XIII, section 28(f) of the California Constitution. The California Department of Tax and Fee Administration (Department) contended it did not because the lessor, not the title insurer/lessee, was the taxpayer. In the Department’s view, whether the lessee reimburses the lessor for its sales tax obligation was strictly a matter of contract and did not implicate the constitutional limit on taxing insurers. Conversely, First American Title Insurance Company (First American) pointed out that in equipment leases not involving an insurer, the state assesses a use tax, not a sales tax. But where, as here, the lessee is constitutionally exempt from paying use tax, Regulation 1660(c)(1) solved that problem by providing that the sales tax applied instead. First American argued that as a result, Regulation 1660(c)(1) imposed a de facto use tax on title insurers in violation of Article XIII, section 28(f). The trial court agreed with First American and ordered the Department to “remove, strike out and otherwise give no force or effect to that portion of Regulation 1660(c)” providing that when the lessee is not subject to use tax, the sales tax applies. The Court of Appeal reversed: “Article XIII, section 28(f) does not prohibit a sales tax whose legal incidence is on a lessor, even though the economic burden of the tax is ultimately borne by the title insurer/lessee.” View "First American Title Insurance Co. v. Courtney, an Equal Employment Opportunity Commission (EEOC) Investigator, was removed from her federal employment effective December 7, 2019, based on a charge of being absent without leave. Her removal was affirmed by the Merit Systems Protection Board and Federal Circuit. Courtney applied to the Office of Personnel Management (OPM) for disability retirement benefits, asserting that she suffered from vision-related ailments, asthma, and diabetes. As a result of the vision problems, she said, she was unable to perform her duties, which were all computer-based, and she had difficulty commuting. Courtney alleged that she had requested reasonable accommodations that were not granted. The EEOC indicated that requested reasonable accommodations had been provided and that Courtney’s performance even with her alleged disability “was not less than fully successful” (even if her conduct was unsatisfactory).OPM denied her application, concluding that Courtney had failed to establish that her medical condition was incompatible with useful service or that the agency-provided reasonable accommodations were ineffective. The Merit Systems Protection Board and Federal Circuit affirmed, agreeing with an administrative judge that although Courtney met some of the requirements for disability retirement, she had not established that she was unable “to render useful and efficient service” in light of her disability—a requirement of 5 U.S.C. 8451(a)(1)(B). Courtney, an Equal Employment Opportunity Commission Investigator. was removed from her federal employment effective December 7, 2019, premised on a charge of being absent without leave (AWOL) for several months. An administrative judge first determined that the EEOC had proven its AWOL charge by a preponderance of the evidence then determined that Courtney had failed to establish her affirmative defenses—allegations of retaliation for EEO activity, discrimination based on disability, and harmful procedural errors. The administrative judge determined that there was a nexus between the AWOL charge and the efficiency of the federal service because an “essential element of employment is to be on the job when one is expected to be there” and agreed that removal was appropriate given the agency’s thorough analysis, which relied on the seriousness of Courtney’s misconduct, the length of her absence, and her supervisor’s statement regarding a loss in confidence in her based on her failures to communicate.The Merit Systems Protection Board and the Federal Circuit affirmed, noting evidence that Courtney was AWOL from March 25 to December 7, 2019, that she provided no medical excuse for her absence, and that the EEOC had granted every requested accommodation. The Food and Drug Administration denied Breeze’s Premarket Tobacco Product Applications for its electronic nicotine delivery systems (ENDS). Breeze sought a stay of the FDA’s order. Under the Family Smoking Prevention and Tobacco Control Act “any person adversely affected by” the denial of a Premarket Tobacco Product Application may seek judicial review of the denial, 21 U.S.C. 387l(a)(1)(B). Breeze argued that seeking a stay from the FDA would have been impracticable because the order takes effect immediately and the FDA can take months to consider an agency-level request for a stay.The Sixth Circuit denied the requested stay, finding that Breeze had not made a strong showing that it is likely to succeed on the merits.” Breeze has not made a strong showing that it would likely succeed on its claim that the FDA’s review of its application was arbitrary or capricious nor that the FDA’s denial of its application contradicted the FDA’s nonbinding 2019 guidance. That guidance contemplated more rigorous scientific data than contained in Breeze's application that its ENDS product adequately protected public health. The FDA cited well-developed evidence showing that flavored ENDS products’ special appeal to youths harms public health to a degree not outweighed by the (far-less-supported) effects of adult cigarette smokers switching to e-cigarettes. In 2008, following a diagnosis of multiple sclerosis (MS), Karantsalis sued the city under the Americans with Disabilities Act (ADA) and the Rehabilitation Act of 1973 by failing to make its facilities and infrastructure accessible to individuals with disabilities. He later voluntarily dismissed the lawsuit, believing that he lacked constitutional standing because his symptoms were mild and did not prevent him from accessing and using the city’s programs or services. By 2019, Karantsalis’s MS and his symptoms had progressed dramatically: he had started falling, developed a limp, and needed a disabled parking permit. His neurologist had prescribed a wheelchair.He again sued the city under the ADA and Rehabilitation Act alleging the sidewalks, municipal gymnasium, and parking at public facilities were inaccessible. The district court dismissed the case with prejudice, holding that it was barred by the four-year statute of limitations, which was triggered before or during 2008 when Karantsalis became aware of his MS diagnosis. The Eleventh Circuit reversed. From the face of his complaint, Karantsalis’s injury did not occur until at least 2017. Stephan “Craig” Mitchell suffered a work-related back injury in 1995. Since that time he had continuing back pain and received numerous medical interventions to try to treat the pain, including several surgeries. This appeal from the Alaska Workers’ Compensation Appeals Commission raised two issues: (1) whether the employer rebutted the presumption that the worker was permanently and totally disabled between 2004 and 2017 due to a back injury; and (2) whether the worker is entitled to compensation for a back surgery obtained without prior approval. The Alaska Supreme Court found that because the employer in this case failed to produce evidence of jobs that could accommodate the worker’s limitations, the employer failed to rebut the presumption that he was disabled. And because the surgery did not yield long­ term pain relief or functional improvement and because it entailed using a medical device in a way that the U.S. Food and Drug Administration (FDA) had specifically warned was not established as safe or effective, it was not an abuse of discretion to deny reimbursement. This case concerned the effect of the Alaska Legislature’s failure to exercise its confirmation power during the disruptions in regular government activity due to the COVID-19 pandemic. The legislature relied on a preexisting statute and a 2020 modification of it to assert that its failure to act is the same as a denial of confirmation for all those appointees, with the consequence that they could not continue to serve as recess appointments. The governor argued that his appointees remained in office and continued to serve until the legislature voted on their confirmation, one way or the other, in joint session. The superior court granted summary judgment to the legislature, and the governor appealed. In April 2021, the Alaska Supreme Court considered the appeal on an expedited basis and reversed the superior court’s judgment in a brief order, concluding that the laws defining legislative inaction as tantamount to rejection violated article III, sections 25 and 26 of the Alaska Constitution, which required that the legislature consider a governor’s appointees in joint session. In 2016, the Environmental Protection Agency issued a rule for trailers pulled by tractors based on a statute enabling the EPA to regulate “motor vehicles.” In that same rule, the National Highway Traffic Safety Administration issued fuel efficiency standards for trailers based on a statute enabling NHTSA to regulate “commercial medium-duty or heavy-duty on-highway vehicles.” The “Greenhouse Gas Emissions and Fuel Efficiency Standards for Medium- and Heavy-Duty Engines and Vehicles—Phase 2.” 81 Fed. Reg. 73,478, requires trailer manufacturers to adopt some combination of fuel-saving technologies, such as side skirts and automatic tire pressure systems. Truck Trailer Manufacturers Association sought review.The D.C. Circuit vacated all portions of the rule that pertain to trailers. Trailers have no motor and art not “motor vehicles.” Nor are they “vehicles” when that term is used in the context of a vehicle’s fuel economy since motorless vehicles use no fuel.
