M.B. (Mother) v. Alaska, DHSS, OCS
The superior court terminated a mother’s parental rights to her daughter after a termination trial. The mother appealed, and the Alaska Supreme Court concluded that on the facts of this case, the mother preserved her evidentiary appeal point. The Court rejected the Office of Children’s Services’s (OCS) assertion that the mother waived her evidentiary objection by not repeatedly raising it to every question asked during the relevant testimony. The Court also concluded that, because the superior court did not explain its evidentiary ruling at any point during the relevant testimony or in its termination decision, it could not determine: (1) whether the court allowed some or all of the hearsay testimony for limited purposes; (2) how the court used the hearsay evidence to reach its findings; or (3) whether the court erred or abused its discretion by allowing and relying on the hearsay testimony. The case was therefore remanded to the superior court for a full explanation of its evidentiary ruling, how the ruling related to the hearsay testimony, and how the hearsay testimony related to the trial court’s findings. In the Matter of the Protective Proceedings of: Baron W.
The grandmother of an Indian child was appointed as the child’s guardian. The Office of Children’s Services (OCS) took emergency custody of the child after the grandmother admitted using methamphetamine and the child tested positive for the drug. After working with the grandmother to address her drug use and other issues, OCS petitioned to terminate the grandmother’s guardianship. Following a hearing, the superior court found that termination of the guardianship was in the child’s best interests and removed the grandmother as guardian. The grandmother appealed, arguing that her removal violated the Indian Child Welfare Act (ICWA) and that termination of the guardianship was not in the child’s best interests. Finding no reversible error, the Alaska Supreme Court affirmed the superior court’s removal of the grandmother as guardian. Mitchell v. United Parcel Service, et al.
Stephan “Craig” Mitchell suffered a work-related back injury in 1995. Since that time he had continuing back pain and received numerous medical interventions to try to treat the pain, including several surgeries. This appeal from the Alaska Workers’ Compensation Appeals Commission raised two issues: (1) whether the employer rebutted the presumption that the worker was permanently and totally disabled between 2004 and 2017 due to a back injury; and (2) whether the worker is entitled to compensation for a back surgery obtained without prior approval. The Alaska Supreme Court found that because the employer in this case failed to produce evidence of jobs that could accommodate the worker’s limitations, the employer failed to rebut the presumption that he was disabled. And because the surgery did not yield long term pain relief or functional improvement and because it entailed using a medical device in a way that the U.S. Food and Drug Administration (FDA) had specifically warned was not established as safe or effective, it was not an abuse of discretion to deny reimbursement. This case concerned the effect of the Alaska Legislature’s failure to exercise its confirmation power during the disruptions in regular government activity due to the COVID-19 pandemic. The legislature relied on a preexisting statute and a 2020 modification of it to assert that its failure to act is the same as a denial of confirmation for all those appointees, with the consequence that they could not continue to serve as recess appointments. The governor argued that his appointees remained in office and continued to serve until the legislature voted on their confirmation, one way or the other, in joint session. The superior court granted summary judgment to the legislature, and the governor appealed. In April 2021, the Alaska Supreme Court considered the appeal on an expedited basis and reversed the superior court’s judgment in a brief order, concluding that the laws defining legislative inaction as tantamount to rejection violated article III, sections 25 and 26 of the Alaska Constitution, which required that the legislature consider a governor’s appointees in joint session. Cynthia W. v. Alaska, Dept. of Health & Social Services, Office of Children’s Services
In Alaska, a child was presumed to be at substantial risk of sexual abuse (and therefore in need of aid) if the parent knowingly leaves the child with a person convicted of or under investigation for a sex offense against a minor. After an adjudication hearing, a superior court found a child to be at substantial risk of sexual abuse based on evidence that she was left with her mother’s boyfriend, who had been indicted for sexual abuse of a minor. The mother appealed, arguing that the superior court erred by not acknowledging that an indictment was weaker proof than a conviction and by not making findings about the likelihood that the conduct underlying the indictment actually occurred. Because the statute did not require the superior court to draw such distinctions or make such findings, and because the findings the court did make are not clearly erroneous, the Alaska Supreme Court affirmed its ruling that the child was in need of aid. Windel v Matanuska-Susitna Borough
Property owners sued the Matanuska-Susitna Borough, challenging the validity of easements that cross their property to give access to neighboring residences. The superior court dismissed most of the property owners’ claims on res judicata grounds, reasoning that the claims had been brought or could have been brought in two earlier suits over the same easements. The court also granted the Borough’s motions for summary judgment or judgment on the pleadings on the property owners’ claims involving the validity of construction permits, redactions in public records, and whether the Borough had acquired a recent easement through the appropriate process. One claim remained to be tried: whether the Borough violated the property owners’ due process rights by towing their truck from the disputed roadway. The court found in favor of the Borough on this claim and awarded the Borough enhanced attorney’s fees, finding that the property owners had pursued their claims vexatiously and in bad faith. The property owners appealed. The Alaska Supreme Court concluded the superior court correctly applied the law and did not clearly err in its findings of fact. Alaska, Office of Lieutenant Governor, Division of Elections v. Arctic Village Council, et al.
About two months before the 2020 general election, a village government, a nonpartisan political organization, and two individual Alaska voters sought to enjoin the State from enforcing a statute that required absentee ballots to be witnessed by an official or other adult. They argued that, under the unusual circumstances posed by the COVID-19 pandemic, the witness requirement unconstitutionally burdened the right to vote. The superior court granted a preliminary injunction, concluding that the State’s interests in maintaining the witness requirement were outweighed by the burden that requirement would impose on the right to vote during times of community lockdowns and strict limits on person-to-person contact. The court also rejected the State’s laches defense, reasoning that the unpredictability of the pandemic’s course made it reasonable for the plaintiffs to wait as long as they did before filing suit. The State petitioned for review. After an expedited oral argument the Alaska Supreme Court affirmed the superior court’s decision, finding no abuse of discretion. Alaska Public Offices Commission v. Patrick, et al.
In 2012, the Alaska Public Offices Commission (APOC) issued an advisory opinion stating that the contribution limits in Alaska’s campaign finance law were unconstitutional as applied to contributions to independent expenditure groups. In 2018, three individuals filed complaints with APOC alleging that independent expenditure groups had exceeded Alaska’s contribution limits. APOC declined to enforce the contribution limits based on its advisory opinion. The individuals appealed to the superior court, which reversed APOC’s dismissal of the complaints and ordered APOC to reconsider its advisory opinion in light of a recent Ninth Circuit Court of Appeals decision. APOC appealed, arguing that it should not have been required to enforce laws it viewed as unconstitutional and that its constitutional determination was correct. Because the Alaska Supreme Court found it was error to reverse APOC’s dismissal of the complaints, it reversed the superior court’s order. View "Alaska Public Offices Commission v. In re Resource Development Council for Alaska, Inc., et al.
The issue this case presented for the Alaska Supreme Court's review centered on a challenge to the lieutenant governor’s decision that the sponsors of an initiative, “An Act changing the oil and gas production tax for certain fields, units, and nonunitized reservoirs on the North Slope,” had collected enough signatures to allow the initiative to appear on the ballot in the 2020 general election. Entities opposed to the initiative argued that signatures should not have been counted because the signature gatherers (the circulators) falsely certified that their compensation complied with Alaska election law. The statute governing circulator compensation allows them to be paid no more than “$1 a signature.” The superior court decided that this statute was unconstitutional because it imposed an unreasonable burden on core political speech — “interactive communication concerning political change.” It therefore concluded that the lieutenant governor properly counted the challenged signatures and properly certified the initiative petition for the ballot. The entities opposed to the initiative filed this appeal. The Supreme Court heard oral argument in August 2020, and on August 31 issued a summary order affirming the superior court’s judgment. French v. Alaska Oil & Gas Conservation Commission
The Alaska Oil & Gas Conservation Commission denied an individual’s request for a hearing regarding a reported natural gas leak and whether the leak constituted “waste” under Alaska law. The agency concluded it had no jurisdiction over the matter because it previously had investigated and had concluded the leak did not constitute “waste.” The individual appealed to the superior court, which affirmed the agency’s decision. The Alaska Supreme Court reversed, finding the individual's request for a hearing was improperly denied: "The Commission has jurisdiction over waste determinations, and substantial evidence does not support its assertion that it investigated and concluded this leak was not waste."
