In 2003, the Pennsylvania Department of Community and Economic Development (“DCED”) designated the City of Pittsburgh as a financially distressed municipality under the Municipal Financial Recovery Act (“Act 47”). The City’s collective bargaining agreement (“CBA”) with Appellant Fraternal Order of Police Fort Pitt Lodge No. 1 (the “Union”) expired on December 31, 2014. As the parties were unable to reach consensus on a new CBA, they entered into interest arbitration governed by the Policemen and Firemen Collective Bargaining Act (“Act 111”). After an evidentiary hearing encompassing ten days of testimony before an Act 111 arbitration panel, the panel issued a final award covering years 2015-2018. The Award contained numbered factual findings one of which included a list of itemized findings relating to the City’s population, income, housing vacancy rate, and, most relevantly, the City’s police officer compensation as measured against other economically and demographically comparable subdivisions. The Union’s financial expert had testified in a prior matter in 2014 that the City’s police pay was above the median of a comparison group; the City’s police officers paid substantially lower contributions toward health insurance than other City employees for the same coverage level; and the Union’s own financial expert believed City police officers were paid competitively. The Union filed an appeal in the Commonwealth Court, contending that the Award deviated from the Plan by failing to ensure competitive compensation for police officers as required by the Plan. The Union argued that the court had jurisdiction to rule on its appeal per Section 252(e) of Act 47. Te Pennsylvania Supreme Court determined the Commonwealth Court properly held that the Union’s challenge to the Award fell outside the scope of Section 252(e). Donaldson, a Capitol Police officer, was involved in an off-duty domestic incident. The Office of Professional Responsibility investigated and recommended termination. The Disciplinary Review Board agreed that Donaldson should be punished but recommended only a 45-day unpaid suspension. The Chief of Police decided to terminate Donaldson. After 30 days passed without intervention by the Capitol Police Board, the Chief’s decision was deemed approved and Donaldson was terminated (2 U.S.C. 1907(e)(1)(B)) Under a collective bargaining agreement (CBA), the Chief’s termination decisions are subject to binding arbitration. The Union requested arbitration. The Police refused to select an arbitrator, arguing that it “would be in violation of a determination of the Capitol Police Board and its distinct statutory authority by consenting to the jurisdiction of any arbitrator.” The Union protested to the General Counsel for the Office of Compliance (OOC) that the Police violated section 220(c)(2) of the Congressional Accountability Act of 1995, 2 U.S.C. 1301–1438, by refusing to arbitrate an unresolved grievance and therefore committed an unfair labor practice. A hearing officer granted OOC judgment. The Board of Directors of the Congressional Accountability Office of Compliance reasoned that the Police is obligated to arbitrate disputes arising under its CBA unless it can cite clearly-established law that removes the dispute in question from arbitration; the Police’s legal arguments fell short. The Supreme Court affirmed the judgment of the court of appeals denying David Murray’s petition for a writ of mandamus challenging the State Employee Relations Board’s (SERB) dismissal of Murray’s unfair labor practice charges against the City of Columbus and the Fraternal Order of Police (FOP) as untimely, holding that the SERB did not abuse its discretion when it dismissed Murray’s unfair labor practice charges.After being fired from his job as a police officer, Murray sought to regain his employment through arbitration involving the City and his union, the FOP. Dissatisfied with the way the arbitration was handled, Murray brought two unfair labor practice charges against the City and the FOP. SERB dismissed all of the charges, concluding that they had been filed outside the ninety-day statute of limitations applicable to each charge. Murray then filed a petition for a writ of mandamus to compel that the charges be set for a hearing. The court of appeals denied the writ. Petitioners the New England Police Benevolent Association, Inc. (NEPBA) and the State Employees’ Association of New Hampshire, Inc., SEIU, Local 1984 (SEA), appealed a decision of the New Hampshire Public Employee Labor Relations Board (PELRB) dismissing their unfair labor practice complaints filed against respondent State of New Hampshire. After several bargaining sessions, the State rejected all wage proposals, explaining that “the Governor was not offering any wage increases . . . given anticipated increases in prescription drug costs in the healthcare market.” As a result, the Teamsters and the NHTA declared an impasse. Although no other unions declared an impasse, the State took the position that all five unions must proceed to impasse mediation. The SEA challenged the State on this position, and subsequently, petitioners each filed complaints with the PELRB. During the pendency of these complaints, the State advised all five unions that it would select a mediator and continued to assert that all of the unions must participate in impasse mediation “because the issues to be resolved affected all bargaining units.” The PELRB consolidated the petitioners’ complaints and found in a 2-1 vote that RSA 273-A:9, I, “requires all five unions to utilize the Union Committee format at the bargaining table and during impasse resolution proceedings until such time as the common terms and condition[s] of employment are settled.” The PELRB, therefore, dismissed the complaints and ordered the petitioners to coordinate with the other unions “to determine the forum in which negotiations will go forward.” Petitioners unsuccessfully moved for rehearing, and this appeal followed. Finding no reversible error in the trial court's dismissal of petitioners' complaints, the New Hampshire Supreme Court affirmed the PELRB. The Supreme Court affirmed the decision of the arbitration board finding that a discount to wholesale customers who renewed their contractual relationship with Nebraska Public Power District (NPPD) was not discriminatory or an abuse of NPPD’s statutory rate-setting authority.Appellants were political subdivisions engaged in the distribution of electricity to retail electric customers and were wholesale customers of NPPD. Appellants brought this complaint after they elected not to renew their contractual relationship, alleging that the discount was discriminatory and that NPPD breached the implied covenant of good faith and fair dealing by charging them a different rate. The arbitration board determined that the discount was reasonable and nondiscriminatory and that NPPD did not breach the contract or the covenant of good faith and fair dealing. The Supreme Court affirmed, holding that NPPD’s rate structure was fair, reasonable, and nondiscriminatory and that the rate structure did not constitute a breach of contract or the implied covenant of good faith. This litigation began when purchasers of computer service contracts filed a putative class action against the sellers. The sellers successfully moved to compel arbitration pursuant to the terms of the computer services contracts. The sellers, in the meantime, had applied for tax abatements from the Commissioner of Revenue. The Commissioner denied the applications, and the sellers petitioned the Appellate Tax Board. Appellant, one of the consumers who purchased these service contracts, moved to intervene in the proceedings, which petition the Board allowed. The Board reversed the Commissioner’s decision and allowed the abatements. Taxes were imposed on the service contracts purchased by Appellant. After final judgment was entered in the sellers’ favor in the class action litigation, the sellers withdrew their tax abatement petitions with prejudice. The Board denied Appellant’s motion to strike the withdrawals and terminated the proceedings. The Supreme Judicial Court reversed, holding (1) the Board did not err as a matter of law in allowing the Sellers’ withdrawals; but (2) the Board’s termination of the proceedings in their entirety, after permitting Appellant to intervene and allowing the abatements, was an error of law. This litigation began when purchasers of computer service contracts filed a putative class action against the sellers. The Agricultural Labor Relations Act’s (ARLA) “mandatory mediation and conciliation” (MMC) statute neither violates equal protection nor unconstitutionally delegates legislative power. Further, employers may not refuse to bargain with unions - whether during the ordinary bargaining process or during MMC - on the basis that the union has abandoned its representative status.In this case, the United Farm Workers’ of America (UFW) filed an MMC request with the Agricultural Labor Relations Board after failing to reach a collective bargaining agreement with Gerawan Farming, Inc. Mediation also failed to produce an agreement, and therefore, the mediator submitted a report fixing the contractual terms. The Board adopted the report in its final order. The court of appeal concluded (1) the MMC statute on its face violates equal protection principles and improperly delegates legislative authority, and (2) an employer may not defend against a union’s MMC request by challenging the union’s certification as bargaining representative on the basis of abandonment. The Supreme Court disagreed, holding (1) the MMC statutes is not unconstitutional; and (2) an employer may not raise an abandonment defense to an MMC request. View "Gerawan Farming, Inc. v. In an appeal by allowance, the issue presented for the Pennsylvania Supreme Court’s review was whether, in the context of a grievance arbitration award, an arbitrator has subject matter jurisdiction to adjudicate a dispute between a union and a municipality arising out of a surviving spouse’s pension benefit, where the benefit was afforded to the surviving spouse statutorily and incorporated into the parties’ collective bargaining agreement (CBA). Pamela Cimino’s husband, Thomas J. Cimino, was a police officer for the City of Arnold, Pennsylvania (City) from July 1, 1990 until April 4, 2002. On April 4, 2002, Officer Cimino died off-duty of natural causes. At the time of his death, Officer Cimino had completed 11.77 years of service. The City issued Mrs. Cimino 142 consecutive monthly death benefit payments, from May 1, 2002 to February 1, 2014. However, in a 2014 compliance audit, the Commonwealth Auditor General’s Office determined that the City was incorrectly administering the death benefit. According to the Auditor General’s compliance audit, the City had been paying Mrs. Cimino twice as much as it should have under its interpretation of the applicable statute. The Wage Policy Committee of the City of Arnold Police Department (Union) initiated a grievance on behalf of Mrs. Cimino to dispute the 50% reduction in her death benefit pension payments. The Union followed the grievance procedure contained in the CBA between the City and the Union. The Pennsylvania Supreme Court concluded a dispute as here was arbitrable under the Policemen and Firemen Collective Bargaining Act (“Act 111”), 43 P.S. secs. 217.1-217.10, because the surviving spouse’s pension benefit was incorporated into the CBA.
