The Union of Concerned Scientists sought review of a Department of Energy (DOE) rule concerning the designation of “critical electric infrastructure information,” 16 U.S.C. 824o-1(a)(3), exempted from FOIA disclosure and not to be “made available by any Federal, State, political subdivision or tribal authority pursuant to any Federal, State, political subdivision or tribal law requiring public disclosure of information or records.”The Union, a national nonprofit organization consisting of scientists, engineers, analysts, and policy and communication experts who conduct “independent analyses,” argued that the rule exceeds the Department’s authority under section 215A of the Federal Power Act, is arbitrary and capricious, and was promulgated in violation of the notice and comment requirements of the Administrative Procedure Act. The D.C. Circuit dismissed the petition for lack of Article III standing. There is no indication that DOE’s rule would deprive the Union or its members of information they would receive if DOE were to apply a 2016 Rule promulgated by the Federal Energy Regulatory Commission. The Surface Transportation Board deadlocked 1–1–1 on what, if anything, to do about an existing rule governing rail carrier fuel surcharges. After five years with no majority position on how to proceed, the Board unanimously voted to discontinue its Advanced Notice of Proposed Rulemaking (ANPRM) in the interest of administrative finality. The League argued that the Board acted unreasonably by deadlocking and that an impasse does not excuse an agency from issuing a well-reasoned merits decision that considers the relevant factors.The D.C. Circuit dismissed the League’s appeal for lack of standing, The League did allege an injury-in-fact: The costs of shipping are supposedly too high. Causation is also easily established because the Board’s safe harbor provision, coupled with the Board’s failure to issue a rule that would modify or eliminate that provision, plausibly created the higher rates. But to satisfy the redressability requirement, the asserted injury must be “capable of resolution and likely to be redressed by judicial decision” and courts lack the power to issue an order to break the Board’s deadlock or to order any individual Board Member to change his policy position. Abbott Laboratories and Abbott Laboratories, Inc. (collectively, "Abbott"), petitioned the Alabama Supreme Court for a writ of mandamus to direct the Mobile Circuit Court to dismiss all claims asserted by the Mobile County Board of Health and the Family Oriented Primary Health Care Clinic (collectively, "Mobile Health") against Abbott on the basis that those claims are barred by the rule of repose or by the applicable statute of limitations. Mobile Health alleged that Abbott had participated in the marketing of a specific prescription drug, OxyContin. Mobile Health alleged that this marketing campaign "precipitated" an "opioid crisis" in the United States, and specifically in Alabama, because it caused an astronomical increase in the use of opioids by patients who quickly became dependent upon the drugs. Mobile Health asserted that it brought this action because of the burdens it had to bear as a result of the "opioid epidemic." The Alabama Supreme Court concluded the applicable statutes of limitations barred Mobile Health's claims against Abbott. Therefore, the Court granted Abbott's petition for a writ of mandamus, and directed the circuit court to enter an order dismissing Mobile Health's claims against Abbott. The State of Alabama appealed a circuit court order that dismissed the State's claims seeking injunctive and declaratory relief "to abate a public nuisance of unlawful gambling," pursuant to section 6-5-120, Ala. Code 1975, against some, but not all, of the defendants. The circuit court certified its order as final pursuant to Rule 54(b), Ala. R. Civ. P. However, we determine that the order was not appropriate for Rule 54(b) certification; therefore, the Alabama Supreme Court dismissed the appeal. View "Alabama v. Keith Bronner sued the City of Detroit seeking no-fault benefits. Bronner was a passenger on a city-operated bus when the bus was involved in an accident with a garbage truck operated by GFL Environmental USA Inc. The city self-insured its buses under the no-fault act, MCL 500.3101 et seq. Under the city’s contract with GFL, GFL agreed to indemnify the city against any liabilities or other expenses incurred by or asserted against the city because of a negligent or tortious act or omission attributable to GFL. The city paid Bronner about $58,000 in benefits before the relationship broke down and Bronner sued the city. Shortly after Bronner sued the city, the city filed a third-party complaint against GFL pursuant to the indemnification agreement in their contract. GFL moved for summary judgment, arguing that the city was attempting to improperly shift its burden under the no-fault act to GFL contrary to public policy. The circuit court denied GFL’s motion and granted summary judgment for the city. GFL appealed as of right, arguing that the indemnification agreement was void because it circumvented the no- fault act. The Court of Appeals agreed with GFL and reversed in an unpublished opinion, citing the comprehensive nature of the no-fault act and concluding that the act outlined the only mechanisms by which a no-fault insurer could recover the cost of benefits paid to beneficiaries. The Michigan Supreme Court reversed, finding that regardless of the differing opportunities for an insurer to reach an indemnification agreement with a vendor, such agreements were enforceable. Plaintiff-appellant Dora Leon’s husband, José Leon, was shot and killed by a neighbor in a driveway of a mobile home park in Cherry Valley, where Dora and José lived. Riverside County Sheriff’s deputies unsuccessfully attempted to revive José but, before doing so, one of the deputies dragged José’s body several feet and, in the process of being dragged, José’s pants fell to his thighs, exposing his genitals. José’s body lay, with his genitals exposed, for around eight hours while sheriff’s deputies and other law enforcement officers evacuated the mobile home park, located the shooter who had shot himself dead, and continued investigating the shooting. José’s body was not removed until shortly after the coroner arrived on the scene and completed processing the body. Dora sued the County of Riverside, alleging a single cause of action for negligence, sounding in negligent infliction of emotional distress, based on the failure of Riverside County Sheriff’s deputies to promptly cover José’s exposed body, or remove the body from the scene, while deputies evacuated the park, searched for the shooter, and investigated the shooting. The trial court granted the county’s motion for summary judgment on Dora’s first amended complaint (FAC). Dora argued on appeal that the deputies who responded to the shooting, and the county as the deputies’ employer, owed Dora a duty of care not to allow José’s body to lie exposed while deputies and other law enforcement officers secured the area and investigated the shooting. The Court of Appeal affirmed, finding that negligence, if any, occurred during the court of the deputies’ official investigation of the shooting. For this reason, they were immune from liability to Dora, and the counts, as the deputies’ public entity employer, was immune from vicarious liability for the deputies’ alleged negligence. The issue before the Washington Supreme Court’s in this case was whether an individual’s YouTube channel qualified as “news media” for requests for certain records under the Washington Public Records Act (PRA). In 2014, Brian Green and Peter Auvil went to the County-City Building in Tacoma to file a document and pay a parking ticket. As they went through security, the guard asked to search Auvil’s bag. Auvil refused. A Pierce County deputy sheriff came to assist, and Auvil began to record a video of the interaction on his phone. Auvil continued to refuse to allow the security guard to search the bag, arguing that the security checkpoint was a violation of his privacy rights. The conversation escalated, and the deputy asked the men to leave. When Green stood too close to him, the deputy shoved Green and caused him to fall backward onto the floor. The deputy arrested Green for criminal obstruction and took him to jail. He was released approximately 24 hours later. The prosecuting attorney’s office dismissed the charge. In December 2017, Green e-mailed a PRA request to the Pierce County Sheriff’s public records office requesting “[a]ny and all records of official photos and/or birth date and/or rank and/or position and/or badge number and/or date hired and/or ID Badge for all detention center and/or jail personnel and/or deputies on duty November 26 & 27 2014.” A representative of the Sheriff’s “Public Disclosure Unit” sent 11 pages of records, but did not include photographs or dates of birth as requested, explaining that the information was exempt under the PRA. Green said he was “working on a story concerning the Pierce County Jail” and again signed his e-mail with the title, “Investigative Journalist.” Green claimed his 6,000-subscriber YouTube channel met the definition of “news media” under the PRA. The Supreme Court concluded the statutory definition of “news media” required an entity with a legal identity separate from the individual. Green did not prove that he or the Libertys Champion YouTube channel met the statutory definition of “news media,” and, thus, he was not entitled to the exempt records. Therefore, the trial court was reversed in part. The Court affirmed the trial court’s denial of Pierce County’s motion to compel discovery. View "Green v. Pierce County" on Justia Law

Loyd Eugene Ware filed suit against the City of Kendrick (the City) alleging that in December 2016, a water pipe maintained by the City failed and flooded his property, causing damage. The City answered, claiming that Ware had failed to file a timely notice of tort claim within 180 days of the City’s alleged negligence, a statutory prerequisite to filing suit against a governmental entity under Idaho Code section 6-906. The City averred the flooding occurred on December 17, 2016, and the notice of tort claim was not filed until two hundred twenty-two days later. The City thus moved for summary judgment, which was granted by the district court. Ware timely appealed. Finding no reversible error, the Idaho Supreme Court affirmed the grant of summary judgment in favor of the City. View "Ware v. City of Kendrick" on Justia Law

This appeal arose from two cases consolidated for trial, involving a California Raisin Marketing Order (the Marketing Order) first issued in 1998 by the California Department of Food and Agriculture (the Department) under the California Marketing Act of 1937 (the CMA). The first case, Lion Raisins, Inc., et al. v. Ross (case No. C086205) sought a declaration and injunctive relief filed by Lion Raisins, Inc., et al. (collectively, Lion). The Lion complaint sought a declaration that the Marketing Order was unconstitutional and invalid, and requested an injunction against future assessments, and a refund of all assessments paid since the 1999-2000 crop year. In the second case, People ex rel. Ross v. Raisin Valley Farms, LLC, et al. (case No. C086206), Raisin Valley Farms, LLC, et al. (collectively, Raisin Valley) sought to recover unpaid assessments, and a related cross-complaint against the Department for declaratory, injunctive, and compensatory relief. Similar to the Lion complaint, the Raisin Valley cross-complaint challenged the validity of the Marketing Order on multiple grounds. The trial court initially entered judgment against the Department on the consolidated cases, concluding the Marketing Order was invalid because there was insufficient evidence that the Marketing Order was necessary to address severe economic conditions in the raisin industry. The Department appealed and the Court of Appeal reversed, concluding the trial court’s interpretation of the CMA was too narrow. On remand, after additional briefing, the trial court entered judgments in favor of the Department, denying the challenges to the Marketing Order. Lion and Raisin Valley appealed those judgments, asserting numerous errors. With regard to the appeal in the Lion case, the Court of Appeal modified the judgment to dismiss the “varietal benefit” and “non-disparagement” claims due to appellants’ failure to exhaust administrative remedies, and affirmed the judgment as modified. Plaintiff New Hampshire Alpha of SAE Trust (SAE) appealed a superior court order ruling that the Town of Hanover Zoning Board of Adjustment (ZBA) had subject matter jurisdiction to hear SAE’s administrative appeal in the related case of New Hampshire Alpha of SAE Trust v. Town of Hanover, 172 N.H. 69 (2019) (SAE I). Defendant Town of Hanover (Town) cross-appealed the trial court’s denial of its request for attorney’s fees. Dartmouth College notified the Planning and Zoning Office that the chapter of the New Hampshire Alpha Chapter of Sigma Alpha Epsilon was suspended by the national organization. The College officially derecognized the fraternity, which meant the facility became ineligible to operate as an “I” district student residence. Continued use of the property as a residence would have been a violation of the zoning ordinance. In subsequent proceedings, SAE challenged the ZBA’s jurisdiction to hear SAE’s appeal in the first instance. The Town argued it was entitled to attorney’s fees because SAE’s challenge in this case was frivolous with no good faith basis in fact or law, and asserted that it was only intended to waste time and needlessly delay final judgment in this matter. Finding no reversible error in the superior court’s judgment, the New Hampshire Supreme Court affirmed judgment to SAE’s appeal and the Town’s cross-appeal. View "New Hampshire Alpha of SAE Trust v.
