Defendant County of Placer sold plaintiff Patrick Hodges’s real property at a tax sale. The County later paid plaintiff the excess proceeds remaining from the sale less payments made to others. Plaintiff contended the County, its board of supervisors, and its treasurer breached a fiduciary duty they owed him, and converted his personal property, when they did not audit a payment made from the proceeds to others and did not pay him interest or earnings on its investment of the proceeds while it held them in trust. The trial court sustained the County’s demurrer to plaintiff’s second amended complaint without leave to amend and entered a judgment of dismissal. The trial court determined plaintiff could not state a claim for breach of a fiduciary relationship because no such relationship existed between him and the County. Even if a fiduciary relationship existed, plaintiff did not allege any breach or any damages arising from a breach. The court also found plaintiff could not state a claim for conversion. He did not allege the County committed a wrongful act in withholding the excess proceeds or that it interfered with his possession of the proceeds. Three cases were consolidated by the Idaho Supreme Court for the purposes of appeal. The cases involved three separate actions: one brought by First Security Corporation and two others brought by Richard Fosbury to quiet title to their purported ownership of irrigation water rights to land owned by Belle Ranch, LLC. All parties agreed that partial decrees for the water rights were issued in the Snake River Basin Adjudication (SRBA) in the name of South County Estates, LLC. As South County’s successors in interest, First Security and Fosbury argued their interests in the water rights are senior and therefore superior to the interest of Belle Ranch, LLC. Notwithstanding these claims, the district court quieted title to the water rights in question to Belle Ranch, LLC. First Security and Fosbury appeal. The Idaho Supreme Court determined First Security and Fosbury’s claims were precluded by res judicata: the claims were the same claims that were adjudicated in the SRBA. The Supreme Court found it was appropriate for the district court to quiet title in favor of Belle Ranch, LLC, because Belle Ranch, LLC, filed a notice of a change in ownership during the pendency of the SRBA. Dale Johnson maintained roller coasters for Silverwood, Inc. Among rising contentions and a dispute with Silverwood’s new director of construction and maintenance, Johnson resigned his position on June 8, 2015. He subsequently applied for unemployment benefits, but his claim was denied. Johnson challenged the denial with the Appeals Bureau of the Idaho Department of Labor, and a hearing was held on August 5, 2015. When denied again, Johnson appealed to the Industrial Commission. While the appeal was pending, Johnson learned that his hearing’s recording was lost. The Industrial Commission remanded the case to the Appeals Bureau for a new hearing. Ultimately, after two additional hearings and a second appeal to the Industrial Commission, Johnson won his claim for benefits with the Commission finding that Johnson was eligible for benefits. Johnson subsequently filed suit against the Department of Labor for unnecessary delays and other alleged improprieties in the handling of his claim. The district court dismissed the case for failure to file a notice of tort claim pursuant to the Idaho Tort Claims Act and then denied Johnson’s post-judgment motions. Charte (relator) filed a False Claims Act (FCA), 31 U.S.C. 3729–3733, "qui tam" suit alleging that defendants, including Wegeler, submitted false reimbursement claims to the Department of Education. Relators are entitled to part of the amount recovered. As required to allow the government to make an informed decision as to whether to intervene, Charte cooperated with the government. Her information led to Wegeler’s prosecution. Wegeler entered into a plea agreement and paid $1.5 million in restitution. The government declined to intervene in the FCA action. If the government elects to pursue an “alternate remedy,” the statute provides that the relator retains the same rights she would have had in the FCA action. Charte tried to intervene in the criminal proceeding to secure a share of the restitution. The Third Circuit affirmed the denial of the motion. A criminal proceeding does not constitute an “alternate remedy” to a civil qui tam action, entitling a relator to intervene and recover a share of the proceeds. Allowing intervention would be tantamount to an interest in participating as a co-prosecutor in a criminal case. Even considering only her alleged interest in some of the restitution, nothing in the FCA suggests that a relator may intervene in the government’s alternative-remedy proceeding to assert that interest. The text and legislative history regarding the provision indicate that the court overseeing the FCA suit determines whether and to what extent a relator is entitled to an award. Darrio Melton, as mayor of the City of Selma ("the city"), appealed a judgment entered in favor of the members of the Selma City Council. In September 2018, the council adopted Ordinance No. O108-17/18 giving the council the power to appoint the city's tax collector, chief of police, and chief of the fire department "in accordance and pursuant to [section] 11-43-5, [Ala. Code 1975]." The mayor vetoed the ordinance shortly after it was passed by the council. However, the council later overrode the mayor's veto, making the ordinance a part of the city's municipal code. In his complaint, the mayor alleged that the ordinance violates § 11-43-8l, Ala. Code 1975, which provides, in part, that the mayor "shall have the power to appoint all officers [of the city or town] whose appointment is not otherwise provided for by law." The mayor sought a judgment declaring the ordinance invalid; the complaint also sought preliminary and permanent injunctions preventing the implementation of the ordinance. Petitioner appealed a circuit court order denying her petition to modify or terminate the guardianship of respondents over her minor biological daughter, K.B. The guardianship was granted by a court of the State of Connecticut in 2010. Because the New Hampshire Supreme Court concluded the circuit court did not have jurisdiction over this petition to modify another state’s child-custody determination, it vacated and remanded with instructions to dismiss the petition. David and Christine Minsavage were married and had four children. David had served as a math teacher for more than twenty-four years when he was diagnosed with terminal stage IV pancreatic cancer in August 2014. In November 2014, following advice allegedly provided by a New Jersey Education Association representative, David selected the “early retirement” option on his retirement application. Early retirement eligibility required twenty-five years of teaching service. David passed away in April 2015, having accumulated just over twenty-four years and nine months of teaching service over the course of his career. Less than two weeks after David’s death, the Division of Pension and Benefits notified Christine that David’s retirement application would not be approved because he had not completed twenty-five years of teaching service. As a result, Christine was entitled only to reimbursement of David’s pension contributions and a group life insurance benefit. Because David did not live long enough to qualify for early retirement, his family would have been entitled to greater benefits had he selected and qualified for “ordinary disability,” rather than “early retirement,” on his retirement application. Christine sought to modify David’s retirement application to select ordinary disability. The Board of Trustees of the Pension Fund (the Board) denied Christine’s request on the ground that the Pension Fund’s “administrative regulations do not allow for retroactive disability retirement applications, and become effective only on or after the date of filing.” The Appellate Division affirmed. The New Jersey Supreme Court reversed, however, finding that neither membership nor prior approval of a retirement application was required for modification of a retirement selection where good cause, reasonable grounds, and reasonable diligence were shown. The Court remanded this matter for further proceedings to allow Christine the opportunity to argue in favor of modification under that standard. View "Minsavage v. In a matter of first impression, the Oklahoma Supreme Court addressed whether a claim of intentional interference with a prospective economic business advantage required a showing of bad faith, and whether the immunity protections provided by 36 O.S. Supp. 2012 section 363 were forfeited under the alleged facts. Plaintiff-appellant Lisa Loven, a general contractor who applied for a public adjuster license with the Oklahoma Department of Insurance (the Department), disclosed that a former client sued her for acting as an unlicensed adjuster. The Department opened an investigation and subsequently denied her application. Loven appealed. During the appeal hearing Church Mutual Insurance and its adjuster Jeffrey Hanes provided information regarding their dealings with Loven as a general contractor when she contracted for storm repair work for two churches they insured. The appellate hearing officer affirmed the denial of her application as a public adjuster because she had illegally acted as an unlicensed public adjuster. Loven sued Church Mutual and Hanes for intentional interference with a prospective economic business advantage. The trial court granted summary judgment to Church Mutual and Hanes because 36 O.S. Supp. 2012 section 363 provided civil tort immunity to insurers who provide any information of fraudulent conduct to the Department. The Court of Civil Appeals affirmed. The Supreme Court held: (1) 36 O.S. Supp. 2012 section 363 provided immunity for those who report or provide information regarding suspected insurance fraud as long as they, themselves, do not act fraudulently, in bad faith, in reckless disregard for the truth, or with actual malice in providing the information; and (2) the alleged tort of intentional interference with a prospective economic business advantage required a showing of bad faith. Because no proffered evidence in this case showed bad faith, the immunity provisions of 36 O.S. Supp. 2012 section 363 applied, and summary judgment was proper. View "Loven v. Church Mutual Ins. The Commodity Futures Trading Commission settled a civil action against Kraft. The consent decree includes a provision: Neither party shall make any public statement about this case other than to refer to the terms of this settlement agreement or public documents filed in this case, except any party may take any lawful position in any legal proceedings, testimony or by court order. The Commission issued a press release announcing the suit’s resolution. Kraft asked the judge to hold the Commission and Commissioners in contempt of court for issuing the press release and concurring statements. The judge scheduled a hearing and directed Chairman Tarbert, two Commissioners, the Commission’s Director of Enforcement, and other employees to appear and testify under oath. The judge stated that he would administer Miranda warnings to these witnesses in preparation for a finding of criminal contempt and would demand that the witnesses explain the thinking behind the press release and the separate statements. The Seventh Circuit granted mandamus relief, in part. There is neither need nor justification for testimony by the Chairman, any Commissioners, or any members of the agency’s staff. Under 7 U.S.C. 2(a)(10)(C), every member of the Commission has a right to publish an explanation of his vote, so the consent decree could not operate to silence individual Commission members. In March 2011, Appellees Elaine Gold, Amy Shaye, Heather Hunter, and Roderick Benson sued Appellants, the DeKalb County School District (“the District”) and the DeKalb County Board of Education (“the Board”) for, inter alia, breaching an agreement to provide two-years advance notice prior to suspending contributions to their DeKalb County Tax-Sheltered Annuity Plan (“TSA Plan”) accounts. Finding that Appellees failed to establish the existence of an enforceable contract, the trial court granted summary judgment in favor of Appellants, and Appellees appealed to the Court of Appeals. The Court of Appeals reversed the grant of summary judgment on the issue of liability, vacated the remainder of the court’s order and remanded the case with direction. The Georgia Supreme Court agreed with the outcome of the appellate court’s decision: summary judgment was granted in error, and denying Appellee’s summary judgment on the issue of liability for breach of contract was made in error too. The Court determined that based upon the language of the Board’s own bylaws, the TSA Plan’s provision providing for the termination or suspension of the plan “at any time” could not amend the two-year notice provision embodied in the bylaws by way of a 1982 Amendment.
