Applicant Derby GLC Solar, LLC appealed a Public Utility Commission (PUC) decision denying its application for a certificate of public good (CPG) for a netmetered solar electric-generation facility. The PUC determined that applicant’s proposed project failed to satisfy 30 V.S.A. 248(b)(7) or (10). Applicant contended the PUC erred by not weighing the alleged economic benefits of the project against its adverse impacts, improperly considered evidence that should not have been admitted, misinterpreted the language of section 248, and treated applicant’s project differently than similarly situated projects. Courtyard Manor Homeowners' Association, Inc. ("Courtyard Manor") appealed dismissal of its complaint against the City of Pelham. In August 2018, Courtyard Manor filed a complaint against the City after the City failed to conduct a hearing or otherwise to respond to Courtyard Manor's petition, filed with the City in September 2017, seeking to be deannexed from the City's municipal limits. Courtyard Manor averred in its complaint the City had agreed to apply its deannexation criteria to the matter, that the City had a duty to set the matter for a hearing, and the City had de facto denied the petition by failing to take any action on it. Courtyard Manor requested that the circuit court conduct a hearing on the petition and enter an order deannexing Courtyard Manor from the City. Alternatively, Courtyard Manor requested that the circuit court order the Pelham City Council to hold a hearing on the petition and to report its decision to the circuit court. The City moved the circuit court to dismiss the complaint for failure to state a claim upon which relief could be granted. The City argued that, in deciding whether to deannex property, a municipal governing body acted in a legislative capacity, a municipal governing body has discretion to determine if and when to deannex property, the governing body's discretion in determining if and when to deannex property was not subject to interference by the courts, the City's governing body had not determined the corporate limits of the City should have been reduced in the manner requested by Courtyard Manor, and that the City had no duty to hold a hearing on Courtyard Manor's petition. The circuit court granted the City's motion to dismiss. Finding no reversible error, the Alabama Supreme Court affirmed dismissal. View "Courtyard Manor Homeowners' Association, Inc. v. Michael Weaver, a former City of Everett firefighter, contracted melanoma. He filed a temporary disability claim, which the Washington Department of Labor & Industries (Department) denied, finding the melanoma was not work related. The melanoma spread to Weaver's brain, for which he filed a permanent disability claim. The Department denied it as precluded by the denial of the temporary disability claim. The issue his case presented for the Washington Supreme Court's review centered on whether the doctrines of collateral estoppel and res judicata properly precluded Weaver's permanent disability claim. The Court found collateral estoppel did not apply because the doctrine would work an injustice in this situation, given that Weaver did not have sufficient incentive to fully and vigorously litigate the temporary disability claim in light of the disparity of relief between the two claims. Likewise, the Court held that res judicata did not apply because the two claims did not share identical subject matter, given that the permanent disability claim did not exist at the time of the temporary disability claim. In July 2013, the California State Board of Pharmacy (the Board) filed an accusation against pharmacist Solomon Oduyale, citing 20 charges for discipline and seeking revocation of his pharmacist license. By August 2016, Oduyale had successfully challenged all but nine of the charges for discipline against him. The Board then ordered Oduyale's pharmacist license revoked. Oduyale challenged the Board's decision in court by filing a petition for writ of mandate. In his petition, Oduyale argued the Board lacked justification for revoking his license, and suggested it could have imposed stringent conditions on probation instead. The superior court did not comment on the propriety of the revocation decision, but concluded that because the Board's decision did not include an explicit discussion of each possible level of discipline with an explanation for why each would have been inappropriate in Oduyale's case, the Board abused its discretion. The Board appealed to the Court of Appeal, challenging the trial court's requirement that it discuss every possible form of discipline short of revocation in its written decision, and also asked for consideration of whether it acted within its discretion to revoke Oduyale's pharmacist license based on the nine causes for discipline. Oduyale cross-appealed, contending the trial court erred by remanding the matter for further consideration by the Board and arguing the court should have directed the Board to impose a penalty short of revocation. The Court of Appeal agreed with the Board: the trial court erred by directing it to provide in writing its reasoning for not imposing each penalty short of revocation. Furthermore, the Court concluded the Board acted within its discretion to revoke Oduyale's pharmacist license. Accordingly, the trial court's judgment was reversed. View "Oduyale v. Ron Koenig was the superintendent and principal of the Warner Unified School District (the district). He and the district entered an agreement to terminate his employment one year before his employment agreement was due to expire. Under the termination agreement, Koenig agreed to release any potential claims against the district in exchange for a lump sum payment equivalent to the amount due during the balance of the term of his employment agreement, consistent with Government Code section 53260. The district also agreed to continue to pay health benefits for Koenig and his spouse "until Koenig reaches age 65 or until Medicare or similar government provided insurance coverage takes effect, whichever occurs first." The district stopped paying Koenig's health benefits 22 months later. Koenig then sued to rescind the termination agreement and sought declaratory relief he was entitled to continued benefits pursuant to his underlying employment agreement, which provided that Koenig and his spouse would continue receiving health benefits, even after the term of the agreement expired. After a bench trial, the trial court determined the district's promise in the termination agreement to pay health benefits until Koenig turned 65 violated section 53261, was unenforceable, and rendered the termination agreement void for lack of consideration. Both Koenig and the district appealed the judgment entered after trial. Koenig contended the trial court properly determined the termination agreement was void but should have concluded he was entitled to continued health benefits until the age of 65. The district contended the trial court erred when it concluded the termination agreement was void; rather, the trial court should have severed the termination agreement's unenforceable promise to continue paying benefits, enforced the remainder of the termination agreement, and required Koenig to pay restitution for benefits paid beyond the term of the original agreement. The Court of Appeal concluded the termination agreement's unlawful promise to pay health benefits in excess of the statutory maximum should have been severed to comply with sections 53260 and 53261, Koenig did not establish he was entitled to rescind the termination agreement, and the district was entitled to restitution for health benefits paid beyond the statutory maximum. Petitioner Ron Gipson challenged Snohomish County’s response to a records request under Washington’s Public Records Act. Gipson requested records that related to allegations of workplace sexual harassment against him. At the time of his request, Gipson was under investigation for those allegations. Due to the voluminous request, Snohomish County responded by producing the documents in five installments over the course of several months, but asserted the active and ongoing investigation exemption under the Act for each installment. Gipson argued treating each installment with the exemption was improper under the Act. The Washington Supreme Court disagreed, finding Snohomish County properly applied the active-and-ongoing-investigation exemption and affirmed. View "Gipson v. Snohomish County" on Justia Law

At issue are motions by several news organizations to intervene in a pending appeal and to unseal an unredacted letter filed by Deutsche Bank on August 27, 2019. Deutsche Bank filed the letter in an appeal from an order denying a preliminary injunction sought by President Trump and others to prevent compliance with subpoenas seeking production of numerous documents, including tax returns.The Second Circuit granted the motions to intervene, because news media have a right to intervene to seek unsealing of documents filed in a court proceeding. However, the court denied the motions for unsealing, because the sealed letter was not relevant to any issue in the underlying appeal and thus it was not a judicial document within the meaning of the decisions requiring unsealing of documents with a court. The Idaho Board of Licensure of Professional Engineers and Professional Land Surveyors (the Board), through its executive director, Keith Simila, brought disciplinary proceedings against Chad Erickson for allegedly violating certain statutes and rules governing the surveying profession. Following an administrative hearing, the Board found that Erickson violated a number of the statutes and rules alleged and revoked his license as a professional land surveyor. Erickson sought judicial review by the district court. On review, the district court upheld the Board’s finding that Erickson had committed certain violations; however, the district court reversed the portion of the Board’s Order revoking Erickson’s license and remanded the matter for further consideration of the appropriate sanction. Erickson appeals from the district court’s decision, arguing that the evidence does not support the Board’s finding of any violations. In addition, Erickson asserts that numerous procedural errors made by the Board necessitate reversal. After its review, the Idaho Supreme Court reversed the district court's order, finding the Board's order against Erickson was time-barred. View "Erickson v. Huey Brock appealed judgments dismissing his negligence action against Richard Price and KS Industries, LLC (“LLC”) and awarding Price and LLC costs and disbursements in the amount of $181,467. Price and LLC cross-appealed the judgment awarding costs and disbursements. In 2011, Brock was severely injured in a traffic accident while traveling in a company-owned vehicle with Price and another LLC employee, resulting in Brock becoming quadriplegic. Days later WSI accepted his claim for benefits. In June 2012, Brock, WSI, and LLC entered into a stipulation that Brock would continue to receive WSI benefits while seeking workers’ compensation benefits in California from KS Industries, LP (“LP”). The stipulation further provided that WSI would cease paying benefits if his claim against LP’s insurance carrier were accepted and his attorney would act in trust for WSI in pursuing reimbursement of funds paid in connection with Brock’s claim. Brock then filed an application for California workers’ compensation benefits claiming he was employed by LP at the time of the accident. Based on a California administrative decision, LP’s workers’ compensation carrier commenced paying benefits to Brock and reimbursed WSI all funds expended on Brock. In 2014, WSI issued a notice of decision reversing its prior decision accepting Brock’s claim. In February 2015, Brock brought this negligence action against Price and LLC. Brock moved for summary judgment arguing collateral estoppel based on the California administrative proceedings precluded Price and LLC from arguing LLC was Brock’s employer rather than LP, and therefore his action was not barred by the exclusive remedy provisions of North Dakota law. In November 2018, Price and LLC filed a motion for summary judgment arguing collateral estoppel did not apply and the exclusive remedy provisions applied to bar Brock’s action against LLC and his co-worker, Price. The district court agreed and dismissed the action. The North Dakota Supreme Court affirmed dismissal of the negligence action because it was indeed barred by the Workforce Safety and Insurance Act’s exclusive remedy provisions. The Court reversed the award of costs and disbursements and remanded for the court to hold a hearing on Brock’s objections required by N.D.R.Civ.P. 54(e)(2). View "Brock v. The South Carolina Supreme Court granted Scott Ledford’s petition for review of the Court of Appeals’ decision to affirm the outcome of a Workers’ Compensation Commission hearing. Ledford was a former lance corporal with the South Carolina Highway Patrol. While employed as a highway patrolman, Ledford was injured in two separate work-related accidents: in July 2010, Ledford sustained injuries to his spine after being tasered during a training exercise; and in March 2012, Ledford was involved in a motorcycle accident while attempting to pursue a motorist. Ledford settled the 2010 claim with Respondents. Following the second accident, Ledford filed two separate claims for workers' compensation benefits. The Workers' Compensation Commission Appellate Panel declined to find Ledford suffered a change of condition; however, she found Ledford was entitled to medical benefits for injuries to his right leg and aggravated pre-existing conditions in his neck and lower back due to the motorcycle accident. Neither party appealed the Commission’s order. Months later, Ledford reached maximum medical improvement ("MMI"). Commissioner Susan Barden held a hearing on Ledford’s Form 21 in August 2014. Following the hearing, but prior to the issuance of a final order, Ledford filed a motion to recuse Commissioner Barden. According to Ledford's motion, Commissioner Barden requested a phone conference with the parties a month after the hearing during which she allegedly threatened criminal proceedings against Ledford if the case was not settled; indicated that she engaged in her own investigation and made findings based on undisclosed materials outside the record; suggested Ledford used "creative accounting" in his tax returns; and questioned Ledford's credibility regarding his claims of neck pain. Ledford contended any one of these grounds was sufficient to warrant recusal. The Court of Appeals affirmed the Commission, finding: (1) Commissioner Barden was not required to recuse herself; (2) substantial evidence supported the Appellate Panel's decision to reverse Commissioner Barden's permanency determination; and (3) substantial evidence supported the Appellate Panel's findings that Ledford was not credible and his landscaping business remained lucrative following the injury. The Supreme Court held the Court of Appeals erred in finding Commissioner Barden was not required to recuse herself. The Court was “deeply concerned” by the Commissioner’s conduct in this matter. “Ledford's counsel provided an opportunity for Commissioner Barden to right her wrong by moving for recusal. Instead of stepping aside, Commissioner Barden became more abusive and strident in both her ruling on the recusal motion and her final order.” The Commission’s orders were vacated and the matter remanded for a new hearing before a different commissioner.
