Johnny Tucker injured his shoulder on May 2, 2011, while working at the South Carolina Department of Transportation. The commission found he "sustained 5% permanent partial disability . . . for which he is entitled to fifteen weeks of compensation." On May 2, 2013, Tucker filed a Form 50 asserting a claim for additional benefits on the basis that his condition caused by the 2011 injury had changed. Tucker checked the box on line 13a of the Form 50 indicating, "I am not requesting a hearing at this time." On July 30, 2014, Tucker filed another Form 50. This second Form 50 was identical to the first except this time he checked the box on line 13b indicating, "I am requesting a hearing." Petitioners, the Department of Transportation and the State Accident Fund, defended the claim on the basis that Tucker did not comply with the timing requirement of subsection 42-17-90(A). The subsection provided that when a party makes a claim based on a change of condition, "the review must not be made after twelve months from the date of the last payment of compensation pursuant to an award." Tucker received his last payment of compensation on November 28, 2012. The first Form 50 was filed within twelve months, but Tucker's request for a hearing in the second Form 50 did not occur within twelve months. The South Carolina Supreme Court rejected Petitioners' argument that satisfying this timing requirement was dependent on a claimant requesting a hearing within the time period set forth in South Carolina Code subsection 42-17-90(A) (2015). Daufuskie Island Utility Company, Inc. (DIUC) filed an application with the Public Service Commission for a rate increase for the water and sewer service it provides to residents of Daufuskie Island in Beaufort County. During a hearing on the merits of the application, the commission approved a purported settlement agreement between the Office of Regulatory Staff (ORS) and three property owners' associations: Haig Point Club and Community Association Inc., Melrose Property Owner's Association, Inc., and Bloody Point Property Owner's Association. DIUC appealed, and the South Carolina Supreme Court reversed, finding the agreement "was not a true settlement" because DIUC did not agree to it. The case was thereafter remanded the case to the commission for a new hearing on all issues. On remand, the commission held a second hearing on the merits and issued a second order. DIUC appealed the second order, arguing the commission erred in disallowing certain rate case expenses and refusing to include items of capital in DIUC's rate base. DIUC argued ORS and the commission applied a higher standard of scrutiny on remand in retaliation against DIUC for successfully seeking reversal of the commission's initial order. At oral argument on this second appeal, when pressed by the Court to respond to DIUC's "retaliation" argument, appellate counsel for ORS conceded a heightened standard had been employed. In reversing the Commission, the Supreme Court determined the arbitrary, higher standard of scrutiny affected substantial rights of DIUC. The commission's findings of fact and conclusions of law therefore had to be reversed. The matter was remanded again for a new hearing. View "Daufuskie Island v. Petitioners Northern Pass Transmission, LLC and Public Service Company of New Hampshire d/b/a Eversource Energy (PSNH), appealed the New Hampshire Site Evaluation Committee’s decision denying their application for a “Certificate of Site and Facility” (certificate) for the siting, construction, and operation of a high voltage transmission line (HVTL) and associated facilities from Pittsburg to Deerfield (the project). A subcommittee of the Evaluation Committee held 70 days of adjudicative hearings between April and December 2017. It received testimony from 154 witnesses and received 2,176 exhibits. At the conclusion of its proceedings, the Subcommittee voted unanimously that petitioners “failed to demonstrate by a preponderance of evidence that the Project will not unduly interfere with the orderly development of the region” and denied the application on February 1, 2018. The New Hampshire Supreme Court reviewed the record and concluded the Subcommittee’s findings were supported by competent evidence and ere not erroneous as a matter of law. Accordingly, the Court held petitioners did not sustain their burden on appeal to show that the Subcommittee’s order was unreasonable or unlawful. Defendant Genesee County served as an administrator for certain employee health insurance plans. Plaintiff Genesee County Drain Commissioner Jeffrey Wright participated in this plan even though the office of drain commissioner had statutory autonomy from the county. The parties’ insurer, Blue Cross Blue Shield of Michigan (BCBSM), conducted a multi-year audit that revealed that the county’s collective insurance premiums, including those paid by the plaintiff, significantly exceeded the amount that should have been charged. The county held a public meeting about the overpayment -allegedly totaling millions of dollars - during which it accepted a refund from BCBSM. The county deposited the refund into its general fund. The plaintiff demanded a proportionate share of the refund; the county denied his request, and this lawsuit followed. The issue plaintiff’s case raised for the Michigan Supreme Court’s review reduced to whether a claim for unjust enrichment was barred by the governmental tort liability act (GTLA). The Court determined a claim for unjust enrichment was neither a tort nor a contract but rather an independent cause of action. And the remedy for unjust enrichment was restitution, not compensatory damages, the remedy for tort. For both reasons, the GTLA did not bar an unjust-enrichment claim. Plaintiff Sacramentans for Fair Planning contended the City of Sacramento violated zoning law and the California Environmental Quality Act (CEQA) when it approved entitlements for real party 2500 J Owners, LLC, to construct a high-rise condominium building in the City’s Midtown area. The project was not consistent with the general plan and zoning code standards for building intensity and height. But the City approved it pursuant to a general plan policy authorizing more intense development than zoning otherwise allowed if the project provided a significant community benefit. The City also conducted a streamlined CEQA review. CEQA authorized the less intense review for a type of residential mixed-use development such as the proposed project which, because of its proximity to mass transit services, may help reduce regional greenhouse gas emissions by generating less use of motor vehicles. In a petition for writ of mandate, plaintiff argued that approving the project under the general plan policy violated constitutional law and an implied-in-law zoning contract that required identical uses in a zoning district to be treated uniformly and prohibited a delegation of legislative authority without sufficient standards to govern its use. Plaintiff also claimed the City violated CEQA because the streamlined review did not analyze all of the project’s environmental effects. The trial court denied plaintiff’s petition. Green Hills Development Company, LLC, forfeited property to the State for failure to pay taxes. Five years later, the State sold the property, following the statutory procedure under which the Secretary of State accepts written applications to purchase and, if an application is approved, issues a land patent. After learning of the sale, Green Hills sued the Secretary of State and the purchasers to have the land patents set aside. Green Hills argued it had been entitled to notice of the purchasers’ pending applications. Had it been properly notified, Green Hills claimed it would have filed its own application. And its application would have received priority based on Green Hills’ status as former owner. Green Hills also sued one of the purchasers for interfering with its rights as developer to enforce protective covenants and maintain common areas within the development. The Defendants successfully moved for summary judgment on Green Hills’ notice-based claims. The trial court ruled that the notice provision on which Green Hills relied was no longer in effect when the purchasers submitted their applications. And under the then-current administrative rules, Green Hills undisputedly received all required notice. The court further ruled the priority status for former owners’ applications was contingent on Green Hills’ filing an application, which Green Hills never did. After review, the Mississippi Supreme Court affirmed this part of the trial court’s judgment: the record confirmed the material facts were not in dispute, and Green Hills received all required notice, and never filed an application to purchase, despite multiple opportunities. So the Defendants were entitled to a judgment as a matter of law on Green Hills’ notice-based claims. However, the Supreme Court reversed the trial court’s ruling that Green Hills lacked standing to challenge the validity of the land patents issued. Because Green Hills’ claims based on the development’s protective covenants and common areas were still pending, Green Hills had a colorable interest in whether the purchasers held valid land patents. Green Hills also suffered an adverse effect from the purchasers’ countersuit to declare the protective covenants unenforceable and to divest Green Hills of its interest in the common areas. The United States Court of Appeals for the Third Circuit certified a question of law to the Pennsylvania Supreme Court. Plaintiffs William DeForte and Evan Townsend were employed as police officers with the Borough of Worthington (the “Borough”). Neither officer was salaried or received benefits. Instead, they were paid hourly wages and, moreover, were simultaneously employed by other police forces. The Borough’s police force consisted of four part-time officers, including Plaintiffs. On November 5, 2012, the Borough terminated Plaintiffs’ employment without affording any process. Plaintiffs brought separate actions (which were consolidated) against the Borough at the federal district court. Plaintiffs asserted, inter alia, that the Borough Code or the Tenure Act conferred a constitutionally-protected property interest in their continued employment, and the lack of any process associated with their dismissal violated their federal due process rights. They requested relief under Section 1983 of the Civil Rights Act of 1871. The Borough moved for summary judgment. In ruling on the motion, the district court considered whether Plaintiffs were entitled to civil-service protections in connection with their dismissal under either the Police Tenure Act, or the Borough Code, The Supreme Court, answering the two-part question forwarded by the Third Circuit: (1) the civil service protections embodied in the Borough Code and the Tenure Act were broadly in pari materia insofar as they were intended to govern all borough police forces; and (2) when calculating the size of a borough police force in any given case, the same test should be used. More particularly, the “normal working hours” criterion contained in the Borough Code should be employed to determine how many members a borough police force has for purposes of deciding whether the Tenure Act’s two-officer maximum or the Borough Code’s three-officer minimum was implicated. In this case, the issue presented for the Pennsylvania Supreme Court's review was whether the Commonwealth Court disregarded the law when it vacated a grievance arbitration award based on its independent interpretation of the parties’ collective bargaining agreement (“CBA”). Millcreek Township Educational Support Personnel Association (the “Association”) and Millcreek Township School District (the “District”) were parties to a CBA that became effective on July 1, 2011, and was set to expire on June 30, 2016. Negotiations for a successor CBA began January 26, 2016 when the Association offered its initial proposal to the District. Approximately one month later, the District presented a counter proposal in which it sought, among other items, to eliminate a no subcontracting provision. The Association rejected this proposal. On March 29, 2016, with successor CBA negotiations ongoing between the Association and the District, the District issued a request for proposals (“RFP”) seeking quotes from prospective bidders for the provision of custodial labor services. On April 7, 2016, upon learning that the District had issued an RFP to subcontract the bargaining unit’s work, the Association filed a grievance with the District. Pursuant to the Pennsylvania Supreme Court’s decisions under the Public Employee Relations Act (“PERA”), a reviewing court had to apply the highly deferential two-prong “essence test” to grievance arbitration awards: (1) the court had to decide whether the issue was encompassed by the CBA; and (2) the court had to uphold the arbitrator’s award if the arbitrator’s interpretation could rationally be derived from the CBA. Subject to a narrow exception for awards that violate a dominant public policy, proper application of the essence test prohibits a court from vacating an arbitrator’s award unless “the award indisputably and genuinely is without foundation in, or fails to logically flow from, the [CBA].” The Supreme Court had "no trouble" concluding that the award in this case drew its essence from the CBA and because no public policy would be violated by its enforcement, it reversed the decision of the Commonwealth Court. Dwayne Wigfall brought an action against the city of Detroit for injuries he sustained in a motorcycle accident allegedly caused when he hit a pothole on a city street. On advice from the city’s Law Department, Wigfall sent a notice via certified mail addressed to the Law Department that included a description of the pothole, its location, and a description of plaintiff’s injuries. An adjuster from the Law Department acknowledged receipt of Wigfall’s claim. After Wigfall filed his complaint, the city moved for summary judgment, arguing that Wigfall’s claim was barred by governmental immunity because Wigfall failed to serve notice of his claim on the mayor, the city clerk, or the city attorney as required by MCL 691.1404(2) and MCR 2.105(G)(2). The court denied the city’s motion, and the city appealed. Faytreon West brought an action against the city of Detroit, for injuries she allegedly suffered when she tripped on a pothole and fell while walking on a city street. West’s counsel sent notice of the injury and highway defect to the city’s Law Department via certified mail, instructing the city to immediately contact West’s counsel if it believed that the notice did not comply with any applicable notice requirements. The Law Department received the letter, and an adjuster from the Law Department acknowledged receipt of West’s claim. After West filed her complaint, the city moved for summary judgment, also arguing West had failed to comply with the notice requirement in MCL 691.1404(2) because she had not served an individual who may lawfully be served with civil process. The trial court granted the motion in favor of the city and denied West’s motion for reconsideration. In both cases, the Michigan Supreme Court reversed the grant of summary judgment in favor of the city: Plaintiffs complied with the requirements of MCL 691.1404(2) by serving their notices on the city’s Law Department. The Supreme Court found the Law Department was an agent of defendant’s city attorney (also known as the Corporation Counsel) and was charged with receiving notice under the city’s charter and ordinances. Juvenile G.B., born in June 2017, appealed a trial court’s order denying his petition to terminate mother’s parental rights and directing the Department for Children and Families (DCF) to prepare a new disposition plan for mother. The Vermont Supreme Court dismissed the appeal for lack of a final judgment. In October 2017, the court held a merits hearing in G.B.’s case. The court found that G.B. was a child in need of care or supervision (CHINS) based on parents’ mental-health issues, substance abuse, failure to consistently engage in parent-child contact, and father’s criminal history. Father did not appear at the hearing; mother was briefly present. The court considered the best-interests factors as to each parent, then granted the petition to terminate father’s rights, concluding that he had not developed a relationship with G.B. and would not be able to assume parental duties within a reasonable period of time. As to mother, the court acknowledged that mother’s relapse resulted in her not being able to play a constructive role in G.B.’s life for seventeen months. The court concluded, however, that mother was ready, willing, and able to resume a constructive role in G.B.’s life and that she “should be given the opportunity over the next six months to reunify with G.B.” Therefore, the court denied the petition to terminate mother’s rights. The court explained that the case was “still at disposition” and directed DCF to prepare a new disposition plan in light of the court’s decision. G.B. appealed the denial to terminate mother’s rights. To the Supreme Court, G.B. argued the trial court failed to view the question of whether mother would be able to parent within a reasonable period of time from the perspective of the juvenile. The Supreme Court determined the order G.B. sought to appeal in this case—the denial of the petition to terminate mother’s rights—was not final because it was neither a final judgment nor a disposition order. The order denying termination of mother’s rights did not finally resolve the status of mother’s parental rights and therefore was not a final judgment. View "In re G.B., Juvenile" on Justia Law
