Plaintiff The Marist Brothers of New Hampshire (MBNH) appealed several superior court orders: (1) a decision upholding the denial by defendant Town of Effingham (Town), of MBNH’s request for a charitable tax exemption, for tax year 2015, for real property; and (2) an order granting the Town’s motion in limine to exclude evidence of the tax treatment of New Hampshire youth camps other than the camp run by MBNH. When Camp Marist was not in session, MBNH rented the Property subject to this appeal: no restrictions were placed on who is eligible to rent, or how renters use, the Property. Rental proceeds were allocated to either the “regular Camp fund, the running of the Camp, or . . . to some of [MBNH’s] scholarships.” MBNH argues that the trial court erred in determining that it met none of the "ElderTrust" factors. After careful consideration, the New Hampshire Supreme Court concluded MBNH did satisfy all ElderTrust factors, reversing the trial court. View "The Marist Brothers of New Hampshire v. William Beaulieu appealed a district court judgment reversing an administrative law judge's ("ALJ") order awarding benefits and affirming prior Workforce Safety & Insurance ("WSI") orders. The ALJ's order finding Beaulieu had a fifty percent permanent partial impairment rating was not in accordance with the law and not supported by the evidence. Therefore, the North Dakota Supreme Court concluded the ALJ erred in awarding permanent partial impairment and permanent total disability benefits. View "WSI v. Beaulieu" on Justia Law

This appeal challenged the trial court’s denial of a special motion to strike pursuant to Code of Civil Procedure section 425.16, the anti-SLAPP statute,, directed at a cross-complaint asserting causes of action arising from a civil enforcement action brought by Feather River Air Quality Management District against Harmun Takhar for multiple violations of state and local air pollution laws. Specifically, this case involved dust. Takhar owned a piece of property in Yuba County. In June 2014, he began the process of converting that property from pasture land to an almond orchard. This process required the clearing, grading, and disking of the land in order to prepare the site for planting. The earthwork generated dust that was carried from Takhar’s property and deposited onto neighboring properties. These neighboring property owners complained to the District. District staff contacted Takhar, informed him the dust emissions were impacting neighboring properties causing a public nuisance, and requested he take reasonable precautions to prevent the dust from reaching the affected properties, such as waiting for the wind to change directions before engaging in earthwork. Violations were ultimately imposed, and an offer to settle the civil penalties was made. Takhar did not take the District up on its settlement offer and instead continued with his clearing activities. The District then brought a civil enforcement action against Takhar. The Court of Appeal concluded Takhar did not demonstrate he qualified for an exemption to the anti-SLAPP statute. The causes of action alleged in Takhar’s cross-complaint arose from protected petitioning activity and he did not establish a probability of prevailing on the merits of these claims. The Court therefore remanded the matter to the trial court with directions to grant the anti-SLAPP motion and dismiss the cross-complaint. View "Takhar v. California ex rel. The petitioner-employer sought review of the Workers' Compensation Court of Existing Claims which upheld a trial court's determination that respondent-employee Jennifer Hodge suffered a change of condition for the worse to her left leg/knee when she was injured in a medical facility where she was receiving medical treatment to a previously adjudicated body part. The employer urged there was insufficient evidence to support the trial court's decision because: (1) any injury arose from an intervening negligent act; and (2) there was no medical evidence to support a worsening of condition to employee's left leg/knee. The three-judge panel disagreed with Employer and affirmed the trial court. Employer then filed a Petition for Review and the Court of Civil Appeals vacated the decision of the three-judge panel. Hodge filed a Petition for Certiorari to the Oklahoma Supreme Court. Granting review, the Supreme Court found competent evidence to support the decisions from the trial court and the three-judge panel. Accordingly, the Court vacated the Court of Civil Appeals and affirmed the Workers' Compensation Court. View "City of Tulsa v. Hodge" on Justia Law

This case involved a variety of constitutional challenges to Georgia’s Child Abuse Registry that a group of high school teachers and administrators filed directly to superior court after their names were put on the Registry. The Georgia Supreme Court determined it could not properly reach the merits of those challenges - and neither could the trial court – because some of the claims were barred by sovereign immunity and the remaining ones should have been raised in the then-pending administrative proceeding also initiated by the teachers and administrators. Accordingly, the Supreme Court reversed the part of the trial court’s order concluding that the trial court could decide the merits of the challenges, vacated the part of the order declaring the Registry statutes and rules to be unconstitutional and granting injunctive relief, and remanded with direction to dismiss the case. The Fifth Circuit affirmed the district court's dismissal with prejudice as to relators and without prejudice as to the Government in an action under the False Claims Act (FCA). The court held that the district court did not err by dismissing the Government without prejudice when relators sought to abandon their claims. The court explained that relators acted on purely private interests and the Government, even one that chose not to intervene, should not be bound by that decision, because it was powerless to vindicate the public's interests in other actions that may have a stronger basis or a relator more able to shoulder the burdens of litigation. The court rejected United's remaining claims regarding relators' voluntary dismissal and held that the district court did not abuse its discretion. View "United States ex rel. Vaughn v. Plaintiff Rochester City Council appealed a superior court order affirming defendant City of Rochester Zoning Board of Adjustment’s grant of a variance to defendants Donald and Bonnie Toy. On appeal, the Council argued the trial court: (1) erred in affirming the ZBA’s decision to grant a variance to the Toys; and (2) unsustainably exercised its discretion in denying the plaintiff’s motions to expand the record. In this case, the issue presented for the New Jersey Supreme Court's review was whether the New Jersey Motor Vehicle Commission (Commission) appropriately issued fines and suspensions without holding hearings. The Commission sent notices of proposed suspension to the dealers. The notice also informed the dealers of their right to request a hearing. Each dealer acted pro se and requested a hearing in writing. Each provided explanations for the alleged violations but did not deny the allegations. The Commission denied the requests for hearings and issued an order of suspension/final administrative decision letter to each dealer. The Commission ruled that each dealer had “failed to identify any disputed material fact(s), legal issue(s) and/or specific mitigating circumstances to be resolved at a hearing,” and interpreted the dealers’ responses as admissions. The Appellate Division panel consolidated the appeals and affirmed the Commission’s imposition of suspensions and fines, determining that the Commission could decide cases “without a trial-type hearing when there are no disputed adjudicative facts.” The panel found that the fines challenged by the dealers were authorized by N.J.S.A. 39:10-20, and the Commission could impose fines under the statute on a case-by-case basis. The New Jersey Supreme Court found that if the reasons given by the dealers presented a colorable dispute of facts or at least the presence of mitigating evidence, the Commission was required to provide an in-person hearing pursuant to N.J.S.A. 39:10-20. Nineteen-year-old M.W. was a nonminor dependent of the court until it terminated dependency jurisdiction over him in August 2017. One of the acceptable living arrangements for nonminor dependents was a “‘[s]upervised independent living placement’” (SILP). The court terminated dependency jurisdiction over M.W. because he had moved in with a former foster mother, and the court believed a former caregiver’s home could not qualify as a SILP. The Court of Appeal determined the trial court erred: "Nothing in the law disqualifies a former caregiver’s home as a SILP. Even the document on which plaintiff and respondent, San Bernardino County Children and Family Services (CFS), relied for its argument—a form developed by the California Department of Social Services—does not disqualify a former caregiver’s home." The Court determined the error was prejudicial to M.W. and therefore reversed and remanded for the trial court to consider whether to retain or terminate dependency jurisdiction. Officer Michael Kelly was responding to a call that an intoxicated person was lying unconscious on the sidewalk outside the Days Inn in Clinton, Mississippi. While en route, his police vehicle collided with Patrice Tornes’s car. Tornes sued Officer Kelly and his employer, the City of Clinton, claiming Officer Kelly’s “reckless and negligent actions directly caused the subject accident.” Specifically, she alleged Officer Kelly “caused his vehicle to be driven in a careless, negligent, and reckless manner and without due regard for the safety and convenience of Patrice Tornes, and without giving any warning sign or proper signal of the approach of said vehicle.” And she asserted the City of Clinton was “vicariously liable for its employee’s careless, negligent, and reckless operation of his vehicle while acting in the course and scope of his employment as an officer for the City of Clinton Police Department.” She also claimed the City was liable for its own actions—specifically, “its negligent training of its employee in how to properly operate his motor vehicle in accordance for the safety of others” and its negligent entrustment of the subject vehicle to Officer Kelly on the day the wreck occurred. Both Officer Kelly and the City moved for summary judgment, claiming immunity from suit. This case came before the Mississippi Supreme Court on interlocutory appeal, because the trial court ruled in Tornes' favor. The Supreme Court held the municipality and the officer could not be liable for plaintiff's claims under the Mississippi Tort Claims Act, reversed the denial of summary judgment and rendered judgment in defendants' favor.
