The Supreme Court vacated the decision of the circuit court affirming the decision of the South Dakota Public Utilities Commission issuing an order accepting the certification of TransCanada Keystone Pipeline LP that it continued to meet permit conditions, holding that the circuit court lacked jurisdiction to hear Appellants’ appeals.The Commission granted a permit to TransCanada to construct the Keystone XL Pipeline in South Dakota. None of the parties in that proceeding appealed the order issuing a permit. Because TransCanada was unable to commence construction within four years, it certified that it continued to meet the permit conditions, as required by S.D. Codified Laws 49-41B-27. After conducting an evidentiary hearing, the Commission accepted the certification. Appellants - the Cheyenne River Sioux Tribe, the Yankton Sioux Tribe, and Dakota Rural Action - each appealed. The circuit court affirmed. The Supreme Court consolidated the appeals, vacated the circuit court’s decision, and dismissed the appeal, holding that the circuit court lacked jurisdiction to hear the appeals. Plaintiff-respondent Dawn Turnbull sued defendants-appellants the Lucerne Valley Unified School District (LVUSD), Tom Courtney, Suzette Davis, John Buchanan, and Keri Gasper. Turnbull brought causes of action for: (1) disclosing her private medical information; (2) invading her privacy; (3) interfering with her constitutional rights; (4) violating her civil rights; and (5) conspiring to deprive her of her right of privacy or right of free speech. Davis was the superintendent of LVUSD. Turnbull and Courtney were members of the LVUSD board. Although not explicit, it was inferred from the complaint that Buchanan was also a member of the LVUSD board. Gasper was an LVUSD volunteer. Turnbull opposed Davis’s alleged misappropriation of LVUSD funds. In retaliation for Turnbull’s opposition, Davis: (1) obtained confidential medical information about Turnbull from Turnbull’s employer; (2) generated false reports from the California Longitudinal Pupil Achievement Data System (CALPADS), concerning school lunch program eligibility; and (3) on July 8, 2015, falsely told LVUSD board members that evidence strongly suggested Turnbull illegally accessed CALPADS. Shortly after a LVUSD board meeting, Courtney and Buchanan, as private citizens, called Turnbull’s employer to report Turnbull’s allegedly unlawful access of CALPADS. Turnbull had legally accessed CALPADS to obtain a report concerning her stepchild. Courtney used his position as a LVUSD board member to obtain access to Turnbull’s private medical information. Courtney, as a private citizen, caused Turnbull’s private medical information to be published on social media or gave the information to people who published it on social media. Courtney intended to intimidate Turnbull to stop her from opposing Davis’s acts of misappropriation. Gasper received Turnbull’s private medical information from Courtney, Davis, or Buchanan. Gasper published the information on social media. LVUSD, Courtney, and Davis brought an anti-SLAPP motion, which the trial court denied. LVUSD, Courtney, and Davis contended the trial court erred by denying their motion. The Court of Appeals affirmed the order denying the anti-SLAPP motion; defendants failed to establish that the allegations in the complaint arose from protected activities. View "Turnbull v. The Jim Hutton Foundation (“Foundation”) owned surface-water rights in the Republican River Basin. The Foundation believed that permitted groundwater wells that people had begun to install in the underlying groundwater basin - the Northern High Plains Basin (“NHP Basin”) - were not in fact pumping designated groundwater, and were injuring its senior surface-water rights. The Foundation sued, hoping to alter the groundwater basin's boundaries to exclude any improperly permitted designated-groundwater wells. The Foundation filed this action in water court, arguing that a legislative amendment to the statutory process to challenge the designation of a groundwater basis, prohibited any challenge to alter a designated groundwater basin's boundaries to exclude a well that already received a permit. The Foundation claimed the amendment deprived surface-water users of the ability to petition the Commission to redraw the NHP Basin’s boundaries to exclude permitted well users upon a showing that groundwater was improperly designated when the NHP Basin’s designation became final. The water court dismissed this claim for lack of subject matter jurisdiction, concluding the Commission must first determine whether the water at issue is designated groundwater before subject matter jurisdiction will vest in the water court, meaning the Foundation’s constitutional claim could not become ripe until it satisfied the Commission that the water was not designated groundwater. The Foundation appealed. The Colorado Supreme Court affirmed the water court and concluded that, because jurisdiction did not vest in the water court until the Commission first determined the water at issue was not designated groundwater, the water court properly dismissed the claim. The Supreme Court affirmed the order of the superior court granting the motions to dismiss filed by Defendants, Bank of America, N.A. (BOA) and EverBank Mortgage (EverBank), on Plaintiff’s complaint seeking monetary damages for breach of contract and breach of the implied covenant of good faith and fair dealing, as well as a preliminary injunction to stop a foreclosure.Plaintiff executed a mortgage on his property in favor of Mortgage Electronic Registration Systems, Inc. (MERS). The mortgage was later assigned to BOA. After the BOA informed Plaintiff that his mortgage was in foreclosure he filed a complaint alleging, inter alia, that the assignment of the mortgage was void and that Defendants had no standing to foreclose on his property. A federal court granted Defendants’ motion to dismiss. Thereafter, Plaintiff brought this complaint. Defendants filed motions to dismiss. The superior court found that res judicata warranted the granting of Defendants’ motions to dismiss. The Supreme Court affirmed, holding that res judicata applied. View "Goodrow v. B.A.K. appealed an order for treatment in which the district court found her to be a person who was mentally ill and requiring treatment. B.A.K. was initially hospitalized after an outburst at her regular physician's office. In March 2018, her daughter petitioned for B.A.K.'s involuntary commitment. B.A.K.'s husband also attempted to commit B.A.K. while they were in Arizona for the winter. At the treatment hearing, the district court heard testimony about B.A.K.'s mental health deterioration and her refusal to take medication. In October 2017, B.A.K. started taking anxiety and depression medication. She then experienced joint pain, and she was prescribed a steroid. B.A.K. was also taking a prescribed statin for high blood pressure. B.A.K. decided to take herself off the anxiety and depression medications, and she eventually stopped taking all medications. B.A.K. believed she was being monitored, among other delusions. On appeal, B.A.K. argued the district court's order was not supported by clear and convincing evidence to show she was a mentally ill person and a person requiring treatment. After review of the Case, the North Dakota Supreme Court was "left with a definite and firm conviction" the district court's conclusion was not supported by clear and convincing evidence: "Despite Dr. Huber's testimony that she believed B.A.K. was a person requiring treatment, she also testified B.A.K. required no restraint, medication, or seclusion while hospitalized. ... Dr. Huber identified B.A.K. was manic and had delusional thoughts, but no evidence was presented showing a reasonable expectation B.A.K. would be a serious risk to herself, others, or property." The Supreme Court reversed the judgment of the court of appeals granting a motion to dismiss Appellant’s complaint for a writ of mandamus challenging the Industrial Commission’s determination that it had continuing jurisdiction to reconsider a previous order denying a claim for death benefits because of a clear mistake of fact regarding how the decedent worker died, holding that the complaint did state a claim for relief.Appellant’s complaint for a writ of mandamus alleged that the Commission abused its discretion in determining that the staff hearing officer had based the disallowance of the claim for death benefits on a clear mistake of fact. Because this question involved whether there was a factual mistake sufficient to invoke the continuing-jurisdiction provisions of Ohio Rev. Code 4123.52, the question was a proper subject matter for an action seeking a writ of mandamus. Therefore, the court of appeals erred in dismissing the action on the basis that the Commission’s decision to exercise its continuing jurisdiction was appealable to the court of common pleas. The issue this case presented for the Colorado Supreme Court's consideration centered on whether Colorado’s Independent Ethics Commission (“the IEC”) had jurisdiction pursuant to article XXIX of the state constitution to hear a complaint based on allegations that then-Secretary of State Scott Gessler (“the Secretary”) breached the public trust by using money from his statutorily-provided discretionary fund for partisan and personal purposes. The IEC investigated the complaint, held a hearing, and determined that the Secretary’s conduct breached the public trust. The Secretary sought judicial review of the IEC’s ruling, arguing that the IEC lacked jurisdiction over the case. Both the district court and the court of appeals affirmed the IEC’s ruling. The Colorado Supreme Court held that relevant jurisdictional language in article XXIX, section 5 of the state constitution authorized the IEC to hear complaints involving ethical standards of conduct relating to activities that could allow covered individuals, including elected officials, to improperly benefit financially from their public employment. Furthermore, the Court held that section 24-18-103, C.R.S. (2017), was one such ethical standard of conduct which established the holding of public office or employment was a public trust, and that a public official “shall carry out his duties for the benefit of the people of the state.” Because the allegations against the Secretary clearly implicated this standard, the Court concluded the complaint fell within the IEC’s jurisdiction and rejected the Secretary’s jurisdictional and vagueness challenges. Additionally, the Court rejected the Secretary’s procedural due process claim because he failed to demonstrate that he suffered any prejudice as a result of the alleged violation. View "Gessler v. William Veitch was a Republican candidate for district attorney for the 10th Judicial Circuit of Alabama. His request for a declaration was denied, and he petitioned for a writ of mandamus when the trial court refused to direct that the names of candidates running for the office of district attorney for the 10th Judicial Circuit be included not only on the ballot to be used in the primary election in the Birmingham Division of Jefferson County, but also on the ballot to be used in the primary election in the portion of Jefferson County known as the Bessemer Cutoff. The trial court dismissed Veitch's action based on its conclusion that it lacked subject-matter jurisdiction and, alternatively, based on the doctrine of laches. Veitch appealed. The Alabama Supreme Court found a jurisdiction-stripping statute did not deprive the trial court of jurisdiction and Veitch was not precluded by the doctrine of laches from bringing his action. At this point, the Court expressed no opinion on the merits of Veitch's arguments regarding the alleged repeal of the 1953 Act, its alleged unconstitutionality, or its alleged unconstitutional application. Appellee, the Marcellus Shale Coalition (“MSC”), filed in the Commonwealth Court’s original jurisdiction a petition for review in the nature of a complaint seeking declaratory and injunctive relief (the “Petition”), on behalf of itself and its members. MSC challenged the validity of several regulations relating to unconventional gas well operations as governed by Pennsylvania’s Oil and Gas Act of 2012 (known as Act 13). MSC alleged that certain provisions were void and unenforceable for multiple reasons, including that they were vague, lacked statutory authorization, and conflicted with other regulations and statutes applicable to the industry. Furthermore, MSC averred that the rulemaking process did not comply with the Regulatory Review Act, and that the Pennsylvania Environmental Quality Board (the “EQB”) failed to develop criteria for the Pennsylvania Department of Environmental Protection (“DEP”) to use in conditioning a drilling permit on relevant factors. The Commonwealth Court issued a single-judge, unpublished opinion and order, granting in part and denying in part preliminary injunctive relief. The Commonwealth Court also issued an order granting in part and denying in part MSC's Application for Expedited Special Relief. The order preliminarily enjoined DEP from implementing and enforcing certain sections of the Act. After its review of the parties' arguments on appeal of the Commonwealth Court order, the Pennsylvania Supreme Court affirmed in part and reversed in part. The Supreme Court affirmed the grant of preliminary injunctive relief as to Counts I and II. As for Count IV, the Court affirmed the grant of relief as to Section 78a.59c, but reversed the grant of relief as to Section 78a.59b(b).
