F.E.V. v. City of Anaheim
Adolf Gonzalez was shot and killed in an incident with two Anaheim police officers. Plaintiffs were the Decedent’s mother and minor daughter, who filed a complaint in federal court against the City of Anaheim (the City) and the two officers (collectively, Defendants). The Federal Complaint ("F.E.V. I") asserted four claims for violation of civil rights pursuant to title 42 United States Code section 1983 and state law claims for false arrest/false imprisonment, battery, negligence, and violation of the Bane Act, Civil Code section 52.1. The federal district court granted summary judgment in favor of defendants on the civil rights claims, and declined to exercise supplemental jurisdiction over the state law claims, dismissing them without prejudice. Following that dismissal, Plaintiffs filed a State Complaint, which overlapped the Federal Complaint, but provided more detail. After the Court of Appeal held oral argument in the prior appeal, the Ninth Circuit Court of Appeals issued its panel opinion in Gonzalez v. City of Anaheim, 2013 U.S.App. Lexis 9607, affirming F.E.V. I. On its own motion, the Court of Appeal took judicial notice of that opinion, which confirmed what would have been the outcome based on the status of the judgment at the time of oral argument. Based on Hernandez v. City of Pomona, 46 Cal.4th 501 (2009), the Court of Appeal held that the federal court judgment collaterally estopped Plaintiffs from pursuing their state law causes of action based on both the shooting and on theory the officers’ conduct before the shooting was negligent, and their battery and false arrest/false imprisonment causes of action. Nine months after we issued our opinion, the Ninth Circuit issued its en banc opinion reversing the federal court judgment as to claims of excessive force. In February 2015, Plaintiffs filed a new complaint (the Second State Complaint) asserting the same five causes of action as in the first State Complaint. Plaintiffs filed a motion to vacate the prior state court judgment. The trial court denied the motion. Plaintiffs brought a petition for writ of mandate to challenge the order denying their motion to vacate the judgment. A panel of the Court of Appeal summarily denied the writ petition. Defendants demurred to the Second State Complaint on the ground the claims were barred by collateral estoppel, jurisdiction, and the applicable statute of limitations. After oral argument, the trial court sustained the demurrer without leave to amend. The Court of Appeal found: (1) the Ninth Circuit en banc opinion did not nullify F.E.V. I; (2) plaintiffs could not collaterally attack the judgment affirmed by F.E.V. I; and (3) it would have been manifestly unjust to give claim preclusion effect to the judgement affirmed by F.E.V. I. Corbeil v. Emericks Van & Storage
Petitioner Lyle Corbeil suffered bilateral inguinal hernias at work, filed for workers' compensation benefits, and asked for a contested hearing on the issue of temporary total disability. The administrative law judge determined that petitioner was limited to six weeks of temporary total disability, despite petitioner's contention he suffered two hernias and should have been eligible for twelve weeks total (six for each hernia). Petitioner appealed to the Workers' Compensation Commission, which affirmed the administrative law judge. The question presented for the Oklahoma Supreme Court's review was whether the hernia provision of the Administrative Workers' Compensation Act (AWCA), 85A O.S. Supp. 2013 section 61, permitted an award of up to six weeks of temporary total disability (TTD) for each hernia suffered by a claimant, regardless of whether the hernias occurred, or were repaired, simultaneously. United States v. Osage Wind
This case presented a question of whether a large-scale excavation project constituted “mining” under the pertinent federal regulations that address mineral development on Indian land. When an entity engages in “mining” of minerals owned by the Osage Nation, a federally approved lease must be obtained from the tribe. The Osage Mineral Council (OMC), acting on behalf of the Osage Nation, appealed the award of summary judgment to Defendant Osage Wind, LLC (Osage Wind), arguing that Osage Wind engaged in “mining” without procuring a federally approved mineral lease. The Bureau of Indian Affairs (BIA) has defined “mining” as the “science, technique, and business of mineral development[.]” The Tenth Circuit held the term “mineral development” had a broad meaning, including commercial mineral extractions and offsite relocations, but also encompass action upon the extracted minerals for the purpose of exploiting the minerals themselves on site. The Court held Osage Wind’s extraction, sorting, crushing, and use of minerals as part of its excavation work constituted “mineral development,” thereby requiring a federally approved lease which Osage Wind failed to obtain. Albuquerque Cab Company, Inc. v. New Mexico Public Regulation Comm’n
The New Mexico Supreme Court consolidated two separate appeals of a final order of the New Mexico Public Regulation Commission (PRC) that granted a taxicab certificate to Q Cab, LLC for new taxicab service in Albuquerque. Two preexisting taxicab companies, Albuquerque Cab Company (Albuquerque Cab) and Yellow-Checker Cab Company (Yellow Cab) wanted the New Mexico Supreme Court to interpret the Motor Carrier Act, NMSA 1978, section 65-2A-1 to -41 (2003, as amended through 2017), because the Act had been recently amended, creating separate designations for “municipal” and “general” taxicab services, and added a definition of fitness which a candidate taxicab company must show, and the PRC must find, before an applicant may operate. The two preexisting companies sought a declaration with respect to their ability to protest new taxicab applications. The PRC determined Q Cab was fit to operate. The Supreme Court, after review, determined Albuquerque Cab and Yellow Cab were not statutorily protected from competing applicants; Albuquerque Cab and Yellow Cab both failed to demonstrate their respective businesses would be impaired; and that the PRC’s determination that Q Cab was fit to operated was supported by substantial evidence and was within the agency’s discretion. Louisiana v. Thompson
During his second term as mayor of Jonesboro, the state filed a bill of information charging defendant Leslie Thompson with three counts of malfeasance in office by failing and/or refusing to maintain proper records and to supply them to the Louisiana Legislative Auditor; by taking public funds of the town to pay for retirement benefits for employees who were not eligible to participate in the Municipal Employee’s Retirement System; and by using public funds to pay for health insurance premiums for former employees. After reviewing the evidence, the Louisiana Supreme Court concluded the evidence was sufficient to find defendant guilty beyond a reasonable doubt as to Count I of the malfeasance in office charge; however, as to Counts II and III, the Court found no rational trier of fact could have found defendant guilty beyond a reasonable doubt. Pretermitting all other assignments of error, the Court additionally found the district court erred in denying defendant’s motion for a mandatory mistrial after the prosecutor directly referenced race in a comment before the jury that was neither material nor relevant and that could create prejudice against defendant in the minds of the jury members. Accordingly, the Court vacated defendant’s convictions and sentences, and remanded this case to the district court for further proceedings. View "Louisiana v. Thompson" on Justia Law
Sharp Image Gaming v. Shingle Springs Band of Miwok Indians
Defendant Shingle Springs Band of Miwok Indians (the Tribe) appealed a judgment after trial in favor of plaintiff Sharp Image Gaming, Inc. (Sharp Image), in plaintiff’s breach of contract action stemming from a deal to develop a casino on the Tribe’s land. On appeal, the Tribe argued: (1) the trial court lacked subject matter jurisdiction because Sharp Image’s action in state court was preempted by the Indian Gaming Regulatory Act (IGRA); (2) the trial court erred in failing to defer to the National Indian Gaming Commission’s (NIGC) determination that the disputed Equipment Lease Agreement (ELA) and a promissory note (the Note) were management contracts requiring the NIGC’s approval; (3) Sharp Image’s claims were barred by the Tribe’s sovereign immunity; (4) the trial court erred in denying the Tribe’s motion for summary judgment; (5) the jury’s finding that the ELA was an enforceable contract was inconsistent with its finding that the ELA left essential terms for future determination; and (6) substantial evidence does not support the jury’s verdict on the Note. After the parties completed briefing in this case, the United States was granted permission to submit an amicus curiae brief in partial support of the Tribe on the questions of preemption and lack of subject matter jurisdiction. The Court of Appeal concluded IGRA preempted state contract actions based on unapproved “management contracts” and “collateral agreements to management contracts” as such agreements are defined in the IGRA regulatory scheme. Thus, the trial court erred by failing to determine whether the ELA and the Note were agreements subject to IGRA regulation, a necessary determination related to the question of preemption and the court’s subject matter jurisdiction. Furthermore, the Court concluded the ELA was a management contract and the Note was a collateral agreement to a management contract subject to IGRA regulation. Because these agreements were never approved by the NIGC Chairman as required by the IGRA and were thus void, Sharp Image’s action was preempted by IGRA. In re C.M.
At a special hearing, the juvenile court issued a permanent restraining order prohibiting the child's stepfather from having any contact with the child (C.M.). The child's mother, E.S., appealed an order the juvenile court issued at the same hearing, directing the San Diego County Health and Human Services Agency (Agency) to immediately remove her child from her care if there is "any evidence that the minor has been exposed to [his stepfather] or if mother violates the restraining order." While the Court of Appeal appreciated the juvenile court's assessment of the need to warn E.S. in no uncertain terms there would be serious consequences if C.M. has any contact with the stepfather, the Court concluded issuing a conditional removal order was not the way to warn her. “Removal, including a temporary detention, must be made on a timely assessment of risk to the child. Here, the court may have informed E.S. about the potential legal consequences of exposing C.M. to [the stepfather], including removal from her custody and termination of parental rights. The court may have directed the Agency to immediately bring to its attention any evidence of contact between C.M. and [the stepfather] and to set a hearing to address the issue. However, the conditional removal order disregards the dependency scheme, which is carefully calculated, not only to protect the child, but also to guarantee procedural and substantive due process to the child and the parent.” View "In re C.M." on Justia Law
WildEarth Guardians v. Bureau of Land Management
Plaintiffs-Appellants WildEarth Guardians and Sierra Club challenged the Bureau of Land Management’s (BLM) decision to approve four coal leases in Wyoming’s Powder River Basin. Plaintiffs brought an Administrative Procedure Act (APA) claim arguing that the BLM failed to comply with the National Environmental Policy Act (NEPA) when it concluded that issuing the leases would not result in higher national carbon dioxide emissions than would declining to issue them. The district court upheld the leases. The Tenth Circuit held the BLM’s Environmental Impact Studies and Records Of Decisions were arbitrary and capricious because they omitted data pertinent to its choice with respect to issuing the leases, and thereby informing the public of its rationale. The Tenth Circuit remanded with instructions to the BLM to revise its Environmental Impact Statements (EISs) and Records of Decision (RODs). The Court did not vacate the resulting leases. State ex rel. Camaco, LLC v. Albu
An employer does not face liability for the violation of a specific safety requirement (VSSR) when it lacked knowledge of a specific danger requiring a safety device.Employee suffered a head injury while working for Employer. The Industrial Commission awarded workers’ compensation benefits and granted an additional award to Employee based upon its finding that Employer had violated a specific safety requirement in failing to provide Employee with protective headgear. Employer filed a mandamus action in the court of appeals challenging the additional award. The court of appeals denied the writ, concluding that Employer had waived a central issue in its mandamus action by not raising it during proceedings before the Commission. The Supreme Court reversed and ordered a limited writ of mandamus ordering the Commission to determine whether Employer knew or should have known about the latent defect at the time that Employee was injured, holding (1) waiver did not apply in this case because the central issue raised in Employer’s mandamus action was not raised by the parties below; and (2) if Employer lacked the requisite knowledge of a design defect at the time of the injury, it cannot have violated a specific safety requirement. Lummi Tribe v. United States
Under the Native American Housing Assistance and Self-Determination Act (NAHASDA), 25 U.S.C. 4101–4243, tribes receive direct funding to provide affordable housing to their members. Grants are based on factors including “[t]he number of low-income housing dwelling units . . . owned or operated” by the tribes on NAHASDA’s effective date. Grantees are limited in how and when they may dispense the funds. The Tribes received NAHASDA block grants. In 2001, a HUD Inspector General report concluded that HUD had improperly allocated their funds because the formula applied by HUD had included housing that did not qualify. HUD provided the Tribes with the opportunity to dispute HUD’s findings, then eliminated the ineligible units from the data and deducted the amount overfunded from subsequent allocations. The Tribes brought suit under the Tucker Act and Indian Tucker Act, 28 U.S.C. 1491(a)(1) and 1505. The Claims Court held that NAHASDA is money mandating, but that the failure to give a hearing alone did not support an illegal exaction claim. Because the finding that NAHASDA is money-mandating was dispositive concerning jurisdiction, the government filed an interlocutory appeal. The Federal Circuit vacated and ordered dismissal for lack of subject-matter jurisdiction.The underlying claim is not for presently due money damages but is for larger strings-attached NAHASDA grants—including subsequent supervision and adjustment—and, therefore, for equitable relief.
