Sinclair Wyoming Refining v. EPA
In an amendment to the Clean Air Act (CAA), Congress directed the EPA to operate a Renewable Fuel Standards Program (the RFS Program) to increase oil refineries’ use of renewable fuels. But for small refineries that would suffer a “disproportionate economic hardship” in complying with the RFS Program, the statute required the EPA to grant exemptions on a case-by-case basis. Petitioner Sinclair Wyoming Refining Company owned and operated two refineries in Wyoming: one in Sinclair, and another in Casper. Both fell within the RFS Program’s definition of “small refinery” and were exempt from the RFS requirements until 2011. Those exemptions were extended until 2013 after the Department of Energy found Sinclair’s Wyoming refineries to be among the 13 of 59 small refineries that would continue to face “disproportionate economic hardship” if required to comply with the RFS Program. Sinclair then petitioned the EPA to extend their small-refinery exemptions. The EPA denied Sinclair’s petitions in two separate decisions, finding that both refineries appeared to be profitable enough to pay the cost of the RFS Program. Sinclair filed a timely petition for review with the Tenth Circuit court, which concluded the EPA exceeded its statutory authority under the CAA in interpreting the hardship exemption to require a threat to a refinery’s survival as an ongoing operation. Because the Court found the EPA exceeded its statutory authority, it vacated the EPA’s decisions and remanded to the EPA for further proceedings. View "Sinclair Wyoming Refining v. EPA" on Justia Law
Dahn v. Amedei
When a state fails to protect a foster child from harm, the foster child can sue the state under the special-relationship doctrine, pursuant to 42 U.S.C. 1983. The special-relationship doctrine provides an exception to the general rule that states aren’t liable for harm caused by private actors. This case is about the geographical reach of the special-relationship doctrine: whether the special relationship (and its accompanying duty to protect)—crosses state lines. James Dahn, a foster child, sued two Colorado social workers responsible for investigating reports that he was being abused, along with others involved with his adoption. Dahn had been in Oklahoma’s custody until, with Oklahoma’s approval, a Colorado-based private adoption agency placed him for adoption with a foster father in Colorado. The foster father physically abused Dahn before and after adopting him. The private adoption agency was responsible for monitoring Dahn’s placement. Together with Colorado, it recommended approval of his adoption by the abusive foster father. Dahn eventually escaped his abusive foster father by running away. Dahn then sued the private adoption agency, its employees, and the Colorado caseworkers who were assigned to investigate reports of abuse from officials at Dahn’s public school. The district court dismissed all of Dahn’s claims except a section 1983 claim against the two Colorado caseworkers and two state-law claims against the agency and its employees, concluding the special-relationship doctrine allowed Dahn to move forward with the 1983 claim, and it exercised supplemental jurisdiction over the remaining state-law claims. The Colorado caseworkers appealed. Though the Tenth Circuit condemned their efforts to protect the vulnerable child, the Court concluded, under the controlling precedents, that the Colorado caseworkers were entitled to qualified immunity, and reversed. BNSF Railway Co. v. LABR
Clyde Carter, Jr. injured his shoulder and neck while working as a carman at BNSF Railway Company’s yard in Kansas City, Kansas. Carter immediately reported the injury to BNSF. The following year, he filed a Federal Employers’ Liability Act (FELA) damage action, alleging that BNSF’s negligence caused his injury. BNSF’s discovery in defending the FELA lawsuit included a July 2009 deposition of Carter. In January 2012, as trial approached, a BNSF manager reviewed discovery materials provided by BNSF’s attorneys. He discovered discrepancies between Carter’s deposition testimony and information provided on his employment application and medical questionnaire submitted to BNSF in 2005. Thompson initiated a disciplinary investigation into potentially dishonest statements. Later, BNSF opened a second disciplinary investigation to determine if Carter signed a false statement that he arrived at work on time on February 5, 2012. The investigations culminated in two "on-property" evidentiary hearings, the conclusions of which found Carter committed dishonesty violations and recommended discipline in accordance with BNSF’s Policy for Employee Performance Accountability (PEPA). It was recommended Carter be terminated for dishonesty, a "stand alone" violation that could result in dismissal without regard to an employee's prior disciplinary history. Following termination, Carter filed an FRSA complaint with the Department of Labor, alleging that BNSF initiated the investigations leading to his dismissal in retaliation for Carter reporting the August 2007 work-related injury. The Occupational Safety and Health Administration dismissed Carter’s complaint, finding he committed the violations, and BNSF proved by clear and convincing evidence that "other employees who had not engaged in protected activity have been dismissed from service for dishonesty." Carter filed objections. After an evidentiary hearing, an Administrative Law Judge (ALJ) found that BNSF violated 49 U.S.C. 20109(a)(4) and awarded reinstatement, back pay, attorneys’ fees, and $50,000 punitive damages. BNSF filed an administrative appeal. The Secretary’s Administrative Review Board (ARB) affirmed the ALJ. BNSF appealed. The Eighth Circuit found the ALJ's reasoning was based on a flawed interpretation of the FRSA; though the Administrative Review Board did not rely on the ALJ's chain-of-events causation theory, it affirmed based on findings which were either non-existent or insufficient to support the Board's contributing factor and affirmative defense rulings. Odom v. Alaska Div. of Corporations, Bus. & Prof. Licensing
The Alaska professional licensing division brought an accusation of professional misconduct against doctor David Odom, M.D., alleging that he acted incompetently when he prescribed phentermine and thyroid hormone for one of his patients. The division sought disciplinary sanctions against the doctor. Following a hearing, an administrative law judge issued a proposed decision concluding that the division had failed to show that the doctor’s conduct fell below the standard of care in his field of practice and that no disciplinary sanctions were warranted. But the Medical Board instead adopted as its decision the proposal for action submitted by the division and revoked the doctor’s medical license. On appeal to the superior court, the case was remanded to the Board for consideration of the doctor’s own late-filed proposal for action. The Board reaffirmed its decision to revoke the doctor’s medical license, and the superior court affirmed that decision. The doctor appealed to the Alaska Supreme Court. Because the Medical Board’s decision to revoke the doctor’s medical license was not supported by substantial evidence, the Court reversed the superior court’s affirmance of that decision. The issue in this case is whether the Multnomah County Sheriff’s Office (county) complied with the requirements of ORS 408.230(2)(c) to “devise and apply methods” of giving veterans and disabled veterans “special consideration” in the hiring process, or as here, when it failed to promote a disabled veteran. The Bureau of Labor and Industries (BOLI) concluded that the county did fail to comply with the statute, as well as administrative rules that implement it. BOLI ordered the county to comply with the law, to train its staff, and to pay the disabled veteran $50,000 in damages for his emotional distress. The county appealed, but the Oregon Supreme Court concluded BOLI correctly construed ORS 408.230(2)(c) and that, given the unchallenged findings in the agency’s final order, there was no basis for the county’s contention that BOLI erred in finding a violation of that statute. With regard to BOLI’s authority to award damages for emotional distress, the county failed to preserve that argument. The Court therefore affirmed the Court of Appeals and the final order of BOLI. This case arose from a community college’s decision to buy a plot of vacant land from a regional park district for potential future use as the site of a new campus. Plaintiffs-appellants Martha Bridges and John Burkett, residents of Wildomar (where the land was located) sued respondent Mt. San Jacinto Community College District (the community college, or the college) alleging it violated California Environmental Quality Act (CEQA) by failing to prepare an environmental impact report (EIR) before executing a purchase agreement for the property. Appellants also alleged the community college violated CEQA by failing to adopt local CEQA implementing guidelines. The trial court dismissed the action in its entirety, and the Court of Appeal affirmed: (1) appellants did not exhaust their administrative remedies before filing this suit and did not demonstrate they were excused from doing so; and (2) even if the exhaustion doctrine did not bar appellants’ suit, the Court would have affirmed the trial court’s ruling because both of their CEQA claims lacked merit. Plaintiff Melony Light appealed judgments in favor of her employer, defendant California Department of Parks and Recreation (Department), and her former supervisors, defendants Leda Seals and Kathy Dolinar, following orders granting defendants' motions for summary judgment. Light worked for the Department's Ocotillo Wells District. She alleged numerous claims against the Department, Seals, and Dolinar, including retaliation, harassment, disability discrimination, assault, false imprisonment, negligent infliction of emotional distress, and intentional infliction of emotional distress. The trial court disposed of several claims at the pleading stage. After two and a half years of litigation, the Department, Seals, and Dolinar moved for summary judgment on the remaining claims against them. As to the Department, the Court of Appeal concluded triable issues of material fact precluded summary adjudication of Light's retaliation claim, but not her disability discrimination claim. Light's claim against the Department for failure to prevent retaliation or discrimination therefore survived based on the retaliation claim. As to Seals and Dolinar, the Court concluded contrary to the trial court that workers' compensation exclusivity did not bar Light's claim for intentional infliction of emotional distress under the circumstances here. However, as to the merits of that claim, the Court concluded Light has raised a triable issue of fact only as to Seals, not Dolinar. Furthermore, the Court concluded Light raised triable issues of fact on her assault claim against Seals. Therefore, the Court affirmed in part and reversed in part the judgments in favor of the Department and Seals, and affirmed in full the judgment in favor of Dolinar. View "Light v. Calif.
