Pueblo of Pojoaque v. New Mexico
Plaintiffs-Appellants Pueblo of Pojoaque appealed a district court’s dismissal of its claim for declaratory and injunctive relief based on the New Mexico’s alleged unlawful interference with Class III gaming operations on the Pueblo’s lands. In July 2005, the Pueblo and New Mexico executed a Class III gaming compact pursuant to the Indian Gaming Regulatory Act (“IGRA”) that allowed it to operate casino-style gaming on its lands. Prior to the expiration of the compact, the New Mexico Gaming Control Board (“the Gaming Board”) sought to perform its annual compliance review of the Pueblo’s gaming operations. The Pueblo complied on June 24; on June 30, 2015, the compact expired at midnight. The Gaming Board announced that despite the U.S. Attorney’s decision allowing the Pueblo’s gaming operations to continue pending the review, the Pueblo’s casinos were operating illegally due to the absence of a compact, and it placed in abeyance approval of any license application or renewal for vendors who did business with the Pueblo. The Pueblo commenced this action, asserting in part that New Mexico failed to conduct compact negotiations in good faith in violation of IGRA and that individual defendants conspired under the color of state law to “deprive the federal right of the Pueblo and its members to be free of state jurisdiction over activities that occur on the Pueblo lands.” The Pueblo sought an injunction, contending that the Gaming Board’s actions were an impermissible attempt to assert jurisdiction over gaming operations on tribal lands, despite the termination of New Mexico’s jurisdiction over such activities upon the expiration of the compact. The district court entered final judgment, stayed the effects of the preliminary injunction, and issued an indicative ruling that it would vacate or dissolve the preliminary injunction on remand. The Pueblo sought to stay the district court’s judgment and restore the preliminary injunction. The district court declined to do so, but the Tenth Circuit extended a temporary injunction against the State mirroring the preliminary injunction entered by the district court. On appeal, the Pueblo argued the district court did not have jurisdiction to proceed to the merits given the interlocutory appeal of the preliminary injunction and, even if it did, it erred in concluding that IGRA did not preempt New Mexico’s regulatory action. The Tenth Circuit found the text of IGRA clearly evinced congressional intent that Class III gaming would not occur in the absence of a compact, and no such compact existed. Accordingly, conflict preemption also does not apply. For similar reasons, the Court rejected the Pueblo’s argument that the Gaming Board’s determination as to the unlawful nature of the Pueblo’s gaming activities was an improper assertion of jurisdiction preempted by IGRA. Because the Pueblo’s gaming activities are not conducted pursuant to a compact or an alternative mechanism permitted under IGRA, the Pueblo’s present gaming is unlawful under federal law, and the State’s conclusion to this effect was not an exercise of jurisdiction that IGRA preempts. Langved v. Continental Resources, Inc.
Appeals from decisions of the Industrial Commission cannot be turned into inverse condemnation actions; the Industrial Commission was authorized to modify previously designated spacing units. Arthur Langved appealed an Industrial Commission grant of Continental Resources, Inc.'s application to terminate existing oil and gas well spacing units, to create new spacing units, and to modify well setback requirements for portions of the Elm Tree-Bakken and Sanish-Bakken pools. Langved owned leased and unleased mineral interests in property covered by spacing units created by the Commission in 2013 and 2014. In 2015, Continental filed an application to amend these Commission orders to terminate the existing spacing units and to create new spacing units. On appeal, Langved stated the issue was "[w]hether the [Commission] could constitutionally, statutorily, or discretionally reunitize a producing drilling and spacing unit and thereby diminish his vested property rights and take his surface estate to afford Continental and the state of North Dakota an opportunity to access submerged minerals under the sections added in the enlarged unit." The North Dakota Supreme Court determined the Commission regularly pursued its authority, and its findings and conclusions were sustained by the law and by substantial and credible evidence. Georgia Republican Party v. Securities & Exchange Commission
The Tennessee Republican Party, the Georgia Republican Party, and the New York Republican State Committee challenged the legality of 2016 amendments to rules proposed by the Municipal Securities Rulemaking Board (MSRB) that are “deemed to have been approved” by the Securities and Exchange Commission (SEC), 15 U.S.C. 78s(b)(2)(D). The rules arose out of concern “that brokers and dealers were engaging in a variety of ethically questionable practices in order to secure underwriting contracts,” and are intended to limit pay-to-play practices in the municipal securities markets. The amendments limit the campaign activities of persons who advise city and state governments on issuing municipal securities. The Sixth Circuit dismissed because the plaintiffs failed to establish their standing to challenge the amendments. There was no “self-evident” injury to the plaintiffs and only limited information on the number of persons possibly affected by the amendments. At most, there were approximately 713 registered non-dealer municipal advisory firms in the United States that would be affected by the Amendments, but it is unclear how many municipal advisor professionals are associated with these firms, let alone the likelihood that they would donate to plaintiffs if not for the Amendments. It is unknown whether the Amendments have hindered individual candidates who are members of the plaintiff organizations. View "Georgia Republican Party v. Zerr v. Workforce Safety & Insurance
Arjuna Zerr appealed a judgment dismissing his action seeking declaratory relief against North Dakota Workforce Safety and Insurance ("WSI"). The North Dakota Supreme Court concluded the district court did not err in dismissing his complaint based on a lack of subject matter jurisdiction because Zerr did not exhaust his statutory administrative remedies. Norton v. Ute Indian Tribe of the Uintah
This matter arose from the death of Todd Murray, a Ute tribal member, following a police pursuit on the Uintah and Ouray Indian Reservation. Murray’s parents, his estate, and the Ute Indian Tribe (the “Tribal Plaintiffs”) sued the officers involved in Ute Tribal Court for wrongful death, trespass, and other torts. The officers then filed suit in federal court against the Tribe, its Business Committee, the Tribal Court, the Acting Chief Judge of the Tribal Court, and the other Tribal Plaintiffs. The district court enjoined the Tribal Court action, holding that Nevada v. Hicks, 533 U.S. 353 (2001), barred tribal civil jurisdiction over the officers, making exhaustion of tribal court remedies unnecessary. It further determined that certain defendants were not entitled to tribal sovereign immunity. After review, the Tenth Circuit concluded the district court erred in excusing the officers from exhaustion of tribal remedies with respect to the Tribe’s trespass claim; that claim at least arguably implicates the Tribe’s core sovereign rights to exclude and to self-govern. The Court further concluded this claim was not barred by Hicks. However, the Court agreed the remaining Tribal Court claims were not subject to tribal jurisdiction and thus exhaustion was unnecessary. The Court reversed the district court’s denial of tribal sovereign immunity as to the Tribe, its Business Committee, and the Tribal Court. View "Norton v. Estate of Jack R. Pirozzolo v. Department of Marine Resources
Certain property owners in the vicinity of a proposed lease site (“the Neighbors”) brought a Me. R. Civ. P. 80C appeal from a judgment of the superior court that affirmed in part and vacated in part a decision of the Department of Marine resources granting Joseph Porada a limited purpose aquaculture lease to farm oysters and quahogs in Morgan Bay in Surry. The superior court vacated the decision insofar as it granted Porada a lease covering four acres and remanded the matter to the Department to reduce the area of the site from four to two acres. The superior court also dismissed as duplicative several independent claims for declaratory relief brought with the appeal. Clam Lake Township v. Dept. of Licensing & Reg. Affairs
In Docket No. 151800, Clam Lake Township and Haring Charter Township (the Townships) appealed the determination of the State Boundary Commission (the Commission) that an agreement entered into under the Intergovernmental Conditional Transfer of Property by Contract Act (Act 425 agreement) between the Townships was invalid. In Docket No. 153008, as the Commission proceedings in Docket No. 151800 were ongoing, TeriDee, LLC brought an action against the Townships, seeking a declaratory judgment that the Act 425 agreement was void as against public policy because it contracted away Haring’s zoning authority by obligating Haring’s zoning board to rezone pursuant to the agreement. The Act 425 agreement at issue here sought to transfer to Haring Charter Township an undeveloped parcel of roughly 241 acres of land in Clam Lake Township that was zoned for forest-recreational use. The agreement provided a description of the Townships’ desired economic development project, including numerous minimum requirements for rezoning the property. Approximately 141 acres of the land were owned by TeriDee LLC, the John F. Koetje Trust, and the Delia Koetje Trust (collectively, TeriDee), who wished to develop the land for commercial use. To achieve this goal, TeriDee petitioned the Commission to have the land annexed by the city of Cadillac. The Commission found TeriDee’s petition legally sufficient and concluded that the Townships’ Act 425 agreement was invalid because it was created solely as a means to bar the annexation and not as a means of promoting economic development. The Townships appealed the decision in the circuit court, and the court upheld the Commission’s determination, concluding that the Commission had the power to determine the validity of an Act 425 agreement. The Townships sought leave to appeal in the Court of Appeals, which the Court of Appeals denied in an unpublished order. The Michigan Supreme Court held: (1) the State Boundary Commission did not have the authority to determine the validity of the Act 425 agreement and could only find whether an agreement was "in effect"; and (2) an Act 425 agreement can include requirements that a party enact particular zoning ordinances, and the Court of Appeals erred by concluding to the contrary. Schoenhofer v. McClaskey
Plaintiff Ralph Rogerson, a licensed pest-control applicator in Kansas, challenged a regulation of the Kansas Department of Agriculture on the ground that it required excessive pesticide treatment in preconstruction applications. He filed suit for declaratory and injunctive relief against the Secretary of the Department, claiming that the regulation: (1) was preempted by the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) because it conflicted with pesticide labels approved by the Environmental Protection Agency (EPA); and (2) was preempted by the Sherman Antitrust Act because it limited consumer choice and competition through retail price maintenance. The United States District Court for the District of Kansas rejected both claims, and Plaintiff appealed. The Tenth Circuit affirmed: the Kansas regulation was neither expressly nor impliedly preempted by FIFRA. And Plaintiff conceded the absence of an essential element of his Sherman Act claim. In re Estate of McElveny
Edward McElveny (McElveny) died intestate in 1991. In April 2013, McElveny’s grandson, Michael Phillips, filed an application with the Santa Fe County Probate Court (Probate Court) to be informally appointed personal representative (PR) of McElveny’s estate. In his application, Phillips noted that the Department of Taxation and Revenue had custody of approximately $70,000 (the Property) that belonged to McElveny and which the Department held as unclaimed property. Phillips asked the Probate Court to order the Department to release the Property to him as PR. The Probate Court granted Phillips’ request, appointed him PR, and ordered the Department to release the Property to him. Phillips then filed an unclaimed property claim with the Department. Phillips left the claim form blank and attached to the blank claim form a copy of the Probate Court’s order. In June 2013, the Department wrote to Phillips, acknowledged receipt of his claim, but informed Phillips that it was “incomplete.” Phillips responded by letter, protested that he had submitted all documentation the Department required to process and approve his claim. The Department did not reply and did not release the Property. In August 2013, the Probate Court transferred the case to the First Judicial District Court. Phillips filed a motion with the district court asking it to enforce the Probate Court’s order and to issue sanctions against the Department. The Department moved to dismiss the proceedings and argued that the district court lacked subject matter jurisdiction because Phillips failed to exhaust administrative remedies. Phillips responded and claimed that the exhaustion doctrine was inapplicable because he was “not suing the Department, i.e.[,] not attempting to obtain subject matter jurisdiction over the Department for the purpose of stating a claim.” The New Mexico Supreme Court held that the administrative claim filing provisions of the Uniform Unclaimed Property Act (UPA)were exclusive and mandatory and that individuals wishing to procure unclaimed property must exhaust the administrative remedies afforded them by the Act. Consequently, estate representatives like Phillips cannot circumvent the UPA’s claim filing provisions by invoking provisions of the Uniform Probate Code 11 (UPC). Although Phillips did not exhaust administrative remedies under the UPA, it the Court determined it was unnecessary to remand for further administrative proceedings, and ordered the Department to release to Phillips the unclaimed property in its custody that belonged to the estate. Marlow v. The New Food Guy, Inc.
Plaintiff Bridgette Marlow sued her employer The New Food Guy, Inc., d/b/a Relish Catering, under the Fair Labor Standards Act (FLSA). The FLSA required employers to pay a minimum wage of $7.25 per hour, plus time and a half for overtime. Relish paid Ms. Marlow $12 an hour and $18 an hour for overtime. Despite this, Marlow claimed Relish was obligated to turn over to her a share of all tips paid by catering customers. She relied on the tip-credit provision of the FLSA, which was directed to employers who satisfy their minimum-wage obligations in part with tips retained by their employees, and on a regulation promulgated by the Department of Labor (DOL) purportedly interpreting that provision. The Tenth Circuit was not persuaded by this argument, finding the tip-credit provision does not apply in this case and that the regulation was beyond the DOL’s authority. The law’s “silence” about employers who decline the tip credit was no “gap” for an agency to fill. Instead, the text limits the tip restrictions in the statute to those employers who take the tip credit, leaving the DOL without authority to regulate to the contrary. View "Marlow v.
