Plaintiffs were families with children enrolled in the Douglas County School District RE-1 (“DCSD”) and the American Humanist Association (“AHA”). Plaintiffs filed suit challenging various DCSD practices as violations of the Establishment Clause and the Equal Access Act (“EAA”), contending DCSD engaged in a pattern and practice of promoting Christian fundraising efforts and permitting faculty participation in Christian student groups. The Tenth Circuit found most of the plaintiffs failed to demonstrate that they or their children experienced “personal and unwelcome contact with government-sponsored religious” activities. Furthermore, they failed to demonstrate their case for municipal taxpayer standing because they could not show expenditure of municipal funds on the challenged activities. The sole exception is plaintiff Jane Zoe: she argued DCSD violated the Establishment Clause when school officials announced they were “partnering” with a Christian student group and solicited her and her son for donations to a “mission trip.” The district court held that because Zoe’s contacts with the challenged actions were not conspicuous or constant, she did not suffer an injury for standing purposes. The Tenth Circuit found "no support in our jurisprudence" for the contention that an injury must meet some threshold of pervasiveness to satisfy Article III. In consolidated cross-appeals, the Pennsylvania Supreme Court accepted review to consider whether three statutory provisions, the “Donated or Dedicated Property Act” (“DDPA”), the “Project 70 Land Acquisition and Borrowing Act” (“Project 70 Act”), and the Eminent Domain Code, allow Appellant Downingtown Borough (“Borough”) to sell four parcels of land to private housing developers , Appellants Progressive Housing Ventures, LLC and J. Loew and Associates, Inc. (“Developers”). The four parcels comprised a public community park owned and maintained by the Borough, and were held by the Borough as trustee. After review, the Court vacated the order of the Commonwealth Court with respect to the Borough’s proposed sale to Developers of two southern parcels, reversed the order regarding the proposed sale by the Borough to Developers of two northern parcels, and reversed the order of the Commonwealth Court involving the Borough’s grant of easements to Developers over all parcels. The Borough was required to obtain court approval before selling the parcels, and easements over the land would have subordinated public rights to the parcels to private rights. The issue before the Pennsylvania Supreme Court in this matter was whether a recently terminated employee was an "employee" and, thus, entitled to inspect her personnel file, according to the Inspection of Employment Records Law ("the Personnel Files Act" or "the Act"). Reading the Personnel Files Act according to its plain terms, the Court concluded that former employees, who were not laid off with re-employment rights and who are not on a leave of absence, have no right to access their personnel files pursuant to the Act, regardless of how quickly following termination they request to do so. The thirty-day period under Wis. Stat. 68.13(1) during which certiorari review may be obtained for a town board’s highway order to lay out, alter, or discontinue a highway begins to run on the date that the highway order is recorded by the register of deeds.In this case, the circuit court granted the town boards’ motions to dismiss Appellant’s petitions for certiorari review of highway orders recorded in Rock and Walworth Counties. The Supreme Court reversed and remanded for certiorari review in either Walworth County Circuit Court or Rock County Circuit Court because Appellant’s petitions were filed within thirty days of the dates on which the highway orders were recorded by the registers of deeds. Because the state proposed to use federal highway funds to widen Wisconsin Route 23, the U.S. Department of Transportation (USDOT) issued an environmental impact statement (EIS). USDOT made a record of decision (ROD) permitting the use of federal funds. Opponents filed suit. The court denied a request for an injunction because Wisconsin can proceed using its own money regardless of whether USDOT satisfied the requirements for a federal contribution, but set aside the ROD, finding that the statement projecting 2035 traffic loads had not adequately disclosed all assumptions. USDOT issued a revised EIS with additional details about how the traffic estimates had been generated. The district court reiterated the order vacating USDOT’s ROD. The judge stated that plaintiff was entitled to a declaratory judgment but neglected to issue one. The order setting aside the ROD was appealed by the Wisconsin Department of Transportation. The Seventh Circuit dismissed an appeal. USDOT did not appeal. Wisconsin remains free to continue the project at the state’s expense. The National Environmental Policy Act, on which the suit rests, applies only to the national government, 42 U.S.C. 4332(2)(C). Wisconsin cannot seek relief against a judgment that does not bind it. Wisconsin does not contend that USDOT had a statutory duty to fund the project, to prepare a better EIS, or to appeal the decision. View "1000 Friends of Wisconsin, Inc v. The Colorado Supreme Court’s decision in this matter addressed appeals from two related cases: Gallegos Family Properties, LLC’s petition to de-designate a portion of the Upper Crow Creek Designated Ground Water Basin, and an order awarding the Well Owners a portion of their litigation costs. At issue was whether Gallegos satisfied the statutory standard for de-designating a portion of the Basin set forth in section 37-90-106(1)(a), C.R.S. (2003), and as interpreted by this the Court in Gallegos v. Colorado Ground Water Commission, 147 P.3d 20 (Colo. 2006), and whether Gallegos should have bourne the Well Owners’ costs. The designated groundwater court concluded that Gallegos had failed to make new showings sufficient to justify de-designating a portion of the Basin and taxed Gallegos for a portion of the Well Owners’ costs. The Supreme Court concluded that Gallegos failed to prove by evidence not before the 1987 Commission that the Well Owners were pumping water connected to Crow Creek such that future conditions and factual data justify de-designating a portion of the Basin. Because a party must show connectivity to prove impact, Gallegos failed to meet its burden, and de-designation was improper. Accordingly, the Court affirmed the designated groundwater court’s order denying Gallegos’s petition. Furthermore, because the designated groundwater court properly denied Gallegos’s petition for de-designation, the Supreme Court concluded that the court did not abuse its discretion in concluding that the Well Owners were prevailing parties for purposes of C.R.C.P. 54(d), that the costs awarded were reasonable and necessary, and that Gallegos should pay these costs pursuant to Rule 54(d). The Stuttering Foundation, Inc. (“Foundation”) leased office space in a commercial development in Glynn County owned by Lucas Properties Holdings III, LLC (“Lucas”). In 2015, Lucas filed an application for rezoning of the property to construct an addition to the rear of one of the existing buildings in the development, the building in which the Foundation leased its office. It also sought approval of a site plan for the proposed construction. Both were approved in March 2016. For various reasons, the Foundation opposed the new development and filed a petition for judicial review of the rezoning application and Site Plan, or in the alternative, for mandamus reversing the County’s approval. Both the County and Lucas filed a motion to dismiss the complaint on its merits. The trial court entered an order granting the County’s motion to dismiss, concluding that the Foundation lacked standing to raise its objections to the rezoning. The Georgia Supreme Court agreed with the trial court that the Foundation demonstrated no right to contest the rezoning decision. Lucas’s motion to dismiss was a nullity and therefore vacated. This case concerned OCGA 36-11-1 and a split of opinions in two controlling case law precedents decided by the Georgia court of Appeals. In In re Estate of Leonard, 783 SEd2 470 (2016), Joe Leonard, Jr. allegedly sustained injuries while riding as a passenger aboard a Whitfield County Transit Services bus. Leonard hired a lawyer; his lawyer sent a letter to Robert Smalley, an attorney in Dalton, Georgia. Although Smalley was engaged in private practice, he also served as the County Attorney for Whitfield County, a position to which he was appointed prior to his receipt of Leonard’s letter. In that letter, Leonard’s lawyer referred to the injuries that Leonard allegedly sustained in January, and he asked that Smalley accept the letter as a presentment of Leonard’s claim against the County. The County ultimately moved for summary judgment under OCGA 36-11-1 claiming that Leonard never properly presented his claim, and as such, was barred. The County acknowledged the letter Leonard’s lawyer sent to Smalley, but argued that was not a proper presentment because Smalley was not an in-house county attorney. The Georgia Court of Appeals said in Coweta County v. Cooper, 733 SE2d 348) (2012), that presentment may properly be made to the county attorney, but only if the county attorney is employed by the county in house. In this case, the Court of Appeals distinguished between inside and outside county attorneys, holding that presentment to an outside county attorney was not a proper presentment. The Georgia Supreme Court granted a petition for a writ of certiorari to review the decision in Leonard, and reversed, holding that presentment to the county attorney (inside or outside) was presentment for the purposes of OCGA 36-11-1. Petitioner Beverly Desmarais appealed the decision of the New Hampshire Compensation Appeals Board (CAB) denying her request for attorney’s fees and costs that she incurred in litigating a fee dispute with the respondents, Utica National Insurance Group (Utica) and AMI Graphics. The CAB determined that, although the Workers’ Compensation Law entitled the petitioner to attorney’s fees and costs associated with litigating the merits of her workers’ compensation claim, it did not further entitle her to fees and costs incurred in successfully litigating the fee dispute. The New Hampshire Supreme Court reversed and remanded, finding that the evident purpose of paragraph VI of RSA 281-A:44 was to encourage claimants to obtain, and attorneys to provide, representation in a certain class of disputes regarding workers’ compensation benefits. The Court remanded to the CAB for a determination as to the reasonableness of the additional fees and costs that the petitioner incurred in litigating the fees and costs issue at the administrative level. Any party aggrieved by the CAB’s order on fees and costs may appeal to the Supreme Court pursuant to RSA chapter 541. View "Appeal of Beverly Desmarais" on Justia Law

Grist Creek owns property in Mendocino County on which it has aggregate and asphalt processing operations. The County Air Quality Management District approved a permit to construct a “Crumb Rubber Heating and Blending Unit” for the production of rubberized asphalt, on the property. The District Hearing Board’s four members who considered an appeal split evenly on their vote; the Board stated no further action would be taken, leaving the permit in place. Oponents filed a petition for writ of administrative mandate, claiming that Grist Creek should have conducted an environmental review and that the District and Hearing Board violated the California Environmental Quality Act (CEQA, Pub. Resources Code, 21000) and District regulations by failing to require one. The trial court dismissed the action against the Board with leave to amend, finding the tie vote was not a decision, so there was nothing to review. The court of appeals reversed. The Board’s tie vote, in this context, resulted in the denial of the administrative appeal, subject to judicial review. View "Grist Creek Aggregates, LLC v. Superior Court" on Justia Law
