This case comes to us for a second time to determine if the Southeastern Pennsylvania Transportation Authority (SEPTA) was exempted from the jurisdiction of the City of Philadelphia (the City) via the Philadelphia Commission on Human Relations (Philadelphia Commission) and the provisions of the Philadelphia Fair Practices Ordinance (FPO). This case originated in seven administrative proceedings against SEPTA that individuals instituted with the Philadelphia Commission from July 2007 through April 2009, alleging violations of the FPO. At least two of the administrative complaints included claims of types of discrimination against which the FPO offers protection, but that the Pennsylvania Human Relations Act (PHRA) did not cover. The Pennsylvania Supreme Court previously remanded this case to the Commonwealth Court to ascertain the legislative intent regarding this issue by employing the analysis set forth in “Dep‘t of Gen. Serv. v. Ogontz Area Neighbors Ass‘n,” (483 A.2d 448 (Pa. 1984)). On remand, the Commonwealth Court determined that, applying the Ogontz test, the language and statutory scheme of the relevant statutes revealed the legislature‘s intent to exempt SEPTA from actions brought under the FPO. The Supreme Court found the Commonwealth Court did not err in its determination that, under the first prong of the Ogontz analysis, the statutory language and legislative scheme of the enabling legislation disclosed the legislature‘s intent to exclude SEPTA from the jurisdiction of the FPO. Consolidated appeals arose out of the district court’s grant of a preliminary injunction to the New Mexico Department of Game and Fish. The injunction followed the release, without a state permit, of two Mexican gray wolf pups on federal land located in New Mexico by the United States Fish and Wildlife Service (“FWS”). The district court’s order enjoined the Department of the Interior, FWS, and certain individuals in their official capacities from importing or releasing: (1) any Mexican gray wolves into the State without first obtaining the requisite state permits; and (2) any Mexican gray wolf offspring into the State in violation of prior state permits. Interior, FWS, Ryan Zinke, in his official capacity as Secretary of the Interior, Jim Kurth, in his capacity as Acting Director of FWS, Dr. Benjamin Tuggle, in his capacity as Southwest Regional Director for FWS, and intervening defendants Defenders of Wildlife, Center for Biological Diversity, WildEarth Guardians, and New Mexico Wilderness Alliance, separately filed timely appeals contending the district court abused its discretion in granting the Department a preliminary injunction. After review, the Tenth Circuit determined the Department failed to present sufficient evidence to support a finding that it was likely to suffer irreparable harm absent a preliminary injunction. As a result, the district court abused its discretion in granting the Department’s request for injunctive relief. The Tenth Circuit therefore reversed and vacated the district court’s order enjoining Federal Appellants from importing and releasing: (1) any Mexican gray wolves into the State without first obtaining the requisite state permits; and (2) any Mexican gray wolf offspring into the State in violation of prior state permits. State employee Shirley Shea suffered from chronic pain and has been unable to work. She applied for occupational disability benefits, claiming that prolonged sitting at work aggravated a preexisting medical condition. The Division of Retirement and Benefits denied the claim. An administrative law judge affirmed that decision, determining that employment was not a substantial factor in causing Shea's disability. On appeal, the superior court reversed the administrative law judge’s decision. Because the administrative law judge’s decision was supported by substantial evidence, the Alaska Supreme Court reversed the superior court’s decision and affirmed the administrative law judge. Laura Miller appeals from a summary judgment entered by the Jefferson Circuit Court ("the circuit court") in favor of the City of Birmingham ("the City"), Sandy Roberts, and Alice Crutchfield (collectively, "the City defendants"). Robert Miller, Laura's husband, was employed by the City as a firefighter. Unum Life Insurance Company of America ("Unum") issued a group life and accidental death and dismemberment policy. According to the summary of benefits, the policy included different life-insurance benefits for active employees and for retired employees. Under the policy, as an active employee, the City paid Robert's insurance premiums, thereby entitling him to a life-insurance benefit of $151,000. However, if Robert were to retire, he would be required to pay his life-insurance premiums and would be entitled to only a $50,000 life-insurance benefit. The summary of benefits specified that, in order to be eligible for a waiver of the life-insurance premiums, the insured had to "be disabled through your elimination period," which was nine months. In 2012, Robert was diagnosed with brain cancer and soon became unable to perform the duties of his job. Laura contended once the Millers learned of Robert's condition, they "sought to obtain information about [Mr. Miller's] life insurance benefit and all other benefits that might be available." The Millers did not have a copy of the policy or the summary of benefits at that time. The Millers and Ed Bluemly, Mrs. Miller's brother-in-law, met with Sandy Roberts, the assistant benefit administrator and the pension coordinator for the Jefferson County Personnel Board, and Alice Crutchfield, a personnel technician for the Jefferson County Personnel Board, to learn about the available benefits. The Millers asked for a copy of the policy, and there was a dispute over whether the Crutchfield gave the Millers a copy. The Millers ultimately sued the City for negligence with respect to the policy and collection of the benefits to which Robert was entitled. After review of this matter, the Supreme Court affirmed the circuit court's summary judgment in favor of the City insofar as the circuit court based its summary judgment in favor of the City on the City defendants' argument that the City was entitled to immunity from Laura's claim alleging wanton and reckless misrepresentation. However, the Court reversed the circuit court's summary judgment in favor of the City defendants in all other respects. The Case was remanded for further proceedings. View "Miller v. This petition for review returned to a long series of administrative cases arising out of the California energy crisis of 2000 and 2001 all centering on whether the Federal Energy Regulatory Commission (“FERC” or “Commission”) acted arbitrarily or capriciously in calculating certain refunds. FERC that FERC had acted outside its jurisdiction when ordering governmental entities/non-public utilities to pay refunds, the Commission vacated each of its orders in the California refund proceeding to the extent that they ordered governmental entities/nonpublic utilities to pay refunds. In sum, although the tariffs were not specific, the Ninth Circuit could not concluded FERC acted arbitrarily or capriciously in its construction of the tariffs. View "California Pub. Util. Comm'n v. In 2006, the City of San Diego (City) obtained a Site Development Permit (SDP) to construct a new lifeguard station on Mission Beach. The SDP stated that failure to utilize the permit within 36 months of its issuance would automatically void the permit. Over the ensuing years, the City worked to secure a permit from the California Coastal Commission (Commission) and to obtain funding for the project. Largely because of the economic downtown, the City struggled to find financing for the project and no construction occurred until 2015. At that time, the City notified nearby residents that its contractor would begin construction in March. The City issued building permits in April and its contractor began initial work on the project, then stopped before the summer moratorium on beach construction. In August 2015, before the end of the moratorium, Citizens for Beach Rights (Citizens) brought a petition for writ of mandate and claim for declaratory relief seeking to halt construction on the grounds that the SDP issued in 2006 had expired. The trial court agreed with Citizens and issued a permanent injunction, preventing further construction without a new SDP. The City appealed, arguing Citizens' claims were barred by the applicable statutes of limitations or the doctrine of laches and, even if the action was not time barred, the SDP remained valid in 2015 under the City's municipal code and policies. The City also argued Citizens improperly sought declaratory relief. After review, the Court of Appeal held Citizens' action was barred by the applicable statutes of limitations and, even if Citizens' claims had been timely pursued, the SDP remained valid when construction began. Petitioner LeAndra Lewis sought workers' compensation benefits for injuries she suffered following a shooting in a night club operated by L.B. Dynasty. In a previous opinion, the South Carolina Supreme Court held Lewis was an employee of L.B. Dynasty, entitling her to workers' compensation benefits. The Court remanded the matter to the court of appeals to review the commission's order awarding benefits to Lewis. Ultimately, the court of appeals affirmed the commission's award of $75 per week. Lewis appealed, arguing the court of appeals erred in holding the commission's findings were supported by substantial evidence. The Supreme Court agreed, and remanded this case back to the commission for a de novo hearing to determine the amount of benefits to which Lewis is entitled. View "Lewis v. L.B. Oscar Blalock sought access to records held by the City of Lovejoy under the Georgia Open Records Act. After failing to receive those records, or any response from the City, Blalock filed a mandamus action seeking to compel compliance with the Act. The trial court dismissed Blalock’s petition, finding that mandamus was unavailable because the Act’s civil penalties provision affords Blalock a remedy “as complete and convenient as mandamus.” Although the Supreme Court did not agree with the trial court’s conclusion regarding the remedial adequacy of civil penalties, that did not save Blalock’s claim: because the Act provided its own cause of action for enforcement in OCGA 50-18-73 (a), that provision was plainly a “complete and convenient” alternative to mandamus. Jerry Nix appealed the entry of summary judgment which found he was an adult in need of protective services under the Adult Protective Services Act of 1976. The Franklin County Department of Human Resources ("DHR") alleged that Nix, then 78 years old, was an "adult in need of protective services." The petition claimed that Nix had not been taking his medications for diabetes and hypertension and that he had been the victim of a postal scam costing him thousands of dollars. DHR further alleged that Nix urgently required nursing-home care to protect his health and safety and that, otherwise, Nix was in immediate danger. DHR requested emergency-protective placement for Nix and that the court set a hearing to determine Nix's need for protective services. The trial court thereafter ordered DHR to provide protective services for Nix, appointed a guardian ad litem to represent Nix in the proceedings, and appointed Nix's son, Darren Nix, as conservator of Nix's estate and guardian of his person. While the Alabama Supreme Court did not question that all involved in this case desired the best for Nix, it was troubled by the "apparent lack of urgency and attention to statutory formalities in the prosecution of this petition for protective services," finding the trial court granted DHR's emergency petition on December 7, 2015; Nix was entitled to a hearing within 30 days. Seven months passed before the trial court entered the summary judgment finding Nix to be an adult in need of supervision, and fifteen months had passed since Nix was removed from his home. "It may very well be that an assisted-living facility is the appropriate and lawful protective placement for Nix, but he is still entitled to all the procedural safeguards due him under the Act, including a timely adjudication of his need for such services. Indeed, without a faithful adherence to the Act and the due process protections owed to each person protected by the Act, we risk unnecessary and wrongful deprivation of liberty and property. For those 'protected persons' dispossessed of their house and their assets, this may seem a fate far worse than a foreign-lottery postal scam." View "Nix v. Val and LaRee Westover appealed the district court’s judgment and denial of their request for writs of mandate and prohibition against Franklin County Assessor Jase Cundick. The dispute arose when the Westovers granted an easement to Rocky Mountain Power on property owned by the Westovers. Based on his office’s records, Cundick sent a letter to Rocky Mountain Power stating that the Westovers did not own the property in question. The Westovers sought a writ of mandate to require Cundick to retract the letter and a writ of prohibition to prevent him from sending such letters in the future. The district court denied the Westovers’ request for writs of mandate and prohibition after it concluded that there were other remedies available at law. On appeal, the Westovers argued the district court erred by failing to grant injunctive relief prohibiting Cundick from sending out letters concerning real estate transactions and property ownership. Although the Westovers’ complaint did not request that the district court grant injunctive relief, they argued that the district court erred because the Westovers were clearly entitled to injunctive relief under Idaho Rule of Civil Procedure 54(c).
