EEOC v. BNSF Railway Co.
Kent Duty filed suit against BNSF Railway Company (“BNSF”), after he applied to work there as a locomotive electrician. Duty had an impairment that limits his grip strength in his right hand. Fearing that Duty would fall from ladders, BNSF revoked his offer for employment. Duty and the Equal Employment Opportunity Commission (the “Commission”) sued BNSF for employment discrimination under the Americans with Disabilities Act (the “ADA”). The ADA limits its protection by recognizing that not all impairments are disabilities. Applying the ADA’s definition of “disability,” the district court found that Kent Duty was not disabled and granted summary judgment to BNSF. On appeal, the Tenth Circuit affirmed. View "EEOC v. BOSC v. Board of County Commissioners
A New Mexico county board filed a lawsuit in state court against its securities broker and registered agent. The board refrained, however, from serving process while it determined whether arbitration was available. The securities broker and agent nonetheless removed the case to federal court and moved to dismiss the suit. Four days after briefing was complete and about three months after the board had filed suit, the board voluntarily dismissed the case and filed for arbitration. The securities broker and agent then filed this action to enjoin arbitration, arguing the board waived its right to demand arbitration when it filed the state court action. The district court disagreed and instead granted the board’s counterclaim to compel arbitration. The broker and registered agent appealed the waiver issue. McLane Co. v. Equal Employment Opportunity Commission
Ochoa worked in a physically demanding job for McLane, which requires new employees in such positions and those returning from medical leave to take a physical evaluation. When Ochoa returned from three months of maternity leave, she failed the evaluation three times and was fired. She filed a sex discrimination charge under Title VII of the Civil Rights Act. The Equal Employment Opportunity (EEOC) began an investigation, but McLane declined its request for names, Social Security numbers, addresses, and telephone numbers of employees asked to take the evaluation. After the EEOC expanded the investigation’s scope, it issued subpoenas under 42 U.S.C. 2000e–9, requesting information relating to its new investigation. The district judge declined to enforce the subpoenas. The Ninth Circuit reversed, holding that the lower court erred in finding the information irrelevant. The Supreme Court vacated. A district court’s decision whether to enforce or quash an EEOC subpoena should be reviewed for abuse of discretion, not de novo. The Court noted “the longstanding practice of the courts of appeals," to review a district court’s decision to enforce or quash an administrative subpoena for abuse of discretion. In most cases, the enforcement decision will turn either on whether the evidence sought is relevant to the specific charge or whether the subpoena is unduly burdensome under the circumstances. Both tasks are well suited to a district judge’s expertise. Deferential review “streamline[s] the litigation process by freeing appellate courts from the duty of reweighing evidence and reconsidering facts already weighed and considered by the district court,” something particularly important in a proceeding designed only to facilitate the EEOC’s investigation. Ramirez v. WCAB
In this writ proceeding, Daniel Ramirez sought review of his independent medical review (pursuant to his workers' compensation claim) on the ground the underlying utilization review was based on an incorrect standard. In effect, he sought review of his utilization review with this the Court of Appeal. The Court concluded this was not a proper ground for appeal of a utilization review determination because "it goes to the heart of the determination of medical necessity. The independent medical reviewer is in the best position to determine whether the proper standard was used to evaluate the medical necessity of the requested treatment, and the statutory scheme requires the independent medical reviewer to use the proper standard in determining medical necessity." Ramirez made no claim that the independent medical reviewer did not use the proper statutory standard, nor did he state a proper ground for review of his independent medical review, which was appealable only for the nonsubstantive reasons. Ramirez also challenged the constitutionality of the independent medical review process, claiming it violated the state Constitution’s separation of powers clause, and state and federal principles of procedural due process. The Court concluded that the Legislature’s plenary power over the workers’ compensation system precluded any separation of powers violation, and the process afforded workers under the system afforded sufficient opportunity to present evidence and be heard. Segura v. State
Plaintiffs’ attorney filed two board claim forms with a state appeals board on behalf of Plaintiffs, signing their names and his own. The attorney did not attach any document showing he had power of attorney. The board rejected Plaintiffs’ claims. Plaintiffs then filed their claim in district court. The district court dismissed Plaintiffs’ claims on the ground that their attorney signed the forms on their behalf. The Supreme Court reversed, holding (1) a claimant presents a claim when the board receives a writing that discloses the amount of damages claimed and generally describes the legal theories asserted against the State; and (2) the district court had jurisdiction to hear Plaintiffs’ claims. Hughes v. Moyer
The Department of Public Safety and Correctional Services (DPSCS) sent Laura Hughes a notice of termination from her position with the agency. Hughes followed the directions for invoking the first tier of the administrative appeal process. The Secretary of DPSCS did not respond within the statutory time limit, thus denying Hughes first-tier appeal. Hughes was unaware that this silent denial triggered the limited time for her to invoke a second-tier appeal, and therefore she did nothing before the deadline passed. Hughes belatedly attempted to pursue her administrative appeal, but DPSCS did not respond. Hughes then commenced this mandamus action in the circuit court. The circuit court dismissed the mandamus action. The Court of Special Appeals affirmed. The Court of Appeals reversed, holding that, in order to discharge its responsibility to provide a disciplined employee with notice of the employee’s administrative appeal rights, an agency must advise the employee of the possibility of a second-tier appeal and alert the employee as to the significance of silence in response to a first-tier appeal. Remanded for consideration whether Hughes should be afforded the opportunity to pursue a second-tier appeal. View "Hughes v. Moyer" on Justia Law
Co. of Riverside v. WCAB
Petitioner County of Riverside (the County) challenged Workers’ Compensation Appeals Board (WCAB) findings that the application for adjudication of claim by respondent Peter Sylves was timely filed, and that Labor Code section 5500.5(a) did not bar liability on the County’s part. Sylves was employed by the County as a deputy sheriff. He took a service retirement and then worked for the Pauma Police Department on a reservation belonging to the Pauma Band of Luiseno Indians, a federally recognized tribe. Sylves’ employment with the Pauma Police Department lasted from 2010, through 2014. Sylves filed an application for adjudication of claim on July 16, 2014. He claimed a continuous trauma for “hypertension, GERDS [gastroesophageal reflux disease], left shoulder, low back and both knees.” In 2015, the WCJ found: “Pursuant to Labor Code section 5500.5, applicant’s continuous trauma is limited to the last year of injurious exposure, even if it is with the Pauma Tribal Police.” The WCJ found that Sylves’s knee and left shoulder injuries, his GERDS, and his sleep disorder were not compensable injuries arising in and out of employment. However, he also found that Sylves’ hypertension and back injury were compensable and arose from employment with the County. With respect to the statute of limitations, the WCAB explained that the time in which to file a claim did not begin to run until a doctor told him the symptoms for which he had been receiving treatment were industrially related; since medical confirmation did not occur until 2013, Sylves’ 2014 application was timely. The WCAB further found that section 5500.5 “is not a Statute of Limitations but provides for a supplemental proceeding in which multiple defendants have an opportunity to apportion liability.” Finally, it agreed with Sylves that section 5500.5 could not limit liability to the Pauma Police Department in this case because the WCAB lacked jurisdiction over the tribe. Essentially, the WCAB determined that the County “failed to meet its burden of proof on the Statute of Limitations defenses raised herein.” Finding no reversible error in the WCAB's decision, the Court of Appeal affirmed. Bonome v. City of Riverside
Defendants-appellants City of Riverside (City) and Riverside Police Chief Sergio Diaz appealed the grant of a petition for writ of mandate filed by plaintiff-respondent Camillo Bonome, Jr. Bonome had been employed as a Riverside Police Officer since 1995. In 2013, a Memorandum of Finding was sustained against Bonome for failing to properly investigate and report an incident involving a sexually abused girl in 2012. Chief Diaz recommended Bonome be terminated. Prior to the hearing on his termination, Bonome applied for and was granted disability retirement by CalPERS for a back injury he sustained while on duty. Upon his disability retirement being effective, Bonome requested his retirement identification badge and that the badge include a Carry Concealed Weapon (CCW) endorsement. Bonome’s request was denied because Chief Diaz and the City did not consider him to be “honorably retired” as that term was defined in Penal Code section 16690. The City and Chief Diaz stated he was not entitled to a hearing to dispute the finding. Bonome filed the Writ contending he was honorably retired and entitled to a CCW endorsement, and if the endorsement was denied for cause, he was entitled to a good cause hearing. The trial court agreed and granted the Writ. On appeal, the City and Chief Diaz insisted the trial court erred when it determined Bonome was “honorably retired.” The Court of Appeal upheld the trial court’s grant of the Writ. The City and Chief Diaz could deny the CCW endorsement for cause but Bonome was entitled to a good cause hearing if it was denied. View "Bonome v. City of Riverside" on Justia Law
Ex parte City of Homewood
Officer J.C. Clifton and Officer Jason Davis, law enforcement officers for the City of Homewood, and the City of Homewood petitioned for a writ of mandamus to direct the Jefferson Circuit Court to enter a summary judgment in their favor on the ground of immunity. In 2013, the officers were dispatched to the Babies "R" Us retail store in the Wildwood Shopping Center in response to a shoplifting incident involving Bristinia Fuller and Bria Mines. When the officers arrived, they learned that Fuller and Mines were leaving the parking lot of the store in a vehicle being driven by Fuller. Officer Clifton and Officer Davis, driving separate patrol cars, attempted to stop the vehicle. Instead of stopping, Fuller eluded the officers by speeding through the parking area and onto Lakeshore Drive. The officers pursued. Fuller continued speeding and ran through multiple red traffic lights before losing control of her vehicle. The vehicle struck a light pole and a stopped vehicleat the intersection. Fuller was killed and Mines was seriously injured. 2015, Mines sued Officer Clifton and Officer Davis, both in their official and individual capacities, Homewood, and others alleging she was injured as a result of the negligent, reckless, and/or wanton conduct of the officers and Homewood during the officers' pursuit of Fuller's vehicle. She also alleged that Homewood was vicariously liable for the officers' conduct and was negligent in hiring and supervising the officers. After review, the Supreme Court concluded the officers established they were entitled to immunity as to Mines' claims against them in both their official and individual capacities. Moreover, because the officers were entitled to immunity, Homewood was also entitled to immunity. The Court therefore granted their petition and issued the writ, directing the trial court to enter a summary judgment for Officer Clifton, Officer Davis, and Homewood. Gerard v. Orange Coast Memorial Medical Center
Three health care workers sued their hospital employer in a putative class and private attorney general enforcement action for alleged Labor Code violations and related claims. In this appeal, their primary complaint was the hospital illegally allowed its health care employees to waive their second meal periods on shifts longer than 12 hours. A statute required two meal periods for shifts longer than 12 hours. But an order of the Industrial Welfare Commission (IWC) authorized employees in the health care industry to waive one of those two required meal periods on shifts longer than 8 hours. The issue this case presented for the Court of Appeal’s review centered on the validity of the IWC order. In its first opinion in this case, the Court concluded the IWC order was partially invalid to the extent it authorized second meal break waivers on shifts over 12 hours, and the Court reversed. After the California Supreme Court granted the hospital’s petition for review in “Gerard I,” that court transferred the case back to the Court of Appeal with directions to vacate the decision and to reconsider the cause in light of the enactment of Statutes 2015, chapter 506 (Sen. Bill No. 327 (2015-2016 Reg. Sess.); SB 327). Upon reconsideration the Court of Appeal concluded the IWC order was valid and affirmed. View "Gerard v.
