Motl v. Bannan
In 2014, the Montana Commissioner of Political Practices (COPP) issued a decision finding sufficient evidence that Terry Bannan had violated Montana’s campaign practices laws during the 2010 primary election and that civil adjudication of the violations was warranted. The COPP forwarded the sufficiency decision to the Lewis and Clark County Attorney for consideration. Bannan filed an action for declaratory relief in the Gallatin County District Court alleging that the COPP acted unlawfully by referring its sufficiency findings to the Lewis and Clark County Attorney rather than the Gallatin County Attorney. The Lewis and Clark County Attorney waived his right to participate in the action, citing Mont. Code Ann. 13-37-124(2). Thereafter, the COPP filed an enforcement action against Bannan in the Lewis and Clark County District Court. Bannan filed a motion to dismiss, contending that the COPP was obligated to assert its claims in the Gallatin County declaratory judgment action. The district court in Lewis and Clark County denied Bannan’s motion to dismiss. Bannan appealed. The Supreme Court dismissed Bannan’s appeal as premature, holding that Bannan’s appeal must be characterized as one seeking relief from the denial of a motion to dismiss, and orders denying motions to dismiss are not appealable. Rancho Pauma Mut. Water Co. v. Yuima Mun. Water Dist.
Rancho Pauma Mutual Water Company filed a petition to enforce a water rights judgment against the Yuima Municipal Water District entered about 60 years earlier. The District appealed the trial court's order, contending the trial court misunderstood subsequent amendments to the judgment and improperly limited the amount of water the District could withdraw. Rancho Pauma argued the appeal should have been dismissed as the order was not appealable. Upon review, the Court of Appeal rejected Rancho Pauma's argument regarding appealability of the order. Pister v. Dept. of Revenue
The State Department of Revenue sought to hold the sole shareholder, director, and employee of a closely held Washington corporation personally liable for the corporation’s unpaid tax debts. The superior court pierced the corporation’s corporate veil, ruled that the shareholder’s successor corporation was liable for the tax debt, voided two contract transfers as fraudulent conveyances, and ruled that the shareholder had breached fiduciary duties to the corporation and the State as the corporation’s creditor. The shareholder and corporation appealed the superior court’s decision to pierce the corporate veil, arguing that the superior court erred by not barring the State’s suit under the principle of res judicata, by applying Alaska rather than Washington veil-piercing law, and by making clear factual errors. The shareholder and corporation also appealed the superior court’s finding that two contracts were fraudulently conveyed. After review, the Alaska Supreme Court concluded that res judicata did not bar the State from seeking to pierce the corporation's corporate veil to collect tax debt established in an earlier case. Furthermore, the Court held that the corporation's veil was properly pierced under both Alaska and Washington state law. Though the superior court's fraudulent conveyance determination contained errors of fact, the Supreme Court concluded that those errors were harmless. Miller v. Dept. of Environmental Conservation
An oyster farmer closed his farm after dozens of people became sick from eating his oysters. He sued the state Department of Environmental Conservation, alleging that the agency negligently informed him that the site of his farm was suitable for shellfish farming. The superior court granted summary judgment for the agency, concluding that the farmer’s misrepresentation claim was barred by state sovereign immunity. The farmer argued on appeal that the agency’s sovereign immunity defense was inapplicable because his complaint alleged a claim of negligence, not negligent misrepresentation. After review, the Supreme Court found the allegations in the farmer’s complaint supported only a negligent misrepresentation claim. Burton v. Glynn County
The issue central to consolidated appeals and cross-appeals was the question of whether property owners were violating a zoning ordinance by operating their property as an event venue. In 2010, East Beach residents began raising complaints to the community homeowners' association and local law enforcement regarding noise, traffic, and parking issues arising from events held at "Villa de Suenos." From that time, Glynn County police investigated more than 20 noise complaints related to the property, many resulting in the issuance of citations or warnings. The property was situated within a single-family residential zoning district classified as “R-6” under the Glynn County Zoning Ordinance. the trial court issued an order on December 20, 2013, adopting the County’s interpretation of its zoning ordinance and directing the owners, Thomas and Lee Burton, to comply with the ordinance, so interpreted, in their future use of the property. The court also denied the Burtons’ equal protection claim, finding that they had presented no evidence of other residential properties in Glynn County that were operated in the same manner as the Burtons’ property but were treated differently by the County. The Burtons appealed, challenging the trial court’s interpretation of the zoning ordinance and its rejection of their equal protection claim; the County cross-appealed, seeking to clarify the nature of the relief the trial court had granted. Subsequently, with the appeal and cross-appeal pending, the County filed a motion for contempt in the trial court, alleging that the Burtons were continuing to promote Villa de Suenos as an event venue and accept bookings for this purpose, in violation of the trial court’s order. Upon review of the arguments made on appeal, the Supreme Court concluded that the trial court properly found that the owners were violating the ordinance, and that the court properly issued a declaratory judgment to that effect. "This is a case of egregious attorney misconduct." Because of the cumulative effect of the attorney's misconduct, the Court of Appeal felt compelled to reverse the judgment she obtained on behalf of her client, Caltrans. "While Judge Di Cesare showed the patience of Job – usually a virtue in a judge – that patience here had the effect of favoring one side over the other. He allowed [the attorney] to emphasize irrelevant and inflammatory points concerning the plaintiff's character so often that he effectively gave CalTrans an unfair advantage." View "Martinez v. Rand v. City of New Orleans
In 2007, the City of New Orleans (CNO) enacted a group of ordinances, codified as Sections 154-1701 through 15-1704 of its Code of Ordinances, which created the Automated Traffic Enforcement System (“ATES”). In 2011, plaintiffs filed a “Petition for Preliminary and Permanent Injunction,” alleging the administrative hearing procedure set out in these ordinances violated Louisiana State Constitution Article I, section 2 due process rights and Article I, section 22 access to courts rights. Following an adversarial hearing, the District Court granted the plaintiffs a preliminary injunction “enjoining, prohibiting, and restraining the City of New Orleans from conducting any administrative hearings authorized by the enabling ordinance section 154-1701 et seq.” The trial court further ordered that its ruling would be stayed “pending final resolution of a writ application to the 4th Circuit Court of appeals [sic] by the City of New Orleans.” In its written reasons for judgment, the District Court found that the enforcement procedure for the CNO's Automated Traffic Enforcement System gave the CNO administrative authority to adjudicate violations. The CNO, therefore, had a financial stake in the outcome of the cases adjudicated by hearing officers in their employ and/or paid by them, raising due process considerations. Thereafter, the City filed a supervisory writ application with the Fourth Circuit Court of Appeal. The Fourth Circuit affirmed, agreeing with the trial court's assessment of the due process problems inherent in the ATES administrative adjudication procedure and finding that “the trial court did not abuse its discretion because the Plaintiffs presented prima facie evidence that they are entitled to the preliminary injunction and may prevail on the merits.” The City filed a supervisory writ application with the Supreme Court seeking review of the District Court's judgment granting the plaintiffs' the preliminary injunction. The Court unanimously denied the City's writ. Plaintiffs then filed a motion for summary judgment, arguing there was no genuine issue of material fact in dispute and they are entitled to summary judgment granting a permanent injunction as a matter of law based solely “on the affidavits attached and the opinion of the 4th Circuit Court of Appeals [sic] and the concurring opinion of Judge Belsom [sic].” Attached to the plaintiffs' motion for summary judgment were: (1) the affidavits of plaintiffs, Keisha Guichard, Edmond Harris, Lee Rand, and Jeremy Boyce; (2) the District Court's judgment granting plaintiffs' preliminary injunction, along with the court's written reasons for judgment; (3) the Fourth Circuit's opinion affirming the judgment granting the preliminary injunction; and (4) the Supreme Court's action sheet, denying the City's application for supervisory review of the preliminary injunction. The District Court granted plaintiffs' motion for summary judgment. The City appealed. Finding that plaintiffs failed to follow the strictures of motion for summary judgment procedure, the Supreme Court declined to address the merits of plaintiffs' constitutional challenge. Due to the fatal flaws present in plaintiffs' motion for summary judgment, the Supreme Court reversed the District Court's judgment granting the permanent injunction, reinstated the preliminary injunction prohibiting the City from undertaking any hearings based on this ordinance, and remanded the matter to the trial court for further proceedings. Idaho v. Philip Morris, Inc.
The State of Idaho appealed a district court judgment denying its motion to vacate portions of a Stipulated Partial Settlement and Award entered by an arbitration panel. This case stemmed from the 1998 Tobacco Master Settlement Agreement, wherein certain cigarette manufacturers entered into an agreement with the State to pay damages for the cost of treating smoking-related illnesses. A dispute arose between the parties as to the amount owed in 2003 and the district court entered an order compelling arbitration. The arbitration panel entered a Stipulated Partial Settlement and Award in March of 2013. In June of 2013, the State moved the district court to vacate, modify, or correct the award. The district court concluded the State did not have standing to move to vacate or modify the award. The State appealed. Finding no reversible error, the Supreme Court affirmed. View "Idaho v.
