Tuluksak Native Community v. Dept. of Health & Soc. Srvs.
removed an Alaska Native child from his mother and placed him with a relative, the child experienced suicidal ideation and checked himself into a psychiatric facility. Following a period of seemingly voluntary care, OCS requested a hearing to place the child at an out-of-state secure residential psychiatric treatment facility. The child’s Tribe intervened and challenged the constitutionality of AS 47.10.087, the manner in which evidence was received, and alleged due process violations. The child joined in some of these objections. The superior court ordered the child placed at a secure residential psychiatric treatment facility per AS 47.10.087. The Tribe, but not the child, appealed the placement decision, contending primarily that the superior court erred in proceeding under AS 47.10.087 and in making its substantive findings, and plainly erred in authorizing placement pursuant to AS 47.10.087 without addressing the Indian Child Welfare Act’s (ICWA) placement preferences. The Alaska Supreme Court found no error in the court’s application of AS 47.10.087 or its substantive findings, and thus affirmed the superior court’s placement determination. The Court expressed concern that the trial court failed to make required inquiries and findings related to ICWA’s placement preferences. However, this did not amount to plain error. The Supreme Court did not reach the Tribe’s other arguments as the Tribe has either waived them or lacked standing to raise them. View "Tuluksak Native Community v. Dept. of Health & Soc. Board of Supervisors for Lowndes County v. Lowndes County School District
The Board of Supervisors for Lowndes County appealed the trial court’s grant of summary judgment in favor of the Lowndes County School District. The Board argued that the trial court erred in its interpretation of Mississippi Code Section 37-57-107(1) (Rev. 2014) and that the trial court lacked jurisdiction to review the Board’s September 15, 2020 decision to exclude $3,352,0751 from the District’s requested ad valorem tax effort. The Mississippi Supreme Court found that the District appealed the decision of a county board of supervisors. As such, the District’s exclusive remedy was Section 11-51-75. Because the District failed to meet these requirements and because Section 11-51-75 was the District’s exclusive remedy, the chancery court was without jurisdiction to hear this matter and issue a declaratory judgment. Therefore, the trial court’s grant of summary judgment was reversed, and the matter remanded to the chancery court for it to enter an order dismissing the case for lack of jurisdiction. South River Watershed Alliance, et al. v. DeKalb County, Georgia
The United States Environmental Protection Agency (“EPA”) and Georgia Department of Natural Resources (“GDNR”) sued DeKalb County for violating the Clean Water Act (“CWA”). To resolve this suit, the parties agreed to a consent decree in 2011. Eight years later, South River Watershed Alliance, Inc. (“South River”) and J.E. sued DeKalb County for failing to follow the decree and violating the CWA. The CWA authorizes citizen suits for enforcement purposes, but such suits are not allowed when an “administrator or State has commenced and is diligently prosecuting a civil or criminal action . . . to require compliance with the standard, limitation, or order.” Thus, this case turned on whether the 2011 consent decree—along with the ongoing efforts of the EPA and GDNR to require compliance—constitutes diligent prosecution. The district court determined that South River’s suit was barred by the diligent prosecution bar. On appeal, South River argued for the opposite result and requests injunctive relief to ensure DeKalb County’s compliance.
The Eleventh Circuit affirmed. The court explained that South River wants the current consent decree discarded in favor of a more muscular alternative. The fact that South River disagrees with the prosecution strategy undertaken by the EPA and GDNR, however, is not enough to prove that the EPA and GDNR have failed to diligently prosecute DeKalb County’s CWA violations. To the contrary, the record shows that the EPA and GDNR have been diligent, which means that South River’s suit is barred under 33 U.S.C. Section 1365(b)(1)(B). Hirschfeld, et al. v. Oklahoma Turnpike Authority
A group of Oklahoma landowners petitioned for a declaratory judgment and injunctive relief, claiming that the Oklahoma Turnpike Authority violated the Open Meeting Act, 25 O.S.2021, §§ 301 to 314, regarding its notice to the public of the ACCESS Oklahoma Program. Both parties sought summary judgment. The district court rendered summary judgment in the landowners' favor, finding that the Oklahoma Turnpike Authority willfully violated the Open Meeting Act. The Oklahoma Supreme Court held that the Oklahoma Turnpike Authority gave sufficient notice of the agenda items that the landowners challenged. Furthermore, the Court found that the lack of notice regarding the announcement of the ACCESS Oklahoma Program at the February 2022 meeting did not violate the Open Meeting Act because the announcement was for informational purposes only. Lonergan v. Town of Sanbornton
Plaintiffs Juliana and David Lonergan appealed a superior court order affirming a Town of Sanbornton’s (Town) Zoning Board of Adjustment (ZBA) approval of a special exception for an excavation site for property that intervenor, R.D. Edmunds Land Holdings, LLC, owned. As a threshold matter, the Town and the intervenor argued that the New Hampshire Supreme Court lacked subject matter jurisdiction based upon plaintiffs’ failure to timely move for rehearing with the ZBA as required by RSA 155-E:9 (2014). To this, the Supreme Court concluded that RSA 155-E:9 applied to plaintiffs’ motion for rehearing to the ZBA and that plaintiffs did not meet the ten-day filing deadline set forth in the statute. Accordingly, the Supreme Court dismissed the appeal for lack of subject matter jurisdiction and vacated the superior court’s order. View "Lonergan v. Town of Sanbornton" on Justia Law
Raffensperger v. Jackson, et al.
In 2018, Mary Jackson and a nonprofit organization, Reaching Our Sisters Everywhere, Inc. (“ROSE”), filed a complaint against the Georgia Secretary of State challenging the constitutionality of the Georgia Lactation Consultant Practice Act (“the Act”), OCGA §§ 43-22A-1 to 43-22A-13. Under the Act, the Secretary issues licenses authorizing lactation care providers to provide lactation care and services for compensation. Only lactation care providers who obtain a privately issued certification as an International Board Certified Lactation Consultant (“IBCLC”) were eligible to obtain a license. Jackson and ROSE (collectively “Plaintiffs”) alleged their work included the provision of lactation care and services and that the Act was irrational and lacked any real and substantial connection to the public health, safety, or welfare because there was no evidence that non-IBCLC providers of lactation care and services ever harmed the public. They also contended the Act would require them to cease practicing their chosen profession, thus violating their rights to due process and equal protection under the Georgia Constitution. In the first round of this litigation, the trial court granted the Secretary’s motion to dismiss for failure to state a claim, but the Georgia Supreme Court reversed and remanded with direction. Following remand, the Secretary withdrew his motion to dismiss, and the parties engaged in discovery and filed cross-motions for summary judgment. On the due process claim, the trial court granted the Secretary’s motion for summary judgment, and on the equal protection claim, the trial court granted Plaintiffs’ motion. The Secretary appealed, and Plaintiffs filed a cross-appeal. The Supreme Court concluded in the cross-appeal that the Act was unconstitutional on due process grounds and that the trial court therefore erred in granting summary judgment to the Secretary and denying it to Plaintiffs. Accordingly, the Court reversed the trial court on the due process claim and did not reach the equal protection claim raised in the main appeal. View "Raffensperger v. Jackson, et al." on Justia Law
Stephen Pond v. US
The IRS audited Plaintiff's and erroneously determined he owed tax for 2013 when he had actually overpaid. Plaintiff sought a timely 2012 tax refund based on the discovered miscalculation. Plaintiff claimed that, in the same envelope, he also requested a refund for the 2013 tax year, although the IRS claims it did not receive the 2013 refund request. Ultimately, the IRS awarded Plaintiff the requested 2012 refund, but denied the 2013 refund based on Plaintiff's failure to provide a timely request.Plaintiff sought enforcement of his 2013 refund, which the district court denied. On appeal, the Fourth Circuit held that Plaintiff failed to meet the required elements of the Mailbox Rule but plausibly alleged physical delivery of his refund request. Thus, the Fourth Circuit reversed in part, affirmed in part, and remanded for further proceedings. View "Stephen Pond v. US" on Justia Law
Rab v. Weber
Petitioner Raji Rab contended that by allowing Los Angeles County workers to scan vote by mail ballots into the Voting Solutions for All People (VSAP) system (the computer hardware and software system used to capture and count votes in Los Angeles County) beginning 10 days before the March 2020 primary election, Dean Logan, the Los Angeles County Registrar-Recorder/County Clerk violated California Elections Code section 15101 (b)’s, prohibition on accessing and releasing a vote count prior to 8 p.m. on the day of an election. Rab alleged respondents the Los Angeles Board of Supervisors and its members (with Logan, the County) and the California Secretary of State, failed in their oversight of Logan, and, therefore, failed to protect the election process and aided and abetted in Logan’s alleged misconduct. Rab brought a petition for writ of mandate, seeking a manual recount of ballots from the March 2020 primary election, and claiming this matter was one “of [the] greatest public interest.” The trial court denied his petition. Specifically, in denying the petition, the trial court wrote, “[t]he Court interprets ‘machine reading’ to include, and thus to permit, scanning ballots. To leave no room for confusion in the future, the Court reiterates: Elections Code section 15101(b) allows the County to start scanning ballots on the 10th business day before the election.” Rab appealed, arguing the trial court misinterpreted Elections Code section 15101(b). Finding no reversible error, the Court of Appeal affirmed the trial court. View "Rab v. Weber" on Justia Law
Vermont Journalism Trust v. Agency of Commerce & Community Development
In August 2020, plaintiff Vermont Journalism Trust (VJT) sought from the State emails to or from former Secretary of the Agency of Commerce and Community Development Lawrence Miller related to the Jay Peak EB-5 fraud scandal. The State denied the request, citing the Public Records Act's (PRA) litigation exception. Following an unsuccessful agency appeal, VJT filed this suit in October 2020. The parties filed cross-motions for summary judgment, which the court granted and denied in part. It found that the requested records were covered by the litigation exception but that outside circumstances had partially overtaken the case. In October 2021, VJT moved to compel the State to produce a "Vaughn" index of the remaining withheld records under 1 V.S.A. § 318(b)(2). VJT argued that the State had do so because it continued to withhold documents. During the pendency of this appeal, the State produced all records responsive to VJT’s public-records request, including those previously withheld. Because no live controversy remains, the Vermont Supreme Court dismissed this appeal as moot. View "Vermont Journalism Trust v. Agency of Commerce & Community Development" on Justia Law
Saltwater Sportsman Outfitters, LLC v. Mississippi Dept. of Revenue
The taxpayer, Saltwater Sportsman Outfitters, LLC (SSO), was a one-man operation that sold clothing online and at trade shows, conventions, and other events. SSO kept few records of what it had sold or where, though its sole member testified that most of its sales occurred out of state. After an audit, the Mississippi Department of Revenue (MDOR) assessed additional sales tax liability, ultimately settling on about $80,000 based on the disparity between SSO’s wholesale purchases and the sales taxes it had paid in Mississippi and other states. MDOR’s assessment was appealed to the circuit court, which granted summary judgment in favor of MDOR. SSO appealed. The Mississippi Supreme Court concluded that SSO’s failure to keep adequate records rendered MDOR’s assessment presumptively correct. The Court found no merit to SSO’s various arguments on appeal, including that the promoters of the events at which SSO sold were the true parties liable for the taxable sales.
