In August 2017, Kansas law enforcement officers, after a traffic chase, pulled over Matthew Holmes for suspected vehicular burglary. The officers were from the City of Newton Police Department (“NPD”), McPherson County Sheriff’s Office (“MCSO”), and Harvey County Sheriff’s Office (“HCSO”). After Holmes stopped and exited the car, officers wrestled him to the ground. McPherson County Sheriff’s Deputy Chris Somers shot Holmes in the back. He later died from the gunshot wound. Holmes' estate sued, alleging constitutional violations under 42 U.S.C. 1983 ad a state law claim. The district court granted in part and denied in part Defendants' Rule 12(b)(6) motions. In particular, it denied each sheriff’s motion to dismiss based on Eleventh Amendment immunity because, “with respect to local law enforcement activities, sheriffs are not arms of the state but rather of the county that they serve.” The Tenth Circuit determined the district court did not err in denying the sheriffs' motions, and therefore affirmed. Plaintiff-appellee Dana Zzyym did not identify as either male or female, rather intersex. The United States State Department refused Zzyym's application for a passport. Zzyym sued, alleging that the State Department's reliance on a binary sex policy: (1) exceeded its statutory authority; (2) was arbitrary and capricious under the Administrative Procedure Act; and (3) violated the federal Constitution. The district court concluded that as a matter of law, the State Department violated the APA on Zzyym's first two grounds; the court did not reach the constitutional claims. After review, the Tenth Circuit concluded the State Department acted within its authority. but exercised this authority in an arbitrary and capricious manner. The State Department gave five reasons for denying Zzyym’s request for a passport. Two of the reasons were supported by the administrative record, but three others weren’t. "Given the State Department’s partial reliance on three unsupported reasons, we don’t know whether the State Department would have denied Zzyym’s request if limited to the two supported reasons. Plaintiff-appellant Nancy Marks was serving a prison term in Colorado when she obtained entry into a community corrections program operated by Intervention Community Corrections Services (Intervention). To stay in the program, plaintiff needed to remain employed. But while participating in the program, she aggravated a previous disability and Intervention deemed her unable to work. So Intervention terminated plaintiff from the program and returned her to prison. Plaintiff sued, blaming her regression on two Colorado agencies,: the Colorado Department of Corrections (CDOC) and the Colorado Department of Criminal Justice (CDCJ). In the suit, plaintiff sought damages and prospective relief based on: (1) a violation of the Americans with Disabilities Act and the Rehabilitation Act; and (2) a denial of equal protection. The district court dismissed the claims for prospective relief and granted summary judgment to the CDOC and CDCJ on the remaining claims, holding: (1) the Rehabilitation Act did not apply because Intervention had not received federal funding; (2) neither the CDOC nor the CDCJ could incur liability under the Americans with Disabilities Act or Rehabilitation Act for Intervention’s decision to regress plaintiff; and (3) plaintiff did not show the regression decision lacked a rational basis. After review, the Tenth Circuit agreed that (1) claims for prospective relief were moot and (2) neither the CDOC nor CDCJ violated plaintiff's right to equal protection. However, the Court reversed on the award of summary judgment on claims involving the Rehabilitation Act and the Americans with Disabilities Act, finding the trial court mistakenly concluded the Rehabilitation Act did not apply because Intervention had not received federal funding, and mistakenly focused on whether the CDOC and CDCJ could incur liability under the Rehabilitation Act and Americans with Disabilities Act for a regression decision unilaterally made by Intervention, "This focus reflects a misunderstanding of Ms. Marks’s claim and the statutes." Plaintiff-appellant James Willis, a peace officer employed by the Carlsbad Police Department (Department), sued defendant-respondent City of Carlsbad (City) alleging in part that it engaged in whistleblower retaliation against him in violation of Labor Code section 1102.5 (b) by denying him promotions after he reported what he perceived was misconduct by another officer and complained about a Department program he believed was an unlawful quota system. Before trial, City successfully moved to strike allegations of other retaliatory acts within Willis's cause of action on grounds he had not timely presented a government tort claim within six months of the acts as required by the Government Claims Act. The trial court in limine excluded evidence of any violations by City of the Public Safety Officers Procedural Bill of Rights Act while at the same time permitting City to present evidence Department had denied Willis promotion because of a June 2012 e-mail he wrote under an assumed name lodging the officer misconduct accusations. The jury returned a verdict finding in favor of Willis that his reporting of City's violation of law was a contributing factor in City's decision to deny him the promotion. However, it also found City would have denied Willis his promotion anyway for legitimate independent reasons. Accordingly, the court entered judgment in City's favor on the whistleblower retaliation claim. On appeal, Willis argued the trial court erred as a matter of law by striking those portions of his section 1102.5 cause of action because the Government Claims Act's six-month statute of limitations was either equitably tolled or his cause of action had not accrued by reason of the continuing tort/continuing violation doctrine. Furthermore, he argued the court's evidentiary rulings were a prejudicial abuse of discretion. We conclude the trial court did not err, and accordingly affirm the judgment. In 2010, plaintiff-appellant James Payne pled nolo contendere to stalking in Case No. CF-2010-27 in Pittsburg County, Oklahoma. He received a five-year deferment with special rules and conditions of probation. He was required to have no contact with the stalking victim. In addition, Payne pled guilty to violating a protective order in many other cases filed in Pittsburg County related to the same victim and was sentenced to six months in the county jail. The sentences were to run concurrently. He received extra credits and was released from custody on May 5, 2010. A month later, on June 10, 2010, the district attorney filed a motion to accelerate the deferred judgment for probation violations, alleging Payne had been contacting and harassing the victim. The district court issued a felony warrant and Payne was arrested and booked into jail by the Pittsburg County Sheriff's Office on June 11, 2010. Payne did not post bail and remained in the county jail. The district court ultimately executed a minute order finding Payne guilty of violating the terms of his deferred sentence, for which he received a five year sentence: four suspended and one year to serve in the Department of Corrections. Payne received credit for time served in the county jail since his June 10 arrest. The Judgment and Sentence ordered Payne into DOC custody and directed the Pittsburg Sheriff's office to transfer Payne to the Lexington Assessment and Reception Center to begin serving his time in DOC custody. The Sheriff's Office of Pittsburg County did not transfer Payne to the Lexington Assessment and Reception Center (LARC) until September 6, 2011, almost three months past the end of his sentence. Payne was released that same day without serving any of his time in DOC custody. Payne sue various Pittsburg county corrections and governmental officials, arguing his constitutional rights had been violated because he remained in custody beyond his sentence. The district court granted summary judgment in favor of the defendants. The Oklahoma Court of Civil Appeals affirmed. The Oklahoma Supreme Court granted certiorari on the remaining issue preserved for review, i.e., whether a private right of action under Article 2 Section 9 of the Oklahoma Constitution existed under the facts of this case. The Court held a private right of action existed at the time Payne was detained past his sentence, and remanded for further proceedings. View "Payne v. Kerns" on Justia Law

The Eighth Circuit affirmed the district court's grant of summary judgment to Ozark in an action brought by plaintiff under the Age Discrimination in Employment Act of 1967 (ADEA), Title VII of the Civil Rights Act of 1964 (Title VII), and the Arkansas Civil Rights Act of 1993 (ACRA).The court assumed without deciding that plaintiff satisfied her burden at step one of the McDonnell Douglas framework in establishing a prima facie case of age and sex discrimination, and held that Ozark articulated a legitimate nondiscriminatory reason for plaintiff's termination. In this case, Ozark satisfied its burden by presenting evidence that the decisionmaker terminated plaintiff because of her "rudeness and insubordination which culminated in a meeting in which she behaved abominably." Finally, plaintiff failed to demonstrate a genuine issue of material fact exists regarding pretext. The court also held that the fact that plaintiff's successor is male and twenty-two years younger than her cannot, by itself, create an inference that plaintiff was terminated based on her sex and age. Christopher Denney, a firefighter, sued the city of Richland, Washington in 2017. He argued the city violated the Public Records Act by withholding two investigative complaints Denney made about on-the-job harassment and discrimination. In 2019, both Denney and the city filed cross motions for summary judgment. After a hearing, the trial court granted summary judgment for the city and denied Denney’s motion, finding the requested records were properly exempted from disclosure as attorney work product. The city promptly filed its notice of presentation three days after the February 12, 2019 judgment. On March 14, 2019, the final judgment was entered against Denny, awarding taxable costs to the city for a total judgment of $200. Because Denney filed his appeal more than 30 days after the summary judgment order was issued, the Court of Appeals sua sponte set the matter for dismissal as untimely. Denney argued the 30-day limitation ran from the March 14 judgment; alternatively, he asked for an extension of time based on the extraordinary circumstance that the February 12 order was misleading. The Court of Appeals commissioner disagreed, noting that under RAP 2.2(a)(1), “[t]he language Mr. Denney quotes from the [trial court’s] Order was not misleading because it clearly refers to entry of a judgment in favor of the City, as the ‘prevailing party.’ The requested judgment is for a judgment that awards specific amounts as costs to the City.” The commissioner dismissed Denney’s appeal, which Denney then moved to modify. The Chief Judge denied the motion in part, upholding the commissioner’s ruling dismissing Denney’s appeal of the February 12 order and granting the motion as to the appeal of the March 14 final judgment on the “limited scope of the [$200] cost award.” Denney moved for discretionary review with the Washington Supreme Court, which found that a summary judgment order disposing of all claims can constitute a final judgment, thereby starting the 30-day appeal deadline. An appeal of a trial court decision on the merits brings along a subsequent cost award, but a timely appeal of a cost judgment does not bring along review on the merits. Here, the Court found the summary judgment order wholly resolved Denney’s suit on the merits and reserved a cost award for later determination, triggering the deadline. Denny filed his appeal more than 30 days after the summary judgment and dismissal order issue. However, because Denney’s misinterpretation of the RAPs was an excusable error, the Supreme Court held Denney’s case warranted an extension of time to appeal. Augustine Caldera was a prison correctional officer who sometimes stuttered when he spoke. In 2010, Caldera filed a lawsuit against the California Department of Corrections and Rehabilitation (CDCR) and his supervisor alleging disability discrimination. The trial court granted defendants’ motion for summary judgment. The Court of Appeal reversed, holding a stutter constituted a disability under the Fair Employment and Housing Act (FEHA). A jury found in Caldera’s favor and awarded $500,000. The court granted a motion for new trial because it found the damage award excessive. The Court of Appeal reversed on procedural grounds. After nearly a decade of litigation, Caldera sought about $2.4 million in statutory attorney fees (a $1.2 million “lodestar” and a 2.0 “multiplier”). The court awarded a little over $800,000. Caldera appealed. The Court of Appeal determined Caldera could not find a local attorney to take his discrimination lawsuit, so he hired an out-of-town firm. But when calculating attorney fees, the court set the attorneys’ hourly rate based on a lower local rate, rather than a higher out-of-town rate. The court then applied the extrinsic "Ketchum" factors to the hourly rate, rather than applying a multiplier to the lodestar. "In sum, Caldera’s attorneys were not adequately compensated consistent with the purposes of the FEHA." Thus, the Court reversed the trial court’s order for attorney fees. View "Caldera v. The residential community of Cordillera in Eagle County, Colorado, featured a private lodge and spa (the “Lodge”) and a village center (the “Village”). For many years, the Lodge offered its dues-paying members certain amenities, including a golf course and spa. The Village offered “open space: tennis courts and hiking paths, which all residents and their guests could use. In 2013, after years of monetary losses, the owner of both parcels listed them for sale. In 2016, CSMN Investments, LLC (CSMN) emerged to purchase both properties. CSMN's plan for the properties would have closed the properties to other uses. Before closing on the sale, CSMN sought confirmation from Eagle County’s Planning Director that its planned use, operating an inpatient addiction-treatment center, was an allowed use under the “Cordillera Subdivision Eleventh Amended and Restated Planned Unit Development Control Document” (PUD). The Director issued a written interpretation of the PUD, concluding CSMN could operate a clinic including inpatient, non-critical care, for treatment of a variety of conditions. In response to the Director’s interpretation, community members unhappy with the change to the Lodge and Village, formed the Cordillera Property Owners Association (CPOA) and Cordillera Metropolitan District (CMD), to jointly appeal the Director's PUD interpretation to the Board of county Commissioners. The Board affirmed the Director on all but one point, concluding the PUD permitted outpatient-only clinical uses. Still aggrieved, the CMD and CPOA took their case to Colorado state court; the district court affirmed the Board's decision. CPOA appealed to the Colorado Court of Appeals, which likewise affirmed the Board's decision. With the state-court appeals pending, CSMN filed a civil-rights action in Colorado federal district court against CPOA, CMD, and various associated people (the CMD board members, the CMD district manager, and the Legal Committee members). In response, Appellees moved under Federal Rule of Civil Procedure 12(b)(6) to dismiss all claims, arguing that the right to petition immunized their conduct. CSMN countered that Appellees’ claim of immunity was unfounded because the petitioning had sought an unlawful outcome, and that even if the immunity somehow did apply, the petitioning fell within an exception to that immunity, that is, the petitioning was a “sham.” The district court sided with Appellees, dismissing all but one of the claims on the ground that their conduct was protected by Noerr-Pennington immunity. CSMN appealed. But the Tenth Circuit concurred with the finding that Appellees engaged in objectively reasonable litigation, thus immunity applied to their conduct. View "CSMN Investments v. The Eleventh Circuit denied a motion for a stay of a preliminary injunction that enjoins certain applications of a public health order issued in response to the COVID-19 pandemic in Alabama. The public health order, published on March 27, 2020, mandated the postponement of all dental, medical, or surgical procedures. Plaintiffs, abortion providers in Alabama, sought a temporary restraining order (TRO) preventing enforcement of the public health order as applied to pre-viability abortions. After the district court issued a TRO, the state filed a motion to dissolve the TRO and included clarifications. The district court subsequently adopted the state's clarifications and issued an April 3rd order, staying the TRO in part. The state later changed its interpretation again. Based on the evidence presented at the preliminary injunction hearing, the district court determined that the medical restrictions, as read pursuant to the state's earlier interpretation, violate the Fourteenth Amendment.The court held that the state has not made a strong showing that it is likely to succeed on the merits of its appeal or that it will be irreparably injured absent a stay. In this case, because of the state's shifting interpretations of the March 27th and April 3rd orders, the district court had ample authority to issue a preliminary injunction to preserve the status quo and prevent the state from reverting to its initial and more restrictive interpretations.The district court considered Jacobson v. Commonwealth of Massachusetts and Smith v. Avino, but read them together with cases holding that the Fourteenth Amendment generally protects a woman's right to terminate her pregnancy. Applying both the Jacobson framework and the Casey undue-burden test together, the district court concluded that the April 3rd order imposed a plain, palpable invasion of rights, yet had no real or substantial relation to the state's goals. The court held that the district court was permitted to reach this conclusion and to issue a status quo preliminary injunction to ensure that the state did not deviate from the Alabama State Health Officer's interpretation of the April 3rd order at the preliminary injunction hearing.
