In re: U.S. Office of Personnel Management Data Security Breach Litigation
These consolidated appeals stemmed from the cyberattack of multiple OPM databases that resulted in the data breach of sensitive personal information from more than 21 million people. Plaintiffs alleged that OPM's cybersecurity practices were inadequate, enabling the hackers to gain access to the agency's database of employee information, in turn exposing plaintiffs to heightened risks of identity theft and other injuries. The district court dismissed the complaints based on lack of Article III standing and failure to state a claim.The DC Circuit held that both sets of plaintiffs have alleged facts sufficient to satisfy Article III standing requirements; the Arnold Plaintiffs have stated a claim for damages under the Privacy Act, and have unlocked OPM's waiver of sovereign immunity, by alleging OPM's knowing refusal to establish appropriate information security safeguards; KeyPoint was not entitled to derivative sovereign immunity because it has not shown that its alleged security faults were directed by the government, and it is alleged to have violated the Privacy Act standards incorporated into its contract with OPM; and, assuming a constitutional right to informational privacy, NTEU Plaintiffs have not alleged any violation of such a right. Ebach v. N.D. Dept. of Transportation
Shaun Ebach appealed a district court judgment affirming an administrative hearing officer’s decision to suspend Ebach’s driving privileges for 180 days for driving under the influence of alcohol. On appeal, Ebach argued the administrative hearing officer erred by admitting invalid chemical breath test records and by making result-oriented findings of fact, and that he was entitled to attorney fees and costs. The North Dakota Supreme Court concluded the test record was properly admitted, and a reasoning mind reasonably could have concluded the administrative hearing officer’s finding that the officer who administered the Intoxilyzer test ascertained a 20-minute waiting period prior to administering the test was supported by the weight of the evidence on the entire record. Gundy v. United States
The Sex Offender Registration and Notification Act (SORNA), intended to combat sex crimes and crimes against children, requires a broad range of sex offenders to register and imposes criminal penalties; 34 U.S.C. 20913 describes the “[i]nitial registration” requirements. Under subsection (b)'s general rule an offender must register “before completing a sentence of imprisonment with respect to the offense giving rise to the registration requirement.” Subsection (d) provides that the Attorney General “shall have the authority” to “specify the applicability” of SORNA’s registration requirements to pre-Act offenders and “to prescribe rules for [their] registration.” The Attorney General issued a rule that SORNA’s registration requirements apply in full to pre-SORNA offenders. The district court and the Second Circuit rejected a claim by a pre-SORNA offender that subsection (d) unconstitutionally delegated legislative power.
The Supreme Court affirmed. Four justices concluded that section 20913(d) does not violate the nondelegation doctrine. Congress may confer substantial discretion on executive agencies to implement and enforce the laws as long as Congress “lay[s] down by legislative act an intelligible principle to which the person or body authorized to [exercise that authority] is directed to conform.” The Supreme Court has already interpreted 20913(d) to require the Attorney General to apply SORNA to all pre-Act offenders as soon as feasible. To “specify the applicability” does not mean “specify whether to apply SORNA” to pre-Act offenders but means “specify how to apply SORNA” to pre-Act offenders; no Attorney General has used section20913(d) in any more expansive way. American Legion v. American Humanist Association
In 1918, residents of Prince George’s County decided to erect a cross as a war memorial to stand at the terminus of another World War I memorial—the National Defense Highway connecting Washington to Annapolis. The 32-foot tall Latin cross has a plaque, naming the 49 county soldiers who died in the war. The Bladensburg Cross has since been the site of patriotic events honoring veterans. Monuments honoring the veterans of other conflicts have been added in a nearby park. The monument is now at the center of a busy intersection. The Maryland-National Capital Park and Planning Commission acquired the Cross and the land in 1961 and uses public funds for its maintenance.
The Supreme Court held that the Bladensburg Cross does not violate the Establishment Clause. Even if a monument’s original purpose was infused with religion, the passage of time may obscure that sentiment and the monument may be retained for the sake of its historical significance or its place in a common cultural heritage. The cross is a symbol closely linked to World War I. The nation adopted it as part of its military honors, establishing the Distinguished Service Cross and the Navy Cross. The soldiers’ final resting places abroad were marked by crosses or Stars of David. As World War I monuments have endured through the years and become a familiar part of the physical and cultural landscape, requiring their removal or alteration would not be viewed by many as a neutral act. The Bladensburg Cross has acquired historical importance, reminding people of the sacrifices of their predecessors. Although the monument was dedicated during a period of heightened racial and religious animosity, it includes the names of Christian and Jewish and Black and White soldiers.
Four justices noted that the “Lemon” test ambitiously attempted to find a grand unified theory of the Establishment Clause but the “expectation of a ready framework has not been met.” “Where monuments, symbols, and practices with a longstanding history follow in the tradition of the First Congress in respecting and tolerating different views, endeavoring to achieve inclusivity and nondiscrimination, and recognizing the important role religion plays in the lives of many Americans, they are likewise constitutional.” View "American Legion v. United States v. Arias-Quijada
Defendant-Appellant Jose Luis Eliseo Arias-Quijada entered a conditional guilty plea to illegal reentry into the United States. He reserved the right to appeal the district court’s denial of his Motion to Assert a Defense of Duress. In this appeal, Arias-Quijada challenged the denial of his motion, arguing he presented sufficient evidence to create a triable issue on the affirmative defense of duress. He specifically challenged the district court’s conclusion that he failed to make a bona fide effort to surrender to immigration authorities once the alleged duress lost its coercive force. Manhattan Community Access Corp. v. Halleck
New York requires cable operators to set aside channels for public access. Those channels are operated by the cable operator unless the local government chooses to operate the channels or designates a private entity as the operator. New York City designated a private nonprofit corporation, MNN, to operate public access channels on Time Warner’s Manhattan cable system. Respondents produced a film critical of MNN. MNN televised the film. MNN later suspended Respondents from all MNN services and facilities. They sued, claiming that MNN violated their First Amendment free-speech rights. The Second Circuit partially reversed the dismissal of the suit, concluding that MNN was subject to First Amendment constraints.The Supreme Court reversed in part and remanded. MNN is not a state actor subject to the First Amendment. A private entity may qualify as a state actor when the entity exercises “powers traditionally exclusively reserved to the State” but “very few” functions fall into that category. Operation of public access channels on a cable system has not traditionally and exclusively been performed by government. Providing some kind of forum for speech is not an activity that only governmental entities have traditionally performed and does not automatically transform a private entity into a state actor. The City’s designation of MNN as the operator is analogous to a government license, a government contract, or a government-granted monopoly, none of which converts a private entity into a state actor unless the private entity is performing a traditional, exclusive public function. Extensive regulation does not automatically convert a private entity's action into that of the state. The City does not own, lease, or possess any property interest in the public access channels. Virginia Uranium, Inc. v. Warren
The company wants to mine raw uranium ore from a site near Coles Hill, Virginia. Virginia law completely prohibits uranium mining. The company alleged that, under the Constitution’s Supremacy Clause, the Atomic Energy Act (AEA) preempts state uranium mining laws like Virginia’s and makes the Nuclear Regulatory Commission (NRC) the lone regulator. The district court, the Fourth Circuit, and the Supreme Court rejected the company’s argument.The AEA does not preempt Virginia’s law banning uranium mining; the law grants the NRC extensive and sometimes exclusive authority to regulate nearly every aspect of the nuclear fuel life cycle except mining, expressly stating that the NRC’s regulatory powers arise only “after [uranium’s] removal from its place of deposit in nature,” 42 U.S.C. 2092. If the federal government wants to control uranium mining on private land, it must purchase or seize the land by eminent domain and make it federal land, indicating that state authority remains untouched. Rejecting “field preemption: and “conflict preemption” arguments, the Court stated that the only thing a court can be sure of is what can be found in the law itself and the compromise that Congress actually struck in the AEA leaves mining regulation on private land to the states. Howard Jarvis Taxpayers Assn. v. Amador Water Agency
Citizens submitted a referendum petition to challenge Amador Water Agency’s Board Resolution No. 2015-19, adopting new water service rates for Agency customers. The Clerk of the Agency rejected the referendum petition and refused to place it on an election ballot, on the grounds that: (1) the petition was “confusing;” and (2) the rate change, while subject to challenge by initiative, was not subject to referendum. Appellants Howard Jarvis Taxpayers Association, Charlotte Asher, and Laura Boggs appealed the trial court’s denial of their petition for a peremptory writ of mandate against Amador Water Agency, its Clerk, and its Board of Directors (collectively “the Agency”). Appellants argued: (1) the Clerk exceeded her ministerial duties by declaring the petition confusing; and (2) referendum was an appropriate avenue to challenge the new water rates. After review, the Court of Appeal determined: (1) the Clerk exceeded the scope of her ministerial duty and should have certified the referendum petition as adequate; and (2) the Resolution was not subject to referendum. The Court reached a different conclusion in a different case currently under California Supreme Court review. Salmeron-Salmeron v. Spivey
The Eleventh Circuit affirmed the district court's dismissal of a petition for habeas relief and partial grant of summary judgment for the Government regarding petitioner's claim that USCIS should have exercised jurisdiction over his application for asylum. The court held that the improper inclusion of irrelevant documents in the administrative record and its subsequent supplementation with relevant documents did not prejudice petitioner and any errors on the part of the Government in this respect were harmless; USCIS's decision not to exercise jurisdiction over petitioner's asylum claim was not arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with the law; and petitioner's habeas petition was moot because he did not otherwise argue that any meaningful relief could be granted to him via a habeas petition. Harbour v. Tupelo Public School District
Following a disciplinary proceeding, Meloney Harbour’s minor son, T.D.H., was suspended from school and placed in an alternative school. The chancery court initially reversed and rendered the decision of the Tupelo Public School District Board of Trustees after finding that the deprivation of an attorney at the initial disciplinary hearing, as well as the failure to state the applicable standard of proof, violated T.D.H.’s due process rights. After a Mississippi Rule of Civil Procedure 59(a) motion, the chancery court amended its judgment to remand the case instead of rendering it. Harbour then filed a Mississippi Rule of Civil Procedure 60(b) motion and, for the first time, challenged the constitutionality of Mississippi Code Section 37-9-71. Harbour contended the statute contained an unconstitutional standard of proof: substantial evidence rather than clear and convincing evidence. Harbour did not notice the attorney general of the constitutional challenge to the statute. Finding that Harbour failed to meet her burden under Rule 60(b), the chancery court denied the motion. Harbour then appealed that ruling. Finding no reversible error, the Mississippi Supreme Court affirmed the chancery court’s denial of the Rule 60(b) motion. View "Harbour v.
