The First Circuit denied and dismissed Petitioner’s petition challenging the Board of Immigration Appeals’s (BIA) denial of her motion to reopen and the BIA’s decision not to exercise its sua sponte authority to reopen her case to grant her request for an adjustment of status, holding that Petitioner was not entitled to relief.Specifically, the First Circuit held (1) Petitioner’s petition for review was denied as to her challenge to the BIA’s determination that the motion to reopen was untimely; and (2) because Petitioner had no colorable constitutional or legal claim on which the Court might base jurisdiction, the petition was dismissed for lack of jurisdiction as to Petitioner’s challenge to the BIA’s decision not to exercise its authority to reopen sua sponte. The Oregon Department of Transportation (ODOT) owned driver records, which were considered as assets of the State Highway Fund and subject to use restrictions set out in Article IX, section 3a, of the Oregon Constitution. Pursuant to ORS 366.395, ODOT sold the Department of Administrative Services (DAS) an exclusive license to provide real-time electronic access to those driver records. Plaintiffs challenged both ODOT’s statutory authority to grant the license and the use to which DAS put it. The license permitted DAS to sublicense its rights and obligations to others; DAS sub-licensed its rights to NICUSA, the company that DAS enlisted to build the state internet portal. Through that portal, NICUSA provided electronic access to driver records and, pursuant to the sublicense agreement, charged a fee equal to what DAS paid for the license ($6.63 per record) plus an additional $3.00 per record convenience fee. The former amount/fee ultimately went to ODOT and into the highway fund to be used in accordance with Article IX, section 3a, and was predicted to produce $55 million dollars over the life of the license. The latter amount/fee was retained by NICUSA at least in part to recoup its costs in creating and maintaining the state internet portal. The end result was that disseminators pay $9.63 per record, $6.63 of which goes to ODOT and $3.00 of which NICUSA kept. Plaintiffs, which included nonprofit corporations representing their members’ interests, claimed the licensing agreements harmed them because, among other adverse effects, they had to pay disseminators an increased amount for driver records. Plaintiffs sought a declaration that ODOT did not have statutory authority to sell the license to DAS, and that the licensing agreements violated Article IX, section 3a. The Oregon Supreme Court determined ODOT lawfully transferred the license in question to DAS, and that neither the use to which DAS put the license, nor the value DAS paid for it it "ran afoul" of the Oregon Constitution. Plaintiffs filed a class action against the State of Missouri and others, alleging that the state failed to meet its constitutional obligation to provide indigent defendants with meaningful representation. The Eighth Circuit reversed the district court's denial of the State and the governor's motion to dismiss based on sovereign immunity and legislative immunity.The court held that the Missouri Supreme Court would apply long-established principles to cases involving prospective equitable relief and hold that the state was immune; neither the statute nor the Missouri Constitution's general-enforcement provision make the governor an Ex parte Young defendant; to the extent plaintiffs claim that the governor's general enforcement authority and appointment authority were non-legislative acts that lead to a constitutional violation, the governor was subject to sovereign immunity for those acts because they did not satisfy Ex parte Young; and even if the governor's appropriation-reduction authority was not shielded by sovereign immunity through Ex parte Young, legislative immunity, a separate defense, foreclosed suit against the governor. This case involved statutory interpretation concerning application of the reporting requirements contained in the Washington Fair Campaign Practices Act (FCPA), chapter 42.17A RCW. The specific issue presented was how the FCPA reporting requirements in RCW 42.17A.255 and the definition in RCW 42.17A.005(4) ("ballot proposition") were to be applied in the context of local initiatives. In 2014, Evergreen Freedom Foundation (EFF) staff created sample municipal ordinances and ballot propositions for citizens to use to advance certain causes to their local city councils or commissions. Local residents in the cities of Sequim, Chelan, and Shelton used those samples in filing two ballot propositions in each city, one to require collective bargaining negotiation sessions to be publicly conducted and the second to prohibit union security clauses in city collective bargaining agreements. The proponents submitted the proposed measures to their local city clerks along with signatures they had gathered in support of the measures, and asked their respective city councils or commissions either to pass the measures as local ordinances or, if the councils or commissions did not agree, to alternatively place each measure on the local ballot for a vote. None of the cities passed the measures as ordinances or placed the ballot propositions on the local ballots. In response, EFF employees, who were attorneys, participated in lawsuits against each jurisdiction on behalf of the local resident proponents, each suit seeking a judicial directive to the respective city to put each measure on the local ballot. Each lawsuit ended in a superior court dismissing the case, and those decisions were not appealed. EFF did not file any campaign finance disclosure reports identifying the value of the legal services it provided to the resident proponents in support of the local ballot propositions. The State conducted an investigation and then filed a civil regulatory enforcement action against EFF alleging EFF failed to report independent expenditures it made in support of the noted local ballot propositions. The Washington Supreme Court affirmed the Court of Appeals' reversal of the trial court's 12(b)(6) dismissal of the State's regulatory enforcement action under the FCPA: under the circumstances of this case, EFF's pro bono legal services were reportable. The applicable reporting statutes were not unconstitutionally vague, nor did their application here violate EFF's First Amendment rights. View "Washington v. Evergreen Freedom Found." on Justia Law

As a cost-saving measure, Flint's municipal water supply was switched from the Detroit Water and Sewerage Department (DWSD) to the Flint River and was processed by an outdated and previously mothballed water treatment plant, with the approval of Michigan regulators and an engineering firm, and distributed without adding chemicals to counter the river water’s known corrosivity. Within days, residents complained of foul smelling and tasting water. Within weeks, some residents’ hair began to fall out and their skin developed rashes. Within a year, there were positive tests for E. coli, a spike in deaths from Legionnaires’ disease, and reports of dangerously high blood-lead levels in Flint children. The river water was 19 times more corrosive than the Lake Huron water pumped supplied by DWSD; without corrosion-control treatment, lead leached out of the lead-based service lines. The district court dismissed many claims and defendants in a suit by residents. The remaining defendants appealed with respect to the remaining 42 U.S.C. 1983 claim--that defendants violated their right to bodily integrity as guaranteed by the Substantive Due Process Clause. The Sixth Circuit concluded that plaintiffs pled a plausible Due Process violation regarding some defendants, rejecting their qualified immunity claims. The court reversed as to other defendants; plaintiffs alleged mere negligence, not a constitutional violation, against them. The court rejected a claim that the city was entitled to Eleventh Amendment immunity based on Michigan's takeover of the city under the “Emergency Manager” law. View "Guertin v. Edward Sloan and the South Carolina Public Interest Foundation (collectively, Appellants) filed suit alleging Act 275 of 2016 violated article III, section 17 of the South Carolina Constitution (the One Subject Rule). Appellants claimed Act 275's title was insufficient and its provisions related to more than one subject, thus violating the Rule. The trial court dismissed the complaint on numerous grounds. The South Carolina Supreme Court did not address all of these issues on certiorari review, but elected to resolve the appeal on the merits. While it has not hesitated to strike down legislation that violates the One Subject Rule, the Supreme Court has also respected the separation of powers doctrine and upheld legislation where a close question is presented. The constitutional challenge to Act 275 did not present a close question—Act 275 manifestly complied with the One Subject Rule. The trial court's dismissal of the complaint was affirmed. Michigan’s Unemployment Insurance Agency's automated program, MiDAS, accessed claimant records from employers, state agencies, and the federal government. When MiDAS detected unreported income or “flagged” other information, it initiated an automated process to determine whether the individual had engaged in fraud. If an employee reported no income for any week during a quarter in which he earned income, MiDAS automatically found fraud. MiDAS did not inform the claimant about the basis for suspicion and did not allow fact-based adjudication but automatically sent claimants multiple-choice questionnaires. No human being took part in the fraud determination. MiDAS sent the questionnaires to claimants’ online accounts, many of which were dormant, and did not take additional steps (emails, mail, or phone) to notify claimants. When MiDAS determined that a claimant committed fraud, the individual’s right to benefits terminated immediately and severe monetary penalties were automatically assessed, even when claimants did not actually receive benefits. Most claimants did not know about the determination until the time for appeal had expired. The Agency did not answer calls and garnished claimants’ wages and intercepted their federal income tax returns without an opportunity to contest the fraud determinations. The Michigan Auditor General reviewed 22,000 MiDAS fraud determinations; 93% did not actually involve fraud.In an action under 42 U.S.C. 1983, the district court denied the Individual Defendants qualified immunity. The Sixth Circuit affirmed in part. Plaintiffs adequately alleged that Defendants violated their right to procedural due process by terminating their eligibility for benefits and seizing their tax refunds without any meaningful pre-deprivation process; the right to a pre-deprivation hearing was clearly established at the time. Plaintiffs failed to state a plausible equal protection claim; they failed to allege Defendants intentionally singled them out for discriminatory treatment. The Seventh Circuit previously concluded that people whose property is taken into custody by Illinois under its Disposition of Unclaimed Property Act, 765 ILCS 1026/15-607, are entitled to receive the time value of their property (interest or other earnings), less reasonable custodial fees. On remand the district court declined to certify a proposed class, ruling that owners are entitled to compensation for the time value of money only if the property was earning interest when the state took it into custody, which meant that the class had internal divisions that made certification inappropriate. The Seventh Circuit vacated. The Supreme Court has held that the Takings Clause protects the time value of money as much as it does money itself. What the property earns in the state’s hands does not depend on what it had been earning in the owner’s hands; cash has time value even if not invested. The Takings Clause does not set up a situation in which someone who wanted to be “in cash” bears the risk of loss as market conditions change without any prospect of offsetting gain. On remand, Illinois can argue that it does not owe interest on small amounts, such as the $100 at issue, because of administrative costs. View "Goldberg v. Frerichs" on Justia Law

This case was brought by the North Idaho Building Contractors Association, Termac Construction, Inc., and other class members (collectively, “NIBCA”), to declare a sewer connection/capitalization fee the City of Hayden enacted in 2007 to be an impermissible tax. The action was originally dismissed on the City’s motion for summary judgment; but, on appeal the Idaho Supreme Court vacated the district court's judgment and remanded for further proceedings because the record did not contain sufficient evidence to establish that the 2007 Cap Fee complied with controlling Idaho statutes and case law. On remand, the parties filed cross motions for summary judgment and the district court found that the 2007 Cap Fee was an impermissible tax and taking of property without just compensation in violation of federal takings law. In doing so, the district court refused to consider expert evidence propounded by the City which opined that the 2007 Cap Fee complied with the applicable Idaho legal standards and was reasonable. The district court subsequently ruled on stipulated facts that NIBCA was entitled to damages in the amount paid above $774 per connection, together with interest, costs, and attorney fees. The City appealed the district court’s refusal to consider its evidence and NIBCA cross-appealed the award of damages. The Idaho Supreme Court again vacated the judgment because the district court improperly refused to consider the City’s evidence on remand. View "No ID Bldg Cont Assoc v. Following a positive drug test, DHS removed Hansen from his position as an Information Technology Specialist for U.S. Customs and Border Protection. After failing the drug test, Hansen had submitted a letter to the agency, claiming that he had unknowingly consumed pot brownies prepared by a friend-of-a-friend’s neighbor, a stranger to him, at a barbeque. The Merit Systems Protection Board affirmed. Hansen appealed, arguing that the Board improperly assigned him the burden of proving that he inadvertently ingested marijuana, that it erred in finding his position was subject to random drug testing, and that even if it was subject to such testing, he lacked required notice of that fact. The Federal Circuit affirmed, holding that intent is not an element of the charged conduct and that the Board properly required Hansen to introduce rebuttal evidence to counter the government’s showing of nexus and choice of penalty. Substantial evidence supports the Board’s finding that Hansen’s position was designated for random drug testing. View "Hansen v. Department of Homeland Security" on Justia Law
