United States ex rel Fields v. Bi-State Development Agency
The Eighth Circuit affirmed the district court's denial of summary judgment to Bi-State in a False Claims Act (FCA), action brought by a private actor. Bi-State is an interstate compact entity that owns and operates public transportation services. After determining that the Barket factors point in two different directions, the court turned to the "Eleventh Amendment's twin reasons for being" as its "prime guide" in determining whether Bi-State was more like an arm of the state or a local government entity. In this case, the twin reasons for being, respect for the dignity of the states as sovereigns and the prevention of federal-court judgments that must be paid out of a State's treasury, weigh in favor of finding that Bi-State was more like a local government entity. Therefore, Bi-State does not enjoy the special constitutional protection of the States themselves and was not entitled to Eleventh Amendment sovereign immunity. View "United States ex rel Fields v. Boler v. Earley
Flint, which previously obtained water from DWSD, decided to join the Karegnondi Water Authority (KWA). The DWSD contract terminated in 2014. Because KWA would take years to construct, Flint chose the Flint River as an interim source. A 2011 Report had determined that river water would need to be treated to meet safety regulations; the cost of treatment was less than continuing with DWSD. Genesee County also decided to switch to KWA but continued to purchase DWSD water during construction. Flint did not upgrade its treatment plants or provide additional safety measures before switching. Residents immediately complained that the water “smelled rotten, looked foul, and tasted terrible.” Tests detected coliform and E. coli bacteria; the water was linked to Legionnaire’s disease. General Motors discontinued its water service, which was corroding its parts. Eventually, the city issued a notice that the drinking water violated standards, but was safe to drink. Subsequent testing indicated high levels of lead and trihalomethane that did not exceed the Safe Drinking Water Act (SDWA) Lead and Copper Rule’s “action level.” The tests indicated that corrosion control treatment was needed to counteract lead levels. The City Council voted to reconnect with DWSD; the vote was overruled by the state-appointed Emergency Manager. The EPA warned of high lead levels; officials distributed filters. Genesee County declared a public health emergency in Flint, advising residents not to drink the water. The Emergency Manager ordered reconnection to DWSD but the supply pipes' protective coating had been damaged by River water. Flint remains in a state of emergency but residents have been billed continuously for water. The Michigan Civil Rights Commission determined that the response to the crisis was “the result of systemic racism.” The Sixth Circuit reversed dismissal, as preempted by SDWA, of cases under 42 U.S.C. 1983. SDWA has no textual preemption of section 1983 claims and SDWA’s remedial scheme does not demonstrate such an intention. The rights and protections found in the constitutional claims diverge from those provided by SDWA. The court affirmed dismissal of claims against state defendants as barred by the Eleventh Amendment. Southern California Edison v. State Department of Taxation
South California Edison (Edison) was not due a refund of use tax paid to Nevada because it did not demonstrate the existence of substantially similar entities that gained an unfair tax advantage because of the unconstitutional tax, and Edison was not owed a tax credit in an amount equal to the transaction privilege tax (TPT) levied by Arizona because the TPT did not qualify as a sales tax paid by Edison within the meaning of Nev. Admin. Code 372.055.Edison filed a claim with the State Department of Taxation for a refund of the use tax it paid between 1998 and 2000. The Department and Nevada Tax Commission denied the requested refund. Edison then filed an independent action in the district court seeking a refund of the taxes it paid. The district court concluded that, while the negative implications of the dormant Commerce Clause rendered Nev. Rev. Stat. 372.270 (the use tax exemption) unconstitutional, Edison was not entitled to a refund because it did not have favored competitors that benefitted from the discriminatory taxation scheme. Josephine Havlak Photographer, Inc. v. Village of Twin Oaks
Plaintiff, a commercial photographer, filed suit against the Village for injunctive and declaratory relief after the Village passed a municipal ordinance prohibiting all commercial activity in its neighborhood park without a permit. The Eighth Circuit affirmed the district court's denial of her Free Speech rights claims, holding that the ordinance met constitutional scrutiny as applied to plaintiff because it was content neutral, was narrowly tailored to serve the Village's significant government interests, left ample alternatives for her to communicate her message, and did not provide the Village with unbridled discretion. Kaminski v. Coulter
Lincoln Park’s dire financial condition led Michigan officials to place the city under the purview of an Emergency Manager pursuant to the Local Financial Stability and Choice Act, Mich. Comp. Laws 141.1541. Emergency Manager Coulter, with the approval of Michigan’s Treasurer, issued 10 orders that temporarily replaced Lincoln Park retiree health-care benefits with monthly stipends that retirees could use to purchase individual health-care coverage. Retirees filed sui under 42 U.S.C. 1983, asserting violations of the Contracts Clause, the Due Process Clause, and the Takings Clause. The district court rejected the Treasurer’s motion to dismiss, arguing qualified immunity and Eleventh Amendment immunity. The Sixth Circuit reversed. The court held, as a matter of first impression, that an alleged Contracts Clause violation cannot give rise to a cause of action under section 1983. With respect to other constitutional claims, the claimed property right derives from contract; a state contract action would be sufficient to safeguard the retirees’ contractual property rights. Because the state contract action is available as a remedy for any uncompensated taking the challenges to the constitutionality of Coulter’s orders are not ripe for resolution. Jowers v. SCDHEC
The Surface Water Withdrawal, Permitting, Use, and Reporting Act regulated surface water withdrawals in South Carolina. Surface water is defined as "all water that is wholly or partially within the State . . . or within its jurisdiction, which is open to the atmosphere and subject to surface runoff, including, but not limited to, lakes, streams, ponds, rivers, creeks, runs, springs, and reservoirs . . . ." Agricultural users are treated differently under the Act. Plaintiffs jointly filed this action against DHEC in Barnwell County, challenging the Act's registration system for agricultural users, contending, amongst other things, that the Act’s provisions were an unconstitutional taking, a violation of due process, and a violation of the public trust doctrine. The circuit court granted summary judgment against the plaintiffs on the grounds the case did not present a justiciable controversy, both because the plaintiffs lacked standing and the dispute was not ripe for judicial determination. Finding no reversible error with that holding, the South Carolina Supreme Court affirmed. View "Jowers v. SCDHEC" on Justia Law
Nate v. Denney
House Bill No. 67 passed the Idaho State House on February 2, 2017, and it was transmitted to the Senate. The bill was amended twice in the Senate, and it passed the Senate, as amended, on March 22, 2017, and was returned to the House. As amended by the Senate, the bill passed the House on March 27, 2017. The bill exempted from the state sales tax the sale of food, as defined in the bill, sold for human consumption. The Governor vetoed the bill and delivered it to the Secretary of State on April 11, 2017. Because of the veto, the Secretary of State thereafter refused to certify House Bill No. 67 as law. This case was brought in the Idaho Supreme Court’s original action seeking a writ of mandamus compelling the Secretary of State to certify 2017 House Bill No. 67 as law because the Governor did not veto the bill and return it to the Secretary of State within ten days (excluding Sundays) after the legislature adjourned. The Supreme Court overruled Cenarrusa v. Andrus, 582 P.2d 1082 (1978), but held that all parties were misconstruing Article IV, section 10, of the Idaho Constitution, and denied the writ of mandate. Pueblo of Pojoaque v. New Mexico
Plaintiffs-Appellants Pueblo of Pojoaque appealed a district court’s dismissal of its claim for declaratory and injunctive relief based on the New Mexico’s alleged unlawful interference with Class III gaming operations on the Pueblo’s lands. In July 2005, the Pueblo and New Mexico executed a Class III gaming compact pursuant to the Indian Gaming Regulatory Act (“IGRA”) that allowed it to operate casino-style gaming on its lands. Prior to the expiration of the compact, the New Mexico Gaming Control Board (“the Gaming Board”) sought to perform its annual compliance review of the Pueblo’s gaming operations. The Pueblo complied on June 24; on June 30, 2015, the compact expired at midnight. The Gaming Board announced that despite the U.S. Attorney’s decision allowing the Pueblo’s gaming operations to continue pending the review, the Pueblo’s casinos were operating illegally due to the absence of a compact, and it placed in abeyance approval of any license application or renewal for vendors who did business with the Pueblo. The Pueblo commenced this action, asserting in part that New Mexico failed to conduct compact negotiations in good faith in violation of IGRA and that individual defendants conspired under the color of state law to “deprive the federal right of the Pueblo and its members to be free of state jurisdiction over activities that occur on the Pueblo lands.” The Pueblo sought an injunction, contending that the Gaming Board’s actions were an impermissible attempt to assert jurisdiction over gaming operations on tribal lands, despite the termination of New Mexico’s jurisdiction over such activities upon the expiration of the compact. The district court entered final judgment, stayed the effects of the preliminary injunction, and issued an indicative ruling that it would vacate or dissolve the preliminary injunction on remand. The Pueblo sought to stay the district court’s judgment and restore the preliminary injunction. The district court declined to do so, but the Tenth Circuit extended a temporary injunction against the State mirroring the preliminary injunction entered by the district court. On appeal, the Pueblo argued the district court did not have jurisdiction to proceed to the merits given the interlocutory appeal of the preliminary injunction and, even if it did, it erred in concluding that IGRA did not preempt New Mexico’s regulatory action. The Tenth Circuit found the text of IGRA clearly evinced congressional intent that Class III gaming would not occur in the absence of a compact, and no such compact existed. Accordingly, conflict preemption also does not apply. For similar reasons, the Court rejected the Pueblo’s argument that the Gaming Board’s determination as to the unlawful nature of the Pueblo’s gaming activities was an improper assertion of jurisdiction preempted by IGRA. Because the Pueblo’s gaming activities are not conducted pursuant to a compact or an alternative mechanism permitted under IGRA, the Pueblo’s present gaming is unlawful under federal law, and the State’s conclusion to this effect was not an exercise of jurisdiction that IGRA preempts. Lund v. Rowan County, North Carolina
The full court granted rehearing en banc and held that Rowan County's practice of lawmaker-led prayer violated the Establishment Clause of the First Amendment. The en banc court held that the prayer practice served to identify the government with Christianity and risked conveying to citizens of minority faiths a message of exclusion. Because the commissioners were the exclusive prayer-givers, Rowan County’s invocation practice fell well outside the more inclusive, minister-oriented practice of legislative prayer described in Town of Greece v. Galloway, 134 S. Ct. 1811 (2014). The en banc court explained that the solemn invocation of a single faith in so many meetings over so many years distanced adherents of other faiths from that representative government which affects the lives of all citizens and which Americans of every spiritual persuasion have every right to call their own. McDonough v. Fernandez-Rundle
Plaintiff filed suit against the Miami-Dade County State Attorney under 42 U.S.C. 1983, after she informed plaintiff that his recording of a meeting between him and the Chief of Police violated the Florida Security of Communications Act, Fla. Stat. 934.03, and that the violation was a felony. The Eleventh Circuit reversed the trial court's judgment and held that plaintiff did not violate section 934.03 and, consequently, the government's threatened prosecution had no basis in the law. In this case, at no point did the chief, or any participant in the meeting, exhibit any expectation of privacy. Nor was there advance notice or published or displayed rules that established confidentiality and certainly none that prohibited note taking or recordings. Furthermore, the meeting fell within the "uttered at a public meeting" exception of section 934.02, and the circumstances did not justify an expectation of privacy. Because the court resolved the case under state law, it need not reach the constitutional issue of whether the recording was protected by the First Amendment. View "McDonough v.
