In the Matter of the Title, Ballot Title and Submission Clause for 2017
Petitioners Scott Smith and D. Michael Kopp, both registered electors, appealed the actions of the Ballot Title Setting Board (“Title Board”) regarding the setting of the title and ballot title and submission clause for Proposed Initiative 2017–2018 #4 (“Initiative #4”). Issues for the Colorado Supreme Court’s review were: (1) Initiative #4 contained a single subject; and (2) whether the Supreme Court had authority to review an abstract prepared and submitted to the Title Board as required by section 1-40-105.5, C.R.S. (2016). The Court concluded: (1) the initiative indeed contained a single subject (the limitation of housing growth in Colorado); and (2) section 1-40-107 authorized the Court to review such an abstract. Horne v. Polk
In this case involving substantial consequences for alleged violations of campaign finance laws, the same individual issued the initial decision finding violations and ordering remedies, participated personally in the prosecution of the case before an administrative law judge, and then made the final agency decision that would receive only deferential review. The court of appeals concluded that because Appellants made no showing of actual bias their due process rights were not violated by the individual’s role as both advocate and adjudicator. The Supreme Court vacated the decision of the court of appeals, holding that, although Appellants did not allege actual bias, the circumstances of this case deprived them of due process, as Appellants were entitled to a determination by a neutral decisionmaker. International Refugee Assistance Project v. Trump
The Fourth Circuit affirmed in substantial part the district court's issuance of a nationwide injunction as to Section 2(c) of the challenged Second Executive Order (EO-2), holding that the reasonable observer would likely conclude EO-2's primary purpose was to exclude persons from the United States on the basis of their religious beliefs. Section 2(c) reinstated the ninety-day suspension of entry for nationals from six countries, eliminating Iraq from the list, but retaining Iran, Libya, Somalia, Sudan, Syria, and Yemen.Determining that the case was justiciable, the Fourth Circuit held that plaintiffs have more than plausibly alleged that EO-2's stated national security interest was provided in bad faith, as a pretext for its religious purpose. Because the facially legitimate reason offered by the government was not bona fide, the court no longer deferred to that reason and instead may look behind the challenged action. Applying the test in Lemon v. Kurtzman, the court held that the evidence in the record, viewed from the standpoint of the reasonable observer, created a compelling case that EO-2's primary purpose was religious. Then-candidate Trump's campaign statements revealed that on numerous occasions, he expressed anti-Muslim sentiment, as well as his intent, if elected, to ban Muslims from the United States. President Trump and his aides have made statements that suggest EO-2's purpose was to effectuate the promised Muslim ban, and that its changes from the first executive order reflect an effort to help it survive judicial scrutiny, rather than to avoid targeting Muslims for exclusion from the United States. These statements, taken together, provide direct, specific evidence of what motivated both executive orders: President Trump's desire to exclude Muslims from the United States and his intent to effectuate the ban by targeting majority-Muslim nations instead of Muslims explicitly. Because EO-2 likely fails Lemon's purpose prong in violation of the Establishment Clause, the district court did not err in concluding that plaintiffs are likely to succeed on the merits of their Establishment Clause claim. The court also held that plaintiffs will likely suffer irreparable harm; the Government's asserted national security interests do not outweigh the harm to plaintiffs; and the public interest counsels in favor of upholding the preliminary injunction. Finally, the district court did not abuse its discretion in concluding that a nationwide injunction was necessary to provide complete relief, but erred in issuing an injunction against the President himself. Barlow v. Miss.State Bd. of Chiropractic Examiners
Dr. Andy Barlow was disciplined by the Mississippi State Board of Chiropractic Examiners for advertising in violation of the statutes governing chiropractors. The complaint alleged that Dr. Barlow advertised using professional designations other than “chiropractor,” “doctor of chiropractic,” “D.C.,” or “chiropractic physician”; Dr. Barlow advertised as D.C., and also as DACNB, FACFN, and as a “Chiropractic Neurologist.” The Board levied a monetary penalty plus the costs of his prosecution. The circuit court affirmed the Board, and Dr. Barlow appealed to the Mississippi Supreme Court, alleging that the statute governing chiropractic advertising had been implicitly amended or repealed, that the statute governing chiropractic advertising violated his First Amendment rights, and that the Board was without authority to assess the costs of the investigation to him. Furthermore, he argued the circuit court erred by failing to afford him a “de novo appeal.” Because Dr. Barlow’s arguments on whether he should be disciplined lack merit, the Court affirmed the judgments of the Board and circuit court on those issues. However, because the Board lacked authority to directly assess Dr. Barlow the costs of its investigation, the Court reversed on the issue of costs. View "Barlow v. Yocum v. PA Gaming Control Board
Petitioner challenged as unconstitutional certain restrictions imposed upon attorneys who were employed by the Pennsylvania Gaming Control Board (Board), and sought declaratory and injunctive relief. The Board filed preliminary objections, asserting petitioner lacked standing to pursue her claim, her claim was not yet ripe, and in any event, her claim failed on the merits. The Pennsylvania Supreme Court overruled the Board’s preliminary objections as to standing and ripeness, but nevertheless concluded petitioner was not entitled to relief on the merits as the restrictions included in the Gaming Act were constitutionally sound. Wikimedia Foundation v. NSA/CSS
Wikimedia and eight other organizations filed suit challenging Upstream surveillance, an electronic surveillance program operated by the NSA. First, Wikimedia alleged that the sheer volume of its communications makes it virtually certain that the NSA has intercepted, copied, and reviewed at least some of its communications (Wikimedia Allegation). Second, all plaintiffs alleged that in the course of conducting Upstream surveillance the NSA was intercepting, copying, and reviewing substantially all text-based communications entering and leaving the United States, including their own (Dragnet Allegation). The district court dismissed the complaint based on lack of Article III standing. The Fourth Circuit held that the analysis of speculative injury in Clapper v. Amnesty International USA, 133 S. Ct. 1138 (2013), was not controlling in this case because the central allegations were not speculative. As to Wikimedia, the court vacated and remanded because Wikimedia made allegations sufficient to survive a facial challenge to standing. As to the other plaintiffs, the court affirmed because the complaint did not contain enough well-pleaded facts entitled to the presumption of truth to establish their standing. Cordova v. Cline
Petitioners who pursue the recall of a local school board member under the Recall Act are entitled to the procedural protections of the New Mexico statute prohibiting strategic litigation against public participation (Anti-SLAPP statute). This dispute arose out of a malicious abuse of process claim made by Taos school board member Arsenio Cordova (Cordova) against eighteen members of an unincorporated citizens’ association (collectively, Petitioners) following their efforts to remove Cordova from office under the Local School Board Member Recall Act (Recall Act). The New Mexico Supreme Court concluded that petitioners were entitled to immunity under the Noerr-Pennington doctrine when they exercise their right to petition unless the petitioners: (1) lacked sufficient factual or legal support; and (2) had a subjective illegitimate motive for exercising their right to petition. City of Pittsburgh v. Fraternal Order of Police Ft. Pitt Ldg. 1
In a discretionary appeal, the issue before the Pennsylvania Supreme Court centered on whether a home rule municipality could amend its home rule charter to eliminate mandatory subjects of bargaining as defined by the Police and Firemen Collective Bargaining Act ("Act 111"), the Pennsylvania Labor Relations Act ("PLRA"), and applicable case law. Appellant, the Fraternal Order of Police, Fort Pitt Lodge No. 1 (“FOP”) was the exclusive collective bargaining representative for the police officers of Appellee, the City of Pittsburgh (“City”), pursuant to Act 111 and the PLRA. The City was subject to the Policemen’s Civil Service Act, which requires officer applicants be residents of the city at the time of application and throughout their term of employment. The General Assembly repealed the residency mandate in 2012. The parties met to bargain the residency issue, but were unable to reach an agreement. The matter went to arbitration, and pending those proceedings, the Pittsburgh City Council passed a resolution to place a referendum on the upcoming general election ballot asking the voters whether the City’s home rule charter should be amended to require all City employees and officials, including police and fire personnel, to maintain their domicile within the City. Voters approved the home rule charter amendment in 2013. The arbitration panel issued a Supplemental Interest Arbitration Award, which provided that the City-only residency requirement would immediately discontinue and be replaced with a different residency requirement: officers would be required to reside within a twenty-five air-mile radius from the Pittsburgh City-County Building. The City sought review with the court of common pleas, seeking to vacate the arbitration supplemental award. The Supreme Court found that to ensure that home rule municipalities would not abrogate the right of police and firefighters to collectively bargain, the General Assembly enacted Section 9 of Act 111, specifically providing that the act was applicable to every political subdivision in the Commonwealth, regardless of its adoption of a home rule charter. Because the home rule charter amendment changed or modified Act 111 by removing residency as a subject of collective bargaining, it violated Section 2962(e) of the Home Rule Charter law. Thus, based strictly on Section 2962 of the Home Rule Charter Law, the FOP was entitled to relief. The trial court affirming the supplemental interest arbitration award directing officers be required to reside within a twenty-five mile radius from the City-County Building was reinstated. Abramyan v. Georgia
During the 2015 General Session, the legislature amended certain statutes governing Certificates of Public Necessity and Convenience (“CPNCs,” also known as taxi medallions) and created new provisions authorizing (and regulating) ride-sharing programs throughout the state. Appellants, taxicab drivers who operated in the City of Atlanta and owned CPNCs, filed suit claiming that the Act resulted in an unconstitutional taking and inverse condemnation of their CPNCs. The State moved to dismiss, arguing, among other things, that Appellants failed to state legally cognizable claims. The trial court agreed and granted the motion. Finding no reversible error, the Georgia Supreme Court affirmed the trial court. View "Abramyan v. Georgia" on Justia Law
Helman v. Department of Veterans Affairs
Veterans Access, Choice, and Accountability Act (VACAA) provisions vesting significant authority in administrative judges violates Appointments Clause. In 2014, Congress investigated reports that senior executives in the Department of Veterans Affairs (DVA) had manipulated hospital performance metrics by maintaining secret wait lists of veterans who needed care. The resulting VACAA established new rules for the removal of DVA Senior Executive employees, 38 U.S.C. 713. Previously, senior DVA executives could only be removed under the Civil Service Reform Act, 5 U.S.C. 1101, and were entitled to appeal to the Merit Systems Protection Board (MSPB), to a hearing, and to attorney representation. Section 713 created an accelerated timeline for MSPB appeals and required the MSPB to refer all appeals to an administrative judge (AJ) for decision within 21 days. Helman, the Director of the Phoenix Veterans Affairs Health Care System, was removed from her position under section 713. An MSPB AJ affirmed. Helman sought review from the full Board. Citing section 713(e)(2), the Board refused to take any further action. The Federal Circuit remanded, holding that, by prohibiting Board review under section 713(e)(2), Congress vested significant authority in an AJ in violation of the Appointments Clause. Section 713(e)(2) and two related sections are severable, leaving the remainder of the statute intact. View "Helman v. Department of Veterans Affairs" on Justia Law
