On January 23, 2015, Judge Callie Granade of the United States District Court for the Southern District of Alabama, issued an order declaring unconstitutional both the Alabama Sanctity of Marriage Amendment, and the Alabama Marriage Protection Act, as violating the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution. Thereafter, the federal court entered an injunction prohibiting the Alabama Attorney General from enforcing any Alabama law that prohibited same-sex marriage. The injunction was to allow time for an appeal of that decision to the Eleventh Circuit Court of Appeals. On January 27, 2015, Roy Moore, Chief Justice of the Alabama Supreme Court, sent a letter, on Supreme Court of Alabama letterhead, to then Governor Robert Bentley regarding Judge Granade’s orders, expressing "legitimate concerns about the propriety of federal court jurisdiction over the Alabama Sanctity of Marriage Amendment." In his three-page letter, Chief Justice Moore laid out his arguments as to why Judge Granade’s federal-court orders were not binding upon the State of Alabama, and ultimately directed Alabama’s probate judges not to recognize marriage licenses for same-sex couples. Months later, the Alabama Supreme Court released a per curiam opinion ordering the probate judges named as respondents to discontinue issuing marriage licenses to same-sex couples in compliance with Alabama law. Chief Justice Moore’s name did not appear in the vote line of this opinion, nor did he author or join any of the special writings. On June 26, 2015, the United States Supreme Court issued its opinion in “Obergefell,” holding that "same-sex couples may exercise the fundamental right to marry in all States" and that "there is no lawful basis for a State to refuse to recognize a lawful same-sex marriage performed in another State on the ground of its same-sex character." The Court of the Judiciary ultimately suspended Chief Justice Moore for his defiance of the laws. He appealed, and the Alabama Supreme Court determined it was “obligated to follow prior precedent” that it had no authority to disturb the sanction imposed by the Court of the Judiciary: “[b]ecause we have previously determined that the charges were proven by clear and convincing evidence and there is no indication that the sanction imposed was plainly and palpably wrong, manifestly unjust, or without supporting evidence, we shall not disturb the sanction imposed.” View "Moore v. Plaintiffs-parents Gabrielle A. and Nicholas G., and John A. and Gregory A. (the children) appealed a judgment following the trial court’s decision to grant a motion for summary judgment by the County of Orange (the County) and several social workers. Plaintiffs’ claims related to the detention of the children for six months. Gabrielle went into early labor, and gave birth at Hoag Hospital to Gregory at 31 weeks. Three days later, Gabrielle was released, and she returned to her mother Barbara’s home. Gregory remained in the Neonatal Intensive Care Unit (NICU). A few days later, Hoag employees filed a referral for an immediate response from the Orange County Social Services Agency (SSA). Hoag staff reported to Villa that Gabrielle had appeared at Hoag with John and Barbara, wearing a trench coat with nothing on underneath, displaying “irrational and aggressive behavior,” including removing the trench coat and walking around unclothed. She had previously asked for Gregory to be placed back inside of her, and she asked a nurse to cut her ankles for blood letting. According to staff, she attempted to wheel Gregory’s isolette out of the NICU and became violent with them. Hospital employees informed Villa that Gabrielle had expressed thoughts of hurting her children and demonstrated paranoia. Gabrielle disputed this version of events, but did not dispute that she was placed on a hospital hold pending evaluation. The trial court found that exigent circumstances existed to detain the children without a warrant at Hoag, and that Nicholas’s arrival at Hoag after the children were detained did not alter matters; there was no evidence to show conduct by the social workers to establish a claim for deliberate indifference, or behavior that shocks the conscience; the social workers were entitled to immunity because there was no evidence of material false statements; numerous claims by the plaintiffs were barred by the parents’ pleas of no contest in dependency court. After review, the Court of Appeal concluded that the parents’ knowing and voluntary pleas of no contest to the jurisdictional allegations during dependency proceedings defeated their claims, and the social workers were entitled to immunity. “[E]ven if we were to disregard the no contest pleas and the relevant immunity doctrines, defendants correctly argue they met their burden to establish they were entitled to summary judgment on each cause of action, and plaintiffs failed to raise triable issues of material fact. Jerry Nix appealed the entry of summary judgment which found he was an adult in need of protective services under the Adult Protective Services Act of 1976. The Franklin County Department of Human Resources ("DHR") alleged that Nix, then 78 years old, was an "adult in need of protective services." The petition claimed that Nix had not been taking his medications for diabetes and hypertension and that he had been the victim of a postal scam costing him thousands of dollars. DHR further alleged that Nix urgently required nursing-home care to protect his health and safety and that, otherwise, Nix was in immediate danger. DHR requested emergency-protective placement for Nix and that the court set a hearing to determine Nix's need for protective services. The trial court thereafter ordered DHR to provide protective services for Nix, appointed a guardian ad litem to represent Nix in the proceedings, and appointed Nix's son, Darren Nix, as conservator of Nix's estate and guardian of his person. While the Alabama Supreme Court did not question that all involved in this case desired the best for Nix, it was troubled by the "apparent lack of urgency and attention to statutory formalities in the prosecution of this petition for protective services," finding the trial court granted DHR's emergency petition on December 7, 2015; Nix was entitled to a hearing within 30 days. Seven months passed before the trial court entered the summary judgment finding Nix to be an adult in need of supervision, and fifteen months had passed since Nix was removed from his home. "It may very well be that an assisted-living facility is the appropriate and lawful protective placement for Nix, but he is still entitled to all the procedural safeguards due him under the Act, including a timely adjudication of his need for such services. Indeed, without a faithful adherence to the Act and the due process protections owed to each person protected by the Act, we risk unnecessary and wrongful deprivation of liberty and property. For those 'protected persons' dispossessed of their house and their assets, this may seem a fate far worse than a foreign-lottery postal scam." View "Nix v. The Mississippi Department of Corrections (MDOC) appealed the Chancery Court’s order granting the Roderick & Solange MacArthur Justice Center’s (Justice Center’s) complaint for declaratory judgment, deeming MDOC in violation of the Mississippi Public Records Act (MPRA) and requiring MDOC to produce records sought by the Justice Center. In November 2014, the Justice Center made a request under the MPRA for records pertaining to MDOC’s process and protocol for lethal injections, as well as MDOC’s acquisition of chemicals it intended or considered for use in lethal-injection executions. MDOC responded to the Justice Center’s 2014 request, furnishing documents, some of which were redacted. The Supreme Court concluded it would have been “ludicrous for this Court to blindly follow” the Mississippi Public Records Act of 1983 (MPRA) as it existed in 2014 when the documents at issue were requested, and “act as though we did not know the law, as adopted by the Legislature in 2016 and readopted in 2017.” The Supreme Court concluded it had to apply the Public Records Act to the this case “as though it has always read as it reads today,” vacated the trial court’s judgment, and rendered a decision in favor of the Mississippi Department of Corrections (MDOC). Officials of the California Department of Corrections and Rehabilitation (the Department) challenged the trial court's order granting a petition for writ of habeas corpus filed by Gregory Rhoades, a Native American prisoner incarcerated at Calipatria State Prison (Calipatria). In granting Rhoades's petition, the trial court concluded that the prohibition on the use of straight tobacco during prisoners' Native American religious ceremonies violated the Religious Land Use and Institutionalized Persons Act of 2000 (RLUIPA) and it ordered the California Department of Corrections to "formulate and implement policies permitting and reasonably regulating the possession and use of straight tobacco" during those ceremonies. The Court of Appeals concluded the trial court improperly granted relief in favor of Rhoades without holding an evidentiary hearing on disputed factual issues, and reversed and remanded matter with directions that the trial court hold an evidentiary hearing. Two consolidated cases involved the California Global Warming Solutions Act of 2006 (the Act), popularly known as “AB 32”). The Act was passed by a simple majority vote of both legislative houses. Its general purpose is to reduce greenhouse gas (GHG) emissions to protect the environment. Plaintiffs attacked one part of the implementing regulations adopted by the California Air Resources Board (Board). The Board created a “cap-and-trade” program that included the auction sale of some, but not all, GHG emissions allowances. The Board distributed some emissions allowances for free, but sold others at quarterly auctions. On appeal plaintiffs asserted: (1) the auction sales exceed the Legislature’s delegation of authority to the Board to design a market-based emissions reduction system; and (2) the revenue generated by the auction sales amounts to a tax that violated the two-thirds supermajority vote requirement of Proposition 13. As to the first question, the Court of Appeal held that the Legislature gave broad discretion to the Board to design a distribution system, and a system including the auction of some allowances did not exceed the scope of legislative delegation. Further, the Legislature later ratified the auction system by specifying how to use the proceeds derived therefrom. As for the second question, although the Court's reasoning differed from that of the trial court, it agreed that the auction sales did not equate to a tax. The Mirabellas alleged that their neighbors extended their backyard into wetlands owned by Montgomery Township, Pennsylvania by fencing the open space, placing playground equipment, and landscaping. They complained to the Township, which removed the fence, required the neighbors to move their playground equipment and required the neighbors to stop landscaping the open space. The Mirabellas alleged the neighbors continued to “cut and clear.” They continued to complain. The Township gave the neighbors permission to mow the open space. The Mirabellas, both attorneys, notified the Township Board that they intended to sue their neighbors and stated that, as the owner of the open space, “the Township will be an indispensable party.” Officials interpreted this as a threat that the Mirabellas would sue the Township and responded that the Township would seek sanctions. The Board’s chair, Walsh, emailed the Mirabellas to “direct all further communications to the Township attorney. Please never contact me, the Board of Supervisors or the Township employees directly.” The Mirabellas attended a Board meeting and protested the destruction of the open space and the emails. The Mirabellas filed suit under 42 U.S.C. 1983, alleging First Amendment violations. The district court rejected claims of qualified immunity. The Third Circuit reversed. While the Mirabellas adequately alleged a retaliation claim and a violation of their right to petition, those rights were not clearly established for purposes of qualified immunity. Following Hurricanes Katrina and Rita, the Louisiana legislature in 2006 passed Act 853 and Act 567, which amended the laws governing compensation for levee servitude appropriations with a particular focus on appropriations for use in hurricane protection projects. The Louisiana Supreme Court granted certiorari in this matter for three purposes: (1) to interpret specific provisions of the 2006 amendments to La. Const. art. I, section 4, La. Const. art. VI, section 42, and La. R.S. 38:281(3) and (4); (2) to determine the amount of compensation that was due a property owner whose property was appropriated by a levee district pursuant to a permanent levee servitude for use in a hurricane protection project; and (3) to determine whether La. R.S. 38:301(C)(2)(f) or La. R.S. 13:5111 governed an award for attorneys’ fees in a levee servitude appropriation dispute. The Court held the 2006 amendments to La. Const. art. I, section 4, La. Const. art. VI, section 42 and 38:281(3) and (4) reduced, rather than eliminated, the measure of damages to be paid to a property owner for the taking of, or loss or damage to, property rights for the construction, enlargement, improvement, or modification of hurricane protection projects from “full extent of the loss” to the more restrictive “just compensation” measure required by the Fifth Amendment to the United States Constitution, which was the fair market value of the property at the time of the appropriation, based on the current use of the property, before the proposed appropriated use, and without allowing for any change in value caused by levee construction. This appeal and cross-appeal relate to the district court's orders releasing video recordings made at Guantanamo Bay, depicting military personnel removing a detainee, Abu Wa'el (Jihad) Dhiab, from his cell, transporting him to a medical unit, and force-feeding him to keep him alive while he was on a hunger strike. The government classified these recordings as "SECRET" because disclosing them could damage the national security, but the district court determined that the public had a constitutional right to view the recordings because the detainee's attorney filed some of them under seal, at which point the recordings became part of the court's record. The government appealed, arguing that the public has no such constitutional right. The Intervenors cross-appealed, arguing that several categories of redactions the court approved prior to public release were too extensive. The court concluded that Press-Enterprise Co. v. Superior Court did not apply to this case and neither the intervenors nor the public at large have a right under the First Amendment to receive properly classified national security information filed in court during the pendency of Dhiab's petition for a writ of habeas corpus. The court further explained that, even if the intervenors had a qualified First Amendment right of access to the Dhiab recordings, the court would still reverse the district court's decision, because the government identified multiple ways in which unsealing these recordings would likely impair national security. People for the Ethical Treatment of Property Owners (“PETPO”) challenged a regulation promulgated by the United States Fish and Wildlife Service (“FWS”) pursuant to the Endangered Species Act (“ESA”). The challenged regulation prohibited the “take” of the Utah prairie dog, a purely intrastate species, on nonfederal land. The ESA defined “take” as meaning “to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect.” The district court granted summary judgment for PETPO on the ground that neither the Commerce Clause nor the Necessary and Proper Clause of the Constitution authorized Congress to regulate take of the Utah prairie dog on nonfederal land. FWS and intervenor-defendant Friends of Animals (“FoA”) appealed the grant of summary judgment, arguing that the challenged regulation was authorized by both the Commerce Clause and the Necessary and Proper Clause, and that PETPO lacked standing. After its review, the Tenth Circuit held that the district court correctly concluded that PETPO had standing, but erred in concluding that Congress lacked authority under the Commerce Clause to regulate (and authorize the Service to regulate) the take of the Utah prairie dog.
