Window Covering Manufacturers Association v. CPSC
In 2022, the Commission promulgated a rule that set stringent safety standards for the operating cords on custom-made window coverings based on a finding that such cords pose a strangulation risk to young children. The rule sought to eliminate the risk of injury by essentially prohibiting corded window products, and it set an aggressive timeline for industry compliance with the new standards. The Window Covering Manufacturers Association (“WCMA”) filed a petition in this court challenging the rule and its compliance deadline.
The DC Circuit granted WCMA’s petition for review and vacated the rule. The court held that the Commission breached notice-and-comment requirements, erroneously relied on certain data in its cost-benefit analysis, and selected an arbitrary effective date for the rule. The court reasoned that the Commission did not explain why it chose to credit the opinion of Safe T Shade’s company president over the contrary feedback that it received from 401 other commenters, the Small Business Association, and its own staff. The court explained that if the Commission wishes to extend a safety standard’s effective date, it must find good cause to do so, and regardless of such an extension, the Commission must find that the effective date. Anvar v. Dwyer
In this appeal arising out of a challenge to Rhode Island's liquor laws the First Circuit affirmed in part and vacated in part the judgment of the district court granting summary judgment for Defendants as to all claims, holding that the district court erred in granting summary judgment as to the constitutionality of the in-state-presence requirement for retailers.Plaintiffs, Rhode Island wine consumers, brought this action alleging that, in violation of the Commerce Clause, Rhode Island consumers are denied access to alcohol deliveries from out-of-state retailers. The district court granted summary judgment for Defendants. The First Circuit vacated the lower judgment in part, holding that the district court erred in entering summary judgment as to the constitutionality of the in-state-presence requirement for retailers and remanded for a fuller consideration of the parties' respective offers of proof. The district court upheld the in-state-presence requirement for retailers. The First Circuit affirmed the judgment in part and vacated it in part and remanded the matter for further proceedings, holding that a discriminatory aspect of the State's version of the "three-tier system" could not be affirmed. Federal Trade Commission v. Credit Bureau Center, LLC
Brown’s credit-monitoring business used a “negative option feature” on its websites, offering visitors a free credit report but automatically enrolling them in a $29.94 monthly subscription when they applied for that report. Information about the monthly membership was buried . Brown’s contractors created website traffic by posting Craigslist advertisements for fake rental properties and directing applicants to the websites for a “free” credit score. The FTC sued under Federal Trade Commission Act (FTCA) section 13(b), which authorizes restraining orders and permanent injunctions to enjoin conduct that violates its prohibition of unfair or deceptive trade practices. On its face, section 13(b) authorizes only injunctive relief but the Commission long interpreted it to permit restitution awards—an interpretation adopted by the Seventh Circuit and others.The district court entered a permanent injunction and ordered Brown to pay more than $5 million in restitution. The Seventh Circuit overruled its precedent and held that section 13(b) does not authorize restitution awards.The Supreme Court granted certiorari and held that section 13(b) does not authorize equitable monetary relief. On remand, the Commission argued that the Court’s decision had significantly changed the law and successfully requested the reimposition of the restitution award under the Restore Online Shoppers’ Confidence Act and FTCA section 19. The Seventh Circuit modified the new judgment. Its direction that any funds remaining after providing consumer redress shall be “deposited to the U.S. Treasury as disgorgement” exceeds the remedial scope of section 19, which is limited to redressing consumer injuries. US v. Walgreen Co.
The United States and the Commonwealth of Virginia (together, the “governments”) appealed the district court’s dismissal of their complaint under the False Claims Act and Virginia state law. The governments alleged that Walgreen Co. (“Walgreens”) misrepresented that certain patients met Virginia’s Medicaid-eligibility requirements for expensive Hepatitis C drugs. The district court dismissed the complaint, holding that Virginia’s eligibility requirements violated the Medicaid Act, and therefore Walgreens’s misrepresentations were immaterial as a matter of law.
The Fourth Circuit vacated and remanded. The court held that the governments plausibly allege facts that establish materiality. The court wrote that the alleged misrepresentation (that Patient 12 couldn’t use the cheaper drug alternative) has nothing to do with the eligibility requirements Walgreens now challenges. The district court didn’t explain how the supposed illegality of Virginia’s eligibility requirements rendered this misrepresentation immaterial or how it otherwise failed to state a claim. Further, the court explained it is also persuaded that Walgreens can’t avoid liability by collaterally challenging the eligibility requirements’ legality under a line of cases beginning with United States v. Kapp. Moreover, the court explained that Walgreens offers no good reason why a contract law (and even more specifically, a collective-bargaining-contract-law) rule should displace the liability created by the False Claims Act, a federal statute. Jerry Bainbridge, et al. v. Director of the Florida Division of Alcoholic Beverages and Tobacco
Over 20 years ago, a group of Florida wine consumers and an out-of-state winery (collectively, the “Plaintiffs”) sued the Director of the Florida Division of Alcoholic Beverages and Tobacco, alleging that certain provisions of Florida’s beverage laws unconstitutionally discriminated against out-of-state wineries. After the United States Supreme Court ruled a virtually identical statutory scheme unconstitutional, the Division agreed to the entry of a judgment declaring Florida’s direct shipment laws unconstitutional as applied to out-of-state “wineries.” The Division also agreed to an injunction prohibiting it from enforcing its direct shipment laws “against out-of-state vendors and producers.” Significantly, these last five words were absent from the parties’ proposed injunction and were added sua sponte by the district court. No one objected to the court’s addition of this language. However, 16 years later, the Division filed a motion in district court to “clarify and modify” the injunction. Specifically, the Division asked the district court to confirm that the injunction applied only to out-of-state wineries rather than out-of-state wine retailers generally. The district court denied the Division’s motion.
The Eleventh Circuit affirmed. The court explained that here, the district court expressly determined that the injunction the court entered “accurately reflects the intent of the parties and the Court.” Rule 60(a) does not allow a district court to rewrite its decision any time a party later contends that the language is ambiguous. Thus, the court held that the district court did not err by construing the Division’s motion as made under Rule 60(b)(1) instead of Rule 60(a). View "Jerry Bainbridge, et al. v. Green Development, LLC v. FERC
Petitioner Green Development, LLC (Green Development) sought interconnection with the distribution system of Narragansett Electric Company (Narragansett), a public utility. Accommodation of the increased flows of electricity required certain upgrades to the transmission system owned by Respondent-Intervenor New England Power Company d/b/a National Grid (NE Power). NE Power assigned the costs of the transmission system upgrades directly to Narragansett. The newly assigned costs were reflected in a revised transmission service agreement (TSA) that NE Power and Narragansett filed for approval by the Federal Energy Regulatory Commission (Commission or FERC). Green Development protested the revised TSA. The Commission denied Green Development’s protest. Green Development petitions for review contending that the Commission (1) erroneously concluded that Green Development’s arguments in the underlying section 205 proceeding operated as a “collateral attack” on the Complaint Order; (2) improperly applied the governing seven-factor test; (3) misinterpreted the Tariff’s definition of “direct assignment facilities”; and (4) erroneously failed to apply the filing procedures of Schedule 21-Local Service of the Tariff.
The DC Circuit denied the petitions. First, the court held that Commission has cured any purportedly erroneous ruling that Green Development’s section 205 protest constituted a collateral attack on the Complaint Order. The court rejected Green Development’s fourth claim. The court wrote that the issue with Green Development’s contention is that it presumes that the procedures in Schedule 21-Local Service are “mandatory processes” that applied to the filing of the TSA. But, the SIS and associated technical arrangements “pertain to initiating transmission service” and “do not demonstrate that Narragansett as an existing transmission customer was required to request new transmission service” under the Tariff. CARA JONES, ET AL V. GOOGLE LLC, ET AL
Google owns YouTube, an online video-sharing platform that is popular among children. Google’s targeted advertising is aided by technology that delivers curated, customized advertising based on information about specific users. Google’s technology depends partly on what Federal Trade Commission (“FTC”) regulations call “persistent identifiers,” information “that can be used to recognize a user over time and across different Web sites or online services.” In 2013, the FTC adopted regulations under COPPA that barred the collection of children’s “persistent identifiers” without parental consent. The plaintiff class alleged that Google used persistent identifiers to collect data and track their online behavior surreptitiously and without their consent. They pleaded only state law causes of action but also alleged that Google’s activities violated COPPA. The district court held that the “core allegations” in the third amended complaint were preempted by COPPA.
The Ninth Circuit reversed the district court’s dismissal of the third amended complaint on preemption grounds. The court remanded so that the district court can consider, in the first instance, the alternative arguments for dismissal to the extent those arguments were properly preserved. The panel held that state laws that supplement, or require the same thing as federal law, do not stand as an obstacle to Congress’s objectives, and are not “inconsistent.” The panel was not persuaded that the insertion of “treatment” in the preemption clause evinced clear congressional intent to create an exclusive remedial scheme for enforcement of COPPA requirements. The panel concluded that COPPA’s preemption clause does not bar state-law causes of action that are parallel to or proscribe the same conduct forbidden by COPPA. View "CARA JONES, ET AL V. Talarico Bros. Bldg. Corp., et al. v. Union Carbide Corp., et al.
Twenty-eight individuals and businesses commenced this citizen suit under the Resource Conservation and Recovery Act (“RCRA”), which creates a private right of action against any entity that has “contributed . . . to the past or present handling, storage, treatment, transportation, or disposal of any solid or hazardous waste which may present an imminent and substantial endangerment to health or the environment.” Plaintiffs complained of elevated levels of radiation detected on their land and seek to hold responsible three entities that operated nearby chemical plants during the twentieth century. The district court dismissed their complaints, holding, among other things, that the radioactive materials found on the plaintiffs’ properties fall outside the scope of RCRA because they were recycled industrial byproducts rather than discarded waste. Defendants raised a host of additional arguments in support of dismissal.
The Second Circuit affirmed in part, vacated in part, and remanded. The court explained that as to Defendants Union Carbide Corporation and Occidental Chemical Corporation, the complaint plausibly alleged the elements of a citizen suit under RCRA, or the Plaintiffs have identified extrinsic evidence that may render amendment fruitful. However, as against defendant Bayer CropScience Inc., there are no particularized allegations from which liability can reasonably be inferred. The court reasoned that there is one probative allegation implicating Bayer: Stauffer’s Lewiston plant was located within 2,000 feet of the Robert Street properties and within a mile of four of the Plaintiffs’ other properties. Colorado v. Center for Excellence in Higher Education
Colorado’s Attorney General and the Administrator of the Colorado Uniform Consumer Credit Code (“UCCC”) (collectively, “the State”) sought to enjoin the respondent corporate entities and individuals that made up the career school known as CollegeAmerica (collectively, “CollegeAmerica”) from engaging in conduct that the State believed to be in violation of Colorado law. Specifically, the State contended that several aspects of CollegeAmerica’s marketing and admissions operations constituted deceptive trade practices under the Colorado Consumer Protection Act (“CCPA”) and that CollegeAmerica’s institutional loan program, “EduPlan,” was unconscionable under the UCCC. The Colorado Supreme Court concluded, as did the division below, that the State’s CCPA civil penalty claims were equitable in nature and thus CollegeAmerica was not entitled to a jury trial on those claims. The Court further concluded the division erred in remanding this case for a new trial without first assessing whether CollegeAmerica had, in fact, had a full and fair opportunity to litigate the issue of significant public impact and, if so, whether the evidence sufficiently established such an impact. Finally, the Court concluded the division correctly determined that CollegeAmerica’s EduPlan loans as a whole were not unconscionable, although the Supreme Court disagreed with the division’s conclusion that individualized evidence regarding the probability of repayment was necessary to establish unconscionability. Naranjo v. Doctors Medical Center of Modesto, Inc.
Plaintiff filed a class action lawsuit against Medical Center seeking declaratory and injunctive relief and alleging violations of the unfair competition law (UCL) and the Consumer Legal Remedies Act (CLRA) in connection with Medical Center’s emergency room billing practices. Briefly summarized, Plaintiff alleged Medical Center’s practice of charging him (and other similarly situated patients) an undisclosed “Evaluation and Management Services Fee” (EMS Fee) was an “unfair, deceptive, and unlawful practice.” The trial entered judgment in favor of Defendants.
The Fifth Appellate District reversed. The court held that Plaintiff sought a declaration of the parties' rights and duties under the COA and their legal rights in connection with EMS Fee disclosures. An actual controversy is alleged and appears to exist. Plaintiff is entitled to seek declaratory relief in regard to each controversy stated. The court concluded he has adequately stated a cause of action for declaratory relief. The court wrote that on remand, the trial court will have the discretion to consider a motion by Plaintiff to amend the FAC to state a cause of action for breach of contract should Plaintiff choose to file one.
