Kleinbard, LLC v. Lancaster Co. DA
A law firm, Kleinbard LLC, provided legal services to the Lancaster County District Attorney's Office, led by then-District Attorney Craig Stedman, to challenge the county commissioners over the use of certain forfeiture assets. ESIMPLICITY, INC. v. US
The United States Department of the Navy issued a solicitation requesting technical support for its electromagnetic spectrum resources, requiring proposals to be submitted via email by a specified deadline. eSimplicity, Inc. submitted its proposal before the deadline, but it was not received by the Contracting Officer due to the email exceeding the maximum file size and being bounced back. The Navy deemed eSimplicity's proposal untimely and did not consider it.eSimplicity filed a pre-award bid protest with the United States Court of Federal Claims. The Claims Court ruled in favor of eSimplicity, concluding that the file size was an unstated evaluation criterion and that the government control exception could apply to electronically submitted proposals. ANCHORAGE v. US
The case involves a dispute between the municipality of Anchorage and the United States regarding two agreements related to the improvement of the Port of Alaska. In 2011, they signed a Memorandum of Agreement (2011 Memorandum) to address issues that arose during the project, including large-scale damage discovered in 2010.The United States Court of Federal Claims held that the United States breached the 2003 Memorandum by failing to deliver a defect-free port and the 2011 Memorandum by settling subcontractor claims without consulting Anchorage. The court awarded Anchorage $367,446,809 in damages, including $11,279,059 related to the settlement of subcontractor claims.The United States Court of Appeals for the Federal Circuit reviewed the case. The court found that the 2003 Memorandum did not require the United States to deliver a defect-free port, as it lacked specific terms such as what was to be built, where, dimensions, deadlines, and costs. The court vacated the Court of Federal Claims' decision regarding the 2003 Memorandum and remanded for further proceedings.However, the Federal Circuit affirmed the Court of Federal Claims' decision that the United States breached the 2011 Memorandum by settling subcontractor claims without conferring with Anchorage. The court upheld the award of $11,279,059 in damages to Anchorage for this breach. USA V. KING COUNTY
King County, Washington, issued Executive Order PFC-7-1-EO, which directed county officials to ensure that future leases at Boeing Field prohibit fixed base operators (FBOs) from servicing U.S. Immigration and Customs Enforcement (ICE) charter flights. This order was based on the county's disagreement with federal immigration policies. Following the issuance of the order, all three FBOs at Boeing Field ceased servicing ICE flights, forcing ICE to relocate its operations to Yakima Air Terminal, which increased operational costs and security concerns.The United States District Court for the Western District of Washington granted summary judgment for the United States, finding that the Executive Order violated both the Supremacy Clause’s intergovernmental immunity doctrine and a World War II-era contract reconveying Boeing Field to King County. The district court concluded that the Executive Order discriminated against the federal government and its contractors and breached the Instrument of Transfer, which required King County to allow the United States nonexclusive use of the landing area at Boeing Field.The United States Court of Appeals for the Ninth Circuit affirmed the district court’s decision. The Ninth Circuit held that the United States had Article III standing to bring the suit, as it had suffered concrete and particularized injuries due to the increased operational costs and imminent risk of future injury from the Executive Order. The court also found that the United States’ claims were ripe for adjudication.The Ninth Circuit concluded that the Executive Order violated the Instrument of Transfer by preventing ICE from using Boeing Field, thus breaching the contractual right of the United States to use the airport. Additionally, the court held that the Executive Order violated the intergovernmental immunity doctrine by improperly regulating federal operations and discriminating against the federal government and its contractors. Obert v State
Laura Marie Obert, a former Broadwater County Commissioner, was investigated by the Montana Department of Justice Division of Criminal Investigation (DCI) in 2015 for allegedly receiving unlawful overtime pay and potential ethics violations. In 2016, Obert entered a deferred prosecution agreement with the Assistant Attorney General, agreeing to repay the excess wages and abstain from voting on matters where she had a conflict of interest. In 2019, based on new allegations of violating the agreement, Obert was charged with felony theft and misdemeanor official misconduct. The district court dismissed these charges in 2021, finding Obert had complied with the agreement and there was insufficient evidence for the misconduct charge.Obert then sued the State of Montana and Broadwater County Attorney Cory Swanson, alleging breach of contract, bad faith, due process violations, and malicious prosecution. The First Judicial District Court dismissed her claims, leading to this appeal.The Montana Supreme Court reviewed the case and made several determinations. It reversed the lower court's dismissal of Obert's breach of contract and good faith and fair dealing claims, holding that these claims were not time-barred and did not accrue until the criminal charges were dismissed. STATE OF NEBRASKA V. SU
Several states challenged Executive Order 14026, which mandated a $15 minimum wage for federal contractors, and the Department of Labor (DOL) rule implementing it. The states argued that the executive order and the DOL rule violated the Federal Property and Administrative Services Act (FPASA) and the major questions doctrine, and that the DOL rule violated the Administrative Procedure Act (APA).The United States District Court for the District of Arizona dismissed the states' complaint and denied their request for a preliminary injunction. The district court concluded that the wage mandate did not violate the FPASA, the major questions doctrine did not apply, and the rule was not subject to arbitrary-or-capricious review under the APA because the DOL had to adopt the policy by executive order.The United States Court of Appeals for the Ninth Circuit reviewed the case and reversed the district court's dismissal of the complaint, vacated the denial of the preliminary injunction, and remanded for further proceedings. The Ninth Circuit held that the minimum wage mandate exceeded the authority granted to the President and DOL under the FPASA because the FPASA’s purpose statement does not authorize the President to impose a wage mandate without other operative language in the FPASA. The court also held that the major questions doctrine did not apply because the executive order was not a transformative expansion of authority. Finally, the court found that the DOL acted arbitrarily or capriciously by failing to consider alternatives to the $15 per hour minimum wage mandate, thus violating the APA. Hencely v. Fluor Corporation
In 2016, a suicide bombing occurred at the U.S. military base in Bagram Airfield, Afghanistan. The bomber, an Afghan national employed by a subcontractor of Fluor Corporation, detonated an explosive vest, injuring Specialist Winston Tyler Hencely, among others. Hencely sued Fluor, alleging negligence in supervision, entrustment, and retention of the bomber, and breach of contract with the U.S. Government.The U.S. District Court for the District of South Carolina granted judgment to Fluor on all claims. The court found that federal law preempted Hencely’s tort claims and that he was not a third-party beneficiary entitled to enforce the Government’s contract with Fluor. Hencely appealed these decisions.The United States Court of Appeals for the Fourth Circuit reviewed the case. The court affirmed the district court’s judgment, holding that the Federal Tort Claims Act’s combatant activities exception preempted Hencely’s state-law tort claims. The court concluded that Fluor was integrated into combatant activities and that the military retained command authority over Fluor’s supervision of Local Nationals at Bagram Airfield. The court also held that Hencely was not an intended third-party beneficiary of the contract between Fluor and the U.S. Government, as the contract did not express an intent to benefit individual soldiers or confer upon them the right to enforce its provisions.Thus, the Fourth Circuit affirmed the district court’s judgment, precluding Hencely’s tort claims and denying his breach of contract claim. GEORGIA DEPARTMENT OF PUBLIC SAFETY v. JUSTICE
Richard Andrew Justice filed a claim against the Georgia Department of Public Safety (DPS) for breach of an employment contract, alleging that DPS failed to pay him for overtime hours as required under the Fair Labor Standards Act (FLSA). Justice argued that the FLSA provisions were incorporated into his employment contract. BOEING COMPANY v. US

OAK GROVE TECHNOLOGIES, LLC v. US
