Plaintiff-appellant Terri Baker appealed the dismissal of this putative class action for lack of standing. She sued on behalf of herself and her son, S.F.B., to challenge Kansas laws and school district policies that: (1) required children to be vaccinated to attend school and participate in child care programs; and (2) provided a religious exemption from these requirements. She claimed these immunization laws and policies violated various federal and state constitutional provisions and statutes. Baker argued she and S.F.B. had standing because the immunization requirements and religious exemptions injured them in two ways: (1) the District misapplied Kansas law when it granted a religious exemption for S.F.B. to attend preschool despite being unvaccinated - her fear that the District would revoke S.F.B.'s religious exemption was an injury in fact that established standing; and (2) Baker "would like the option" of placing S.F.B. in a non-accredited private school (i.e., home school), school programs, or licensed child care - she contended Kansas law inhibited her from exercising these options and caused an injury in fact because she would be unable to secure a religious exemption for S.F.B. if she tried. The circuit court dismissed with prejudice a complaint relating to an alleged sexual assault of a minor at an Autauga County, Alabama school. Multiple requests for continuances were granted. The last such grant, the circuit court admonished it would not grant additional continuances "absent a showing of extraordinary circumstances." A few days later, plaintiffs moved for another continuance, citing a scheduling conflict involving mediation in a separate case in another county. The circuit court did not rule on the motion, instead issuing an order dismissing the case with prejudice. The Alabama Supreme Court determined the circuit court exceeded its discretion in dismissing S.C. and K.C.'s claims when there was no clear record of delay or contumacious conduct by the plaintiffs. "By contacting court personnel, the parties were attempting to find a date for the circuit court's convenience as well as to make sure that the case proceeded to the merits in a timely manner. . . . The union represents teachers and other professional employees at schools on U.S. military bases in Puerto Rico. In 2015, the federal agency and the union began negotiating a successor to an expired collective bargaining agreement (CBA). The union sought to continue workday provisions from the 2011 agreement. The agency sought to eliminate the dedicated hour for preparatory and professional tasks and to require teachers to be at school for that hour. The agency argued that these terms implicated its right to assign work (5 U.S.C. 7106(a)(2)(B) and were nonnegotiable. The Federal Service Impasses Panel factfinder concluded that the workday provisions were negotiable and recommended that the successor agreement maintain them; recommended terms to resolve other disputes, including new compensation terms; and recommended that the successor agreement incorporate all provisions on which the parties had already tentatively agreed. The Panel ordered the parties to adopt an entire CBA according to those recommendations.The Federal Labor Relations Authority held that the Panel lacked authority to impose the workday and agreed-to provisions. The Panel is authorized to resolve bargaining impasses but not to resolve antecedent legal questions about whether disputed provisions are negotiable. Those questions turn on the scope of the duty to bargain in good faith, which the Authority must determine. The D.C. Circuit affirmed those rulings but set aside a ruling that the workday provision imposed by the Panel infringed the agency’s statutory right to assign work. Appellant Derrick Lingnaw, a registered sex offender, sought declaratory relief from the district court asking whether he could legally reside on his property. The district court found Lingnaw’s residence was within five hundred feet of property on which a school was located, as that term was used in Idaho Code section 18-8329(1)(d). The court thus denied Lingnaw’s request to enjoin the Custer County Sheriff, Stuart Lumpkin, from interfering with Lingnaw’s ability to reside on his property. The court also denied Sheriff Lumpkin’s request for attorney fees and costs. On appeal, the parties mainly disputed the district court’s finding that Lingnaw’s residence was within five hundred feet of a school. After review, the Idaho Supreme Court affirmed the district court's ruling that Lingnaw's property was within five hundred feet of property on which a school was located. Lingnaw raised a question of fact as to whether the building, ruled as a "school," was simply a gymnasium and building leased by the Bureau of Land Management (“BLM”); Lingnaw argued the plain meaning of “school” required some form of traditional educational instruction. The trial court found “that the gymnasium, as contemplated by the statute, is a school building utilized by the school for school functions on a regular basis . . . for sporting events and other school activities. And children are coming and going from that building on a regular basis.” Because it was “clear from the evidence” that Lingnaw’s property fell “well within” five hundred feet or the buildings’ property line, the district court found that Lingnaw lived within five hundred feet of a school. The issue presented in this declaratory action before the South Carolina Supreme Court in its original jurisdiction was a challenge to the constitutionality of Governor Henry McMaster's allocation of $32 million in federal emergency education funding for the creation of the Safe Access to Flexible Education ("SAFE") Grants Program. Petitioners contended the program violated South Carolina's constitutional mandate prohibiting public funding of private schools. The Supreme Court held the Governor's decision constituted the use of public funds for the direct benefit of private educational institutions within the meaning of, and prohibited by, Article XI, Section 4 of the South Carolina Constitution. "Even in the midst of a pandemic, our State Constitution remains a constant, and the current circumstances cannot dictate our decision. On October 25, 2011, Appellant Nicole B.’s then-eight-year-old son N.B. was sexually assaulted by three of his male fourth-grade classmates in a bathroom at his public elementary school in the City of Philadelphia. According to Appellant, N.B. had endured two months of pervasive physical and verbal harassment at school leading up to the sexual assault. During that time, both Appellant and N.B. reported the harassment to his teacher and to school administrators, to no avail. In November 2011, Appellant withdrew N.B. from the elementary school after learning of the attack. Over two years later, in 2014, Appellant filed an administrative complaint with the Human Relations Commission against the Philadelphia School District (“District”) in her individual capacity and on N.B.’s behalf, asserting claims of discrimination on the basis of gender and race under the Pennsylvania Human Relations Act (“PHRA”). The Human Relations Commission rejected Appellant’s complaint as untimely, because it was filed beyond the 180-day time limit. In this appeal by allowance, the Pennsylvania Supreme Court considered whether principles of equitable tolling found in PHRA, or Pennsylvania’s Minority Tolling Statute (“Minority Tolling Statute”), applied to an otherwise untimely complaint. After review, the Supreme Court found the PHRA’s equitable tolling provision applied to a minor whose parent failed to satisfy the applicable statute of limitations for filing an administrative complaint prior to the minor reaching the age of majority. Cynthia Anthony, former interim president of Shelton State Community College; William Ashley, then-president of Shelton State; and Jimmy Baker, chancellor of the Alabama Community College System ("the ACCS") (collectively, "the college defendants"), appealed a circuit court judgment entered in favor of Khristy Large and Robert Pressley, current instructors at Shelton State, and Scheree Datcher, a former instructor at Shelton State (collectively, "the instructor plaintiffs"). Large and Pressley were instructors in the Office Administration Department ("OAD") at Shelton State; Datcher was an OAD instructor, now retired. Under college policy, an instructor was placed into one of three groups based on the instructor's "teaching area": Group A, Group B, or Group C. After an instructor was placed into a group, the instructor was ranked within the group for salary purposes according to criteria listed in the policy. The primary issue in this case was whether the instructor plaintiffs should be placed in Group A or Group B. In 2013, Joan Davis, then-interim president of Shelton State, concluded that Datcher and Pressley should have been reclassified from Group A to Group B, contrary to their credentialing document. Datcher and Pressley received higher salaries by being reclassified to Group B. When Large was hired to be an OAD instructor in 2013, she was also placed in Group B. In 2016, Chancellor Heinrich directed Anthony, then interim president, to review instructors' classifications to make sure they were properly classified. Anthony determined the instructor plaintiffs should have been classified as Group A, in accordance with the credentialing document. Thus, she reclassified the instructor plaintiffs to Group A, which resulted in decreased salaries. The trial court entered a judgment in favor of the instructor plaintiffs, concluding that they are properly classified in Group B under the policy and ordering that the instructor plaintiffs be placed in Group B. The trial court also awarded the instructor plaintiffs backpay for the period following Anthony's reclassification, during which they were classified as Group A instead of Group B. The Alabama Supreme Court determined the placement of OAD instructors in Group A was "plainly incorrect." Because the college defendants lacked discretion to classify the instructor plaintiffs as Group A, the claims for backpay against them in their official capacities were not barred by the doctrine of State immunity. When Anthony left her position as interim president, her successor was automatically substituted for her with respect to the official-capacity claims alleged against her; judgment should not have been entered against her. Jane Doe appealed the dismissal of her Title IX claim against School District No. 1, Denver, Colorado (the District or DPS) for failure to state a claim. According to the complaint, a group of students began sexually harassing Ms. Doe after she was sexually assaulted by another student in March of her freshman year at East High School (EHS). She alleged that despite her numerous reports of the harassment to school personnel, as well as reports from teachers and a counselor, the school administration never investigated her complaints and little if anything was done to prevent the harassment from continuing. She stopped attending regularly scheduled classes about 14 months after the assault, and she transferred to a different school after completing her sophomore year. The Tenth Circuit reversed and remanded, finding Ms. Doe's complaint contained sufficient allegations to support an inference of deliberate indifference. View "Doe v. In February 2017, students at Rubidoux High School (RHS) participated in a protest; approximately one quarter of the student body boycotted school for a day. Plaintiff-appellant, Patricia Crawford, a guidance counselor at RHS, criticized the students who boycotted in an e-mail to a colleague and by leaving several comments on a RHS teacher’s public Facebook post that was similarly critical of the boycotting students. Some students and others considered the post and Crawford’s comments on the post to be offensive. The Facebook post “went viral,” and a public outcry against Crawford and other RHS teachers’ comments ensued, resulting in nationwide media attention, a RHS student protest against the teachers, and a flurry of e-mails to RHS administration from the public. Real party in interest, Jurupa Unified School District (the District), dismissed Crawford on the grounds that her conduct was “immoral” and showed that she was “evidently unfit for service” under Education Code section 44932. Defendant-respondent, the Commission on Public Competence of the Jurupa Unified School District (CPC), upheld Crawford’s dismissal, as did the trial court. On appeal, Crawford suggested there were three fixed categories of conduct that constituted "immoral conduct" as a matter of law, and her conduct did not fit into any of them. To this, the Court of Appeal disagreed: "A teacher’s conduct is therefore 'immoral' under [Education Code] section 44932 (a)(1) when it negatively affects the school community in a way that demonstrates the teacher is 'unfit to teach.'" The Court affirmed the trial court's finding that the weight of the evidence supported CPC's finding that Crawford engaged in immoral conduct and was evidently unfit to serve. View "Crawford v. Congress enacted an appropriations rider in 2009 prohibiting the District of Columbia from paying more than $4,000 in attorneys' fees for any past proceeding under the Individuals with Disabilities Education Act (IDEA). At issue in these 11 consolidated cases was whether the District must pay interest on amounts that exceed the payment cap.After determining that the District did not forfeit the interest issue, the court held that the District cannot be compelled to pay interest on the portion of fee awards that it has been legally prohibited from paying off. The court explained that this case implicates a well-established common-law principle: If the law makes a debt unpayable, then interest on the debt is also unpayable. Furthermore, the court had no basis to conclude that 28 U.S.C. 1961(a) abrogated this background rule. The court reversed the district court's judgment requiring payment of interest on above-cap fees, affirmed the district court's judgment in all other respects, and remanded for further proceedings.
