Sheehy v. Commissioner of Political Practices
The Supreme Court affirmed in part and reversed in part the judgment of the district court reversing the Montana Commissioner of Political Practices' summary decision of complaint without informal contested case hearing against Montana Board of Regents of Higher Education member Martha Sheehy, holding that Sheehy did not violate the Montana Code of Ethics, that the Commissioner lacks enforcement authority over regents, and that regents are public employees subject to the Ethics Code.The Commissioner concluded that Regents are public employees subject to the Commissioner's Ethics Code enforcement authority and that Sheehy violated the Ethics Code by soliciting support for a ballot issue while suing public time, facilities, and equipment. The district court overruled the Commissioner's summary decision, concluding that the Ethics Code does not apply to regents, that the Commissioner lacked enforcement authority over regents, and that Sheehy's statements did not violate the Ethics Code. The Supreme Court reversed in part, holding (1) the Ethics Code applies to the Board of Regents of the Montana University System; (2) Sheehy did not violate the Ethics Code; and (3) the Commissioner does not have authority to enforce the Ethics Code against members of a state administrative board, like the Board of Regents. Pearl River County Board of Supervisors v. Mississippi State Board of Education
Poplarville School District and Pearl River County sought to undo the July 1, 2018 consolidation of the Lumberton Public School District and the Lamar County School District. In 2016, the Mississippi Legislature adopted Senate Bill 2500, which, after being signed into law, was codified as Mississippi Code Section 37-7-104.5, the purpose of which was to administratively dissolve, consolidate, and split the Lumberton Public School District at the Lamar and Pearl River County line. The statute created the Commission on the Administrative Consolidation of the Lumberton Public Schools to work in conjunction with the Mississippi State Board of Education to accomplish the consolidation goal. However, Poplarville School District contended that instead of following the directive of Section 37-7-104.5, the Commission dissolved the Lumberton School District and consolidated all of it, to include the students who reside in Pearl River County, into the Lamar County School District. The Mississippi Supreme Court determined the Pearl River County Board of Supervisors was a “person aggrieved” for purposes of Section 37-7-115, publication was not necessary pursuant to Section 37-7-115, and Section 37-7-115 was an exclusive remedy. Furthermore, the Court held the chancery court did not err by finding that the appeal was untimely filed pursuant to Section 37-7-115, and affirmed the chancery court's decision. Graham v. Friedlander
The Supreme Court affirmed the judgment of the trial court denying certain defendants' motion to dismiss Plaintiffs' complaint, holding that Defendants were not entitled to sovereign immunity.Plaintiffs, the parents of four school-age children diagnosed with autism spectrum disorder, brought this action seeking judgment from the City of Norwalk's Board of Education and three of its members. Plaintiffs alleged that the negligent hiring and supervision of Stacy Lore, who was hired to provide autism related services to children in the school district, proximately caused them to suffer permanent and ongoing injuries and losses. The Board filed a motion to dismiss for lack of jurisdiction and, in the alternative, claiming that the doctrine of sovereign immunity mandated dismissal of the claims. The trial court granted the motion to dismiss on the ground that Plaintiffs had failed to exhaust their administrative remedies. The Supreme Court affirmed but on other grounds, holding (1) the trial court improperly dismissed this action on the ground that Plaintiffs had not exhausted their administrative remedies; and (2) the Board and its members were not entitled to sovereign immunity because they were acting under the control of, and as an agent of, the municipality rather than the state. Melnyk v. Board of Education of the Delsea Regional High School District
By calling a teacher’s instructional work in a specialized and separate school district educational program, provided outside of regular school instructional hours, an “extracurricular assignment,” the school district claimed the teacher had no tenure protection to that position and had no recourse when she was replaced by a non-tenured teacher and suffered a loss in compensation. The district wrapped the label “extracurricular” around the assignment even though the after-hours instructional program was provided by the school district in order to fulfill core curriculum requirements for certain students unable to fulfill those requirements through the school district’s day program. The teaching position in which petitioner served in the alternative education program was tenure eligible. Indeed, the Board of Education and the Commissioner both conceded that a person serving in that “BookBinders” position exclusively for the requisite period of time would have been entitled to tenure. But petitioner was denied tenure because she already held tenure in a teaching position in the district’s regular-education day-instruction program. After review, of the Commissioner of Education’s decision regarding the teacher’s tenure, the New Jersey Supreme Court concluded petitioner met the statutory criteria for tenure, and that she was entitled to a remedy for the violation of her right not to be removed or reduced in salary while protected by tenure for her work in the BookBinders program. Visalia Unified School District v. Superior Court of Tulare County
Real party in interest filed suit against the school district and two individuals for, inter alia, retaliation in violation of the Reporting by School Employees of Improper Governmental Activities Act. The trial court subsequently denied the school district's motion to strike the punitive damages allegations from the complaint and held that the Act supersedes Government Code section 818.The Court of Appeal held that Government Code section 818 prohibits the imposition of punitive damages against school districts sued under the Act, and the trial court therefore erred in denying the motion to strike the punitive damage allegations as to the school district from the complaint. Accordingly, the court directed the trial court to strike the punitive damage allegations as to the school district from the complaint. View "Visalia Unified School District v. Physicians Com. for Responsible etc. v. L.A. Unified School Dist.
Physicians Committee for Responsible Medicine (Physicians Committee) filed a petition for writ of mandate seeking to prohibit local educational agencies Los Angeles Unified School District (LAUSD) and Poway Unified School District (PUSD) from serving processed meats in their schools, and directing them to modify wellness policies to reflect the goal of reducing or eliminating processed meats. The local educational agencies demurred, arguing they were under no statutory obligation to reduce or eliminate processed meat from schools. The trial court granted the demurrers. Physicians Committee appealed, contending the local educational agencies' failure to reduce or eliminate processed meat from schools abused their discretion in developing statutorily-mandated, local wellness policies. Division of Justice & Community Service v. Fairmont State University
The Supreme Court affirmed the decision of the circuit court reversing the decision of the state agency that oversees law-enforcement training refusing a state university's application seeking authorization to establish and operate a new law enforcement training academy for senior university students majoring in criminal justice studies, holding that the circuit court did not err.In denying the university's application to create a new law enforcement training academy the state agency concluded that the university's proposed academy was not necessary. The circuit court reversed the state agency's decision and ordered that the agency approve the university's application, finding that the agency's decision was arbitrary, capricious, and unsupported by law. The Supreme Court affirmed, holding that the agency's decision to deny the university's application to establish and operate an entry-level law enforcement training academy was arbitrary, capricious, and not supported by any statutory authority. Zeyen v. Pocatello/Chubbuck School Dist 25
The named plaintiff, Mike Zeyen sought declaratory relief and recovery of damages from Pocatello/Chubbuck School District No. 25 on behalf of all students currently enrolled in the district and their guardians. Zeyen alleged that School District 25’s practice of charging fees violated Article IX, section 1, of the Idaho Constitution. Zeyen first sought to certify the class to include all students within School District 25. Zeyen’s later motion to amend sought to add a takings claim under both the Idaho and U.S. Constitutions. The district court denied Zeyen’s motion for class certification based on lack of standing and denied his motion to amend both as untimely and prejudicial to School District 25. The Idaho Supreme Court determined Zeyen failed to show that the district court abused its discretion by denying his second motion for leave to amend the complaint. Furthermore, the Court determined Zeyen lacked standing to bring his class action suit. The Court therefore affirmed the district court's denial of Zeyen's motion to certify the class and denial of his motion for leave to amend the first amended complaint. View "Zeyen v. Jones v. City of Canton, Mississippi
Walter Jones appeals the order of the Circuit Court of Madison County affirming his removal as trustee of the Canton Public School District (CPSD) by the Board of Aldermen (the Board) of the City of Canton (the City). Jones argued the Board lacked the authority to remove him as a public official. Finding that the Board’s actions were prohibited by the Mississippi Constitution, the Mississippi Supreme Court agreed: because the Board’s authority was based on a city ordinance inconsistent with the Mississippi Constitution and because the Board’s action violated Jones’s right to due process, the Supreme Court reversed the circuit court’s decision to affirm the Board’s removal of Jones as school-board trustee. I. T. K. v. Mounds Public Schools
Plaintiff, a child, by and through his parents, brought a Governmental Tort Claims Act action alleging he was injured through the negligence of a school bus driver. The child was taken to a hospital emergency room, given several diagnostic tests, and treated with 4 staples for one laceration and Dermabond for another. When he filed his District Court action more than one year later he alleged he had medical-related expenses in the amount of $6,209.30, and potential unknown medical expenses as a result of being hit by the bus. Further, he alleged pain and suffering and sought a sum in excess of $10,000. The three basic questions raised on application for certiorari review by the Oklahoma Supreme Court were: (1) whether an Oklahoma Governmental Tort Claims notice sent by certified mail to a superintendent of a public school statutorily sufficient; (2) whether an insurance adjuster's request for more information tolled the GTCA time limits if the request also stated an intent for tolling to not occur; and (3) whether a unilateral request by plaintiff for settlement negotiations tolled the GTCA time limits. The Supreme Court held plaintiff's Governmental Tort Claims Act (GTCA) notice of claim sent to the correct school superintendent by certified mail satisfied the requirement in 51 O.S. 156(D) for filing the GTCA notice with the office of the clerk of the school's board of education, although the superintendent did not transmit the notice to the proper clerk for filing. Further, the Court held the insurance adjuster's request for additional information did not toll the 90-day time limit for approval, denial, or deemed denial of the GTCA claim when the request expressly stated it would not extend or waive the GTCA time limits. Finally, the Court held a plaintiff's letter unilaterally seeking settlement negotiations was not an agreement pursuant to 51 O.S. 157 to toll the GTCA time limits. View "I. T. K. v.
