In 2010, the Colorado General Assembly enacted Senate Bill 10-191 (SB 191), which significantly amended Teacher Employment, Compensation, and Dismissal Act of 1990 (TECDA) provisions concerning teacher contracts and the transfer process. SB191 eliminated the earlier practice of transferring teachers to schools without the consent of the principal of the recipient school. Under SB 191, nonprobationary teachers who were deemed effective during the prior school year and who have not secured a mutual consent placement become members of a “priority hiring pool” for available positions. However, nonprobationary teachers who were unable to secure such a position after the longer of twelve months or two hiring cycles are placed on unpaid leave until they are able to secure an assignment. Defendant-Petitioner School District No. 1 in the City and County of Denver (DPS) sought review of the trial court’s denial of its motion to dismiss Plaintiff-Respondent Rebecca Reeves-Toney’s constitutional challenge to the “mutual consent” provisions of section 22-63-202(2)(c.5) of the TECDA. Reeves-Toney alleged these provisions violated the local control clause of article IX, section 15 of the Colorado Constitution by delegating local school boards’ hiring decisions to principals and other administrators. DPS moved to dismiss Reeves-Toney’s complaint, arguing, among other things, that she lacked standing to bring her claim. The trial court agreed that Reeves-Toney lacked individual standing, but nevertheless concluded that she sufficiently alleged taxpayer standing to challenge section 22-63-202(2)(c.5) and plausibly alleged that the statute was facially unconstitutional. The court thus denied the motion to dismiss. The Colorado Supreme Court determined Reeves-Toney did not allege an injury based on an unlawful expenditure of taxpayer money, thus failing to demonstrate a clear nexus between her status as a taxpayer and the challenged government action. Reeves-Toney therefore lacked taxpayer standing to bring her constitutional challenge to section 22-63-202(2)(c.5). Defendant-Appellant Harrison School District No. 2 asks us to reverse the district court’s ruling that it violated the Individuals with Disabilities Education Act (IDEA) by failing to provide Plaintiff-Appellee Steven R.F. with a free appropriate public education. The Tenth Circuit concluded this case was moot “[b]ecause the status quo remained in effect from the time [the parents] challenged the school district’s attempt to modify the IEP, they de facto received the relief they originally sought . . . ; the modified IEP never took effect.” And there was no evidence that the asserted IDEA violation was likely to occur again. The First Circuit affirmed the judgment of the district court upholding a decision of the Massachusetts Bureau of Special Education Appeals (BSEA) ruling that the Natick Public School District had complied with the "free appropriate public education" (FAPE), "least restrictive environment" (LRE), and transition requirements in proposed individualized education programs (IEP) for C.D., holding that the district court did not err.Under the Individuals with Disabilities Education Act (IDEA) and Massachusetts law, the IEPs of certain disabled students must contain, in addition with FAPE and LRE requirements, postsecondary transition goals and services based on age-appropriate assessments. Appellants were C.D., who qualified as a child with a disability under the IDEA, and her parents. Appellants filed a complaint with the BSEA seeking reimbursement for C.D.'s tuition at a specialized private school. The BSEA denied Appellants' request. The district court affirmed. The First Circuit affirmed, holding that the district court (1) applied the correct legal standards; (2) properly ruled that the IEPs did not violate the LRE mandate; and (3) did not err in affirming the BSEA's ruling that the IEPs complied with the statute's transition provision. The Washington South Education Association was the representative of all licensed teachers within the Northfield schools. The Northfield School Board and the Association negotiated and entered into the CBA, which was in effect from July 1, 2017 to June 30, 2018. Paul Clayton was a middle-school physical-education teacher at the Northfield Middle High School (the School) and was a member of the Association. Therefore, Clayton’s employment was subject to the CBA. In late fall 2017, administrators at the School received complaints about Clayton’s workplace conduct. The complaints alleged that Clayton created a hostile work environment by intimidating his colleagues and advised a student (his daughter) to punch another student in the face. In response to the allegations, Clayton was placed on paid leave while the administrators investigated the complaints and interviewed a number of the School’s staff. Upon the conclusion of their investigation, the administrators wrote a letter to the School’s superintendent describing their findings and noting that while they gave Clayton the opportunity to respond, Clayton declined to respond in a follow-up meeting and then a second meeting scheduled to receive his rebuttal a few days later. After receiving the administrators’ letter, the superintendent wrote a letter to Clayton offering him an opportunity to meet with her to discuss the matter, and attached to the letter a summary of the allegations against Clayton. About a week later, the superintendent met with Clayton and his Association representation. Clayton did not file a notice of appeal of his ultimate suspension. Shortly thereafter, Clayton and the Association, now represented by the Vermont affiliate of the National Education Association (Vermont-NEA), submitted a grievance alleging a violation the CBA. The Board declined to accept the grievance, noting Clayton did not follow the prescribed termination procedures outlined in the CBA. Vermont-NEA thereafter invoked the CBA's arbitration procedures. A trial court agreed with the Board, and Clayton and the Association appealed. The Vermont Supreme Court determined Clayton and the Association failed to exhaust statutory remedies as required by 16 V.S.A. 1752, thus the trial court properly enjoined arbitration. The Wilcox County Board of Education ("the Board"), and Board members Lester Turk, Donald McLeod, Joseph Pettway, Jr., and Shelia Dortch (collectively, "the Board members"), petitioned the Alabama Supreme Court for a writ of mandamus to direct the Wilcox Circuit Court to vacate its order denying their motion to dismiss the claims against them based on immunity and to enter an order granting that motion. In 2017, Kimberly Perryman, as guardian and next friend of her minor son, R.M., sued the Board, and J.E. Hobbs Elementary School principal Roshanda Jackson, and teacher Timothy Irvin Smiley. Perryman alleged in 2016, Smiley, "in a fit of rage and unprovoked, did lift the Plaintiff R.M. and slam him down upon a table, with such force as to break said table." Perryman further alleged in her rendition of the facts that "Smiley was in the habit of continuously and repeatedly using harsh, physical and otherwise inappropriate tactics on the students in his class" and that "Smiley's behavior was known or should have been known to the Principal Defendant and the School Board Defendant[]." Perryman asserted claims of assault and battery and intentional infliction of emotional distress against Smiley; claims of negligence and negligent/wanton hiring, training, retention, and supervision against Jackson; and a claim of negligence against the Board. Specifically, the negligence claim against the Board stated: "The ... Wilcox County Board of Education negligently breached [its] dut[y] to R.M. by failing to supervise, discipline or remove if necessary, the Defendant teacher [Timothy Smiley], thereby placing the Plaintiff R.M. in harm's way." The Alabama Supreme Court concluded the Board and the Board members in their official capacities were entitled to immunity from the state-law claims asserted against them; the Board members in their individual capacities were entitled to State-agent immunity from any state-law claims asserted against them; and that the Board members in their individual capacities were entitled to qualified immunity from the 42 U.S.C. 1983 claim asserted against them. Therefore, the circuit court should have dismissed Perryman's claims with respect to those parties, and to that extent the petition for mandamus relief was granted. However, the Board and the Board members in their official capacities were not entitled to Eleventh Amendment immunity from the section 1983 claim, and the petition was denied with respect to that claim. Alabama Public Charter School Commission members Mac Buttram, Charles Jackson, Lisa Williams, Melinda McLendon, Terri Tomlinson, Tommy Ledbetter, Melissa Kay McInnis, Chad Fincher, Henry Nelson, and Ibrahim Lee (collectively, "the Commission members"); LEAD Education Foundation ("LEAD"); and Ed Richardson, former interim State Superintendent of Education (with the Commission members, referred to collectively as "defendants"), separately appealed the grant of summary judgment entered in favor of the Alabama Education Association ("the AEA"), Vicky Holloway, and Felicia Fleming (collectively, "plaintiffs"). In 2017, LEAD submitted an application to the Alabama Public Charter School Commission ("the Commission") seeking to open a public charter school beginning in the 2018-2019 school year. In 2018, the Commission conducted an open meeting, with seven out of nine members present. Neither Holloway, Fleming, nor an AEA representative was present at the meeting, and no private citizens voiced any opposition to LEAD's application. At the conclusion of the meeting, the Commission voted 5-1 to approve LEAD's application. On March 15, 2018, the Commission adopted a resolution approving LEAD's application. On March 5, 2018, plaintiffs filed a complaint seeking declaratory and injunctive relief against the Commission members, Richardson, and LEAD, seeking among other things, to invalidate the Commission's 5-1 decision to approve LEAD's application to open a public charter school. Plaintiffs alleged, among other things, defendants did not have a quorum vote, and that the Commission violated the ASCSOA by not rejecting what they called a "weak or inadequate charter application." Extending "great weight and deference" to the interpretation of the ASCSOA by the Commission as the implementing agency, the Alabama Supreme Court concluded the Commission's interpretation of the ASCSOA as requiring an 11th member only when the local school board is an authorizer to be reasonable. The local school board was not an authorizer at the time the Commission considered the charter-school application. Thus, the Commission did not violate the ASCSOA by failing to include an 11th member. Furthermore, the Court concluded that, to the extent the circuit court denied defendants' motions for summary judgment with respect to plaintiffs' claim that the Commission violated the ASCSOA by voting as a majority of a quorum, the circuit court's decision was incorrect as a matter of law. Mother appealed an order concluding that her children were children in need of care or supervision (CHINS) due to educational neglect. In April 2018, the State filed a petition alleging that B.C., born in January 2007, Bo.B., born in May 2012, and Br.B., born in April 2013, were CHINS for lack of proper education necessary for their well-being. B.C. had been referred to an educational support team because she was not meeting certain achievement levels in her educational program. In prior years, there had been three educational neglect/truancy assessments involving B.C. In January 2018, the assistant principal reported to the Department for Children and Families (DCF) that B.C. had missed twenty-two days and Bo.B. had missed thirty-two days of school and all absences were unexcused. By March 2018, B.C. and Bo.B. had missed thirty-eight and fifty days of school, respectively. DCF contacted mother, who asserted that the absences were occurring because she was not receiving sufficient support from the school, the children were often absent due to illness, and transportation was a barrier. When asked, mother did not appear to understand the details of Bo.B.’s Individualized Education Plan (IEP). DCF set up a plan to implement services through NCSS in March, however, mother cancelled the meeting. The court found that the three children were CHINS due to the parents’ inability to provide for the children’s educational needs. The court found that the children’s absences resulted in missed educational opportunities that put them at risk of harm, especially in light of their needs. On appeal, mother argued: (1) the court erred in not requiring the State to demonstrate that the children’s absences were without justification; (2) the evidence did not support the court’s finding that missing school caused the children harm; (3) the existence of IEPs for the two young children, who were not legally required to attend school, did not support a finding of educational neglect; and (4) the court erred in admitting the school attendance records. The Vermont Supreme Court affirmed as to B.C. and reversed and remanded the CHINS determinations as to Bo.B. and Br.B. In 1998, petitioner Christal Fields pled guilty to attempted second degree robbery for trying to snatch a woman's purse. As a result, Fields was permanently disqualified from working at any licensed childcare facility in Washington pursuant to Department of Early Learning (DEL) regulations. At issue in this case was the extent to which a criminal record could preclude a person from supporting herself through lawful employment in her chosen field. The Washington Supreme Court held DEL's regulations prohibiting any individualized consideration of Fields' qualifications at the administrative level violated her federal right to due process as applied. Five African-American women on the basketball team at California State University at San Marcos (CSUSM) sued their head coach and the Board of Trustees of the California State University, claiming the coach engaged in race-based discrimination and retaliation: derogatorily referring to them as "the group," reduced their playing time, afforded them fewer opportunities, punished them more severely and generally singled them out for harsher treatment as compared to their non-African-American teammates. The trial court granted both motions for summary judgment filed by the Board, concluding plaintiff Danielle Cooper's claims were untimely and that the remaining plaintiffs could not show a triable issue on the merits. The Court of Appeal reversed summary judgment and directed the court to enter a new order granting summary adjudication on some, but not all, of plaintiffs' claims: plaintiffs cannot sue the Board under 42 United States Code sections 1981 and 1983 because CSUSM was not a "person" subject to suit under those statutes. With regard to the remaining claims brought by the four "freshmen plaintiffs," summary adjudication was improper as to their racial discrimination claims under title VI of the Civil Rights Act of 1964 and the Unruh Civil Rights Act. The Board did not meet its moving burden to show the lack of a triable issue as to whether these plaintiffs suffered a materially adverse action under circumstances suggesting a racially discriminatory motive. For similar reasons, summary adjudication was improper on title VI retaliation claims brought by three of the four freshmen plaintiffs, Lynette Mackey, Kianna Williams, and Sierra Smith: each of these women complained about the coach's discriminatory treatment and indicated how they suffered adverse consequences as a result. The Court reached a different conclusion as to plaintiff Crystal Hicks, who never made a complaint and denied facing any consequences as a result of complaints made by her peers. View "Mackey v. Southwestern Community College District (District) and its governing board (Board) (together Southwestern) demoted Arlie Ricasa from an academic administrator position to a faculty position on the grounds of moral turpitude, immoral conduct, and unfitness to serve in her then-current role. While employed by Southwestern as the director of Student Development and Health Services (DSD), Ricasa also served as an elected board member of a separate entity, the Sweetwater Union High School District (SUHSD). The largest number of incoming District students were from SUHSD, and the community viewed the school districts as having significant ties. As a SUHSD board member, Ricasa voted on million-dollar vendor contracts to construction companies, such as Seville Group, Inc. (SGI) and Gilbane Construction Company, who ultimately co-managed a bond project for the SUHSD. Before and after SGI received this contract, Ricasa went to dinners with SGI members that she did not disclose on her Form 700. Ricasa's daughter also received a scholarship from SGI to attend a student leadership conference that Ricasa did not report on her "Form 700." In December 2013, Ricasa pleaded guilty to one misdemeanor count of violating the Political Reform Act, which prohibited board members of local agencies from receiving gifts from a single source in excess of $420. Ricasa filed two petitions for writs of administrative mandamus in the trial court seeking, among other things, to set aside the demotion and reinstate her as an academic administrator. Ricasa appealed the denial of her petitions, arguing the demotion occurred in violation of the Ralph M. Brown Act (the Brown Act) because Southwestern failed to provide her with 24 hours' notice of the hearing at which it heard charges against her, as required by Government Code section 54957. Alternatively, she argued the demotion was unconstitutional because no nexus existed between her alleged misconduct and her fitness to serve as academic administrator. Southwestern also appealed, arguing that the trial court made two legal errors when it: (1) held that Southwestern was required to give 24-hour notice under the Brown Act prior to conducting a closed session at which it voted to initiate disciplinary proceedings, and (2) enjoined Southwestern from committing future Brown Act violations. The Court of Appeal concluded Southwestern did not violate the Brown Act, and that substantial evidence supported Ricasa's demotion.
