Newsome v. Superior Court (Gallagher)
In May 2020, the chairs of the California Assembly and Senate committees that consider election-related matters prepared a formal letter to Governor Gavin Newsom indicating they were working on legislation to ensure Californians could vote by mail in light of the emergency occasioned by COVID-19. The Governor issued Executive Order No. N-64-20 on May 8, 2020, which required all voters to be provided vote-by-mail ballots. That order affirmed, however, that the administration continued to work “in partnership with the Secretary of State and the Legislature on requirements for in-person voting opportunities and how other details of the November election will be implemented” and “[n]othing in this Order is intended, or shall be construed, to limit the enactment of legislation on that subject.” The order was signed on June 3, 2020. The issue presented for the Court of Appeal's review concerned an order of the Sutter County Superior Court, entered on June 12, 2020, granting a temporary restraining order against the Executive Order, finding it constituted “an impermissible use of legislative powers in violation of the California Constitution and the laws of the State of California.” The Court of Appeal determined there was no basis for the superior court to grant real parties in interest relief using ex parte procedures prescribed by California law. "The hearing on the ex parte application, conducted only one day after the underlying action was filed in superior court, was held without proper notice to the Governor or his appearance. Apart from these procedural deficiencies, real parties in interest also failed to make the requisite substantive showing for use of an ex parte proceeding. In short, the real parties in interest failed to present competent evidence establishing imminent harm from the Governor’s executive order requiring immediate action." View "Newsome v. Buel/Markley v. Rosenblum
By Legislative Referendum (LR) 401 (2020), the Oregon legislature asked voters to approve or reject a constitutional amendment that would permit the legislature, local governments, and the people through the initiative process to pass laws regulating campaign finance and advertising. As provided in Oregon Laws 2019, chapter 674, section 1, a joint legislative committee drafted the ballot title and explanatory statement for LR 401. In consolidated cases, petitioners sought review of the ballot title and the explanatory statement. Petitioner Markley challenged all parts of the ballot title, contending that the caption, “yes” and “no” result statements, and the summary did not comply with the requirements set out in ORS 250.035(2). Petitioner Buel challenged the ballot title summary and the explanatory statement. After the parties completed briefing on petitioners’ challenges, this court decided Multnomah County v. Mehrwein, 366 Or 295, 462 P3d 706 (2020), in which the Oregon Supreme Court concluded that a Multnomah County ordinance limiting campaign contributions was not subject to a facial challenge under Article I, section 8, of the Oregon Constitution. That decision overruled, in part, the court’s earlier decision in Vannatta v. Keisling, 931 P2d 770 (1997), which held that certain statutes that provided for, among other things, mandatory limits on contributions to state political campaigns, violated Article I, section 8. Because the ballot title “no” result statement and summary and the explanatory statement all briefly described the state of the law before the court’s issuance of the Mehrwein decision, the Court asked the parties to submit supplemental briefing concerning the effect, if any, that Mehrwein had on this matter. After review of the supplemental briefs of the parties, the Supreme Court concluded the the ballot title’s “no” result statement and summary and the explanatory statement had to be modified. Ritchie v. Polis
On March 10, 2020, Colorado Governor Jared Polis declared a disaster emergency pursuant to the Colorado Disaster Emergency Act as a result of the COVID-19 global pandemic. Since that time, the Governor relied on his authority under the Act to issue a wide range of executive orders suspending certain statutes, rules, and regulations in an effort to prevent further escalation of the pandemic and mitigate its effects. Among these was Executive Order D 2020 065 (“EO 65”), which (1) suspended the operation of certain statutes governing the ballot initiative process that require signature collection to take place in person; and (2) authorized the Secretary of State to create temporary rules to permit signature gathering by mail and email. Petitioners filed this lawsuit against Governor Polis and Secretary of State Jena Griswold, seeking a preliminary injunction against enforcement of EO65 and a declaratory judgment finding the Order unconstitutional under the Colorado Constitution and unauthorized under the Colorado Disaster Emergency Act. After ordering expedited briefing, the district court held a remote hearing via WebEx on May 22. In its May 27 Order, the district court concluded that (1) petitioners had not established the necessary factors outlined in Rathke v. MacFarlane, 648 P.2d 648 (Colo. 1982), to obtain a preliminary injunction; and (2) petitioners had not established an entitlement to declaratory relief under C.R.C.P. 57. The court also found that the petitioners’ claims against the Secretary were not ripe because she had not yet promulgated the temporary rules that EO 65 had authorized. The Colorado Supreme Court determined Article V, section 1(6) of the Colorado Constitution required ballot initiative petitions be signed in the presence of the petition circulator. "That requirement cannot be suspended by executive order, even during a pandemic." Judgment was therefore reversed and the matter remanded for further proceedings. View "Ritchie v. City and County of San Francisco v. All Persons Interested in Proposition C
In the November 2018 general election, 61percent of San Francisco voters voted for Proposition C, entitled “Additional Business Taxes to Fund Homeless Services.” San Francisco filed suit to establish that Proposition C has been validly enacted through the voters’ initiative power. The City’s complaint against “All Persons Interested in the Matter of Proposition C” was answered by three defendants: the California Business Properties Association, the Howard Jarvis Taxpayers Association, and the California Business Roundtable (the Associations). The Associations allege that Proposition C is invalid because it imposes a special tax approved by less than two-thirds of the voting electorate as required by Propositions 13 and 218. (California Constitution Art. XIII A, section 4 & Art. XIII C, section 2(d).)The trial court granted the City judgment on the pleadings. The court of appeal affirmed, citing two California Supreme Court cases interpreting other language from Proposition 13 and Proposition 218. The supermajority vote requirements that those propositions added to the state constitution coexist with and do not displace the people’s power to enact initiatives by majority vote. Because a majority of San Francisco voters who cast ballots in November 2018 favored Proposition C, the initiative measure was validly enacted. View "City and County of San Francisco v. Veitch v. Friday
William G. Veitch was a Republican candidate in 2018 for District Attorney of the 10th Judicial Circuit ("Jefferson County D.A.") and a resident of the area of Jefferson County, Alabama known as the Bessemer Cutoff. When he went to cast his vote in the Republican primary, he was not able to vote for the very office for which he was running. In fact, none of his neighbors in the Bessemer Cutoff were. Because of a local law enacted in 1953, residents of the Bessemer Cutoff did not participate in primary elections for Jefferson County D.A. Veitch challenged that law before the 2018 primary, and he continued to maintain that it violated the United States Constitution. The trial court entered a judgment against him. The Alabama Supreme Court reversed, finding the Jefferson County D.A. had the statutory authority to displace the Bessemer Division D.A. and exercise his powers in the Bessemer Cutoff. Because residents of the Bessemer Cutoff were subject to the prosecutorial power of the Jefferson County D.A., they had an equal interest with other Jefferson County residents in who occupied that office. Despite that equal interest, Act No. 138 denied voters in the Bessemer Cutoff the right to participate in the primary election for Jefferson County D.A. That discrimination, the Court held, violated the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution and rendered Act No. 138 unconstitutional. View "Veitch v. In re Title, Ballot Title & Submission Clause for 2019 (Initiative 293)
Proponents-respondents Monica Vondruska and Jon Caldara submitted proposed Initiative #293 to the Title Board for the setting of a title and submission clause. Initiative #293 proposed to add section 22 to article X of the Colorado Constitution and to amend certain statutory provisions in Titles 24 and 39 of the Colorado Revised Statutes in order to create a new preschool program. The measure implements the new preschool program, in part, by: (1) redirecting certain state cigarette and tobacco tax revenue away from local governments that ban selling tobacco or nicotine products and to the new preschool program and (2) reallocating a portion of the cigarette and tobacco taxes collected under article X, section 21 of the Colorado Constitution that are currently allocated to several health-related programs (Initiative #315 differed from Initiative #293 to the extent that Initiative #315 also added a ten percent sales tax on tobacco-derived nicotine vapor products). Petitioner Anna Jo Haynes then filed a motion for rehearing, asserting that the title did not satisfy either the single subject or clear title requirement. The Colorado Supreme Court concluded that the title that the Title Board set for Initiative #293 presented a single subject, namely, the creation and administration of a Colorado preschool program funded by reallocating existing taxes on, and other revenues derived from, tobacco and nicotine products. Furthermore, the Court concluded the title satisfied the clear title requirement because it described Initiative #293’s central features succinctly, accurately, and fairly and in a manner that will not mislead voters. Proponents-respondents Monica Vondruska and Jon Caldara submitted proposed Initiative #315 to the Title Board for the setting of a title and submission clause. Meyer v. Alaskans for Better Elections
This appeal arose from the State’s action limiting the people's constitutional right to legislate directly by initiative. A proposed initiative instituting three substantive changes to Alaska's election laws was submitted to the lieutenant governor for review, certification and printing signature booklets. Determining the initiative violated a constitutional requirement that proposed initiative bills be confined to one subject, the lieutenant governor denied certification. The initiative's sponsors filed an action in superior court to challenge that decision. The superior court concluded, contrary to the lieutenant governor, that the initiative's various provisions were confined to the single subject of "election reform" and it accordingly should have been certified. The Court directed the State distribute petition booklets for the sponsors to collect signatures for placing the initiative on a future election ballot. The lieutenant governor and State elections officials appealed the superior court decision. The Alaska Supreme Court determined the superior court correctly adhered to the Supreme Court's prior interpretation of the relevant provisions of the constitution. Furthermore, the Court rejected the request to reverse precedent that the people's power to initiate laws generally was equivalent to that of the legislature. View "Meyer v. Level the Playing Field v. Federal Election Commission
Plaintiffs filed suit alleging that the CPD routinely endorses and supports Republican and Democratic nominees at the expense of third-party candidates, and that the CPD uses subjective and biased criteria for selecting debate participants. Specifically, plaintiffs challenged the 15% polling criterion, which the CPD used to determine eligibility for participation in the debates preceding the 2012 Presidential election. Plaintiffs also challenged the Commission's denial of its request to initiate a rulemaking to change its rules to prohibit debate sponsors from using public opinion polls as a criterion for eligibility.Applying de novo review, the DC Circuit affirmed the district court's grant of summary judgment for the Commission. The court held that plaintiffs failed to show that the Commission's decisionmaking was arbitrary and capricious where the Commission offered detailed explanations in support of its view that plaintiffs failed to show impermissible bias against independent candidates or in favor of candidates from the two major political parties. The court also held that the Commission acted reasonably in determining that a 15% polling threshold is an objective requirement. Finally, because the court has found that the Commission acted reasonably in reaching its decisions, the court held that the Commission did not err by electing not to initiate a rulemaking. State ex rel. Cook v. Bowling Green City Schools Board of Education
The Supreme Court granted a writ of mandamus ordering the school board to certify a petition proposing the transfer of territory from one school district to another and certify the transfer proposal to the board of elections for placement on the ballot at the August 4 special election, holding that a writ of mandamus was warranted.Petitioner, a qualified elector in the territory proposed to be transferred, filed a mandamus complaint alleging that the school board failed to comply with its statutory obligations to promptly certify the petition and the proposal to the board of elections and that the school board's unwarranted delay caused the transfer proposal to miss the deadline for certification to the August 4 ballot. Petitioner also sought a writ ordering the board of elections to place the proposal on the August 4 ballot. The Supreme Court granted the writ as to the school board and denied it as to the elections board, holding (1) the school board had the opportunity to certify the proposal for placement on the August 4 special election ballot but declined to do so for reasons outside its authority; and (2) Petitioner's mandamus claim against the elections board was not ripe.
