The Alaska Democratic Party amended its bylaws to allow registered independent voters to run as candidates in its primary elections without having to become Democratic Party members. But the Division of Elections refused to allow independent voter candidates on the Democratic Party primary election ballot, taking the position that Alaska election law, specifically the “party affiliation rule,” prevented anyone not registered as a Democrat from being a candidate in the Democratic Party’s primary elections. The Democratic Party sued for declaratory and injunctive relief preventing enforcement of the party affiliation rule, and the superior court ruled in its favor. The State appealed. Because the Alaska Constitution’s free association guarantee protects a political party’s choice to open its primary elections to independent voter candidates, and because in this specific context the State had no countervailing need to enforce the party affiliation rule, the Alaska Supreme Court affirmed the superior court’s decision. A complaint filed with the Alaska Public Offices Commission (APOC) against John Eberhart was filed when he was a city council member, alleging Eberhart had improperly used government resources in his campaign for mayor of Fairbanks. After investigating the complaint and holding a hearing, APOC fined Eberhart $37.50 for improper use of government resources in violation of a state statute. Eberhart appealed to the superior court, which affirmed APOC’s decision. Eberhart petitioned the Alaska Supreme Court to find APOC misinterpreted and misapplied relevant statutes, violated the First Amendment, and violated its own procedural rules. The Lieutenant Governor of Alaska declined to certify a proposed ballot initiative that would establish a permitting requirement for activities that could harm anadromous fish habitat, reasoning that the initiative effected an appropriation of state assets in violation of article XI, section 7 of the Alaska Constitution. The initiative sponsors filed suit, and the superior court approved the initiative, concluding that the proposal would not impermissibly restrict legislative discretion. The Alaska Supreme Court concluded the initiative would encroach on the discretion over allocation decisions delegated to the Alaska Department of Fish and Game by the legislature, and that the initiative as written effected an unconstitutional appropriation. But the Court concluded the offending sections could be severed from the remainder of the initiative. Accordingly, the Court reversed the judgment of the superior court and remanded for that court to direct the Lieutenant Governor to sever the offending provisions but place the remainder of the initiative on the ballot. Mendocino County Ballot Measure AI, which imposed a tax on commercial cannabis businesses, was approved by a simple majority of county voters. The trial court dismissed a challenge and denied plaintiffs’ motion for a preliminary injunction. The court of appeal affirmed, rejecting an argument that under a correct interpretation of article XIII of the California Constitution the tax imposed by Measure AI was not a general tax but, together with a related advisory measure, amounted to a special tax requiring approval by a supermajority of county voters. The court also rejected an alternative argument that Measure AI did not involve a tax at all, and instead imposed an unlawful fee. Because Measure AJ did not in any way limit the County’s ability to spend the proceeds collected under Measure AI, the tax necessarily and by its terms remained a general tax. View "Johnson v. Roland Riemers petitioned the North Dakota Supreme Court to exercise its original jurisdiction and issue a writ of mandamus directing the North Dakota Secretary of State Alvin Jaeger to order a recount of the June 12, 2018 primary election for the office of secretary of state. Riemers argued he was entitled to an automatic recount under N.D.C.C. 16.1-16-01(1)(a) because he "failed to be nominated in a primary election by one percent or less of the highest vote cast for a candidate for the office sought." The Supreme Court determined the plain language of N.D.C.C. § 16.1-16-01(1)(a) requires a comparison of the highest votes cast for a candidate for the office sought without regard to the candidate's party. “The fact that we are required to construe N.D.C.C. 16.1-16-01(1)(a) does not preclude the remedy of mandamus.” Moreover, given the time constraints on ballot preparation for the general election, the Court determined no plain, speedy, and adequate remedy at law was available for Riemers. Under the plain language of N.D.C.C. 16.1-16-01(1)(a), Riemers was entitled to an automatic recount, and the Secretary of State was statutorily required to order that automatic recount. The New Hampshire Secretary of State transmitted a certified copy of a resolution of the Governor and Executive Council requesting an opinion of the New Hampshire Supreme Court regarding House Bill 1264, an act to amend the definition of “resident” and “residence” in RSA 21:6 and 21:6-a. The Supreme Court concluded the request was proper for it to issue an advisory opinion. The problem that gave rise to the proposed change in the law of residency set forth in HB 1264 was that the definitions were interpreted to impose requirements that went beyond the traditional definition of “domicile. The result – counterintuitive as it may be – is that, notwithstanding the ‘resident’ and ‘residence’ labels used in their titles, to satisfy the current definitions… requires a degree of connection to a place that is greater than that required to be domiciled in this state for voting purposes pursuant to RSA 654:1, I (2016).” To correct this problem, HB 1264 removed the words “for the indefinite future” from the text of RSA 21:6 and :6-a. If HB 1264 became law, out-of-state students who come to New Hampshire to attend a postsecondary institution or others, who were able to establish a “sufficient attachment to the state” to satisfy the requirements of domicile, would be entitled to vote in New Hampshire. “There is nothing unfair or unconstitutional about state laws that require persons to make this choice.” View "Opinion of the Justices (Definition of Resident and Residence)" on Justia Law

In consolidated cases, petitioners sought review of the Oregon Attorney General’s certified ballot title for Initiative Petition (IP) 43 (2018), contending that various aspects did not comply with requirements set out in ORS 250.035(2). IP 43 proposed a statutory enactment that, with exceptions including a limited registration scheme, would prohibit the unlawful possession or transfer of an “assault weapon” or a “large capacity magazine,” as those terms are defined in the proposed measure. After defining the weapons and magazines within its scope, IP 43 created a new crime, “unlawful possession or transfer of an assault weapon or large capacity magazine,” for any person who “manufactures, imports, possesses, purchases, sells or transfers any assault weapon or large capacity magazine,” with exceptions. After review, the Oregon Supreme Court referred the ballot title for IP 43 back to the Attorney General for modification of the caption, the “yes” and “no” result statements, and the summary. Petitioners, CREW and its executive director, filed suit alleging that the Commission acted "contrary to law" in 2015 when it dismissed their administrative complaint against an unincorporated association. On appeal, CREW raised the judicial review provision of the Federal Election Campaign Act (FECA) and the Administrative Procedure Act (APA). The DC Circuit affirmed, holding that the Commission's dismissal of the complaint constituted the "agency action" supporting the district court's jurisdiction. In this case, the district court held that the Commission's explanation of its failure to prosecute was a rational exercise of prosecutorial discretion. The court dismissed CREW's arguments to the contrary. The court addressed remaining issues and the dissent's position before affirming the judgment. William Veitch was a Republican candidate for district attorney for the 10th Judicial Circuit of Alabama. His request for a declaration was denied, and he petitioned for a writ of mandamus when the trial court refused to direct that the names of candidates running for the office of district attorney for the 10th Judicial Circuit be included not only on the ballot to be used in the primary election in the Birmingham Division of Jefferson County, but also on the ballot to be used in the primary election in the portion of Jefferson County known as the Bessemer Cutoff. The trial court dismissed Veitch's action based on its conclusion that it lacked subject-matter jurisdiction and, alternatively, based on the doctrine of laches. Veitch appealed. The Alabama Supreme Court found a jurisdiction-stripping statute did not deprive the trial court of jurisdiction and Veitch was not precluded by the doctrine of laches from bringing his action. At this point, the Court expressed no opinion on the merits of Veitch's arguments regarding the alleged repeal of the 1953 Act, its alleged unconstitutionality, or its alleged unconstitutional application.
