Mission Peak Conservancy v. State Water Resources Control Board
The Water Rights Permitting Reform Act of 1988 provides a streamlined process for acquiring a right to appropriate up to 10 acre-feet of water per year from a stream into a storage facility, such as a pond or tank, by registering the use with the State Water Resources Control Board, paying a fee, and subsequently putting the water to “reasonable and beneficial use.” Given its lack of discretion over individual permits, the board has designated the registration process generally to be exempt from the California Environmental Quality Act (CEQA, Pub. Resources Code 21000) as a ministerial decision.Mission Peak sued the board, alleging CEQA violations by granting a small domestic use registration to the Georges without first conducting an environmental review. The Georges’ registration form, on its face, met the program requirements. Mission Peak alleged that the form was replete with false information, of which the board was or should have been aware. The court of appeal affirmed the dismissal of the suit. The registration was exempt from CEQA as a ministerial act. Conducting an environmental review would be a meaningless exercise because there is no discretion to reduce a project’s environmental damage by requiring changes. View "Mission Peak Conservancy v. Save Civita Because Sudberry Won’t v. City of San Diego
The City of San Diego (City) certified an environmental impact report (EIR) for the “Serra Mesa Community Plan [SMCP] Amendment Roadway Connection Project” (Project) and approved an amendment to the SMCP and the City’s General Plan to reflect the proposed roadway. Save Civita Because Sudberry Won’t (“Save Civita”) filed a combined petition for writ of mandate and complaint for declaratory and injunctive relief (Petition/Complaint) against the City, challenging the City’s certification of the EIR and approval of the Project. Save Civita contended that the City violated the California Environmental Quality Act (“CEQA”), the Planning and Zoning Law, and the public’s due-process and fair-hearing rights. The trial court denied the Petition/Complaint in its entirety and entered a judgment in favor of the City. On appeal, Save Civita raised four claims related to the City’s certification of the EIR for the Project: (1) the City violated CEQA Guidelines section 15088.5, subdivision (g) in failing to summarize revisions made in the Project’s recirculated draft EIR (RE-DEIR); (2) the Project’s final EIR (FEIR) was deficient because it failed to adequately analyze, as an alternative to the Project, a proposal to amend the MVCP to remove the planned road from that community plan; (3) the FEIR is deficient because it failed to adequately analyze the Project’s traffic impacts; and (4) the FEIR failed to adequately discuss the Project’s inconsistency with the General Plan’s goal of creating pedestrian-friendly communities. In addition to its EIR / CEQA claims, Save Civita maintains that the Project will have a deleterious effect on the pedestrian-friendly Civita community and that the City therefore violated the Planning and Zoning law in concluding that the Project is consistent with the City’s General Plan. Finally, Save Civita maintains that the City acted in a quasi-adjudicatory capacity in certifying the FEIR and approving the Project and that a City Council member violated the public’s procedural due process rights by improperly advocating for the Project prior to its approval. Mission Peak Conservancy v. State Water Resources Control Board
Mission Peak filed suit against the State Water Resources Control Board, alleging that it violated the California Environmental Quality Act (CEQA) by granting a small domestic use registration to Christopher and Teresa George without first conducting an environmental review.The Court of Appeal affirmed the trial court's decision sustaining the board's demurrer without leave to amend, concluding that the registration was exempt from CEQA as a ministerial act, rather than a discretionary act. In this case, Mission Peak points to no statute that grants the board authority to place conditions on the Georges' registration to lessen its environmental effects; the only conditions the board may impose are general conditions applicable to all registrations; registration is automatically deemed complete, and the registrant obtains the right to take and use the specified amount of water, when the board receives a substantially compliant registration form along with the registration fee; the board determines whether a registration is compliant essentially by applying a checklist of fixed criteria; and the registration is effective as of the date of the form and remains so until and unless the water right is forfeited, abandoned, or revoked. Dep’t of Ecology v. Acquavella
There have been multiple cases that purported to (at least partially) adjudicate and reserve water rights of various parties throughout the Yakima River Drainage Basin (the Basin). The underlying litigation began in 1977 when the Washington State Department of Ecology filed a general water rights adjudication for all waters contained within the Basin. The Yakima County Superior Court divided the Basin into multiple distinct subbasins and issued conditional final orders (CFOs) for each subbasin at various points within the litigation. The superior court issued its final decree in May 2019, incorporating all of the prior CFOs as necessary. Multiple parties appealed the final decree, and, after briefing, the Court of Appeals certified the case to the Washington Supreme Court. The appeal could be categorized as three separate appeals, each seeking to modify the trial court's final decree (or the incorporations of the CFOs within). Although each distinct appeal was unrelated as to the disputed issues, some parties had an interest in more than one appeal. Further, all three appeals were tied together by variations on one common procedural gatekeeping issue: the appealability of CFOs and how that related to an appeal of the final decree. District 4 Lodge of the International Ass’n v. Raimondo
In this dispute between the Maine lobster industry and the National Marine Fisheries Service (the Agency) over a rule barring frequently employed methods of lobstering the First Circuit granted the Agency's motion for a stay pending appeal of the district court's issuance a permanent injunction, holding that the Agency was entitled to a stay.In 2021, the Agency issued a rule barring, from October to January each year, the most frequently employed methods of lobstering in an approximately 1,000-square-mile area of the Atlantic Ocean in order to reduce the risk that a right whale would become entangled in the ropes connecting lobster traps to buoys. Plaintiffs brought this action seeking to postpone enforcement of the new rule until the district court could finally decide whether the new rule was lawful. The district court granted Plaintiffs' preliminary request. The Agency appealed and asked the First Circuit to issue a stay of the district court order. The First Circuit granted the government's motion, holding the district court misapprended the record and erred in rejecting the Agency's arguments. Truck Trailer Manufacturers Association, Inc. v. Environmental Protection Agency
In 2016, the Environmental Protection Agency issued a rule for trailers pulled by tractors based on a statute enabling the EPA to regulate “motor vehicles.” In that same rule, the National Highway Traffic Safety Administration issued fuel efficiency standards for trailers based on a statute enabling NHTSA to regulate “commercial medium-duty or heavy-duty on-highway vehicles.” The “Greenhouse Gas Emissions and Fuel Efficiency Standards for Medium- and Heavy-Duty Engines and Vehicles—Phase 2.” 81 Fed. Reg. 73,478, requires trailer manufacturers to adopt some combination of fuel-saving technologies, such as side skirts and automatic tire pressure systems. Truck Trailer Manufacturers Association sought review.The D.C. Circuit vacated all portions of the rule that pertain to trailers. Trailers have no motor and art not “motor vehicles.” Nor are they “vehicles” when that term is used in the context of a vehicle’s fuel economy since motorless vehicles use no fuel. Farmland Protection Alliance v. County of Yolo
Defendants Yolo County and its board of supervisors (collectively, the County) adopted a revised mitigated negative declaration and issued a conditional use permit to real parties in interest to operate a bed and breakfast and commercial event facility supported by onsite crop production intended to provide visitors with an education in agricultural operations (project). A trial court found merit in three of several arguments presented to challenge the decision, specifically finding substantial evidence supported a fair argument under the California Environmental Quality Act that the project may have had a significant impact on the tricolored blackbird, the valley elderberry longhorn beetle (beetle), and the golden eagle. The trial court ordered the County to prepare an environmental impact report limited to addressing only the project’s impacts on those three species. Further, the Court ordered the project approval and related mitigation measures would remain in effect, and the project could continue to operate. Plaintiffs-appellants Farmland Protection Alliance and Yolo County Farm Bureau appealed, contending the trial court violated the Act by: (1) ordering the preparation of a limited environmental impact report, rather than a full one, despite finding substantial evidence with respect to the three species; (2) finding the fair argument test was not met as to agricultural resource impacts; and (3) allowing the project to continue to operate during the period of further environmental review. Real parties in interest cross-appealed, arguing the trial court erred in finding substantial evidence supported the significant impacts on the three species. They requested an order vacating the judgment requiring the preparation of the limited environmental impact report (even though the limited environmental impact report was already certified by the County). The Court of Appeal concluded Public Resources Code section 21168.9 did not authorize a trial court to split a project’s environmental review across two types of environmental review documents. The trial court thus erred in ordering the County to prepare a limited environmental impact report after finding the fair argument test had been met as to the three species. In the unpublished portion of the opinion, the Court concluded the trial court did not err in: (1) upholding the County’s determination that the project was consistent with the Code and the Williamson Act; and (2) finding substantial evidence supported the projects effects on the beetle. Judgment was reversed requiring the preparation of a limited impact report, and the case remanded with directions to issue a peremptory writ of mandate directing the County to set aside its decision to adopt the revised mitigated negative declaration and to prepare a full environmental impact report for the project. Protect Tustin Ranch v. City of Tustin
Respondent City of Tustin (City) reviewed a proposed construction of a new gas station and ancillary facility (project) pursuant to the California Environmental Quality Act, Public Resources Code section 21000 et seq. (CEQA), and concluded the project was exempt from CEQA under the categorical exemption for “in-fill development.” After the City approved the project and filed a notice of exemption, appellant Protect Tustin Ranch (Protect) sought a writ of mandate to set aside the City’s approvals due to what it claimed was an erroneous finding by the City that the project was exempt from CEQA. Chevron U.S.A., Inc. v. County of Monterey
Ordinances banning “land uses in support of” new oil and gas wells and “land uses in support of” wastewater injection in unincorporated areas of Monterey County were enacted as part of Measure Z, an initiative sponsored by PMC and passed by Monterey County voters.The trial court upheld, in part, a challenge to Measure Z by oil companies and other mineral rights holders. The court of appeal affirmed. Components of Measure Z are preempted by state laws. Public Resources Code section 3106 explicitly provides that the State of California’s oil and gas supervisor has the authority to decide whether to permit an oil and gas drilling operation to drill a new well or to utilize wastewater injection in its operations. Those operational aspects of oil drilling operations are committed by section 3106 to the state’s discretion and local regulation of these aspects would conflict with section 3106. McCann v. City of San Diego
Plaintiff Margaret McCann appealed a judgment in favor of defendant City of San Diego (City) on McCann’s petition for writ of mandate and an order denying her request for a preliminary injunction. McCann challenged the City’s environmental review process related to its decision to approve two sets of projects that would convert overhead utility wires to an underground system in several neighborhoods. McCann’s primary concern was the need for the underground system to be supplemented with several above-ground transformers, which would be housed in three-foot-tall metal boxes in the public right-of-way. According to McCann, the City violated the California Environmental Quality Act (CEQA) by failing to prepare an environmental impact report (EIR) for both sets of projects. The Court of Appeal concluded McCann’s claims were barred as to the first set of projects because she failed to exhaust her administrative remedies to challenge the City’s determination that the projects were exempt from CEQA. The Court determined the City complied with the CEQA. However, the Court found merit in McCann’s argument the City’s finding that the projects would not have a significant environmental impact due to greenhouse gas emissions was not supported by substantial evidence. The Court found remand was necessary to allow the City to conduct a further review to determine if the greenhouse gas emissions were consistent with the City’s Climate Action Plan. Judgment was therefore reverse in part and affirmed in all other respects. View "McCann v. City of San Diego" on Justia Law
