California v. Continental Ins. Co.
The State of California sued to recover from various insurers the costs of cleaning up the Stringfellow hazardous waste site, pending since 1993. The only remaining insurers were the Continental Insurance Company and Continental Casualty Company (collectively Continental), and the only remaining issues related to prejudgment interest. In 2015, Continental paid the State its full policy limits of $12 million. The trial court ruled that the State was entitled to mandatory prejudgment interest on that amount at seven percent, dating back to 1998. In the alternative, it also ruled that the State was entitled to discretionary prejudgment interest, at seven percent, dating back to 2002. Continental appealed. In the published portion of its opinion, the Court of Appeal addressed Continental’s contentions that the award of mandatory prejudgment interest was erroneous because: (1) the award was premised on the trial court’s erroneous ruling as to when Continental’s policies attached; and (2) the State was not entitled to mandatory prejudgment interest because the amount of its damages was uncertain. Continental further contended the award of discretionary prejudgment interest was erroneous because the trial court used an inapplicable interest rate. Finding no error affecting the award of mandatory prejudgment interest, the Court of Appeal affirmed. The Court did not review the award of discretionary prejudgment interest. View "California v. Alabama River Group, Inc. v. Conecuh Timber, Inc. et al
Conecuh Timber, Inc., Ayres Forestry, Inc., BAR Forest Products, LLC, Dry Creek Loggers, Inc., Pea River Timber Company, Inc., Pineville Timber Co., LLC, and THE Timber Company, LLC ("TTC") (collectively referred to as "the wood dealers"), sued Alabama River Group, Inc. ("ARG"), and ARG's chairman and chief executive officer George Landegger, asserting various claims arising from transactions between the wood dealers and ARG's predecessors; the transactions were affected by a short-lived subsidy program administered by the United States Department of Agriculture's Farm Service Agency ("the FSA") known as the Biomass Crop Assistance Program ("BCAP"). Following a jury trial, a judgment was entered against the ARG defendants awarding the wood dealers $1,092,692.71 in compensatory damages and $7,000,000 in punitive damages. The trial court reduced the punitive-damages award by virtue of the statutory cap in section 6- 11-21, Ala. Code 1975, resulting in a total judgment of $6,395,489.37. The ARG defendants filed post-trial motions, which, after a hearing, the trial court denied. The ARG defendants appealed. After review, the Alabama Supreme Court affirmed the trial court's judgment as to liability and compensatory damages. The Court affirmed the punitive damages awarded to Dry Creek Loggers, Inc., and to Conecuh Timber, Inc. With respect to the punitive-damages awards of the remaining wood dealers, the judgment of the trial court was affirmed on the condition that those wood dealers file a remittitur of the punitive-damages awards to a 3:1 ratio to the Supreme Court. Should any wood dealer fail to timely file the respective remittitur, the judgment as to that wood dealer would be reversed and the cause remanded for a new trial. View "Alabama River Group, Inc. v. In re Vermont Gas Systems, Inc.
At issue before the Vermont Supreme Court in this appeal was whether land dedicated to a public use could be condemned for another public use when the new use did not materially interfere with the prior use. Intervenors, a group of Hinesburg residents who use Geprags Park, appealed the Public Service Board’s order authorizing Vermont Gas Systems, Inc. (VGS) to condemn an easement through the park for the purpose of installing a natural gas pipeline. They argued the Board erred in authorizing the condemnation in light of the fact that the park was already dedicated to a public use, and in concluding that the condemnation was necessary under 30 V.S.A. section 110(a)(2). The Supreme Court affirmed the Board’s decision, but remanded for a minor correction to the order relating to the terms of the easement. View "In re Vermont Gas Systems, Inc." on Justia Law
Rivers v. Executive Director of Utah Department of Environmental Quality
Petitioner waived its challenge to the decision of the Utah Department of Environmental Quality (UDEQ) to issue a “permit by rule” to U.S. Oil Sands Inc. for a bitumen-extraction project. Petitioner, which appeared before the Supreme Court for a second time to challenge the permit, failed to argue that UDEQ’s Executive Director erred in concluding that Living Rivers v. U.S. Oil Sands, Inc., 344 P.3d 568 (Living Rivers I), barred its requests for agency action. The Supreme Court affirmed the executive Director’s decision on the ground that Petitioner failed adequately to challenge an alternative ground for the Executive Director’s decision. View "Rivers v. Wyoming v. Zinke
In cases consolidated for review, the issue presented for the Tenth Circuit centered on whether the Bureau of Land Management (BLM) acted beyond its statutory authority when it promulgated a regulation, 43 C.F.R. sec. 3162.3-3 (2015), governing hydraulic fracturing (fracking) on lands owned or held in trust by the United States. The district court invalidated this regulation as exceeding the BLM’s statutory authority. While these appeals were pending, a new President of the United States was elected, and shortly thereafter, at the President’s direction, the BLM began the process of rescinding the Fracking Regulation. Given these changed and changing circumstances, the Tenth Circuit concluded these appeals were unripe for review. As a result, the Court dismissed these appeals and remanded with directions to vacate the district court’s opinion and dismiss the action without prejudice. View "Wyoming v. Zinke" on Justia Law
United States v. Osage Wind
This case presented a question of whether a large-scale excavation project constituted “mining” under the pertinent federal regulations that address mineral development on Indian land. When an entity engages in “mining” of minerals owned by the Osage Nation, a federally approved lease must be obtained from the tribe. The Osage Mineral Council (OMC), acting on behalf of the Osage Nation, appealed the award of summary judgment to Defendant Osage Wind, LLC (Osage Wind), arguing that Osage Wind engaged in “mining” without procuring a federally approved mineral lease. The Bureau of Indian Affairs (BIA) has defined “mining” as the “science, technique, and business of mineral development[.]” The Tenth Circuit held the term “mineral development” had a broad meaning, including commercial mineral extractions and offsite relocations, but also encompass action upon the extracted minerals for the purpose of exploiting the minerals themselves on site. The Court held Osage Wind’s extraction, sorting, crushing, and use of minerals as part of its excavation work constituted “mineral development,” thereby requiring a federally approved lease which Osage Wind failed to obtain. Accordingly, the Court reversed the award of summary judgment and remanded for further proceedings. View "United States v. Osage Wind" on Justia Law
WildEarth Guardians v. Bureau of Land Management
Plaintiffs-Appellants WildEarth Guardians and Sierra Club challenged the Bureau of Land Management’s (BLM) decision to approve four coal leases in Wyoming’s Powder River Basin. Plaintiffs brought an Administrative Procedure Act (APA) claim arguing that the BLM failed to comply with the National Environmental Policy Act (NEPA) when it concluded that issuing the leases would not result in higher national carbon dioxide emissions than would declining to issue them. The district court upheld the leases. The Tenth Circuit held the BLM’s Environmental Impact Studies and Records Of Decisions were arbitrary and capricious because they omitted data pertinent to its choice with respect to issuing the leases, and thereby informing the public of its rationale. The Tenth Circuit remanded with instructions to the BLM to revise its Environmental Impact Statements (EISs) and Records of Decision (RODs). The Court did not vacate the resulting leases. Wild Wilderness v. Allen
Wild Wilderness, a group representing non-motorized users, filed suit challenging the Forest Service's approval of the building of Kapka Sno-Park, alleging that the Forest Service had violated both the National Forest Management Act (NFMA) and the National Environmental Policy Act (NEPA). The panel held that the case was neither moot nor lacking redressability; the Forest Service did not violate the NFMA because Kapka Sno-Park was not inconsistent with the Deschutes Forest Plan; and the Forest Service did not violate NEPA because the agency complied with the relevant regulations, completed an environmental assessment, and issued a finding of no significant impact. Bitterrooters for Planning, Inc. v. Montana Department of Environmental Quality
The Supreme Court reversed in part and affirmed in part the judgment of the district court granting summary judgment to Plaintiffs that the Montana Department of Environmental Quality (DEQ) violated the Montana Environmental Policy Act (MEPA) by issuing a wastewater discharge permit for a “big box” retail merchandise store. DEQ appealed. Intervenors and current owners of the site (Landowners) joined the appeal and also appealed the district court’s summary judgment that MEPA requires DEQ to identify the owner or operator of the contemplated retail store. The Supreme Court held (1) the district court erred in concluding that DEQ violated MPEA, in contravention of Admin. R. M. 17.4.609(3)(d) and (e), by failing to further consider the environmental impacts of the construction and operation of the facility other than water quality impacts and impacts of the related construction of the required wastewater treatment system; and (2) the district court correctly concluded that DEQ must identify and disclose the actual contemplated owner or operator of the facility for which the applicant seeks the subject wastewater discharge permit. Coon v. N.D. Dep’t of Health
Landowners from the Buffalo area appealed a district court judgment affirming the Department of Health's decision to issue Rolling Green Family Farms an animal feeding operation (AFO) permit. The landowners argued the Department erred by issuing Rolling Green an AFO permit and by failing to reopen the public comment period after Rolling Green provided further information to supplement its permit application.
