The Monte Vista Villas Project, on the site of the former Leona Quarry, has been in development since the early 2000s. The developers planned to close the 128-acre quarry site, reclaim it, and develop the land into a residential neighborhood with over 400 residential units, a community center, a park, pedestrian trails, and other recreational areas. In 2005, the developers entered into an agreement with Oakland to pay certain fees to cover the costs of its project oversight. The agreement provided that the fees set forth in the agreement satisfied “all of the Developer’s obligations for fees due to the City for the Project.” In 2016, Oakland adopted ordinances that imposed new impact fees on development projects, intended to address the effects of development on affordable housing, transportation, and capital improvements, and assessed the new impact fees on the Project, then more than a decade into development, when the developers sought new building permits.The trial court vacated the imposition of the fees and directed Oakland to refrain from assessing any fee not specified in the agreement. The court of appeal reversed, finding that any provision in, or construction of, the parties’ agreement that prevents Oakland from imposing the impact fees on the instant development project constitutes an impermissible infringement of the city’s police power and is therefore invalid. Ascension Medical Group sought to depose a DEA agent and a federal prosecutor in state court litigation. Their testimony would help Ascension prove that one of its doctors failed to disclose that he was under federal investigation, in violation of his employment agreement. The Department of Justice refused to make either employee available for depositions. Ascension sued to compel their testimony. The district court determined that the Department’s refusal was reasonable and entered judgment in its favor.The Seventh Circuit affirmed. Under 5 U.S.C. 301, each federal agency has promulgated “Touhy regulations,” governing when it will disclose information or make its employees available for depositions. The Department of Justice’s Touhy regulations are at 28 C.F.R. 16.21. Unless the Department unreasonably applied its Touhy regulations, a federal court is powerless to compel its participation in state court discovery. Because the Department reasonably applied its Touhy regulations to the particulars of Ascension’s request, its refusal was neither arbitrary nor capricious. The court noted that if the doctor denies that he was under investigation, Ascension can point to the DEA proffer letter he signed acknowledging that he was “a subject of a federal investigation.” View "St. Vincent Medical Group, Inc. v. According to allegations in the complaint, for over forty years, Monsanto was the only U.S. manufacturer of polychlorinated biphenyls (“PCBs”). The federal government and states spent enormous sums cleaning up PCB environmental contamination. The State of Delaware alleged Monsanto knew that the PCBs it produced and sold to industry and to consumers would eventually be released into the environment and would cause lasting damage to public health and the State’s lands and waters. The State brought this action to hold Monsanto responsible for its cleanup costs, asserting claims for public nuisance, trespass, and unjust enrichment. A Delaware superior court dismissed the complaint, reasoning that even though the State alleged Monsanto knew for decades PCBs that were toxic and would contaminate the environment for generations, the State: (1) could not assert a public nuisance claim or trespass claim because Monsanto manufactured PCB products, which entered the environment after sale to third parties; (2) State did not have standing to bring a trespass claim because it held public lands in trust rather than outright and therefore did not have the exclusive possession of land needed to assert a trespass claim; (3) the superior court held it lacked subject matter jurisdiction to hear the unjust enrichment claim as a standalone claim; and (4) the State could not use an unjust enrichment claim to recover future cleanup costs. The Delaware Supreme Court found the State pled sufficiently that even though Monsanto did not control the PCBs after sale it substantially participated in creating the public nuisance and causing the trespass by actively misleading the public and continuing to supply PCBs to industry and consumers knowing that PCBs were hazardous, would escape into the environment after sale to third parties, and would lead to widespread and lasting contamination of Delaware’s lands and waters. Further, the Supreme Court found the State alleged that it owned some land directly and therefore had exclusive possession of that land needed to assert a trespass claim. An 1868 treaty established the Navajo Reservation that today spans some 17 million acres, almost entirely in the Colorado River Basin. While the Tribe has the right to use water from the reservation’s numerous water sources, the Navajos face water scarcity problems. The Navajos sought to compel the United States to take affirmative steps to secure needed water for the Tribe, by assessing the Tribe’s water needs, developing a plan to secure the needed water, and potentially building infrastructure. Three states intervened to protect their interests in Basin's water. The Ninth Circuit reversed the dismissal of the suit.The Supreme Court reversed. The treaty reserved necessary water to accomplish the purpose of the Navajo Reservation but did not require the United States to take affirmative steps to secure water for the Tribe. The federal government owes judicially enforceable duties to a tribe “only to the extent it expressly accepts those responsibilities.” While the treaty “set apart” a reservation for the “use and occupation of the Navajo tribe,” 15 Stat. 668, and did impose several specific duties on the United States, it contains no language imposing a duty on the United States to take affirmative steps to secure water for the Tribe. Indian treaties cannot be rewritten or expanded beyond their clear terms. The United States maintains a general trust relationship with tribes, but unless Congress has created a conventional trust relationship with a tribe as to a particular trust asset, common-law trust principles do not imply duties not found in the text of a treaty, statute, or regulation. It is unsurprising that an 1868 treaty did not provide for all of the Navajos’ current water needs 155 years later; a breach-of-trust claim “cannot be premised on control alone.” View "Arizona v. The Supreme Court reversed the judgment of the circuit court reversing an administrative law judge's (ALJ) decision determining that Appellant was disqualified from receiving reemployment assistance benefits because he was discharged for work-connected misconduct, holding that this Court could not conduct a meaningful appellate review.The ALJ in this case determined that Appellant could not entitled to reemployment assistance benefits because he was discharged for work-related misconduct, as defined by S.D. Codified Laws 61-6-14.1. The circuit court reversed, concluding that Appellant's habit of hugging co-workers did not constitute misconduct. The Supreme Court reversed, holding that because the ALJ failed to enter findings on Appellant's alleged sexual misconduct, this Court could not conduct a meaningful appellate review. This case stemmed from a 2019 lease by Respondents the City of Sandpoint (“the City”) to The Festival at Sandpoint (“The Festival”), a nonprofit corporation, to operate a multi-day music concert series in War Memorial Field Park. The Festival had a long-standing policy of prohibiting festival patrons from bringing weapons, including firearms, into the event. On August 9, 2019, Scott Herndon and Jeff Avery purchased tickets to the festival and attempted to enter. Avery openly carried a firearm and Herndon possessed a firearm either on his person or in a bag (the record was unclear on this point). Security personnel for the event denied entry to both. After discussions with a City police officer and the City’s attorney, who was coincidentally attending the same event in his private capacity, Herndon and Avery eventually left the music festival and received a refund for their tickets. Appellants Herndon, Avery, the Idaho Second Amendment Alliance, Inc., and the Second Amendment Foundation, Inc. subsequently sued the City and The Festival, asserting several claims, including seeking injunctive relief prohibiting the Respondents from violating the Idaho and United States Constitutions, particularly the Second Amendment and the Idaho Constitution’s provision securing the right to keep and bear arms in public for all lawful purposes. The district court ultimately granted the Respondents’ motions for summary judgment, awarded both the City and The Festival attorney fees and costs, and dismissed all the Appellants’ claims with prejudice. The issue raised on appeal was whether a private party who leased public property from a municipality may govern those who come and go from the property during the lease. The Supreme Court affirmed the order of the Public Service Commission (PSC) denying in part and granting in part motions for reconsideration of an order it issued setting forth the inputs it would use to calculate the export credit rate (ECR), holding that this Court lacked jurisdiction as to certain issues and, as to the two remaining issues, the PSC did not exceed the bounds of its authority.The export credit rate system at issue in this case was created to eventually replace the "net metering" program for customers who generated electricity. The PSC engaged in a lengthy public process to decide what factors to consider in calculating the ECR. After the PSC issued an order setting forth the inputs to use for the ECR Appellants filed motions for reconsideration. The PSC granted in part the motions, agreeing to reconsider some of the ECR calculation's components. The Supreme Court dismissed the petition as to issues for which the Court lacked jurisdiction and otherwise denied the motion, holding that the PSC did not exceed the bounds of its authority. Petitioner Sarah Farum filed a frivolous asylum application. An immigration judge determined the application rendered her permanently ineligible for immigration benefits under the Immigration and Nationality Act. Farnum did not challenge the frivolousness finding made by the immigration judge, nor did she challenge she had proper notice of the consequences of filing a false application. She instead challenged the timing of when the frivolous-asylum bar was effective. In her view, the frivolous-application bar outlined in 8 U.S.C. § 1158(d)(6) could not be invoked in the same proceeding as a frivolousness finding was made, thus allowing an immigration court to consider other potential claims that might support a finding that the Attorney General should withhold her deportation. To this, the Tenth Circuit Court of Appeals disagreed: "Once an immigration judge or the Board of Immigration Appeals makes the required frivolousness finding, the statutory bar is effective." Appellants in these tandem appeals are each a parent of a disabled child. Arguing that his or her child was entitled to benefits under the Individuals with Disabilities Education Act (“IDEA”), 20 U.S.C. Section 1415(i), each parent brought an administrative action against his or her local education agency and prevailed. Subsequently, each parent brought a federal action for attorneys’ fees pursuant to 20 U.S.C. Section 1415(i)(3)(B). In each case, the district court awarded less attorneys’ fees than the parent requested, and the parents appealed.   The Second Circuit reversed the district court’s denial of travel-related fees in No. 21-1961 and remanded for further proceedings. The court otherwise affirmed the judgments of the district courts. The court found that it was persuaded that there was no abuse of discretion in the district court’s calculation of reasonable attorneys’ fees in each case. Further, the court wrote that the district courts that declined to award prejudgment interest did not abuse their discretion because “delays in payment” may be remedied by “application of current rather than historic hourly rates.” However, the court held that the district court abused its discretion when it denied any travel-related fees to M.D.’s counsel. A district court may permissibly adjust excessive travel costs. But the district court could not “eliminate all of the hours submitted by [CLF] as travel time” by denying travel-related fees altogether. View "H.C. v. NYC DOE, et al." on Justia Law

Child K.T. was born June 2016. Allegheny County Office of Children, Youth and Families (CYF) first became involved with her when she tested positive for cocaine at birth; CYF had been involved with Mother since 2009 regarding an older child. Prompted by continued housing instability, a report of intimate partner violence between Mother and Child’s biological father, and Mother’s failure to follow through with service referrals, CYF sought a finding of dependency in early 2017. For more than two years, while Child remained in a foster home, and prior to CYF filing for termination, Mother was inconsistent with participation in CYF’s recommended services. The orphan court ultimately concluded “terminating the parental rights of Mother does not serve the needs and welfare of the child.” A majority of the Court of Appeals determined the record supported the trial court’s “evaluation of the bond that clearly exists between Mother and Child, and its determination that this bond was worth preserving[,]” and the court was thus within its discretion to deny termination. In this discretionary appeal, the Pennsylvania Supreme Court was asked to determine whether the court that denied CYF’s petition for involuntary termination of a mother’s parental rights gave “primary consideration to the developmental, physical and emotional needs and welfare of the child” as required by 23 Pa.C.S. §2511(b). More specifically, the Court considered whether the court evaluating the parent-child bond must determine whether the bond was necessary and beneficial to the child, and severing the bond would cause the child to experience extreme emotional consequences, rather than a mere “adverse” impact. Upon review, the Supreme Court found error and thus (1) vacated the appellate court's orders and (2) remanded to the trial court for further proceedings. View "In the Int. of: K.T." on Justia Law
