Plaintiff, a police officer for the Metropolitan Transportation Authority (“MTA”), sued the MTA under the Federal Employers’ Liability Act (“FELA”), alleging that the MTA negligently failed to provide him with a safe workplace when it sent him on patrol in a vehicle without a prisoner compartment. A jury found the MTA liable and awarded Plaintiff damages. The MTA moved for judgment as a matter of law notwithstanding the verdict, arguing that it is immune from liability pursuant to the governmental function defense and that the evidence was insufficient to support the verdict because it lacked expert testimony. The district court denied that motion, holding that the governmental function defense does not apply in FELA cases.   The Second Circuit affirmed the district court’s judgment. The court held that the FELA does not abrogate the governmental function defense, and therefore the defense is available in FELA cases. Though the governmental function defense was available for the MTA to assert, the MTA failed to show that the defense barred liability in this case. Here, the defense did not apply on the merits in this case, however, because the MTA has failed to show that it performed a discretionary governmental function when committing the allegedly negligent acts. Additionally, the court held that expert testimony was not required in this case. The Supreme Court reversed the appellate court's judgment reversing in part the decision of the Town Plan and Zoning Commission of the Town of Fairfield extending its approvals of a special permit and a coastal site plan review granted to Fairfield Commons, LLC, holding that a local zoning authority may not, by regulation, condition the continuing validity of a special permit on completing development in connection with the permitted use within a period of time that is shorter than the statutory period.The appellate court in this case affirmed the trial court's judgment concluding that the Commission improperly granted Fairfield Commons' request for an extension of its special permit deadline to complete development but reversed the court's conclusion that the special permit could not be subject to a temporal limitation as a matter of law. The Supreme Court reversed, holding (1) a special permit regulation may not prescribe a shorter time limitation for completing development than the statutory period set forth for completion of development in connection with an accompanying site plan under Conn. Gen. Stat. 8-3(i) and (m); and (2) the appellate court incorrectly concluded that the special permit at issue expired in April 2011. View "International Investors v. Petitioners Wages and White Lion Investments, LLC, d/b/a Triton Distribution (“Triton”) and Vapetasia, LLC (“Vapetasia”) sought to market flavored nicotine-containing e-liquids for use in open-system e-cigarette devices. Petitioners needed to submit premarket tobacco product applications as required by 21 U.S.C. Section 387j—which the Food and Drug Administration (“FDA”) deemed applicable to e-cigarette tobacco products. FDA denied the requested marketing authorizations, finding that Petitioners failed to offer reliable and robust evidence (such as randomized controlled trials or longitudinal studies) to overcome the risks of youth addiction and show a benefit to adult smokers. Petitioners sought review of those marketing denial orders (“MDOs”), and prior to the consolidation of the two cases. Petitioners argued that the FDA lacks the authority to impose a comparative efficacy requirement and that FDA acted arbitrarily and capriciously by “requiring” scientific studies.   The Eleventh Circuit denied the petitions for review. The court explained that Congress passed the Family Smoking Prevention and Tobacco Control Act (“TCA”) in an active effort to protect public health. Relevant here, the Deeming Rule subjected e-cigarette manufacturers to the TCA’s prior authorization requirement—manufacturers of “new tobacco product[s]” must submit premarket tobacco product applications (“PMTAs”). The court held that the FDA’s consideration of the lack of cessation as a risk and comparing that risk between new tobacco products and old tobacco products “fall[s] squarely within the ambit of the FDA’s expertise and merit[s] deference.”  As such, the court cannot say that FDA acted arbitrarily and capriciously by disagreeing with Petitioners as to the significance of the evidence they presented. The Supreme Court denied the claims brought by Erik Jones in this expedited election case, holding that Jones was not entitled to a writ of mandamus based on the doctrine of laches.Jones filed a declaration of candidacy and petition to appear on the August 2, 2022 primary ballot as a candidate for the Republican Party State Central Committee, but the Lorain County Board of Elections did not certify his name to the ballot based on the instructions in Ohio Secretary of State Frank LaRose's Directive 2022-34 to reject declarations and petitions filed after February 2, 2022 by state-central-committee-member candidates. Jones subsequently sought a writ of mandamus compelling LaRose to instruct the county boards of elections to accept declarations of candidacy filed before May 4, 2022. The Supreme Court denied the claims, holding that Jones's unreasonable delay in bringing this lawsuit resulted in prejudice to the Board in its administration of the election. View "State ex rel. Frederick Burkes, Sr. appealed a circuit court judgment entered in favor of James Franklin in an action initiated by Burkes. In March 2020, Burkes defeated Franklin, the incumbent, in a primary election for the office of constable for District 59 in Jefferson County, Alabama. Burkes was unopposed in the general election and was declared and certified as the winner of the election on Friday, November 13, 2020. Thereafter, Franklin sent a letter to the Jefferson Probate Court informing the probate court that Burkes had not filed an official bond within 40 days of the declaration of Burkes's election to the office of constable. The probate court notified the Governor that the bond had not been posted, making the office vacated by operation of law. The Governor thereafter appointed Franklin to the office of constable for District 59. On April 22, 2021, Burkes, acting pro se, initiated this action, which he identified as a quo warranto action, with the circuit court. Burkes alleged in his complaint that he had been sworn into the office of constable on January 4, 2021, and that he had filed an official bond on December 31, 2020, which he contended was timely pursuant to § 36-23- 4, Ala. Code 1975. Also acting pro se, Franklin filed an "answer" in which he also moved for a "summary judgment." In summary, Franklin asserted that Burkes had vacated the office of constable by failing to comply with the pertinent statutory procedure concerning the payment of official bonds. Franklin requested, among other things, that Burkes be ordered to cease and desist all activities concerning the office of constable and that Burkes's quo warranto action be "dismissed with prejudice." The Alabama Supreme Court found that Burkes's failure to give the circuit court security for the costs of this action deprived the circuit court of subject-matter jurisdiction over the action. Because the circuit court lacked subject-matter jurisdiction over this action, its judgment was void. Because a void judgment will not support an appeal, this appeal was dismissed. View "Burkes v. Plaintiff-appellee James Nelson was seriously injured while riding his bicycle on a trail on Air Force Academy property in Colorado. He and his wife, Elizabeth Varney, sued the United States under the Federal Tort Claims Act (“FTCA”). Nelson sought damages for his personal injuries; Varney sought damages for loss of consortium. After several years of litigation, the district court ruled the government was liable for Nelson’s accident and injuries. The court based its decision on the Colorado Recreational Use Statute (“CRUS”). The court awarded Nelson more than $6.9 million, and awarded Varney more than $400,000. In addition to the damages awards, the district court also ordered the government to pay plaintiffs' attorney’s fees. CRUS contained an attorney’s-fees-shifting provision, allowing prevailing plaintiffs to recover their fees against defendant landowners. Providing an exception to the United States’s sovereign immunity, the Equal Access to Justice Act (“EAJA”) provided that “[t]he United States shall be liable for such fees and expenses to the same extent that any other party would be liable under the common law or under the terms of any statute which specifically provides for such an award.” The district court concluded that the government had to pay for plaintiffs' fees. The issue this case presented for the Tenth Circuit's review centered on whether the district court erred in ordering the government to pay the attorney's fees after holding the CRUS qualified under the EAJA as “any statute which specifically provides for” an attorney’s fees award. Petitioner, an Army veteran, arrived at the Tampa International Airport to pick up two of his children who were visiting for the holiday. After a swab of Petitioner’s hands tested positive for traces of explosive material, screening personnel from the Transportation Security Administration attempted to perform a full-body pat-down. Citing medical reasons, Petitioner repeatedly refused to be patted down and was subsequently escorted away from the checkpoint by law enforcement.   The agency assessed Petitioner a civil penalty for “interfer[ing] with screening personnel in the performance of their screening duties[.]” 49 C.F.R. Section 1540.109. Petitioner petitioned the DC Circuit to overturn the penalty on the ground that his refusal to submit to a pat-down, particularly in light of his medical justifications, did not constitute interference under the regulation. The court denied the petition finding that the agency lawfully applied its interference regulation to Petitioner’s conduct.   The court explained that it has recently defined the “ordinary meaning” of interfere as “to interpose in a way that hinders or impedes: comes into collision or be in opposition.” Here, in light of the established meaning, the TSA logically concluded that Petitioner’s conduct interfered with TSA personnel engaged in screening operations. TSA policy requires that whenever an individual triggers a positive explosives alarm, he or she must undergo a full-body pat-down. Petitioner’s repeated resistance to being patted down was “in opposition” to and “r[a]n at cross-purposes” with that policy.   Further, the court found that TSA’s conduct did not approach the level of egregiousness or outrageousness needed to establish a violation of substantive due process. Lanclos was born in 1982 at the Keesler Air Force Base Medical Center. During childbirth, she was seriously injured and as a result, suffers from Athetoid cerebral palsy. The settlement agreement for Lanclos’s medical malpractice suit required the government to make lump sum payments to Lanclos’s parents and their attorney; Lanclos would receive a single lump sum payment followed by specific monthly payments for the longer of 30 years or the remainder of her life. The government would purchase an annuity policy to provide the monthly payments. The government selected Executive Insurance to provide the monthly annuity payments. Executive encountered financial difficulties and, in 2014, reduced the amount of the monthly payments by 42%. Lanclos estimates that the reduction will result in a shortfall of $731,288.81 from the amount described in the settlement agreement.The Court of Federal Claims reasoned that the “guarantee” language in the Lanclos agreement applies to the scheduled monthly structure of the payments but not the actual payment of the listed amounts and that the government was not liable for the shortfall. The Federal Circuit reversed. Under the ordinary meaning of the term “guarantee” and consistent with the agreement as a whole, the government agreed to assure fulfillment of the listed monthly payments; there is no reasonable basis to conclude that the parties sought to define “guarantee” or to give the term an alternative meaning. The Supreme Judicial Court held that the housing appeals committee had jurisdiction over the projects at issue in this case and the power to remove or modify conditions that made such projects significantly more uneconomic.Under the Massachusetts Comprehensive Permit Act, Mass. Gen. Laws ch. 40B, 20-23, qualifying developers of low or moderate income housing have access to a comprehensive streamline permitting process and expedited appeal before HAC. The Act further authorizes HAC to strike or modify any conditions on a comprehensive permit application that would make it "uneconomic" to proceed with a project. At issue was whether the HAC has the power to reject conditions where a project has received a funding commitment from a public subsidizing agency and the developer receives a comprehensive permit subject to conditions but the rate of return for the original proposal is found to be uneconomic and HAC determines that the imposed conditions make the project "significantly more uneconomic" and therefore rejects them. The Supreme Judicial Court answered the question in the affirmative, holding that HAC is authorized to eliminate conditions that effectively prevent such projects by rendering them significantly more uneconomic. This case was the second appeal arising out of a dispute over the operation of a commercial self-storage facility (Treelake Storage) within a planned unit development in Granite Bay (Treelake Village). Silversword Properties, LLC (Silversword) owned the property upon which K.H. Moss Company and Moss Equity (collectively, Moss) operated Treelake Storage. In a separate but related lawsuit filed in 2017, Parkford Owners for a Better Community (Parkford) challenged Placer County’s (County) issuance of a building permit for the construction of an expansion of Treelake Storage, arguing that the County failed to comply with both the California Environmental Quality Act (CEQA) and the Planning and Zoning Law. The trial court concluded: (1) the County’s issuance of the building permit was ministerial rather than discretionary, and therefore CEQA did not apply; and (2) Parkford’s challenge under the Planning and Zoning Law was barred by the statute of limitations. Parkford appealed. In August 2020, a different panel of the Court of Appeal dismissed the appeal, concluding that completion of the challenged expansion of Treelake Storage prior to entry of judgment rendered moot Parkford’s challenge to the County’s issuance of a building permit authorizing construction of the expansion. In June 2021, the trial court concluded that the lawsuit here, filed by Parkford in 2018 and challenged the County’s issuance of a business license for the operation of Treelake Storage, was barred by both aspects of the doctrine of res judicata--claim and issue preclusion. The Court of Appeal concluded “Parkford I” was not a final judgment “on the merits,” therefore res judicata did not operate to bar this suit.
