Valentine v. Collier
Shortly after COVID-19 struck the Wallace Pack Unit, plaintiffs filed suit seeking injunctive relief on behalf of three certified classes of inmate for violations of the Eighth Amendment, the Americans with Disabilities Act (ADA), and the Rehabilitation Act. Specifically, plaintiffs alleged that defendants acted with deliberate indifference to their health and safety in violation of the Eighth Amendment in light of the dangers of COVID-19 for a geriatric prison population, and that defendants violated the ADA and Rehabilitation Act by failing to accommodate for specific risks to wheelchair-bound and other mobility-impaired inmates.On April 16, 2020, the district court entered a preliminary injunction which was stayed by the Fifth Circuit on April 22 and then vacated on June 5. On September 29, 2020, the district court issued a permanent injunction, concluding that plaintiffs did not need to exhaust administrative remedies; defendants were deliberately indifferent; and defendants violated the ADA and the Rehabilitation Act.The Fifth Circuit reversed the district court's permanent injunction and rendered judgment for defendants. The court concluded that the prison officials were not deliberately indifferent based on a lack of a systemic approach. After considering Policy B-14.52, its unwritten additions, and its administration, the court explained that the record does not support a finding of deliberate indifference in the way the officials considered and adopted a response to COVID-19. The court also concluded that the prison officials were not deliberately indifferent based on a failure to abide by basic public health guidance regarding testing, social distancing, mask use, handwashing, sanitation, and cleaning. Finally, the court concluded that the mobility-impaired inmates failed to establish their prima facie ADA claim, and consequently their Rehabilitation Act claim. View "Valentine v. State, ex rel. Young v. Schnell
The Supreme Court reversed the conclusion of the court of appeals that this appeal was moot but affirmed the court's decision dismissing the appeal, holding that Appellant, a Level III predatory offender serving the conditional release term of his sentence, was not entitled to a writ of habeas corpus.Before the time that Appellant filed this habeas petition, his conditional release had been revoked on five separate occasions. An order was later entered preventing the Department from using Appellant's inability to maintain an agent-approved placement due to his epilepsy as a basis for future revocations of his conditional release. In his habeas corpus petition, Appellant argued that his epilepsy was the sole reason for the revocation of his conditional release and continued incarceration. During the appeal from the denial of relief the Department released Appellant from prison. The court of appeals determined that Appellant's release from prison rendered his appeal moot. The Supreme Court affirmed in part and reversed in part, holding (1) the mootness exception applied in this case; and (2) The Department did not violate Appellant's substantive due process rights or the rule of law set forth in State ex rel. National Audubon Society v. United States Army Corps of Engineers
The Society field suit challenging the Corps' issuance of a permit to the Town of Ocean Isle Beach to construct a shoreline jetty to stop chronic erosion of its beaches. The Society claimed that numerous analyses conducted by the Corps in both its Environmental Impact Statement (EIS) and its Record of Decision were inconsistent with the National Environmental Policy Act (NEPA) and the Clean Water Act (CWA).The Fourth Circuit applied a deferential standard of review under the Administrative Procedure Act and affirmed the district court's grant of summary judgment for the Corps, concluding that the Corps adequately examined the relevant facts and data and provided explanations that rationally connected those facts and data with the choices that it made. In this case, the Corps collected a broad range of data drawn from the facts and objectives of the project at issue, historical statistics and records, computer analyses, and opinions of other specialized agencies, and it analyzed those data to make judgments ultimately based on its own special expertise under the numerous criteria imposed by NEPA and the CWA. Miller v. United States
Plaintiff appealed the district court's dismissal of his complaint, alleging various causes of action arising from his termination as a police officer with the Reno-Sparks Indian Colony, a federally recognized Indian Tribe.The Ninth Circuit agreed with the district court that, to the extent that plaintiff's claims alleged that the Tribe's decision to fire him was retaliatory, those claims are barred by the discretionary function exception of the Federal Tort Claims Act. The panel applied the two-part Gaubert-Berkovitz test and concluded that the discretionary function test bars plaintiff's two retaliation-based wrongful termination claims. In regard to plaintiff's third cause of action alleging that his termination was wrongful, the panel concluded that the first element of the Gaubert-Berkovitz test was not met and the discretionary function exception did not apply. Therefore, the district court erred in concluding that plaintiff's third cause of action was barred. Finally, the panel concluded that the district court erred in determining that the discretionary exception function barred the two additional claims plaintiff sought to raise in the Third Amended Complaint. Secretary of Labor v. Knight Hawk Coal, LLC
The Federal Mine Safety and Health Amendments Act, 30 U.S.C. 801, requires the Secretary of the Department of Labor, through the Mine Safety and Health Administration (MSHA), to negotiate mine-specific ventilation plans with companies that operate the mines. In 2006-2018, Knight Hawk Coal operated its Prairie Eagle Mine pursuant to an MSHA-approved ventilation plan that permitted perimeter mining with 40-foot perimeter cuts. In 2018, MSHA conducted a ventilation survey at Prairie Eagle and concluded that the approved plan did not adequately ventilate the perimeter cuts. MSHA relied primarily on the results of chemical smoke tests, which involved survey team members observing smoke movement from a 44-foot distance. Months later, MSHA revoked the Prairie Eagle ventilation plan. After receiving a technical citation from MSHA for operating without an approved plan, Knight Hawk sought review by the Federal Mine Safety and Health Review Commission.The Commission’s ALJ found the revocation arbitrary and capricious, in part because the chemical smoke test results were unreliable and inconsistent and the Secretary ignored disagreements among MSHA ventilation survey team members regarding the results. The ALJ reinstated the previously-approved ventilation plan. The Commission affirmed, concluding that the Secretary failed to explain adequately why the existing ventilation plan was deficient. The D.C. Circuit denied the Secretary’s petition for review, finding that substantial evidence supports the ALJ’s finding. View "Secretary of Labor v. Knight Hawk Coal, LLC" on Justia Law
Shafer & Freeman Lakes Environmental Conservation Corp. v. Federal Energy Regulatory Commission
In 2012, U.S. Fish and Wildlife Service scientists discovered that endangered mussels were dying on the banks of Indiana's Tippecanoe River. The Service focused on the upstream Oakdale Dam, which significantly restricts the flow of water downstream in order to generate hydroelectricity and to create a lake. The Service worked with Oakdale's operator to develop new procedures that would require the dam to release more water during droughts. After a lengthy process of interagency cooperation and public dialogue, the new procedures were approved by the Federal Energy Regulatory Commission, which has licensing authority over hydroelectric dams on federally regulated waters.Local governmental entities sought review of the Commission’s decision and the Service’s Biological Opinion upon which the Commission relied. The D.C. Circuit affirmed in part. The court rejected some challenges to the validity of the Biological Opinion, which were not raised on rehearing before the Commission. There was otherwise no error in the agencies’ expert scientific analyses. The agencies failed to adequately explain why the new dam procedures do not violate a regulation prohibiting the Service from requiring more than “minor” changes to the Commission’s proposal for dam operations. Because vacating the agencies’ decisions would subject the dam operator to contradictory legal obligations imposed by separate agencies, the court remanded to the Commission without vacatur for further proceedings. In re S.R., Juvenile
Juvenile S.R. appealed a family division order granting the Department for Children and Families' (DCF) request to place him in a secure out-of-state psychiatric residential treatment facility pursuant to 33 V.S.A. 5926. In November 2019, mother stipulated that S.R. was CHINS. The stipulated merits order indicated that S.R. and mother were homeless, mother needed to undergo a medical procedure that would preclude her from caring for S.R., and S.R. had mental health and behavioral needs that needed continued treatment. The stipulated order included a statement that S.R. did not meet criteria for voluntary or involuntary mental health admission. Mother stipulated that she was unable to meet S.R.’s needs for stability, housing, and mental and behavioral health services. The COVID-19 pandemic struck, delaying court hearings. Over the following months, S.R. moved through a series of ten to twelve placements. The constant changes in placement prevented S.R. from establishing any therapeutic connections with service providers and also inhibited S.R.’s educational progress. S.R. was charged with delinquency several times after he reportedly became abusive during three of his placements. DCF, Mother and S.R.'s guardian ad litem eventually agreed on a placement in Harbor Point, Virginia. S.R. himself objected to placement at Harbor Point, and to any other placement out-of-state, unless a program could be found in New York, where his mother was living at the time of the hearing. The court ultimately granted DCF’s motion for out-of-state placement, finding that there were no equivalent facilities in Vermont, and that placement at Harbor Point was in S.R.’s best interest. On appeal, S.R. argued the court erred in granting the motion for out-of-state placement in the absence of any psychiatric or psychological evaluation supporting a conclusion that psychiatric residential treatment was necessary for him. He contended his placement was akin to the involuntary commitment of an adult, and that involuntary commitment decisions had to be supported by full psychiatric evaluations and expert testimony. The Vermont Supreme Court concluded the order was not supported by sufficient evidence, and reversed. "While we have no doubt that everyone involved in the proceeding below was concerned with S.R.’s best interest and acted in good faith, and it may be that DCF’s position is ultimately adequately supported, the record simply does not contain the sort of expert evidence required to support long-term placement in a locked psychiatric residential treatment facility over S.R.’s objection." Billewicz, et al. v. Town of Fair Haven
Plaintiffs Johnathan Billewicz, Michael Billewicz, J & M Investment Trust, and Lillian Billewicz appealed a the trial court’s grant of summary judgment to defendant Town of Fair Haven. Plaintiffs sought damages and a declaratory judgment that deeds purporting to convey their properties to the Town following a tax sale were void. The court found their action was foreclosed by the one-year statute of limitations at 32 V.S.A. 5294(4) for claims challenging the validity of a tax collector’s acts. Plaintiffs argued this was error because their claims were instead subject to the three-year statute of limitations for actions for the recovery of land sold at a tax sale under 32 V.S.A. 5263. Public Utility Commission of Texas v. Texas Industrial Energy Consumers
The Supreme Court reversed the judgment of the court of appeals reversing the judgment of the trial court upholding the determination of the Public Utility Commission that Southwestern Electric Power Company (SWEPCO) met its burden of establishing that its decision to build a power plant was a prudent one and allowing SWEPCO to include the plant's construction costs in its utility rates, holding that the court of appeals erred.In reversing, the court of appeals concluded that the Commission had used an improper standard for assessing SWEPCO's decision to complete construction of the plant and that, because SWEPCO did not produce independent expert testimony, the Commission's decision was without a proper basis. The Supreme Court reversed, holding (1) the Commission properly applied its standard in evaluating SWEPCO's decision to complete construction; and (2) substantial evidence supported the Commission's decision. Merryman v. University of Baltimore
In this grievance proceeding, the Court of Appeals affirmed the judgment of the court of special appeals vacating the judgment of the circuit court affirming in part and reversing in part the decision of the ALJ and remanding with instructions to dismiss the proceeding, holding that the complaint did not present a grievable issue.Keith Merryman, a police officer employed by the University of Baltimore and the president of the Fraternal Order of Police, Lodge 146 (the Union), initiated a grievance proceeding complaining about holiday leave. The ALJ ruled in favor of the Union. The circuit court affirmed in part and reversed in part. The court of special appeals held that the ALJ lacked jurisdiction over the complaint because the dispute was not a grievable issue. The Court of Appeals affirmed, holding that, under the memorandum of understanding in this case, which incorporated the grievance procedures set forth in Md.
