Outdoor Amusement Business Association, Inc. v. Department of Homeland Security
In 2008, Homeland Security passed rules requiring that employers receive a favorable labor certification from Labor before obtaining a visa. Homeland Security and Labor jointly issued a new series of rules in 2015. Plaintiffs, a group of employers and associations whose members rely on H-2B visas, filed suit challenging Homeland Security's 2008 Rules and the joint 2015 Rules as exceeding the agencies' statutory authority.The Fourth Circuit held that there is standing to challenge the 2008 Rules but the challenge is time-barred; there is standing to challenge the 2015 Program and Wage Rules; and the 2015 Program and Wage Rules are valid exercises of Labor's implied delegation to rulemake as part of its duty as Homeland Security's chosen consulting agency. The court explained that this implied delegation is evident from the statutory circumstances in the Immigration and Nationality Act, including the requirement that Homeland Security engage in "consultation with appropriate agencies," the definition of H-2B, and Labor's rulemaking powers for similar visas. The court concluded that, while there are limits on which agencies Homeland Security can choose and on those agencies' ability to rulemake, Labor's 2015 Program and Wage Rules fall within both boundaries. Seal v. Welty d/b/a North Country Services
A worker died at a construction site when a retaining wall collapsed. Neither the putative employer, who claimed the worker was an independent contractor, nor the property owner, who hired the putative employer, had workers’ compensation coverage. The worker’s mother, who also was the personal representative of the worker’s estate, filed both a workers’ compensation claim against the Alaska Workers’ Compensation Benefits Guaranty Fund and a superior court wrongful death action against both the putative employer and the property owner. The Fund later caused the property owner, the putative employer, and the worker’s father to be joined as parties to the workers’ compensation claim before the Alaska Workers’ Compensation Board.All parties to the workers’ compensation proceeding, except the putative employer, entered into a settlement agreement; in the settlement the estate elected the wrongful death suit as its remedy, agreed to dismiss the workers’ compensation claim entirely to effectuate its remedy election, received a settlement payment from the property owner’s general liability insurer, and dismissed the wrongful death claim against the property owner. The agreement explicitly preserved the estate’s wrongful death claim against the putative employer. The Board approved the agreement, and the superior court dismissed the property owner from the wrongful death action based on a separate stipulation. The putative employer then sought dismissal of the wrongful death suit, contending that the Alaska Workers’ Compensation Act’s exclusive liability provision precluded the lawsuit because the settlement effectively paid workers’ compensation benefits to the estate. The superior court granted the putative employer summary judgment, relying on the Act to decide that the Board’s approval of the settlement transformed the settlement money into workers’ compensation benefits. Because the superior court misinterpreted the settlement agreement and the Act, the Alaska Supreme Court reversed the grant of summary judgment and remanded for further proceedings. View "Seal v. Ashe County v. Ashe County Planning Board
In this dispute between petitioner Ashe County Board of Commissioners and respondents Ashe County Planning Board and Appalachian Materials, LLC arising from Appalachian Materials' application for a permit pursuant to the County's Polluting Industries Development Ordinance authorizing Appalachian Materials to operate a portable asphalt production facility on property located in Ashe County, the Supreme Court held that the case should be remanded due to errors by the court of appeals.After the Planning Board ordered that a permit be issued to Appalachian Materials Ashe County sought judicial review. The trial court ordered the County to issue the requested permit within ten business days. The court of appeals affirmed the challenged trial court order. At issue before the Supreme Court was whether the County's failure to appeal a letter written by the Planning Director gave that letter partially binding effect. The Supreme Court reversed in part and remanded the case, holding that the court of appeals erred by holding that Ashe County lost its right to challenge the issuance of the contested permit because it failed to seek review of opinions that the Planning Director expressed in the letter. Massachusetts Department of Telecommunications & Cable v. Federal Communications Commission
The First Circuit denied the petition for review filed by the Massachusetts Department of Telecommunications and Cable (MDTC) challenging the FCC's determination that the cable system operated by Charter Communications, Inc. in Massachusetts was subject to "effective competition" in its franchise areas under the statutory Local Exchange Carrier (LEC) test, Telecommunications Act of 1996, 301(b)(3)(C), 47 U.S.C. 543(1)(1)(D), holding that the FCC did not act arbitrarily and capriciously.In 2018, Charter, a cable operator, sought a determination that it faced effective competition in its franchise areas in Massachusetts and Kauai, Hawaii because the availability of DIRECTV NOW in those franchise areas constituted effective competition under the LEC test. The FCC granted Charter's petition. The First Circuit affirmed, holding that the FCC's findings were not arbitrary and that the FCC properly interpreted its regulations and acted reasonably. Marquez-Paz v. Barr
The First Circuit denied Petitioner's petition for review of the decision of the Board of Immigration Appeals (BIA) denying his applications for asylum, withholding of removal, and protection under the United Nations Convention Against Torture (CAT), holding that Petitioner was not entitled to relief.After the Department of Homeland Security initiated removal proceedings against him Petitioner conceded removability but cross-applied for asylum, withholding of removal, and protection under CAT. The immigration judge denied the petition, determining, as relevant to this appeal, that Petitioner suffered no persecution and that any alleged persecution was not caused by his membership in a particular social group. The BIA affirmed. The First Circuit affirmed, holding that Petitioner's claim failed because he did not prove a nexus between the alleged persecution and a statutorily protected ground. Trump v. New York
Every 10 years, the U.S. undertakes an “Enumeration” of its population “in such Manner” as Congress “shall by Law direct.” The Secretary of Commerce must “take a decennial census of population . . . in such form and content as he may determine,” 13 U.S.C. 141(a), and report to the President, who must transmit to Congress a “statement showing the whole number of persons in each State, excluding Indians not taxed, as ascertained” under the census, 2 U.S.C. 2a(a), applying the “method of equal proportions” formula to the population counts to calculate the number of House seats for each state.In July 2020, the President issued a memorandum to the Secretary, announcing a policy of excluding from the apportionment base aliens who are not in lawful immigration status. The President ordered the Secretary “to provide information permitting the President, to the extent practicable, to exercise the President’s discretion to carry out the policy.”The Supreme Court vacated an injunction, prohibiting the Secretary from including the information needed to implement the President’s memorandum and directed dismissal of the lawsuits for lack of jurisdiction. The threatened impact of an unlawful apportionment on congressional representation and federal funding does not establish a “legally cognizable injury.” Any chilling effect from the memorandum dissipated upon the conclusion of the census. The Secretary has not altered census operations in a concrete manner that will predictably change the count. Any prediction of how the Executive Branch might eventually implement the general statement of policy is conjecture. It is unclear how many aliens have administrative records that would allow the Secretary to avoid impermissible estimation; whether the Census Bureau can timely match its records to census data; and to what extent the President might direct the Secretary to “reform the census” to implement his general policy. The plaintiffs suffer no concrete harm from the challenged policy, which does not require them “to do anything or to refrain from doing anything.” View "Trump v. New York" on Justia Law
PSSI Global Services, LLC v. Federal Communications Commission
The DC Circuit upheld the FCC's order significantly narrowing a frequency band dedicated to fixed satellite transmissions in order to make room for the emerging fifth generation of mobile cellular technology. At issue in this case is whether this change permissibly modified the existing station licenses of three small satellite operators (SSO) and PSSI, a company that broadcasts live events through satellites. The SSOs and PSSI each filed an appeal for review of the FCC's order under 47 U.S.C. 402(b) and a petition under 47 U.S.C. 402(a).In this case, the SSOs and PSSI principally argue that the order exceeds the FCC's statutory authority to modify existing station licenses. The court concluded that, although the governing statutes by their terms speak only of licenses, the FCC gives market access grants the same protection that it gives to full Commission licenses. The court rejected the SSO's claims that the change to their market access grants was too fundamental to qualify as a modification under section 316(a)(1) of the Communications Act of 1934; that the FCC arbitrarily restricted their future business opportunities and excluded them from receiving compensation from the future 5G providers; and that the FCC impermissibly sanctioned them without prior notice. The court also rejected PSSI's claim that its licenses to transmit within the C-band uplink have been fundamentally changed. Rather, substantial evidence supported the FCC's conclusion that earth stations—including PSSI's mobile ones—will be able to "provide the same services" to their customers after the license modification. Harts v. County of Knox
The Supreme Court affirmed the judgment of the district court reversing and vacating the decision of the County of Knox board of supervisors approving a conditional use permit for an expansion of H&H Cattle's feedlot to 20,000 head of cattle, holding that there was no merit to Defendants' appeal.In 2003, H&H Cattle, the predecessor in interest of Epic Land and Cattle, LLC, obtained an impact easement from the mother of Plaintiffs. Thereafter, the County's board of supervisors approved a conditional use permit for an expansion of H&H Cattle's feedlot to 7,500 head of cattle. Fourteen years later, H&H Cattle again sought expansion of its feedlot. Relying in part on the 2003 impact easement, the board of supervisors granted the conditional use permit. The district court reversed and vacated the decision approving the permit. The Supreme Court affirmed, holding (1) the district court did not err in finding Plaintiff was unable to execute an easement that bound the shares of her children; (2) Defendants' arguments regarding estoppel by deed and ratification were without merit; and (3) any reliance on the easement was not reasonable. City of Fresno v. Fresno Building Healthy Communities
The City filed a complaint for declaratory relief to establish whether Measure P, the Fresno Clean and Safe Neighborhood Parks Tax Ordinance, has been duly enacted through the voters' initiative power. On the same day the City filed its action, FBHC filed its own complaint for declaratory relief and petition for writ of mandate, seeking a declaration declaring that Measure P had been duly enacted.The Court of Appeal consolidated the cases and endorsed the holdings and reasoning of All Persons City and County of San Francisco v. All Persons Interested in the Matter of Proposition C (2020) 51 Cal.App.5th 703, 708. Finding that All Persons was controlling in this case, the court concluded that neither Proposition 13 nor Proposition 218 affects the voters' initiative power, and therefore neither imposes a two-thirds voting requirement on the passage of voter initiatives that impose special taxes. The court rejected the Association's policy argument, noting that the Association's policy concerns are best addressed by the Legislature. The court reversed the judgments; on the City's action, the court ordered the trial court to enter a new judgment in favor of FBHC declaring that Measure P has passed; and on FBHC's action, the court directed the trial court to enter a new judgment granting FBHC's request for declaratory relief and declaring that Measure P has passed. International Union of Operating Engineers v. Daley
Wisconsin grants public-sector employees the right to bargain collectively through the State Employment Labor Relations Act (SELRA) and the Municipal Employment Relations Act (MERA). In 2011, SELRA and MERA were amended by Act 10, which divided Wisconsin state and municipal employees into “[p]ublic safety employee[s],” which includes police officers, firefighters, and deputy sheriffs, and “general municipal employee[s],” i.e., everyone else. A subsequent amendment created a class of “[t]ransit employee[s].” Public safety and transit employees and their unions continue to operate under the pre-Act 10 scheme but for general employees, Act 10 limited the scope of employers’ collective bargaining obligations, prohibiting bargaining over anything except increases to base wages and mandating that general employee unions submit to an annual recertification election. Certification now requires affirmative votes from an absolute majority of all employees in the bargaining unit, not just those voting. Act 10 bars public employers from deducting union dues from the earnings of general employees.The Seventh Circuit has previously rejected two challenges to Act 10’s constitutionality and affirmed the dismissal of this First Amendment suit, filed a public-employee labor union and two of its members, challenging the annual recertification requirement, the limitations on collective bargaining, and the prohibition on payroll deduction of union dues.
