City of Littleton v. Indus. Claim Appeals Office
Littleton firefighter Jeffrey Christ was diagnosed with glioblastoma multiforme (“GBM,” a type of brain cancer). After undergoing surgery, chemotherapy, and radiation, he returned to work, but ultimately died as a result of the disease. He (and later his widow and child) sought workers’ compensation benefits to cover his cancer treatment, asserting that his brain cancer qualified as a compensable occupational disease under the “firefighter statute” of the Workers’ Compensation Act of Colorado. .At issue here was whether Christ’s employer, the City of Littleton, and Littleton’s insurer, Cannon Cochran Management Services, Inc. (collectively “Littleton”), successfully overcame a statutory presumption that Christ’s condition resulted from his employment as a firefighter. After review, the Supreme Court held that the employer, through a preponderance of the evidence, could meet its burden to show the firefighter's cancer "did not occur on the job" by establishing the absence of specific causation. Here, the ALJ applied the statutory presumption and found that Littleton established by a preponderance that Christ's GBM condition was not caused by his occupational exposures. A panel of the Industrial Claim Appeals Office (“Panel”) reversed, concluding that Littleton’s medical evidence was insufficient to overcome the presumption. In a split decision, a division of the court of appeals affirmed the Panel. Because the Supreme Court disagreed with the court of appeals’ interpretation of the breadth of the statutory presumption and of the employer’s burden to overcome the presumption, the Court concluded that the court of appeals erroneously evaluated the medical evidence presented by Littleton and erroneously failed to defer to the ALJ’s findings of fact, which are supported by substantial evidence. The court of appeals' judgment was therefore reversed and the case remanded back to the Panel for reinstatement of the ALJ’s original findings of fact, conclusions of law, and order. Timothy G. v. Alaska Dept. of Health & Social Services
Timothy G. alleged he was abused by his stepfather repeatedly between 1997 and 2006. In 2006, Timothy reported the abuse to his mother. She took Timothy and his four siblings to a shelter, sought a protective order against the stepfather, and instituted divorce proceedings. The Office of Children’s Services (OCS) then substantiated the report of harm, removed the children from their mother’s care, and placed them in foster care. In 2012, Timothy filed a complaint naming OCS and his stepfather as defendants. He sought compensatory damages from OCS, claiming that “[a]s a direct and proximate consequence of [OCS’s] breach of [its] dut[y] of care, [he] suffered physical injury, psychological and emotional injury and distress, psychological torment, torture and sexual abuse, pain and suffering, and resultant loss of earning capacity.” Timothy alleged that OCS had investigated at least ten reports of harm involving him and his siblings, but had taken no action. In response to OCS' motion to dismiss, Timothy G. asserted that the statute of limitations had been tolled on his claim because he was mentally incompetent following those years of abuse. The superior court held an evidentiary hearing on this issue and concluded that Timothy had failed to prove that he was incompetent. On appeal, Timothy argued that the superior court should have ruled in his favor if he produced more than a scintilla of evidence to support his assertion. But the Supreme Court concluded that the superior court applied the proper burden of proof and the proper test for competency, and that the court did not clearly err in finding that Timothy did not prove his incompetence. Green v. Industrial Special Indemnity Fund
The Industrial Special Indemnity Fund (ISIF) appeals a decision of the Industrial Commission in which the Commission concluded that ISIF must pay a portion of Roy Green’s disability benefits because Green had a pre-existing condition. In 2006, Green was logging alone when a 1700-pound tree fell on him, striking him on his hardhat. The accident occurred after another tree that he had just felled knocked the culpable tree loose. Green avoided being crushed only because of the presence of a nearby stump. When Green came to, he found that his legs were tingling, he had little sensation and difficulty walking. Green managed to drive to St. Maries to seek medical treatment. After receiving treatment from various physicians and completing an Independent Medical Evaluation (IME), Green was referred to neurosurgeon Dr. Bret Dirks. Dr. Dirks diagnosed Green with a lower back injury that was directly related to the 2006 Accident. Dr. Dirks recommended surgery, and in early 2007, Green underwent a bi-level lumbar fusion with decompression surgery from L3 to L5. Following the surgery, Green expressed concern about “right-sided neck pain that goes into the right arm and makes it feel like jelly.” MRI images of Green’s cervical spine taken on July 11, 2006, and May 23, 2007, showed, among other things, a bulging disk at C5–6. Dr. Dirks recommended an anterior cervical discectomy and fusion at C5–6 with plating and cadaver bone. Dr. Dirks attributed the need for this surgery to the 2006 Accident. On October 30, 2006, Green filed a complaint against St. Joes Salvage Logging (Employer) and Travelers Indemnity Company (Surety). Two years later, on November 6, 2008, Employer/Surety filed a complaint against ISIF. The Industrial Commission considered whether Green had pre-existing injuries that subjected ISIF to liability. The ISIF appealed when the Commission held that it was responsible for a portion of Green's disability benefits. Finding no reversible error, the Supreme Court affirmed the Commission. View "Green v. Loyd v. Michelin North America, Inc.
Claimant James Loyd was awarded permanent partial disability benefits after being injured on the job. Loyd did not appeal, and the order became final. Less than a month after such order was issued, Loyd filed a "Form 9" requesting continuing medical maintenance and requesting a portion of his permanent partial disability award be commuted to a lump sum payment. When this request was denied and the denial upheld by the Workers' Compensation Court and Court of Appeals, he appealed. Upon consideration, the Supreme Court hold that a claimant may seek to commute his or her permanent partial disability award after the hearing on permanent partial disability under 85 O.S. 2001 sec. 41(A). Additionally, the Court concluded that because Loyd did not request reservation of continuing medical maintenance and the trial court's order awarding permanent partial disability did not address or reserve the issue of continuing medical maintenance, Loyd's only recourse was to seek continuing medical maintenance through a reopening proceeding under 85 O.S. 2001 sec. 28. Dept. of Human Svcs v. Bruce
Claimant Nancy Bruce worked as a Certified Nurse's Assistant, or "residential life staff aide," for the Oklahoma Department of Human Services for twenty-six years. Her duties consisted primarily of lifting clients, cleaning them up, feeding them, and daily care. In 2012, Claimant was injured while lifting one such client. Although her Employer admitted the injury, the trial court denied compensability finding Claimant's employment was not the major cause of her injury. Claimant appealed, and a three-judge panel reversed and found that Claimant's employment was the major cause of the injury to her neck. Employer appealed, and the Court of Civil Appeals reversed the order of the three-judge panel. Upon review, the Supreme Court held that the three-judge panel's decision finding Claimant's work-related injury was the major cause of Claimant's neck injury was not against the clear weight of the evidence. Sikkelee v. Precision Airmotive Corp
The Textron Lycoming engine, manufactured in 1969, was installed on a Cessna aircraft in 1998. It was overhauled in 2004, with a carburetor in accordance with Lycoming’s type-certificated design. Sikkelee was piloting the aircraft when it crashed shortly after taking off. Sikkelee died. His estate sued, claiming that the aircraft lost power as a result of a malfunction or defect in the carburetor. The court held that Sikkelee’s claims, which were premised on state law standards of care, fell within the preempted “field of air safety.” An amended complaint incorporated federal standards of care by alleging violations of FAA regulations. Before trial, the court concluded that the federal standard of care was established in the type certificate. Reasoning that the FAA issues a type certificate based on its determination of compliance with pertinent regulations, it held that the FAA’s issuance of a type certificate for the engine meant that the federal standard of care had been satisfied as a matter of law. The court granted Lycoming partial summary judgment and certified an immediate appeal. The Third Circuit reversed, concluding that federal statutes and FAA regulations reflect that Congress did not intend to categorically preempt aircraft products liability claims. Subject to traditional principles of conflict preemption, including concerning specifications included in a type certificate, aircraft products liability cases may proceed using a state standard of care. Kendrick v. City of Midfield
Keneisha Kendrick appeals from a summary judgment entered against her and in favor of the City of Midfield ("the City") and one of its police officers, Joseph Wordell, in her action for damages based on personal injuries she sustained as a result of a car accident. Wordell had been dispatched in response to a domestic-disturbance call; he was traveling south on Highway 11 in his City-owned, police-outfitted Ford Crown Victoria automobile. Wordell testified that, upon receiving the dispatch, he turned on his emergency lights and siren and began proceeding toward the scene of the domestic disturbance. Kendrick was on her way to work and was traveling eastward on Woodward Road toward Highway 11 in a Ford Freestyle sport-utility vehicle owned by her mother. Kendrick was planning to turn left onto Highway 11. The front of Kendrick's vehicle collided with the right front passenger side of Wordell's vehicle. The impact of the crash rendered Kendrick unconscious. The impact of the collision caused Wordell's vehicle to veer across the median and two lanes of traffic in the opposite direction on Highway 11 and to collide head-on with a third vehicle. After review, the Alabama Supreme Court concluded there remained disputed facts in the record, for which granting summary judgment was inappropriate. Hartzell v. Palmetto Collision
Petitioner Richard Hartzell appealed the court of appeals' decision to reverse the South Carolina Workers' Compensation Commission's determination that he was entitled to medical benefits for a work-related back injury. Petitioner argued the record contained substantial evidence to support the Commission's finding that he reported his work-related injury to Employer within the requisite time, and therefore, the court of appeals erred in reversing the Commission's order based on this issue. Maxwell v. Sprint PCS
In 2014, Petitioner Theresa Maxwell suffered an injury to her knee while working for her Employer, Respondent Sprint PCS. She promptly notified her Employer and timely filed a CC-Form-3 with the Workers' Compensation Commission. The Employer admitted Petitioner's injury to her knee was compensable, and she had surgery to repair a tendon in her knee. Petitioner also received temporary total disability benefits from February 6, 2014, until February 24, 2014. After reaching maximum medical improvement on July 2, 2014, she returned to her pre-injury position with her employer earning her pre-injury wages. Later that year, Petitioner filed a request for a contested hearing on the issue of permanent partial disability. The ALJ concluded that Petitioner sustained 2% permanent partial disability to the body as a whole as a result of the injury to her knee and that the rate of compensation was $323.00 for a total award of $2,261.00. However, because she returned to her pre-injury position and pay, the ALJ ordered the award of benefits be deferred at a rate of $323.00 beginning July 2, 2014, for every week Petitioner worked in her pre-injury or equivalent job. Petitioner appealed the order, and the Workers' Compensation Commission sitting en banc affirmed. The Supreme Court concluded that scheduled members are exempt from the AMA Guides under the AWCA. The Court also held that the permanent partial disability deferral provision of 85A O.S. Supp. 2013 sec. 45(C)(5) was an unconstitutional violation of due process under Art. 2, section 7.51 Sections 45(C)(5)(a-e) were invalid and stricken. The deferral of permanent partial disability benefits to a subclass of injured workers under 85A O.S. Supp. 2013 sec. 46(C) was an unconstitutional special law under Art. 5, sec. 59.52. Only that portion of Section 46(C) that made the deferral provision applicable to injuries to the body as a whole or "other cases" was invalid. Any definitional provisions found in 85A O.S. Supp. 2013 section 2, as were deemed invalid to the extent they were inconsistent with the Court's opinion with regard to this matter. On remand, the Commission, through its ALJs, were mandated to take all action necessary to implement the pronouncement made by this case. View "Maxwell v. Sprint PCS" on Justia Law
Vandenberg v. Dept. of Health & Social Services
After a work-related injury left appellant Laurie Vandenberg (a nurse) with a permanent partial impairment, she applied for reemployment benefits. The rehabilitation specialist assigned to her case used two job descriptions to describe one of her former jobs because the specialist did not think that a single job description adequately described that former job. The Alaska Workers’ Compensation Board decided that only one job description was needed and that appellant retained the physical capacity to perform the functions of that job description; it therefore denied her reemployment benefits. The Alaska Workers’ Compensation Appeals Commission affirmed the Board’s decision. Appellant appealed, arguing that the Board erred in selecting only one job description because the job description it selected did not adequately describe the job she held.
