The Association of American Physicians and Surgeons maintains a website and publishes the Journal of American Physicians and Surgeons, both of which host information concerning “important medical, economic, and legal issues about vaccines,” The Association, joined by an individual, sued a Member of Congress (Schiff) who wrote to several technology and social media companies before and during the COVID-19 pandemic expressing concern about vaccine-related misinformation on their platforms and inquiring about the companies’ policies for handling such misinformation. The Association alleged that the inquiries prompted the technology companies to disfavor and deprioritize its vaccine content, thereby reducing traffic to its web page and making the information more difficult to access.The D.C. Circuit affirmed the dismissal of the complaint for lack of Article III standing. The Association has not plausibly alleged injury-in-fact; it maintains that Schiff’s actions interfered with its “free negotiations” with the technology companies but never alleged that it has made any attempts at such negotiations, nor that it has concrete plans to do so in the future. The Association’s other claimed injuries, to its financial prospects and to its speech and associational interests, are not adequately supported by allegations that any injury is “fairly traceable” to Schiff’s actions. The Fourth Circuit considered for the second time the Wikimedia Foundation's contentions that the government is spying on its communications using Upstream, an electronic surveillance program run by the NHS. In the first appeal, the court found that Wikimedia's allegations of Article III standing sufficient to survive a motion to dismiss and vacated the district court's judgment to the contrary. The district court dismissed the case on remand, holding that Wikimedia did not establish a genuine issue of material fact as to standing and that further litigation would unjustifiably risk the disclosure of state secrets.The court concluded that the record evidence is sufficient to establish a genuine issue of material fact as to Wikimedia's standing, and thus the district court erred in granting summary judgment to the government on this basis. However, the court concluded that the state secrets privilege prevents further litigation of this suit. Furthermore, Wikimedia's other alleged injuries do not support standing. The issue before the Washington Supreme Court’s in this case was whether an individual’s YouTube channel qualified as “news media” for requests for certain records under the Washington Public Records Act (PRA). In 2014, Brian Green and Peter Auvil went to the County-City Building in Tacoma to file a document and pay a parking ticket. As they went through security, the guard asked to search Auvil’s bag. Auvil refused. A Pierce County deputy sheriff came to assist, and Auvil began to record a video of the interaction on his phone. Auvil continued to refuse to allow the security guard to search the bag, arguing that the security checkpoint was a violation of his privacy rights. The conversation escalated, and the deputy asked the men to leave. When Green stood too close to him, the deputy shoved Green and caused him to fall backward onto the floor. The deputy arrested Green for criminal obstruction and took him to jail. He was released approximately 24 hours later. The prosecuting attorney’s office dismissed the charge. In December 2017, Green e-mailed a PRA request to the Pierce County Sheriff’s public records office requesting “[a]ny and all records of official photos and/or birth date and/or rank and/or position and/or badge number and/or date hired and/or ID Badge for all detention center and/or jail personnel and/or deputies on duty November 26 & 27 2014.” A representative of the Sheriff’s “Public Disclosure Unit” sent 11 pages of records, but did not include photographs or dates of birth as requested, explaining that the information was exempt under the PRA. Green said he was “working on a story concerning the Pierce County Jail” and again signed his e-mail with the title, “Investigative Journalist.” Green claimed his 6,000-subscriber YouTube channel met the definition of “news media” under the PRA. The Supreme Court concluded the statutory definition of “news media” required an entity with a legal identity separate from the individual. Green did not prove that he or the Libertys Champion YouTube channel met the statutory definition of “news media,” and, thus, he was not entitled to the exempt records. The Louisiana Supreme Court granted certiorari to determine whether the lower courts correctly ruled an online marketplace was obligated as a "dealer" under La. R.S. 47:301(4)(l) and/or by contract to collect sales tax on the property sold by third party retailers through the marketplace’s website. Wal-Mart.com USA, LLC (“Wal-Mart.com”) operated an online marketplace at which website visitors could buy products from Wal-Mart.com or third party retailers. From 2009 through 2015, Wal-Mart.com reported its online sales in Jefferson Parish, Louisiana of its products and remitted the required sales tax to the Louisiana Department of Revenue and ex-officio tax collector, then Sheriff Newell Normand (Tax Collector). The reported sales amount did not include proceeds from online sales made by third party retailers through Wal-Mart.com’s marketplace. Following an attempted audit for this period, Tax Collector filed a “Rule for Taxes” alleging Wal-Mart.com “engaged in the business of selling, and sold tangible personal property at retail as a dealer in the Parish of Jefferson,” but had “failed to collect, and remit . . . local sales taxes from its customers for transactions subject to Jefferson Parish sales taxation.” In addition, Tax Collector alleged that an audit of Wal-Mart.com’s sales transactions was attempted, but Wal-Mart.com “refused to provide [Tax Collector] with complete information and records” of Jefferson Parish sales transactions, particularly, those conducted on behalf of third party retailers. In connection with online marketplace sales by third party retailers, Tax Collector sought an estimated $1,896,882.15 in unpaid sales tax, interest, penalties, audit fees, and attorney fees. The Supreme Court determined an online marketplace was not a “dealer” under La. R.S. 47:301(4)(l) for sales made by third party retailers through its website and because the online marketplace did not contractually assume the statutory obligation of the actual dealers (the third party retailers), the judgment of the trial court and the decision of the court of appeal were reversed and vacated. The DC Circuit declined to vacate the FCC's 2018 Order in its entirety, which classified broadband internet access services as an information service under Title I of the Communications Act of 1934, as amended by the Telecommunications Act of 1996. Specifically, the 2018 Order classified broadband internet as an "information service," and mobile broadband as a "private mobile service." In the Order, the Commission adopted transparency rules intended to ensure that consumers have adequate data about Internet Service Providers' network practices, and the Commission applied a cost-benefit analysis, concluding that the benefits of a market-based, "light-touch" regime for Internet governance outweighed those of common carrier regulation under Title II.The court held, under the guidance of National Cable & Telecomms. Ass'n v. Brand X Internet Servs., 545 U.S. 967, 980–981 (2005), that the Commission permissibly classified broadband Internet access as an "information service" by virtue of the functionalities afforded by DNS and caching. The court also held that, even though petitioners' reading of a functional equivalence in 47 U.S.C. 332(d)(3) was not foreclosed by the statute, the agency's interpretation of that term, and its application to mobile broadband, were reasonable and merit Chevron deference. Furthermore, the court held that the Commission's rationales in favor of its reading of Section 706 of the Telecommunications Act was reasonable, and agreed that the transparency rule was authorized by 47 U.S.C. 257. Therefore, the court upheld the 2018 Order with two exceptions. The court held that the Commission has not shown legal authority to issue its Preemption Directive, which would have barred states from imposing any rule or requirement that the Commission "repealed or decided to refrain from imposing" in the Order or that is "more stringent" than the Order. Accordingly, the court vacated that portion of the Order. The court also remanded the Order to the agency on three discrete issues regarding public safety, pole attachments, and the Lifeline Program. These consolidated appeals stemmed from the cyberattack of multiple OPM databases that resulted in the data breach of sensitive personal information from more than 21 million people. Plaintiffs alleged that OPM's cybersecurity practices were inadequate, enabling the hackers to gain access to the agency's database of employee information, in turn exposing plaintiffs to heightened risks of identity theft and other injuries. The district court dismissed the complaints based on lack of Article III standing and failure to state a claim.The DC Circuit held that both sets of plaintiffs have alleged facts sufficient to satisfy Article III standing requirements; the Arnold Plaintiffs have stated a claim for damages under the Privacy Act, and have unlocked OPM's waiver of sovereign immunity, by alleging OPM's knowing refusal to establish appropriate information security safeguards; KeyPoint was not entitled to derivative sovereign immunity because it has not shown that its alleged security faults were directed by the government, and it is alleged to have violated the Privacy Act standards incorporated into its contract with OPM; and, assuming a constitutional right to informational privacy, NTEU Plaintiffs have not alleged any violation of such a right. The Second Circuit affirmed the district court's grant of defendant's Rule 12(b)(6) motion to dismiss an action challenging a Connecticut law imposing recycling fees on electronics manufacturers. VIZIO alleged that Connecticut's E-Waste Law effectively regulated interstate commerce in violation of the Commerce Clause. The court analyzed the claim through a "well-worn path," N.Y. Pet Welfare Ass'n, Inc. v. City of New York, 850 F.3d 79, 89 (2d Cir. 2017), and held that VIZIO failed to articulate entitlement to relief under this familiar rubric. The court declined to extend the extraterritoriality doctrine in such a way as to prohibit laws that merely consider out‐of‐state activity, did not apply the user fee analysis to VIZIO's case, and found no burden on interstate commerce that was clearly excessive to the considerable public benefits conferred by Connecticut's E‐Waste Law. Thirteen Illinois municipalities claimed that the online travel agencies (OTAs), including Expedia, Priceline, and Travelocity, have withheld money owed to them under their local hotel tax ordinances. The OTAs operate their online travel websites under the “merchant model”; customers pay an OTA directly to reserve rooms at hotels the OTA has contracted with. The participating hotels set a room rental rate. The OTA charges the customer a price that includes that rate, the estimated tax owed to the municipality, and additional charges for the OTA’s services. After the customer’s stay, the hotel invoices the OTA for the room rate and taxes and remits the taxes collected to the municipality. Contracts between hotels and the OTAs confirm that the OTAs do not actually buy, and never acquire the right to enter or grant possession of, hotel rooms. The municipalities claim that OTAs do not remit taxes on the full price that customers pay. The Seventh Circuit affirmed summary judgment in favor of the OTAs. None of the municipal ordinances place a duty on the OTAs to collect or remit the taxes, so the municipalities have no recourse against the OTAs View "Village of Bedford Park v. Between 1996-1999, Skulason was convicted of three misdemeanors involving the operation of a vehicle. In 2000, she applied for a real estate salesperson’s license. The Bureau of Real Estate initiated an administrative proceeding by filing a statement listing Skulason’s three convictions and alleging that they “constitute[d] cause for denial of [Skulason’s] application,” Gov. Code, 11504. The proceeding settled in 2004. Skulason admitted the allegations; the Board agreed to issue a restricted license. The settlement did not require the parties to maintain its confidentiality. In 2010, Skulason obtained an unrestricted license. Three years later, she obtained court dismissals of her three misdemeanor convictions. The Bureau maintains a public website that contains information about real estate licensees, including Skulason. It identifies her license number, its unrestricted status, the dates of issuance and expiration, and actions the Bureau has taken involving her license. Under the heading “Disciplinary or Formal Action Documents,” is a link to the case number of the administrative proceeding that resulted in Skulason’s 2004 restricted license. The court of appeal reversed an order that the Bureau remove the information. The Board has no mandatory duty to remove from its website publicly available information about a licensee’s convictions, including convictions that are eventually dismissed under Penal Code sections 1203.4 and 1203.4a.
