The Board denied Petitioner's application and instead granted Petitioner ordinary disability benefits. The Supreme Court affirmed, holding that the Board based its decision on legally competent evidence that Petitioner's employment was not the natural and proximate cause of her disability. The Supreme Court affirmed the judgment of the court of appeals denying Appellant's request for a writ of mandamus against the State Highway Patrol Retirement System (HPRS), holding that Appellant was not entitled to an order compelling HPRS to vacate its finding that his disability was "not in the line of duty" and to grant disability retirement "in the line of duty."Appellant, a state trooper, applied to HPRS for permanent and total disability retirement benefits based on the diagnosis of an L5-S1 disk collapse and right-side disc bulge, as well as disintegration of L5-S1 vertebrae and arthritis. HPRS approved Appellant's disability but concluded that Appellant's condition did not occur in the line of duty. Appellant filed a complaint for a writ of mandamus, but the court of appeals denied the request. The Supreme Court affirmed, holding that Appellant failed to show that HPRS abused its discretion when it found that Appellant's injury did not occur in the line of duty. View "State ex rel. Goldstein worked until March 2013. The Employment Development Department (EDD) granted him unemployment insurance benefits, which he received in March 2013 through August 10, 2013. In August 2013, he successfully applied for disability benefits, which he received until he exhausted his maximum benefit amount in September 2014. Goldstein filed another unemployment claim, which had an effective date of March 23, 2014. EDD determined that Goldstein’s second claim was invalid under Unemployment Insurance Code section 1277 because during the benefit year of his first claim he neither was paid sufficient wages nor performed any work. An ALJ and the Appeals Board agreed while acknowledging that disability benefits qualify as wages under section 1277.5. The court of appeal affirmed, finding that the Board erred, but the error was not prejudicial. A claimant can establish a valid claim under section 1277(a) even if he received unemployment insurance benefits during the benefit year of the prior valid claim if both the earnings and work requirements are satisfied. Goldstein satisfied the earnings requirement and the Board erred in ruling otherwise but there is no evidence Goldstein performed services for pay during that time. View "Goldstein v. The Supreme Court affirmed the order of the circuit court denying Petitioners' appeal and petition for writ of mandamus and affirming the order issued by the Martinsburg Police Civil Service Commission, holding that the circuit court did not err in ruling that the Commission's awarding points to a candidate on competitive examination for promotion based on education credentials did not violate the requirements of the Police Civil Service Act (Act), W. Va. Code 8-14-6 to -24.Petitioners, both of the Martinsburg Police Department, sat for competitive examinations for promotions. Without the consideration of points for education, both petitioners would have finished with sufficient scores for promotion. The Commissioner heard Petitioners' arguments on the legality of awarding points for education and found no basis to deviate from its established rule. The circuit court affirmed the final order issued by the Commission. The Supreme Court affirmed, holding that the circuit court did not commit reversible error in concluding that the Commission's consideration of higher education as a component of "experience" under the Act was consistent with the Act's purpose of ensuring meritorious promotions. Julie Reed sued her former employer, KeyPoint Government Solutions, LLC (“KeyPoint”), for violating the federal False Claims Act. Her qui tam claims alleged KeyPoint violated the Act by knowingly and fraudulently billing the government for work that was inadequately or improperly completed. Reed also claimed that KeyPoint fired her in retaliation for her efforts to stop KeyPoint’s fraud. The issues this case presented for the Tenth Circuit's review centered on whether: (1) the district court erred in granting summary judgment in KeyPoint's favor on Reed's qui tam claims; and (2) whether the district court erred in dismissing Reed's retaliation claim under Federal Rule of Civil Procedure 12(b)(6). According to Reed, KeyPoint’s management not only knew of systemic violations but also encouraged them by pressuring investigators to rush investigations to maximize revenue. Alarmed by the abuses, Reed voiced her concerns within the company. Reed’s efforts to curb the violations failed. Eventually, KeyPoint fired Reed. About a month later, Reed and her counsel contacted the Department of Justice (“DOJ”) and discussed the abuses she claimed to have witnessed while at KeyPoint. At the government’s urging, Reed sued KeyPoint in January 2014. Her operative complaint raised three qui tam claims and a retaliation claim. The qui tam claims alleged that KeyPoint violated the False Claims Act by: (1) falsely certifying that it performed complete and accurate investigations, (2) falsely certifying that it did proper case reviews and quality-control checks, and (3) falsifying corrective action reports. Reed’s retaliation claim alleged that KeyPoint fired her for trying to stop it from violating the False Claims Act. The Tenth Circuit determined Reed pled sufficient facts to survive a motion for summary judgment with respect to the False Claims Act, but not enough to survive dismissal of her retaliation claim. The Tenth Circuit concluded Reed failed to show KeyPoint knew of her protected activities such that the company was on notice of her efforts to stop its alleged violations. The Supreme Court reversed the judgment of the court of appeals granting a writ of mandamus compelling the Ohio Public Employees Retirement Board (the OPERS board) to grant Appellee membership status and service credit in the Ohio Public Employees Retirement System and denied the writ, holding that there was "some evidence" to support the OPERS board's conclusion that Appellee was an independent contractor rather than a contract employee.The OPERS board found that Appellee was an independent contract under Ohio Adm.Code 145-1-42. The court of appeals granted Appellee a writ of mandamus, concluding that the OPERS board abused its discretion in finding that Appellee was an independent contractor. The Supreme Court reversed, holding that the language of Appellee's contract, the fact that he was required to submit invoices in order to be paid for his work, and his ineligibility for benefits that were available to contract employees satisfied the "some evidence" standard supporting the conclusion that Appellee was an independent contractor. In this dispute between the Board of Education of the Town of New Milford (Board) and the New Milford Education Association (Union) the Supreme Court affirmed the judgment of the trial court denying the Board's application to vacate a grievance arbitration award and granting the Union's application to confirm the grievance arbitration award, holding that the arbitrator did not manifestly disregard the law and properly concluded that the Union's grievance was arbitrable.The Union, which represented the teachers employed by the Board, filed a grievance alleging that the Board had violated an agreement between the parties. The arbitrator decided the grievance in the Union's favor. The trial court denied the Board's application to vacate the grievance arbitration award and granted the Union's application to confirm the award. The Supreme Court affirmed, holding that the trial court (1) correctly denied the Board's application to vacate the grievance arbitration award on the grounds that the arbitrator manifestly disregarded the law by concluding that the doctrines of collateral estoppel and res judicata did not apply to bar the Union's grievance; and (2) the trial court properly concluded that the Union's grievance was arbitrable under the terms of the agreement. The Pennsylvania Supreme Court granted discretionary review to determine whether the Commonwealth Court erred in holding appellant Daniel Harmon was disqualified from receiving unemployment compensation benefits pursuant to Section 402.6 of the Unemployment Compensation Law. Appellant was a part-time employee at Brown’s Shop Rite beginning February 14, 2013. By December, he was convicted of driving with a suspended license and sentenced to a term of 60 days’ imprisonment to be served on 30 consecutive weekends, beginning March 14, 2014 and ending August 7, 2014. Appellant’s employment with Brown’s Shop Rite was terminated on March 24, 2014 due to a violation of company policy, which was unrelated to his incarceration. He then filed for benefits and received them for the week ending March 29, 2014 through the week ending July 26, 2014. This period included weeks when appellant was serving his sentence of weekend incarceration. The Supreme Court held appellant was not disqualified from receiving unemployment compensation benefits, and therefore reversed the order of the Commonwealth Court. View "Harmon v. The Supreme Court affirmed the decision of the court of appeals reversing the decision of the Kansas Workers Compensation Board (Board) affirming an ALJ's denial of Helen Knoll's application for hearing with the Kansas Division of Workers Compensation (Division), holding that Kan. Stat. Ann. 44-523(f)(1) controlled Knoll's claim and required its dismissal.More than five years after Knoll filed her application with the Division, Employer moved to have Knoll's claim dismissed under section 44-523(f)(1) because the claim had not proceeded to a final hearing within three years of the filing of an application for hearing. The ALJ concluded that Knoll's motion for extension was timely and entered an award of compensation. The Board affirmed the ALJ's denial of the motion to dismiss. The Court of Appeals reversed, concluding that dismissal was appropriate because Knoll did not file a motion for extension within three years of filing her application for hearing. The Supreme Court affirmed, holding (1) if a workers compensation claimant filed an application for hearing under Kan. Stat. Ann. 44-534 after Kan. Stat. Ann. 44-523(f)(1) took effect in 2011, the 2011 statute governs the claim; and (2) because Knoll filed her application for hearing six months after the 2011 amendments became effective, section 44-523(f)(1) controlled her claim. The Supreme Court affirmed the decisions of the Court of Appeals and the Kansas Board of Workers Compensation concluding that Kan. Stat. Ann. 44-523(f)(1) unambiguously requires a claimant to move for extension within three years of filing an application for hearing for the claim to survive a proper motion to dismiss, holding that the statute unambiguously prohibits an ALJ from granting an extension unless a motion for extension has been filed within three years of filing the application for hearing.Appellant filed an application for hearing with the Kansas Division of Workers Compensation asserting that he fell and injured himself while working for Employer. Approximately three years later, Employer filed an application for dismissal, arguing that the ALJ should dismiss Appellant's claim under section 44-523(f) because Appellant had failed to move the claim toward a hearing or settlement within three years of filing his application for hearing. The ALJ granted Employer's application to dismiss. The Board and Court of Appeals affirmed. The Supreme Court affirmed, holding that the Court of Appeals' interpretation of the statute was correct.
