International Union of Painters & Allied Trades, District Council No. 4 v. New York State Department of Labor
In this case concerning the interpretation of New York’s constitutional prevailing wage requirement, the Court of Appeals upheld the New York State Department of Labor’s statute-based policy limiting the payment of apprentice wages on public work projects to apprentices who are performing tasks within the respective trade classifications of the approved apprenticeship programs in which they are enrolled, holding that the Department’s interpretation of the relevant statute was rational.Plaintiffs brought this declaratory judgment action asserting that the Department’s interpretation of N.Y. Labor Law 220(3-3) violates the plain meaning of the law and that the statute permits contractors on public works to pay apprentices the posted apprentice rates provided that they are registered in any Department-certified apprenticeship program. Supreme Court granted summary judgment for Defendants, concluding that the Department’s analysis was an arbitrary and irrational interpretation of the statute. The Appellate Division reversed. City of Phila. FD v. WCAB; Appeal of: Sladek, S.
The Pennsylvania Supreme Court granted discretionary review to address two issues associated with workers’ compensation claims by firefighters suffering from cancer. First, the Court had to determine the evidentiary requirements for a claimant to demonstrate that he or she has an “occupational disease,” as that term is defined in Section 108(r) of the Workers’ Compensation Act (the “Act”). Second, the Court had to decide whether epidemiological evidence may be used by an employer to rebut the evidentiary presumption that the claimant’s cancer is compensable as set forth in Section 301(f) of the Act. With respect to the first issue, the Supreme Court concluded that pursuant to Section 108(r), the claimant has an initial burden to establish that his or her cancer is a type of cancer that is capable of being caused by exposure to a known IARC Group 1 carcinogen. With respect to the second, the Court concluded that epidemiological evidence was not sufficient to rebut the evidentiary presumption under Section 301(f). View "City of Phila. FD v. Appeal of James Cole
This case arose out of the termination of petitioner James Cole by the New Hampshire Department of Information Technology (DOIT). One of Cole’s initial assignments was overhauling an Account Security Form (ASF). This was intended to be a short-term project. Although some aspects of Cole’s work on this project were satisfactory, his incorrect processing of other aspects of the overhaul resulted in audits being conducted on the forms to ensure accuracy. Cole was also initially assigned a “Wireless Access Point” Project (WAP). This project required communication with customers who were requesting installation of a WAP, and coordination with the persons who were to install the WAPs. However, Cole’s communications were inadequate. This resulted in customers not knowing how to use the WAPs after they were installed, or even that the WAPs had been installed. Cole was given three warnings over the course of his employment. The New Hampshire Personnel Appeals Board (PAB) upheld Cole’s termination. On appeal, Cole argued his termination did not comply with New Hampshire Administrative Rules, Per 1002.08 because he did not receive the three letters in accordance with New Hampshire Administrative Rules, Per 1002.04 for the same or substantially similar conduct or offense. DOIT argued the New Hampshire Supreme Court lacked subject matter jurisdiction to decide this case, and, in the alternative, that Cole’s termination complied with Per 1002.08 and Per 1002.04. Finding that it had jurisdiction, the Supreme Court affirmed the PAB’s decision. View "Appeal of James Cole" on Justia Law
Bower v. Eaton Corp.
The Supreme Court affirmed the award of the Nebraska Workers’ Compensation Court, holding that none of Employee’s contentions on appeal warranted modification of the award.In his petition, Employee sought temporary total disability benefits, vocational rehabilitation, payment of past and future medical bills, and waiting-time penalties and attorney fees. The Supreme Court affirmed, holding that the Workers’ Compensation Court did not err by failing to (1) award permanent disability based on a loss of earning capacity rather than a member impairment rating; (2) award permanent disability based on a twelve-percent member impairment rating rather than a fifteen-percent member impairment rating; (3) award a waiting-time penalty from the date of the injury rather than the date of payment of benefits in August 2016; (4) award Employee out-of-pocket medical expenses; and (5) award reimbursement of vacation time and short-term disability. Appeal of State Employees’ Association of New Hampshire, Inc., SEIU, Local 1984
Petitioner State Employees’ Association of New Hampshire, Inc., SEIU, Local 1984 (Union), appealed a New Hampshire Public Employee Labor Relations Board (PELRB) order finding respondent State of New Hampshire did not commit an unfair labor practice by prospectively eliminating salary enhancements for newly hired Sununu Youth Services Center (SYSC) employees under the parties’ collective bargaining agreement (CBA). Based on its review of the PELRB record, the New Hampshire Supreme Court concluded that, as a matter of law, the Union’s withdrawal of a proposal during the mediation phase that led to the adoption of the 2015-2017 CBA established that elimination of the salary enhancements was a bargained-for result of the new CBA. Exby-Stolley v. Board of County Commissioners
Plaintiff Laurie Exby-Stolley sued her former employer, the Board of County Commissioners of Weld County, Colorado (the County), under the Americans with Disabilities Act (ADA). She alleged the County had failed to accommodate her disability, resulting in the loss of her job. The jury returned a verdict for the County. Exby-Stolley appealed, arguing: (1) the district court improperly instructed the jury that she needed to prove she had suffered an adverse employment action; (2) the district court refused to instruct the jury on a claim of constructive discharge or allow her to argue constructive discharge in closing argument; and (3) the district court misallocated the burden of proof in its undue-hardship jury instruction. Payan v. United Parcel Service
Charles Payan appealed the district court’s grant of summary judgment in favor of United Parcel Service (“UPS”) in relation to his claims for racial discrimination and retaliation arising under Title VII and 42 U.S.C. 1981, as well as his state law claims for breach of contract and breach of the covenant of good faith and fair dealing. Payan identified himself as Hispanic and worked for UPS since 1991. UPS uses the “Ready Now” list to determine candidates for promotions, so Payan’s removal from the list meant that he could no longer be considered for promotions. Charles Martinez, Payan's direct supervisor, continued thereafter to rate Payan’s promotion status as “Retain at Current Level,” meaning he believed Payan needed more time to develop before being promoted. After Payan’s downgrade, two UPS employees with similar credentials were promoted to Security Division Managers, positions that Payan wanted but was not eligible for in light of his promotion status downgrade. In November 2012, and in response to the recommendations of Martinez, UPS put Payan through a Management Performance Improvement Process (“MPIP”), designed to “help employees who are not performing well go through a formalized training with their manager to help them improve their skill sets so they could perform effectively and eliminate whatever those deficiencies are.” At some point, UPS determined Payan was not meeting the plan’s requirements. Shortly thereafter, Payan filed a charge of discrimination with the Equal Employment Opportunity Commission (“EEOC”). Payan alleged that he had been subjected to harassing and degrading behavior from Martinez and that his non-Hispanic coworkers were not treated in such a way. He also alleged that UPS retaliated against him by placing him on an MPIP. The EEOC ultimately dismissed Payan’s charge of discrimination and issued him a right-to-sue letter. Finding no reversible error in the district court's grant of summary judgment to UPS, the Tenth Circuit affirmed. View "Payan v. United Parcel Service" on Justia Law
Belling v. Emp’t Sec. Dep’t
Christopher Belling was forced to litigate to receive workers' compensation. The Employment Security Department sought to share in his award. Under some circumstances, when a person is forced to litigate to recover an award, others who seek to share in that award must also share in attorney fees. Under RCW 50.20.190, when a person receives both unemployment and workers' compensation benefits, the unemployment benefits must be repaid. The statute allows for situations when "equity and good conscience" makes repayment unfair under the circumstances. The Washington Supreme Court held in this case, the Department has to consider whether equity and good conscience required it to share in Belling's attorney fees as part of its large consideration of whether it would be fair to partially waive reimbursement of overpaid benefits under RCW 50.20.190(2). Given the case presented to the Department, the Supreme Court could not say the Department erred in declining to reduce reimbursement to account for Belling's attorney fees and costs. In re Grievance of Kobe Kelley
The State appealed a Vermont Labor Relations Board decision interpreting a collective bargaining agreement between the State and the Vermont State Employees’ Association (VSEA). The question at issue was whether a change made to the agreement’s family-leave provisions in 1999 limited an employee’s right to use more than six weeks of accrued, paid sick leave while on family leave because of the employee’s own serious illness. The Board found that, although the agreement itself was ambiguous, extrinsic evidence showed that the parties did not intend to limit the use of sick leave. The State argued on appeal to the Vermont Supreme Court that the contract was not ambiguous and that the limitation on use of sick leave applies. Atempa v. Pedrazzani
Paolo Pedrazzani was the owner, president, secretary, and director of Pama, Inc. which did business as Via Italia Trattoria (Via Italia), a restaurant in Encinitas. During the time period for which the trial court awarded the civil penalties at issue, Pama employed 71 individuals at Via Italia. Labor Code section 558 (a) provided that an employer "or other person acting on behalf of an employer" who violates or causes a violation of the state's applicable overtime laws shall be subject to a civil penalty. Similarly, section 1197.1 (a) provided that an employer "or other person acting either individually or as an officer, agent, or employee of another person" who pays or causes to pay an employee less than the state's applicable minimum wage shall be subject to a civil penalty. Following a trial, the superior court issued civil penalties against Pedrazzani as the corporate employer's owner as the "other person" who caused violations of these two statutes. The issue on appeal was whether any individual other than the corporate employer can ever be found liable for the civil penalties associated with statutory violations in the payment of wages to a corporate employee where, as here, there is no allegation or finding that the corporate laws have been misused or abused for a wrongful or inequitable purpose. The Court of Appeal modified judgment against Pedrazzani to the extend that civil penalties assessed were not distributed in accordance with the applicable statutory scheme; otherwise, the judgment was affirmed.
