Glaviano v. Sacramento City Unified School District
After Jerald Glaviano interceded in a confrontation between two of his students, the Sacramento City Unified School District (the District) placed him on unpaid leave and issued an accusation and a notice of intent to dismiss or suspend him without pay. The Commission on Professional Competence (Commission) dismissed the accusation and ordered the District to reinstate Glaviano to his former position with back pay and benefits. Education Code section 449441 provided that if the Commission determines an employee should not be dismissed or suspended, the governing board of the school district shall pay “reasonable attorney’s fees incurred by the employee.” Glaviano requested fees based on the prevailing hourly rate for similar work in the community, but the trial court concluded the fee award must be based on the reduced hourly rate Glaviano’s counsel actually charged. The issue presented on appeal was whether the phrase “reasonable attorney’s fees incurred by the employee” in section 44944 necessarily limited a fee award to fees actually charged. The Court of Appeal concluded it did not. The Court found the lodestar method appropriate: reasonable hours spent, multiplied by the prevailing hourly rate for similar work in the community. Plumley v. Kroger, Inc.
The Supreme Court affirmed the opinion of the court of appeals affirming the decision of the Workers’ Compensation Board upholding the decision of the administrative law judge (ALJ), which awarded Michael R. Plumley permanent partial disability benefits.On appeal, the Court held that the ALJ did not err (1) by relying upon the medical report of Dr. Greg Snider, who evaluated Plumley under the range-of-motion method and used terminology different from that which Plumley would use to describe essentially the same condition; (2) by finding that Plumley had three distinct work-related injuries, for each of which the ALJ made three tandem benefit awards rather than a single-injury with a single-benefit award; and (3) in his use of modifier multipliers. Ford Motor Co. v. Jobe
The Supreme Court affirmed the judgment of the court of appeals affirming the decision of the Workers’ Compensation Board (Board) affirming the decision of the administrative law judge (ALJ) awarding Donald Jobe benefits regarding his back.Jobe, an employee of Ford Motor Company, suffered a right hip injury stemming from a work-related accident. Jobe applied for workers’ compensation benefits, asserting that he sustained a low back impairment due to the hip injury. The ALJ found that Jobe’s work-related hip injury was a proximate cause of his low back impairment and awarded Jobe benefits for a fourteen percent permanent partial disability, temporary total disability benefits for the periods he was off work due to his back impairment, and medical benefits. The Board affirmed, concluding that the ALJ had substantial evidence to support his finding that Jobe’s low back impairment had a causal connection to the work-related injury. The court of appeals affirmed. The Supreme Court affirmed, holding that the ALJ based his decision that Jobe’s back impairment was work-related on substantial evidence. View "Ford Motor Co. v. Kegerise v. Delgrande, et al,
Dr. Susan Kegerise sought reinstatement as superintendent of the Susquehanna Township School District, as well as back pay and benefits. In January 2010, Kegerise was appointed superintendent. In 2013, the District’s Board of Directors extended Kegerise’s contract for a three-year term after agreeing, at Kegerise’s request, to include a resignation provision in her employment contract. Kegerise alleged this resignation clause was necessary to protect her interests in light of several Board members’ inappropriate behavior. Kegerise further alleged that, this clause notwithstanding, and in an effort to force her resignation, several Board members persisted in hostile actions including, inter alia, physical intimidation and verbal abuse, even after the contract was executed. In 2014, Kegerise informed the Board that she was receiving medical care and would be unable to return to work until April 21, 2014. While Kegerise was on medical leave, the Board received several letters from Kegerise’s counsel asserting that Kegerise had been constructively discharged. The Board responded by affirming that Kegerise remained the Superintendent of Schools, and that “[h]er time away from the District since that day has been recorded as sick leave derived from Dr. Kegerise’s pre-existing sick leave accumulation.” On April 17, 2014, Kegerise filed a complaint at the United States District Court, alleging, inter alia, that the Board had constructively discharged her. Kegerise asserted that, “although no formal termination has taken place, [she] cannot perform the job duties of Superintendent,” due to the Board’s behavior toward her. Kegerise sought damages in excess of six million dollars, including compensatory and economic damages “for loss of contractual salary and other emoluments of employment” and consequential damages for “damage to professional reputation and loss of future salary as an educational administrator.” The trial court held an evidentiary hearing to determine whether Kegerise had intended to resign when she filed her federal complaint, after which, it ordered the Board to reinstate Kegerise to her position with back pay and benefits. The Board appealed to the Commonwealth Court; the Commonwealth Court affirmed the trial court’s grant of mandamus. The Pennsylvania Supreme Court, however, found Kegerise did not demonstrate to a clear legal right to reinstatement. Appeal of State Employees Association/Service Employees International Union, Local 1984
Petitioner, the State Employees’ Association of New Hampshire/Service Employees’ International Union, Local 1984 (Union), appealed a New Hampshire Public Employee Labor Relations Board (PELRB) order dismissing its unfair labor practice complaint against respondent, the Community College System of New Hampshire (CCSNH). The Union argued the PELRB erred in ruling that CCSNH was not obligated to: (1) bargain over wages for on-campus tutoring services performed by adjunct faculty; and (2) compensate an adjunct faculty member for lost tutoring income resulting from his participation in collective bargaining negotiations. The New Hampshire Supreme Court concluded that the tutoring services at issue here were, if anything, more closely related to the normal adjunct faculty members’ duties than the extracurricular activities in Appeal of Berlin Education Association, 125 N.H. 779 (1984) were related to the teachers’ regular duties. "Thus, the result reached in Berlin applies a fortiori to control the outcome here. Either way, the PELRB erred as a matter of law." Because the plain language of RSA 273-A:11, II obligated CCSNH to afford “[a] reasonable number of employees who act as representatives of the bargaining unit . . . a reasonable opportunity to meet” for collective bargaining negotiations “during working hours without loss of compensation or benefits,” the Supreme Court agreed with the Union that CCSNH had to compensate the adjunct faculty for the tutoring hours he missed while attending such negotiations. Heffernan v. Vermont
Katherine Heffernan appealed the trial court’s decision dismissing her complaint, which sought indemnification from the State on a default judgment she obtained against a state employee and which claimed that the State was vicariously liable for the employee’s conduct. The State determined that the acts alleged by Heffernan were outside the scope of the employee’s official duties and that, therefore, the State did not have a duty to defend the employee against Heffernan’s action. Heffernan, unable to locate the employee to make service of process, eventually served him through process by publication. Heffernan notified the State that she had served the employee, and the State again declined to take any action. The employee did not appear or offer any defense in Heffernan’s suit, and the trial court eventually issued a default judgment against him. The court subsequently held a hearing on damages and awarded Heffernan both punitive and compensatory damages. The Vermont Supreme Court found that while Heffernan presented complex arguments, its decision regarding both of her theories of State liability was controlled by the plain language of Vermont’s statutory scheme concerning each issue. Pursuant to the clear limitations on liability in Vermont’s Tort Claims Act, the State retains sovereign immunity relative to the actions alleged in Heffernan’s complaint. Irwin v. Jefferson County Personnel Board
Paul Irwin, Jr., appealed a final judgment of the Jefferson Circuit Court dismissing his claim for injunctive relief against the Jefferson County Personnel Board ("the Board") and the City of Trussville ("Trussville"). This case arose from Trussville's desire to hire a police chief following the retirement of its former chief. Trussville interviewed Irwin and two other candidates from a certified list of candidates. Trussville did not hire Irwin or any other candidate from the certified list supplied by the Board in January 2017. Instead, Trussville returned the list to the Board and requested that the Board administer a new test for the position of Police Chief II. On January 23, 2017, the Board "expired" the eligibility list. On January 27, 2017, the Board also approved Trussville's request to hire a provisional police chief until such time as a new assessment examination could be administered and a new eligibility list generated. On March 1, 2017, Irwin sued the Board and Trussville, contending that, once the Board issued to Trussville a certified list of eligible candidates for the position of police chief, Trussville was required to hire a candidate from that list and had no discretion to leave the position unfilled. The complaint sought only injunctive relief. The Alabama Supreme Court determined the specific actions Irwin sought to enjoin –- the administration of a new examination for the position of Trussville's police chief and the appointment of a candidate to the position of police chief who was not on the January 2017 certified list –- have since occurred. Wynne v. Menard, Inc.
The Supreme Court reversed the decision of the Nebraska Workers’ Compensation Court sustaining Appellant’s motion for summary judgment insofar as it awarded her benefits for two scheduled injuries but denied her claim that she was permanently and totally disabled. The Court held (1) there was no merit to Appellant’s first assignment of error that Appellant’s employer admitted, through its responses to Appellant’s requests for admission, that Appellant was permanently and totally disabled; but (2) the trial court erred in weighing the evidence in the summary judgment matter and concluding that Appellant was not permanently and totally disabled. Bureau of Workers’ Compensation v. Verlinger
The definition of “claimant” for purposes of Ohio Rev. Code 4123.931(G) is any party who is eligible to receive compensation, medical benefits, or death benefits from the Ohio Bureau of Workers’ Compensation. Further, a claimant becomes eligible at the time of the injury or death that occurred during the course of employment and remains eligible unless and until a determination that the claimant is not entitled to benefits has been made and has become final or, if no claim is filed, until the time allowed for filing a claim has elapsed.Loretta Verlinger, a benefits applicant, appealed the denial of her application to the Industrial Commission. During the pendency of the appeal, Verlinger settled claims with Metropolitan Property and Casualty Insurance Company and Foremost Property and Casualty Insurance Company. The Commission subsequently allowed Verlinger’s claim. The trial court granted summary judgment for Verlinger, concluding that she was not a claimant pursuant to section 4123.931. The Supreme Court vacated the judgment, holding (1) Verlinger was a claimant at the time she settled with the insurance companies; and (2) Metropolitan and Foremost were jointly and severally liable to the Ohio Bureau of Workers’ Compensation, a statutory subrogee, for the full amount of its subrogation interest. Powell v. Bear Valley Community Hospital
The Board of Directors (the Board) of Bear Valley Community Hospital (Bear Valley) refused to promote Dr. Robert O. Powell from provisional to active staff membership and reappointment to Bear Valley's medical staff. Dr. Powell appealed the superior court judgment denying his petition for writ of mandate to void the Board's decision and for reinstatement of his medical staff privileges. Dr. Powell practiced medicine in both Texas and California as a general surgeon. In 2000, the medical executive committee of Brownwood Regional Medical Center (Brownwood), in Texas, found that Dr. Powell failed to advise a young boy's parents that he severed the boy's vas deferens during a hernia procedure or of the ensuing implications. Further, the committee found that Dr. Powell falsely represented to Brownwood's medical staff, on at least two occasions, that he fully disclosed the circumstances to the parents, behavior which the committee considered to be dishonest, obstructive, and which prevented appropriate follow-up care. Based on the committee's findings, Brownwood terminated Dr. Powell's staff membership and clinical privileges. In subsequent years, Dr. Powell obtained staff privileges at other medical facilities. In October 2011, Dr. Powell applied for appointment to the medical staff at Bear Valley. On his initial application form, Dr. Powell was given an opportunity to disclose whether his clinical privileges had ever been revoked by any medical facility. In administrative hearings generated by the Bear Valley Board’s decision, there was a revelation that Dr. Powell had not been completely forthcoming about the Brownwood termination, and alleged the doctor mislead the judicial review committee (“JRC”) about the circumstances leading to that termination. Under Bear Valley's bylaws, Dr. Powell had the right to an administrative appeal of the JRC's decision; he chose, however, to bypass an administrative appeal and directly petition the superior court for a writ of mandamus. In superior court, Dr. Powell filed a petition for writ of mandate under Code of Civil Procedure sections 1094.5 and 1094.6, seeking to void the JRC's/Board's decision and to have his medical privileges reinstated. The trial court denied the petition, and this appeal followed. On appeal of the superior court’s denial, Dr. Powell argued he was entitled to a hearing before the lapse of his provisional staff privileges: that the Board surreptitiously terminated his staff privileges, presumably for a medical disciplinary cause, by allowing his privileges to lapse and failing to act. The Court of Appeal determined the Bear Valley Board had little to no insight into the true circumstances of Dr. Powell’s termination at Brownwood or the extent of his misrepresentations, thus the Board properly exercised independent judgment based on the information presented. In summary, the Court of Appeal concluded Bear Valley provided Dr. Powell a fair procedure in denying his request for active staff privileges and reappointment to the medical staff. View "Powell v.
