DOJ v. FLRA
At issue in this case was whether the provisions in the Master Agreement between the Agency and the Union covered a matter with respect to which the parties had a dispute after the Master Agreement was signed. The Agency argued that the DC Circuit's decision in BOP I, 654 F.3d 91 (D.C. Cir. 2011), was controlling. In BOP I, the court held that "Article 18 covers and preempts challenges to all specific outcomes of the assignment process." The court held, in accord with BOP I, that the subject of consolidated relief rosters was covered by Article 18 of the Master Agreement. Sierra Packaging & Converting, LLC v. Chief Administrative Officer of Occupational Safety & Health Administration
Exposure to a hazard can be demonstrated by facts establishing that exposure to the hazard is reasonably predictable.Appellant in this case argued that the Nevada Occupational Safety and Health Administration (NOSHA) improperly cited it for violating 29 C.F.R. 1910.132(f), which requires employers to provide training regarding the use of personal protective equipment to employees exposed to hazards requiring the use of such equipment. Specifically, Appellant argued that it was improperly cited for a violation because no facts established that its employees were actually exposed to such a hazard in the course of their work or were required to have fall protection training. The Nevada Occupational Safety and Health Review Board upheld NOSHA’s citation. The Supreme Court reversed, holding (1) when a statute or regulation requires NOSHA to establish employee exposure to a hazard, the Board’s decision regarding a NOSHA citation may be upheld if NOSHA presents substantial evidence demonstrating that exposure to the hazard was or would be reasonably predictable; and (2) the Board in this case relied on an incorrect standard in evaluating the citation. Matheny v. Scolapio
The Supreme Court affirmed the order of the circuit court granting mandamus relief to Lieutenant Gregory Scolapio and finding that Scolapio was entitled to a hearing before the Harrison County Civil Service Commission for Deputy Sheriffs regarding the decision of Robert Matheny, Sheriff of Harrison County, to terminate his employment. The court held (1) the circuit court did not err in determining that Scolapio was entitled to receive both a pre-disciplinary hearing before the hearing board and a de novo evidentiary hearing before the Commission; and (2) the circuit court did not err in permitting the Sheriff to intervene in the proceedings. Hopkins County Coal v. Mine Safety and Health Administration
Gatlin, an employee of Hopkins County Coal (HCC), was terminated from his job after refusing to perform a pre-shift examination that he believed entitled him to extra pay. Gatlin filed a discrimination complaint with the Mine Safety and Health Administration (MSHA). After forwarding the complaint to HCC and making an initial request to interview HCC managerial employees, the MSHA sent a letter requesting to review documents that it claimed were necessary to properly evaluate Gatlin’s claim. Following a series of letters and a site visit, HCC refused to produce Gatlin’s personnel file and the personnel files of other employees at the mine who faced discipline during the previous five years for engaging in the conduct that led to Gatlin’s termination. An MSHA investigator issued citations and an order to HCC under sections 104(a) and (b)1 of the Mine Safety and Health Act, 30 U.S.C. 814. An ALJ with the Federal Mine Safety and Health Review Commission upheld the citations and order. The Commission and the Sixth Circuit affirmed, rejecting HCC’s claims that the MSHA exceeded its authority under the Mine Act by demanding company personnel documents without first identifying any basis for a discrimination claim and the MSHA’s demands to inspect the records violated HCC’s Fourth Amendment rights. Walker v. Physical Therapy Bd. of California
Grace Walker appealed a superior court judgment denying her petition for a writ of administrative mandamus. The petition asked the court to set aside a decision of the Physical Therapy Board of California (the "Board") that subjected Walker to discipline based on a misdemeanor hit-and-run conviction and the Board's finding she had used alcohol in a manner dangerous to herself or others. The superior court concluded the misdemeanor conviction was not an appropriate ground for discipline because it was not sufficiently related to Walker's fitness to practice physical therapy, but that discipline was appropriate pursuant to Business and Professions Code sections 2239 and 2660 based on Walker's use of alcohol in a dangerous manner. On appeal, Walker argued the court erred because the statutes did not permit discipline of a physical therapist based on a single isolated instance of alcohol use in a dangerous manner without a specific finding of a nexus between the conduct at issue and the fitness of the individual to practice physical therapy. The Court of Appeal concluded sections 2239 and 2260 did permit the Board to impose discipline in this context and affirm the judgment. View "Walker v. Anderson v. EMCOR Group, Inc.
The Supreme Court affirmed the order of the Workers’ Compensation Court awarding an injured employee unspecified vocational rehabilitation. A vocational rehabilitation counselor recommended formal training. A vocational rehabilitation specialist, however, “denied” the proposed plan, concluding that formal training was not reasonable or necessary. The compensation court dismissed Employer’s petition to eliminate the formal training requirement and ordered that Employee was entitled to participate in the proposed vocational rehabilitation plan. The Supreme Court affirmed, holding that the findings of the compensation court were supported by competent evidence, and the plan would comport with the statutory goal to return the injured employee to “suitable employment.” View "Anderson v. Toyota Motor Manufacturing, Kentucky, Inc. v. Prichard
The Supreme Court affirmed the opinion of the court of appeals, which affirmed the decisions of the Workers’ Compensation Board and the Administrative Law Judge (ALJ) holding that Kathy Prichard was entitled to reopen her workplace injury claim almost seven years after her initial award of workers’ compensation benefits but within four years of a subsequent order granting her additional disability benefits. The court held (1) Prichard’s motion to reopen was timely filed within the four-year limitation period contained in Ky. Rev. Stat. 342.125(3); and (2) Prichard demonstrated through objective medical evidence a change in her disability indicating a worsening of her impairment, as required for reopening a claim under section 342.125(1)(d). Pearson Ford v. Workers’ Comp. Appeals Bd.
In this case, we deny relief on a petition for review of an award of benefits made by the Workers' Compensation Appeals Board (WCAB). In 2006, while working at Pearson Ford, Leopoldo Hernandez accidentally slammed the trunk of a car on his left hand and crushed one of his fingers. Although no bones in his hand were broken, he was unable to continue working at Pearson Ford because of continuing pain in his hand and shoulder. Hernandez applied for and received workers' compensation benefits. Pearson Ford's workers' compensation carrier retained the services of a private investigator, who conducted video surveillance of Hernandez following each of the three visits to his doctor in early 2010. Following each visit, Hernandez was observed taking off his sling, using his left hand to get in and out of his truck or a car, using his left hand to steer his truck or car, and on one occasion stopping at a grocery store and using his left hand to carry a bag of groceries. After the investigator witnessed other instances of Hernandez using his allegedly injured left hand, the carrier notified the district attorney, who in turn, commenced its own investigation. In specified circumstances, a worker who engages in criminal fraud in attempting to recover workers' compensation benefits and is convicted of doing so is thereafter barred from recovering benefits growing out of the fraud. However, in given circumstances where, independent of any fraud, a worker is able to establish his or her entitlement to benefits, benefits may be awarded. Here, the WCAB found evidence, independent of a worker's fraud, that he had suffered a compensable injury and was entitled to benefits. In doing so the WCAB relied on the determination of a medical expert. The Court of Appeal found no error in the WCAB's determination the workers' claim was not barred by the eventual misdemeanor conviction for workers' compensation fraud and in the WCAB's adoption of the expert's finding of a permanent disability. Pyle v. Woods
Defendant James Woods, a detective in the Cottonwood Heights Police Department, was informed by Utah’s Unified Fire Authority (“UFA”) that medications, including opioids and sedatives, were missing from several UFA ambulances. Detective Woods accessed a state database and searched the prescription drug records of 480 UFA employees in an effort to “develop suspect leads of those who have the appearance of Opioid dependencies.” Consistent with Utah law at the time, Woods did not obtain a search warrant before accessing the Database. Based on the information Woods obtained from the Database search, he developed suspicions about Plaintiffs Ryan Pyle and Marlon Jones. Neither Plaintiff, however, was ever prosecuted for the thefts from the ambulances. Plaintiffs brought separate lawsuits pursuant to 42 U.S.C. 1983, each challenging Defendants’ conduct as violative of the Fourth Amendment and the Fair Credit Reporting Act (“FCRA”). In both suits, the district court dismissed the claims against Defendant Woods, concluding Woods was entitled to qualified immunity because the law governing warrantless access to prescription drug information by law enforcement was not clearly established. The district court also dismissed the FCRA claims because Defendants’ actions fit within an exemption set out in the Act. In Jones’s suit, the district court dismissed the constitutional claims against the city of Cottonwood Heights with prejudice because Jones’s complaint failed to state a claim for municipal liability plausible on its face. In Pyle’s suit, the district court dismissed the constitutional claims against Cottonwood Heights without prejudice, concluding Pyle failed to notify the Utah Attorney General of those claims as required by Rule 5.1 of the Federal Rules of Civil Procedure. Pyle and Jones each appealed. Exercising jurisdiction pursuant to 28 U.S.C. 1291, and finding no reversible error, the Tenth Circuit Court of Appeals affirmed the district court’s judgments. Parkinson v. Department of Justice
Sacramento FBI Agent Parkinson led a group tasked with relocating a previously compromised undercover facility. In 2006, the FBI leased a facility from Rodda, who agreed to contribute $70,000 to construction, documents, permits and fees. Parkinson negotiated the lease for the FBI, and managed the tenant improvement funds. In 2008, during the work, Parkinson made whistleblower-eligible disclosures, implicating pilots in misconduct. Parkinson’s supervisor issued Parkinson a low-performance rating, removed him as group leader, and reassigned him. Believing this to be retaliation, Parkinson contacted Senator Grassley, who forwarded Parkinson’s allegations to the Department of Justice’s Office of the Investigator General (OIG), which OIG sent the FBI its report. The Merit Systems Protection Board (MSPB) upheld Parkinson’s subsequent termination for lack of candor under oath and obstruction of the Office of Professional Responsibility. The Federal Circuit sustained the obstruction charge and dismissal of Parkinson’s affirmative defense of violations of the Uniformed Services Employment and Reemployment Rights Act, but remanded the lack of candor charge. On rehearing, en banc, the court concluded that 5 U.S.C. 2303 requires all FBI employees to bring claims of whistleblower reprisal to the Attorney General and vacated that portion of its prior opinion.
