In January 2011, plaintiff-appellant Virgin Bunn was hired for a one-year probationary period as a human resources assistant at the United States Forest Service’s (“USFS”) Albuquerque Service Center. Ten months into the job, Bunn's supervisor became concerned about Bunn's job performance. After his supervisor asked a colleague to oversee Bunn’s work, Bunn complained to his supervisor about the colleague’s comments to him. Bunn later contacted USFS’s Equal Employment Opportunity (“EEO”) Counselor Office about these comments. On January 6, 2012, Bunn was fired. Bunn thereafter filed an EEO complaint with the United States Equal Employment Opportunity Commission (“EEOC”) alleging harassment, a hostile work environment, and retaliation. An administrative law judge dismissed the suit, granting summary judgment to the agency on all claims. The USDA’s Office of Adjudication issued a final order implementing the EEOC’s decision. Bunn appealed. The Office of Federal Operations affirmed the USDA’s final decision. After its review of the matter, the Tenth Circuit Court of Appeals found: Bunn's appeal of the summary judgment order was untimely; and (2) there was no reversible error in the district court's order striking Bunn's motion to vacate. After the Department discharged plaintiff based on her failure to report another deputy's use of force against an inmate and her failure to seek medical assistance for the inmate, the Commission affirmed the discharge. However, the trial court granted plaintiff's petition for writ of mandate and directed the Commission to set aside the discharge, award her back pay, and reconsider a lesser penalty.The Court of Appeal reversed and held that the Department did not abuse its discretion in discharging plaintiff where plaintiff's conduct furthered the code of silence at the Men's Central Jail, requiring the Department to take action. In this case, plaintiff's conduct in following the code of silence undermined the Department's trust and confidence in plaintiff as a deputy sheriff and negatively impacted the operation of the jail. Furthermore, at the Commission hearing, plaintiff minimized her responsibility to report the use of force. Therefore, given the Department's reasoned explanation that the discharge was necessary, the court concluded that this is not the exceptional case where reasonable minds cannot differ on the appropriate penalty. In a matter of first impression, the issue this case presented for the Pennsylvania Supreme Court's review was the appropriate test to determine whether a claimant who is otherwise entitled to receive unemployment compensation benefits due to a separation from employment becomes ineligible for those benefits as a result of being self-employed pursuant to Section 402(h) of the Unemployment Compensation Law (the Act, known as the self-employment exclusion). The Court held that Section 4(l)((2)(B), 43 P.S. section 753(l)(2)(B), contained the appropriate test for determining whether or not an individual is in self-employment. If an individual was not in “self-employment,” then he remained eligible for benefits. Applying that test to the facts of this case, the Supreme Court affirmed the Commonwealth Court's ruling that the claimant was not self-employed. View "Lowman v. Unemp. Comp. Virgil Adams, a self-described journeyman carpenter, worked sporadically from 2009 to 2011 at a house located on Snow Bear Drive in Anchorage. He suffered a “T12 burst fracture with incomplete spinal cord injury” when he fell from the house’s roof in 2011, and became permanently and totally disabled as a result of the fall. He filed a claim with the Alaska Workers’ Compensation Board, and, because the property owner for whom he worked had no workers’ compensation insurance, the Workers’ Compensation Guaranty Fund was joined to the workers’ compensation case. The Fund disputed whether the property owner for whom the carpenter worked was an “employer” as defined in the Alaska Workers’ Compensation Act and contended the worker’s intoxication caused the accident. The Board decided the injury was compensable based on two findings: (1) the property owner was engaged in a real-estate-related “business or industry” and (2) the worker’s alleged intoxication did not proximately cause the accident. The Fund appealed to the Alaska Workers’ Compensation Appeals Commission; the Commission reversed because, in its view, the Board applied an incorrect legal test in determining whether the property owner was an employer and no evidence in the record could support a determination that the property owner was engaged in a “business or industry” at the time of the injury. The Commission decided the intoxication issue was not ripe for review. After review, the Alaska Supreme Court reversed the Commission’s decision, finding the Board did not legally err and substantial evidence supported its employment-status decision. The California State Teachers’ Retirement System (CalSTRS) determined that Ernest Moreno’s retirement benefits had been incorrectly calculated and initiated proceedings to adjust Moreno’s retirement benefits and collect the overpayment. The trial court denied Moreno’s petition for writ of administrative mandamus challenging the CalSTRS actions. Moreno appealed, contending: (1) CalSTRS’s adjustment of his retirement benefits and collection of the overpayment were barred by the statute of limitations found in Education Code section 22008 (c) because CalSTRS was on inquiry notice of the problem as early as 2008; and (2) CalSTRS should have been equitably estopped from adjusting his retirement benefits and collecting the overpayments. After review, the Court of Appeal concluded: (1) CalSTRS was not on inquiry notice of the reporting error that led to overpayment until December 2014 when it began an audit of Moreno’s retirement benefits, and, therefore, CalSTRS’s adjustments to Moreno’s retirement benefits and collection of overpayments were not barred by the statute of limitations; and (2) CalSTRS was not equitably estopped because CalSTRS was not apprised of (or on notice about) the overpayments until December 2014. In this appeal by allowance, the issue presented for the Pennsylvania Supreme Court was whether application of the Pennsylvania Human Relations Act (“PHRA”) to the judicial branch of our tripartite form of government violated separation of powers principles. On April 3, 1989, the Lehigh County Court of Common Pleas (“CCP”) Office of Adult Probation hired Appellant Michael Renner as a Parole Officer. In July 2011, Appellant informed Lehigh County Chief Probation Officer John Sikora that he had been diagnosed with a serious mental health condition and was hospitalized; he was subsequently absent from work for 4 to 6 weeks. During Appellant’s absence, Sikora telephoned him numerous times to confirm the legitimacy of Appellant’s condition. Upon his return to work, Appellant alleged Sikora and Lehigh County Benefits Manager Mark Surovy, both of whom supervised Appellant, pressured Appellant to resign or take a leave of absence. Appellant confronted Sikora about his hostilities towards him, but Sikora refused to discuss the matter. Subsequently, in March 2014, Sikora terminated Appellant for failing to administer a urine test to an offender under his supervision. Appellant claimed the test was not required and that the reason for his termination was pretextual. Appellant protested his termination to then-President Judge of the CCP Carol McGinley, but Judge McGinley refused to take any action. As a result, Appellant claimed he could not obtain other employment in any other court system, and, in 2014, he filed a charge of unlawful discrimination with the Equal Employment Opportunity Commission, which was dual-filed with the Pennsylvania Human Relations Commission (“PHRC”), against Lehigh County Adult Probation, Sikora, and Surovy. Thereafter, Appellant completed training as a municipal officer, and, subsequently, was offered a police officer position by Northampton and Fountain Hill Boroughs. Appellant alleged that the CCP and Lehigh County learned that Appellant was offered employment as a police officer, and caused an order to be issued banning Appellant from possessing a firearm or taser in the Lehigh County Courthouse, Old Courthouse, and Government Center. As a result, Northampton and Fountain Hill Boroughs rescinded their employment offers. Appellant eventually got his gun possession ban lifted, but as a condition, the CCP and Lehigh County required him to undergo a medical exam, which Appellant contended was a violation of the PHRA. The Pennsylvania Supreme Court concluded that application of the PHRA to the judiciary would violate separation of powers principles, and thus, affirmed the order of the Commonwealth Court. After claimant Danny Arvidson received an award of permanent total disability, insurer Liberty Northwest Insurance Corporation requested a hearing before an administrative law judge (ALJ) to review the award. The ALJ dismissed insurer’s hearing request as time-barred. The question on review before the Oregon Supreme Court was whether that dismissal entitled claimant to attorney fees under ORS 656.382(2), which provided that, if an insurer initiates review of a compensation award and the reviewing body “finds that ... all or part of the compensation awarded ... should not be reduced or disallowed,” the insurer shall pay the claimant’s attorney a “reasonable attorney fee.” The ALJ determined that the statute applied to the dismissal of insurer’s claim and awarded fees to claimant. The Workers’ Compensation Board reached a different conclusion and reversed that decision. The Court of Appeals affirmed without opinion. The Oregon Supreme Court reversed, finding the ALJ correctly determined that his dismissal of insurer’s request for hearing entitled claimant to attorney fees. Delgado, an agent with the Bureau of Alcohol, Tobacco, Firearms, and Explosives, sought relief under the Whistleblower Protection Act, 5 U.S.C. 1214(q)(1)(A), 2302(b)(8), for retaliation he suffered after reporting his suspicions that another ATF agent may have committed perjury during a federal criminal trial. In 2018, the Seventh Circuit held that the Merit Systems Protection Board had acted arbitrarily in dismissing his administrative appeal under the Act and that Delgado had properly alleged “a protected disclosure” and had exhausted his administrative remedies so that the Board had jurisdiction to evaluate his claim. On remand, the Board, acting only through an Administrative Judge (since 2017 the Board has lacked a quorum), denied relief.The Seventh Circuit remanded, only with respect to the relief Delgado is entitled-to. The Administrative Judge “paid only lip-service” to its earlier decision, “ignoring critical holdings and reasoning.” Delgado proved that he made a disclosure that was protected under the Act and proved retaliation for his protected disclosure, which affected decisions to deny him several promotions. Noting that it had “already remanded, only to be met by obduracy,” and that the government had the opportunity to offer evidence to support its affirmative defense, which fails as a matter of law, the court held that Delgado is entitled at least to pay and benefits as if he had been promoted effective March 2014. The Fifth Circuit reversed the Commission's decision affirming the application of OSHA's commercial diving safety regulations to the dives its staff members perform to feed animals housed at the Aquarium and to clean the facility's tanks. A majority of the Commission panel affirmed the ALJ's determination that feeding and cleaning dives did not fall within the "scientific diving" exemption to the commercial standard.The court held that the ALJ did not err in crediting the compliance officer's testimony about the Commercial Diving Operations (CDO) standard as lay opinion testimony; even if the compliance officer testified to some matters that fell outside the realm of lay opinion testimony, the admission of the testimony was harmless; and the Aquarium's witnesses were properly treated as lay witnesses. Under a plain reading of the entire definition of "scientific diving," as well as the regulation guidelines and regulatory history, the court held that the activities performed during the feeding and cleaning dives fall within the plain text of the exemption. In this case, the Aquarium has shown that feeding and cleaning dives are a necessary component of its scientific research. View "Houston Aquarium, Inc. v. The Supreme Court affirmed the decision of the Department of Workforce Services, Unemployment Insurance Commission denying Jesse Gerber unemployment benefits, holding that the Commission correctly determined that Gerber was not eligible for employment benefits.The Commission determined that Gerber had left work voluntarily without good cause and did not qualify for the "returning to approved training" exception in Wyo. Stat. Ann. 27-3-311(a)(i)(B). The Supreme Court affirmed, holding that Gerber did not meet the conditions of the statutory exception, and therefore, the Commission's decision denying Gerber unemployment benefits conformed with the law.
