Ricci v. Merit Systems Protection Board
Immigration and Customs Enforcement (ICE) notified Ricci that she had been “tentatively” selected for a Criminal Investigator position; she was required to satisfactorily complete a background investigation before receiving a final offer of employment. ICE subsequently sent Ricci a “Notice of Proposed Action,” stating that her background investigation had revealed information serious enough to warrant that she be found unsuitable for the position and possibly denied examination for all ICE positions for up to three years. ICE alleged that Ricci had engaged in numerous acts of misconduct while employed with the Boston Police Department. Ricci filed an appeal with the Merit Systems Protection Board, claiming that ICE’s claim was based upon bad intelligence and that ICE was “continuing the . . . discrimination.” The administrative judge explained that the board generally lacks jurisdiction over an individual’s non-selection for a specific position, even if that non-selection is based upon the suitability criteria set out in 5 C.F.R. 731.202. Ricci asserted that ICE’s actions "effectively constitute[d] a suitability action of debarment.”The Federal Circuit affirmed the AJ's dismissal for lack of jurisdiction. ICE’s action was a non-selection for a specific vacant position. ICE did not take any “broader action” against Ricci, such as “debarring her from future agency employment.” Regardless of the impact on an applicant’s ability to secure future federal employment, the board may only review actions designated as appealable. Bonebright v. City Of Miller
The Supreme Court affirmed the judgment of the circuit court affirming the decision of the Department of Labor to award benefits to James Bonebright's widow, Stephanie, after Bonebright died from injuries he sustained in a work-related accident, holding that the workers' compensation claim was not precluded by willful misconduct.Bonebright's employer, the City of Miller, and the City's workers' compensation provider denied workers' compensation liability on the ground that Bonebright had engaged in willful misconduct. Stephanie petitioned the Department for medical and funeral expenses along with indemnity benefits as a surviving spouse. The Department awarded Stephanie benefits, concluding that although Bonebright had engaged in willful misconduct, the City had not established that Bonebright's failure to follow safety precautions was a proximate cause of his injury and death. The circuit court reversed the Department's willful misconduct finding. The Supreme Court affirmed, holding that Stephanie's claim was not precluded by willful misconduct because the City did not demonstrate bona fide enforcement of its safety rules. View "Bonebright v. Annayeva v. SAB of the TSD of the City of St. Louis
The Supreme Court affirmed the decision of the Labor and Industrial Relations Commission denying Appellant's claim for workers' compensation benefits for injuries she suffered when she fell while entering her workplace, holding that Appellant failed to prove that her injury arose out of and in the course of her employment.An administrative law judge denied Appellant any workers' compensation benefits, concluding that Appellant did not meet her burden of showing that her fall was the prevailing factor causing the conditions of which she complained. The Commission affirmed, holding that Appellant failed to establish that her injury arose out of her employment. The Supreme Court affirmed, holding that Appellant's claim was noncompensable because she failed to prove her injury arose out of and in the course of her employment because the hazard or risk involved was one Appellant was equally exposed to in her regular, nonemployment life. Crane v. Raber’s Discount Tire Rack
Danny Crane sought workers' compensation benefits for hearing loss and brain injuries he alleged he suffered in a work-related accident. The workers' compensation commission denied most of Crane's claims, finding he was not entitled to benefits for temporary total disability, permanent impairment, or future medical care. The primary basis for denying these three claims was the commissioner who initially heard the case found Crane was not credible. The court of appeals reversed the commission's denial of temporary total disability benefits, but otherwise affirmed. The South Carolina Supreme Court reversed the commission's denial of permanent impairment and future medical care benefits, finding the commission erred in denying Crane's claims based on credibility without explaining any basis on which credibility could justify ignoring objective medical evidence. Dickerson v. Stamford
The Supreme Court affirmed the decision of the Compensation Review Board, which vacated the decision of the Workers' Compensation Commissioner dismissing Plaintiff's claim for benefits brought pursuant to Conn. Gen. Stat. 7-433c(a), holding that Plaintiff met the jurisdictional prerequisites of section 7-433c and that, on remand, the Commissioner shall determine whether Plaintiff's hypertension was a substantial factor in his subsequent development of heart disease.The Commissioner found that Plaintiff was not entitled to benefits for heart disease because he failed to file a notice of new claim within one year of his diagnosis. In making this finding, the Commissioner rejected Plaintiff's argument that his heart disease diagnosis was the sequela of his compensable claim for hypertension. The Board vacated the Commissioner's dismissal because the Commissioner did not present findings as to whether Plaintiff's heart disease was caused by his hypertension or constituted a new injury. The Supreme Court affirmed and remanded the case, holding (1) when a plaintiff has a compensable claim for hypertension under section 7-433c, the plaintiff may also be eligible for benefits for subsequent heart disease if his heart disease is causally related to his hypertension; and (2) Plaintiff was not required to file a notice of new claim in order to pursue benefits for his heart disease. Coughlin v. Stamford Fire Department
The Supreme Court affirmed the decision of the Compensation Review Board, which reversed the decision of the Workers' Compensation Commissioner denying benefits to Plaintiff pursuant to Conn. Gen. Stat. 7-433c(a), holding that the Board incorrectly determined that Plaintiff's heart disease claim was untimely.The Commissioner found that Plaintiff was neither diagnosed with heart disease nor filed a claim for that disease under section 7-433c until after he had retired. Therefore, the Commissioner concluded that Plaintiff's disease and resulting disability were not suffered while Plaintiff was employed by Defendant and that even if Plaintiff was developing heart disease while he was employed by Defendant that was not sufficient to make the claim compensable. The Board reversed, concluding that it was reasonable to infer that Plaintiff's heart disease was the sequela of his accepted claim under section 7-433c for hypertension. The Supreme Court affirmed, holding (1) Plaintiff's initial claim for hypertension met the requirements of section 7-433c, was timely, and was compensable; and (2) the Board reasonably concluded that Plaintiff's heart disease was the sequela of his hypertension, which was the injury at issue in his primary claim. Lower v. Peabody Powder River Services, LLC
The Supreme Court affirmed the decision of the district court upholding the decision oft he Office of Administrative Hearings (OAH) denying workers' compensation benefits to Appellant, holding that a previous order by the OAH was not a final, appealable order and that collateral estoppel was not applicable.Appellant filed for workers' compensation benefits after his leg was amputated below the knee. The Department of Workforce Services, Workers' Compensation Division (the Division) denied the claim. Appellant appealed, but while the contested case hearing was pending the Division withdrew its denial of benefits. In response, the OAH issued an order vacating the hearing and directing the Division to award workers' compensation benefits. The Division issued a redetermination in favor of Appellant. Appellant's employer objected, and after a contested case hearing, OAH denied workers' compensation benefits. The district court upheld the OAH decision denying benefits. On appeal, Appellant claimed that the first OAH order was a final appealable order awarding benefits and that his employer was collaterally estopped from objecting to the Division's redetermination awarding benefits. The Supreme Court disagreed, holding that the first OAH order was not a "prior adjudication" of workers' compensation benefits and provided no basis to implicate the principle of collateral estoppel. State ex rel. Navistar, Inc. v. Industrial Commission
The Supreme Court affirmed the judgment of the court of appeals denying the request of Gary Bisdorf's former employer, Navistar, Inc., for a writ of mandamus ordering the Industrial Commission of Ohio to vacate its award of permanent total disability (PTD) compensation to Bisdorf, holding that Navistar was not entitled to an extraordinary remedy in mandamus.In its complaint for a writ of mandamus Navistar asserted that the Commission had abused its discretion in several ways. The magistrate recommended that the court of appeals deny the writ. The court adopted the magistrate's recommendation. Navistar appealed and moved for oral argument. After briefing in the Supreme Court was complete, Bisdorf died. Navistar filed a motion to continue the case. The Supreme Court granted Navistar's motion to continue the case, affirmed the judgment of the court of appeals, and denied Navistar's motion for oral argument, holding that Navistar did not make a showing by clear and convincing evidence that the Commission abused its discretion by entering an order not supported by evidence in the record. Kansas v. Garcia
The Immigration Reform and Control Act (IRCA) makes it unlawful to hire an alien knowing that he is unauthorized to work in the U.S., 8 U.S.C. 1324a(a)(1), (h)(3). Employers must use an I-9 form to “attest” that they have “verified” that any new employee “is not an unauthorized alien” by examining approved documents. IRCA requires all employees to complete an I–9, attest that they are authorized to work, and provide specific personal information. It is a federal crime for an employee to provide false information on an I–9 or to use fraudulent documents to show work authorization, 18 U.S.C. 1028, 1546; it is not a federal crime for an alien to work without authorization. State laws criminalizing such conduct are preempted. The I–9 forms and appended documentation and the employment verification system may only be used for enforcement of specified federal laws.Kansas makes it a crime to commit “identity theft” or engage in fraud to obtain a benefit. Unauthorized aliens were convicted for fraudulently using another person’s Social Security number on tax withholding forms that they submitted upon obtaining employment. They had used the same Social Security numbers on their I–9 forms. The Kansas Supreme Court reversed, concluding that IRCA prohibits a state from using any information contained within an I–9 as the basis for a state law identity theft prosecution of an alien who uses another’s Social Security information in an I–9.The U.S. Supreme Court reversed, rejecting the theory that no information placed on an I–9 could ever be used by any entity or person for any reason, other than the listed federal statutes. The sole function of the federal employment verification system is to establish that an employee is not barred from working in this country. The tax-withholding documents play no part in that process. Submitting withholding documents helped the defendants get jobs, but did not assist them in showing that they were authorized to work. The Kansas laws do not fall into a field that is implicitly reserved exclusively for federal regulation. Federal law does not create a unified, comprehensive system regarding the information that a state may require employees to provide. It is possible to comply with both IRCA and the Kansas statutes; the Kansas prosecutions did not frustrate any federal interests. View "Kansas v. Garcia" on Justia Law
BHC Northwest Psychiatric Hospital, LLC v. Secretary of Labor
The Hospital petitioned for review of an administrative decision affirming the Secretary's citation for violating the General Duty Clause of the Occupational Safety and Health Act (OSHA) by inadequately protecting its employees from the recognized hazard of patient aggression toward staff.The DC Circuit held that, to the extent that they were preserved, the Hospital's objections failed to overcome the court's deference for the agency. In this case, substantial evidence supported the IJ's conclusion that the Hospital's incomplete and inconsistently implemented safety protocols were inadequate to materially reduce the hazard posed by patient-on-staff violence. Furthermore, the ALJ's determination that a more comprehensively considered and applied program would materially reduce the hazard was fully warranted by her legal analysis and evidentiary findings. Finally, the court held that the General Duty Clause provided fair notice in this case. Accordingly, the court dismissed in part and denied in part the petition for review.
