New Mexico ex rel. CYFD v. Mercer-Smith
While the parties in this case litigated contempt proceedings over the course of seven years, the children at the center of the case aged out of the system and became peripheral to a nearly $4,000,000 judgment in favor of Respondents Janet and James Mercer-Smith, who pleased no contest to allegations of abuse against their two minor daughters Julia and Rachel. This case began in 2001 as an abuse and neglect proceeding and turned into a dispute over whether Children, Youth and Families Department (CYFD) had violated the district court's decision and Julia and Rachel could not be placed with former employees of a group home where they had been residing. After protracted litigation, the district court held CYFD in contempt for violating its placement decision and, almost four years later, imposed the sanction for the violation, ordering CYFD to pay the Mercer-Smiths more than $1,600,000 in compensatory damages and more than $2,000,000 in attorney fees and costs. The award was based on the district court’s determination that the violation of the placement decision resulted in the loss of the Mercer-Smiths' chance of reconciliation with Julia and Rachel. The New Mexico Supreme Court held that the purpose for which the district court exercised its contempt power was not remedial in nature and therefore could not be upheld as a valid exercise of civil contempt power. City of San Diego v. Superior Court
As part of an internal affairs investigation regarding the unauthorized disclosure of a confidential police report, the San Diego Police Department (Department) questioned plaintiff/real party Dana Hoover, a detective for the Department, regarding the content of communications between Hoover and an attorney representing her in an employment-related lawsuit against defendant/petitioner City of San Diego. Although Hoover invoked the privilege, the Department directed her to answer the internal affairs questions or face discipline and/or termination of employment. The Court of Appeal found the trial court properly concluded that the City violated the attorney-client privilege when Department investigators insisted Hoover respond to questions despite her invocation of the privilege. A deputy city attorney attending the interview as an observer also violated the California State Bar Rules of Professional Conduct when she began questioning Hoover about her lawsuit without the permission of her lawyer in the case. Hoover filed a motion to disqualify the City Attorney in her lawsuit. The Court of Appeal found disqualification of counsel, was a drastic remedy that should be ordered only where the violation of the privilege or other misconduct has a "substantial continuing effect on future judicial proceedings." The Court found the transcript of the internal affairs interview demonstrated that although relevant confidential information could in theory have been elicited in response to the internal affairs questions, in fact no such information was disclosed. Under these circumstances, because "a disqualification order must be prophylactic, not punitive" the drastic remedy of depriving a party of its counsel of choice was unwarranted. In re Texas ex rel. Brian Wice v. 5th Judicial District Court of Appeals
The issue this case presented for the Court of Criminal Appeals’ review centered on whether a trial court could pay an appointed prosecutor at an hourly rate even though the fee schedule approved by the judges of the county only allowed for payment of a fixed fee. Relators (the attorneys appointed to prosecute the defendant) argued that upholding the trial court’s order for payment was appropriate because the trial court’s determination of a reasonable fee for their services was a discretionary call, not a ministerial one. The primary Real Party in Interest (the Collin County Commissioners Court) responded that vacating the trial court’s order for payment was appropriate because the trial court lacked authority to set a fee outside of the fixed rate in the fee schedule approved by the local judges. According to the Commissioners Court, the local rule authorizing the trial court to “opt out” of its own fee schedule conflicts with a statute that requires payment according to that fee schedule. The Court of Criminal Appeals agreed with the Commissioners Court that the statute in question limited the trial court’s authority, and the Court agreed with the court of appeals that the second order for payment should be vacated. Ex parte Utilities Board of the City of Tuskegee.
In May 2017, Jerry Tarver, Sr., sued the Utilities Board of the City of Tuskegee ("UBT") and numerous other defendants seeking damages based on alleged exposure to contaminated water purportedly caused by defendants' combined and concurring negligence. The UBT petitioned the Alabama Supreme Court for a writ of mandamus to direct the Macon Circuit Court to vacate its December 2017 order disqualifying UBT's retained counsel, Huie, Fernambucq & Steward, LLP (the Huie Firm) from representing it in Tarver's suit. The Supreme Court determined Tarver did not present evidence indicating that a Huie firm lawyer, in his capacity as a commissioner of the Alabama Environmental Management Commission, was a conflict of interest regarding the attorney's representation of UBT. Therefore, the attorney was not disqualified under Rule 1.11(a), Ala. R. Prof. Cond., and no disqualification could be imputed to the Huie firm. Griswold v. Homer City Council
Frank Griswold submitted public records requests to the City of Homer, seeking all records of communications between members of the Homer Board of Adjustment, City employees, and attorneys for the City leading up to the Board’s decision in a separate case involving Griswold. He also requested attorney invoices to the City for a six-month period. Citing various privileges, the City Manager refused to provide any records of communications surrounding the Board’s decision; the Manager provided some complete invoices but provided only redacted versions of some invoices and completely withheld some invoices. Griswold appealed the partial denial of his records request to the City Council; the Council affirmed, and Griswold appealed to the superior court. The superior court substantially affirmed. Griswold then turned to the Alaska Supreme Court. After review, the Supreme Court affirmed with respect to the communications relating to the Board’s decision, but vacated and remanded the attorney invoices issue for further analysis. D. A. R. v. R.E.L., D.H., and R.H.
D.A.R. appealed a circuit court judgment dismissing his complaint against R.E.L., D.H., and R.H. D.A.R., a licensed attorney practicing in Alabama, filed a complaint against R.E.L., D.H., and R.H. R.E.L. was also a licensed attorney, and was employed as an assistant general counsel for the Alabama State Bar ("the ASB"). D.H. and R.H. were brothers; they were not attorneys. According to the complaint, at some point before December 2007, R.E.L. and D.H. began "a personal, professional and/or sexual relationship," and R.E.L. and R.H. began "a personal and/or professional relationship." D.A.R. alleged that in December 2007, at R.E.L.'s recommendation and with his assistance, D.H. and R.H. "filed a baseless complaint against [D.A.R.] with the ASB." D.A.R. alleged that the motivation for the complaint was to use it "as a means to protect [D.H. and R.H.] from liability for a debt owed by [them] to a client represented by [D.A.R.] and/or as retaliation for his role in representing that client." According to D.A.R., R.E.L. knew when it was filed that the complaint against D.A.R. was baseless in fact and in law. R.E.L. asserted the defense of absolute immunity, but presented arguments to the trial court establishing why quasi-judicial immunity should apply to the facts presented in D.A.R.'s complaint. The Alabama Supreme Court found D.A.R. failed to demonstrate the trial court erred by dismissing his complaint on the grounds he presented to it, and as such, affirmed the trial court's judgment. Sander v. State Bar of California
Sander and the First Amendment Coalition sought a writ of mandate to obtain information from the State Bar of California’s bar admissions database--individually unidentifiable records for all applicants to the California Bar Examination from 1972 to 2008 in the categories: race or ethnicity, law school, transfer status, year of law school graduation, law school and undergraduate GPA, LSAT scores, and performance on the bar examination. Making these records available to the public in a manner that protects the applicants’ privacy and anonymity, they believe, will allow researchers to study the potential relationship between preferential admissions programs in higher education and a gap in bar passage rates between racial and ethnic groups. The superior court upheld the State Bar’s denial of the request. The court of appeal affirmed. The court correctly found Petitioners’ request to be beyond the purview of the California Public Records Act (Gov. In Re: 40th Statewide IGJ
This appeal centered on a challenge to the practice of requiring private attorneys who may be privy to confidential information related to a grand jury investigation to commit to maintaining the secrecy of all information they may acquire regarding the grand jury. The 40th Statewide Investigating Grand Jury was convened in 2016. Under the authority of the 40th Statewide Investigating Grand Jury, subpoenas requiring the production of documents were recently issued to the Dioceses of Harrisburg and Greensburg (“Appellants” or the “Dioceses”). Their counsel requested a copy of the notice of submission that the Office of the Attorney General (the “OAG”) had provided to the supervising judge. The supervising judge replied that he would furnish a copy of this notice to counsel, but that counsel first would be required to sign and submit appearance form, which included an oath or affirmation to keep all that transpired in the Grand Jury room secret (under threat of penalty of contempt). Counsel declined to accept these terms, however, and Appellants lodged a joint motion to strike the non-disclosure provision from the entry-of-appearance form. They argued that the requirement of secrecy was not authorized by the Investigating Grand Jury Act, both as to the obligation being imposed upon counsel and, alternatively, in terms of the breadth of that duty. The Dioceses’ lead contention was that the secrecy requirement of 42 Pa.C.S.A. Section 4549(b) did not apply to private attorneys, positing that, “[b]y its terms,” Section 4549(b) applies only to persons who are “sworn to secrecy” -- i.e., those who are required in practice to sign an oath of secrecy -- such as “Commonwealth attorneys, grand jurors, stenographers, typists, and operators of recording equipment.” The Pennsylvania Supreme Court concluded an attorney would will be privy to matters occurring before an investigating grand jury shall be sworn to secrecy per the requirements of the Investigating Grand Jury Act, either via an appropriately tailored entry-of-appearance form or otherwise. The obligation of confidentially generally extends to all matters occurring before the grand jury, which includes, but is not limited to, what transpires in a grand jury room. A lawyer otherwise subject to secrecy, however, may disclose a client’s own testimony to the extent that the client would otherwise be free to do so under applicable law. Such disclosure is also subject to the client’s express, knowing, voluntary, and informed consent; the Rules of Professional Conduct; and specific curtailment by a supervising judge in discrete matters following a hearing based on cause shown. Bedford School District v. New Hampshire
The State and other defendants the New Hampshire Department of Education; Margaret Wood Hassan, individually; Christopher T. Sununu, as Governor; Virginia M. Barry, individually; and Frank Edelblut, as Commissioner of the New Hampshire Department of Education, appealed a superior court order granting plaintiffs Bedford School District and William Foote (collectively, “Bedford”), attorney’s fees in a case that Bedford had filed to recover adequate education funding that the State withheld in fiscal year 2016 because of a statutory limit on state funding imposed under RSA 198:41, III(b) (Supp. 2015) (repealed 2015, repeal effective July 1, 2017). On appeal, the State argued that because the trial court specifically declined to find that the State had acted in bad faith in this litigation, the trial court unsustainably exercised its discretion in awarding attorney’s fees. The State also argued that Bedford waived its right to attorney’s fees when it accepted education funds appropriated by a bill that contained a waiver provision. The New Hampshire Supreme Court found after review of the superior court record, that Bedford waived its right to an award of attorney’s fees, and thus reversed the superior court’s order. Nat’l Conference of Black Mayors v. Chico Community Publishing, Inc.
In 2015, the Sacramento News and Review (the newspaper), published by appellant Chico Community Publishing, Inc., investigated Sacramento’s then-Mayor Kevin Johnson and his staff’s use of city resources in the take over and eventual bankruptcy of the National Conference of Black Mayors (the National Conference). As part of that investigation, the newspaper made a request to the City of Sacramento (the City) pursuant to the Act for e-mails in the City’s possession that were sent from private e-mail accounts associated with Johnson’s office. In the City’s review of the records on its servers, it identified communications between Johnson’s office and the law firm which represented the National Conference in its bankruptcy proceedings and Johnson, along with the National Conference, in litigation connected with Johnson’s contested election as the National Conference’s president. The City flagged these e-mails as potentially containing attorney-client privileged information. It then contacted the law firm to notify it that the City was compelled to release these emails because the City had no authority to assert attorney-client privilege over the records on behalf of outside counsel. The law firm contacted the newspaper and asked it to agree the City could withhold any records it determined included attorney-client communications. The newspaper refused and contacted the City, which admitted telling the law firm that some of the emails may have been privileged. Following the newspaper’s refusal to allow the City to withhold e-mails containing attorney-client communications, the National Conference, Johnson in his official capacity as the former president of the National Conference, and Edwin Palmer in his official capacity as Chapter 7 Trustee for the National Conference filed a petition for peremptory writ of mandate against the City and its City Attorney’s Office to prevent disclosure of records to the newspaper. A requester of public records who successfully litigates against a public agency for disclosure of those records is entitled to reasonable attorney fees under the California Public Records Act. The issue this case presented for the Court of Appeal's review was whether the Act also allowed for an award of attorney fees to a requester when the requester litigates against an officer of a public agency in a mandamus action the officer initiated to keep the public agency from disclosing records it agreed to disclose.
