A mother sued the Department of Human Services (DHS) after the death of her son in the home in which DHS placed him. Austin Watkins was removed from the home of his mother, Tammy Watkins, and placed in the home of his paternal grandmother, Janice Mowdy. Approximately a year and a half after Mowdy was awarded durable legal custody of Austin, Austin died from starvation. The trial court granted DHS’s motion for summary judgment, determining that DHS enjoyed sovereign immunity from liability for the acts alleged in the complaint. Upon review of the facts and circumstances of this case, the Supreme Court concluded the trial court erred in granting summary judgment. Zachariah Stennis sued Moss Point School District (MPSD) and several school-district officials for injuries she sustained in an off campus assault by a fellow student and the student’s mother. MPSD filed a motion for summary judgment and a motion to dismiss, which were denied by the circuit court. Upon denial of its motion for reconsideration, MPSD filed this interlocutory appeal. The Supreme Court reversed and remanded, finding that the circuit court erroneously found that MPSD’s duty of ordinary care to provide a safe school environment applied in this case. However, the student handbook evidence presented at trial arguably imposed a duty on the school to report the threat. Based on the record before it, the Supreme Court could not make that determination. As such, the case was remanded for consideration of whether the student handbook imposed such a duty. This appeal stemmed from a grand jury subpoena duces tecum served upon Entergy Mississippi, Inc., that requested the names and billing addresses of all of Entergy's residential customers in two zip codes in Madison County. The subpoena followed Entergy's refusal to provide its customer list to the Madison County Tax Assessor's Office for those geographic areas which the tax assessor had requested in an effort to identify and combat homestead exemption fraud. Entergy appealed the Circuit Court's denial of Entergy's Motion to Quash. But finding not reversible error, the Supreme Court affirmed. View "Entergy Mississippi, Inc. v. Mississippi" on Justia Law

Shirley Adams and other landowners challenged a petition of the U.S. Oil and Gas Association that proposed amendments to Statewide Rule 681 which authorized the surface and subsurface landspreading of NORM as additional methods of disposal. The Mississippi Oil and Gas Board approved the proposed amendments to Rule 68, and its decision was upheld by the Chancery Court. After careful consideration, the Supreme Court found that the landowners failed to prove that the Board's adoption of amended Rule 68 was arbitrary and capricious or against the weight of the evidence. In addition, the Board's decision did not violate federal law or the landowners' constitutional rights; however, the Board violated state law when it exceeded its statutory authority under Section 53-1-17 by amending Rule 68 without gaining the approval of the Mississippi Commission on Environmental Quality. The Mississippi Department of Revenue assessed taxes, penalties, and interest against Isle of Capri Casino, Inc. and its affiliated entities for tax years 2004, 2005, 2006, and 2007. The Department based the assessment on the application of the license fees as a credit, claiming that only the tax liability of four Isle of Capri entities that actually held the licenses were eligible for offset, and could not benefit the affiliated group as a whole. Isle of Capri appealed the Department's assessment first to the Board of Review and then to the Board of Tax Appeals; both affirmed the assessment with minor changes. Isle of Capri appealed again, and the chancery court granted summary judgment in its favor. The Department subsequently appealed. The Mississippi Department of Employment Security determined that distributors for Sara Lee Bakery Group, Inc. (now Earthgrains Bakery Group, Inc.) were agent drivers and commission drivers for Sara Lee, rather than independent contractors, such that Sara Lee was required to pay unemployment insurance taxes for the distributors. The circuit court affirmed, and Sara Lee appealed. Finding that MDES failed to apply the law correctly and that its decision was not supported by substantial evidence, the Supreme Court reversed and remanded the case for further proceedings. The Board of Aldermen for the City of Ridgeland denied Baymeadows, LLC's proposed repair plans to correct 1,478 cited code violations, and Baymeadows appealed. Upon review of the Board's decision, the Supreme Court held that the Board did not adequately state its rationale for denying the proposed plans. Therefore, the Court remanded the case back to the Board either to issue Baymeadows a permit or provide an appropriate factual basis for its denial. View "Baymeadows, LLC v. The Jackson County Board of Supervisors terminated June Seaman, and she applied to the Mississippi Employment Security Commission (MESC) for unemployment benefits. A claims examiner, an administrative-law judge, and the Board of Review all determined that Seaman was entitled to unemployment benefits because Jackson County had failed to prove by clear and convincing, substantial evidence that Seaman had been terminated for misconduct. The circuit court affirmed the agency’s decision, but the Court of Appeals reversed, finding that the employer had proven misconduct by substantial evidence. After its review, the Supreme Court concluded the Court of Appeals improperly reweighed the evidence before the MESC. Therefore, the Supreme Court reversed the Court of Appeals and reinstated and affirmed the circuit court's judgment. View "Jackson County Board of Supervisors v. Sherry Walker was denied disability benefits by the Public Employees’ Retirement System (PERS). The Circuit Court reversed PERS’s decision. The Court of Appeals reversed the circuit court, reinstating PERS’ denial of benefits. Upon review of the matter, the Supreme Court concluded PERS’ decision to deny Walker’s request for regular disability benefits was unsupported by substantial evidence. Accordingly, the Court reversed part of the appellate court's decision and reversed the Circuit Court's decision, and remanded the case with instructions to enter judgment in Walker’s favor on her regular disability benefits claim.
