Video Gaming Technologies v. Rogers County Bd. of Tax Roll Corrections
Video Gaming Technologies, Inc. ("VGT") contended the district court improperly granted summary judgment to the Rogers County Board of Tax Roll Collections ("Board"), the Rogers County Treasurer, and the Rogers County Assessor. VGT is a non-Indian Tennessee corporation authorized to do business in Oklahoma. VGT owns and leases electronic gaming equipment to Cherokee Nation Entertainment, LLC (CNE), a business entity of Nation. Nation was a federally-recognized Indian tribe headquartered in Tahlequah, Oklahoma. CNE owned and operated ten gaming facilities on behalf of Nation. The questions presented to the Oklahoma Supreme Court was whether the district court properly denied VGT's motion for summary judgment and properly granted County's counter-motion for summary judgment. VGT argued that taxation of its gaming equipment was preempted by the Indian Gaming Regulatory Act (IGRA) because the property was located on tribal trust land under a lease to Nation for use in its gaming operations. The County argued that ad valorem taxation was justified to ensure integrity and uniform application of tax law. Due to the comprehensive nature of IGRA's regulations on gaming, the federal policies which would be threatened, and County's failure to justify the tax other than as a generalized interest in raising revenue, the Oklahoma Supreme Court found that ad valorem taxation of gaming equipment here was preempted, and reversed the order of summary judgment, and remanded for the district court to enter an appropriate order of summary judgment for VGT. FMC Corp. v. Shoshone-Bannock Tribes
The Ninth Circuit affirmed the Shoshone-Bannock Tribal Court of Appeals' judgment ruling that FMC must pay an annual use permit fee for storage of hazardous waste on fee lands within the Shoshone-Bannock Fort Hall Reservation pursuant to a consent decree settling a prior suit brought against FMC by the EPA under the Resource Conservation and Recovery Act (RCRA).The panel held that the judgment of the Tribal Court of Appeals was enforceable pursuant to the two exceptions under Montana v. United States, 450 U.S. 544 (1981). First, a tribe may regulate the activities of nonmembers who enter into consensual relationships with the tribe or its members. Second, a tribe retains inherent power to exercise civil authority over the conduct of non-Indians on fee lands within its reservation when that conduct threatens or has some direct effect on the political integrity, the economic security, or the health or welfare of the tribe. In this case, the panel held that the Tribes had regulatory jurisdiction to impose the permit fees because FMC entered into a consensual relationship when it signed a permit agreement with the Tribes. Furthermore, FMC's storage of millions of tons of hazardous waste on the Reservation fell within the second Montana exception. Cherokee Nation v. Zinke
Intervenor-Appellant the United Keetoowah Band of Cherokee Indians in Oklahoma (UKB) purchased an undeveloped 76-acre parcel of land near Tahlequah, Oklahoma, with the intention of developing it into a tribal and cultural center (Subject Tract, or Subject Parcel). The Subject Parcel sat entirely within the boundaries of the former reservation of Appellees the Cherokee Nation of Oklahoma (Nation). In 2004, the UKB submitted an application to the Department of the Interior’s Bureau of Indian Affairs (BIA), requesting the BIA take the Subject Parcel into trust, thereby formally establishing a UKB tribal land base. The Nation opposed the application. After seven years of review, the BIA approved the UKB’s application. The Nation sued Department of the Interior and BIA officials, with the UKB intervening as defendants, challenging the BIA’s decision on several fronts. The district court found in favor of the Nation, determining that the BIA’s decision to take the Subject Parcel into trust was “arbitrary and capricious, an abuse of discretion, and otherwise not in accordance with law.” Among other holdings, the district court concluded that: (1) the BIA had to obtain Nation consent before taking the Subject Parcel into trust; (2) the BIA’s analysis of two of its regulations as applied to the UKB application was arbitrary and capricious; and (3) the BIA must consider whether the UKB meets the Indian Reorganization Act (IRA)’s definition of “Indian” in light of the Supreme Court case Carcieri v. Salazar, 555 U.S. 379 (2009). On appeal, the Tenth Circuit determined the Secretary of the Interior had authority to take the Subject Parcel into trust under section 3 of the Oklahoma Indian Welfare Act of 1936 (OIWA). The BIA was therefore not required to consider whether the UKB met the IRA’s definition of “Indian.” Nor was the BIA required to obtain the Nation’s consent before taking the land into trust. United States v. Idaho
Four appeals arose from a consolidated subcase that was a part of the broader Coeur d’Alene-Spokane River Basin Adjudication (CSRBA). The United States Department of the Interior (the United States), as trustee for the Coeur d’Alene Tribe (the Tribe), filed 353 claims in Idaho state court seeking judicial recognition of federal reserved water rights to fulfill the purposes of the Coeur d’Alene Tribe’s Reservation (the Reservation). The Tribe joined the litigation. The State of Idaho (the State) and others objected to claims asserted by the United States and the Tribe. The district court bifurcated the proceedings to decide only the entitlement to water at this stage, with the quantification stage to follow. After cross-motions for summary judgment, the district court allowed certain claims to proceed and disallowed others. The district court specifically allowed reserved water rights for agriculture, fishing and hunting, and domestic purposes. The district court allowed reserved water rights for instream flows within the Reservation, but disallowed those for instream flows outside the Reservation. The district court determined priority dates for the various claims it found should proceed to quantification, holding generally the Tribe was entitled to a date-of-reservation priority date for the claims for consumptive uses, and a time immemorial priority date for nonconsumptive uses. However, in regard to lands homesteaded on the Reservation by non-Indians that had since been reacquired by the Tribe, the district court ruled the Tribe was entitled to a priority date of a perfected state water right, or if none had been perfected or it had been lost due to nonuse, the Tribe’s priority date would be the date-of-reacquisition. The Idaho Supreme Court affirmed in part and reversed in part. The Supreme Court determined the district court improperly applied the controlling case law's rule of "primary-secondary" distinction and instead should have allowed aboriginal purposes of plant gathering and cultural uses under the homeland purpose theory. Furthermore, the Court determined the priority date associated with nonconsumptive water rights was time immemorial. The Court affirmed the remainder of the district court’s decisions and remanded for further proceedings. View "United States v. Idaho" on Justia Law
In re A.W.
Mother C.W. and father J.C. appealed a juvenile court’s orders terminating parental rights and freeing the minor for adoption. The parents contended the juvenile court erred in failing to find the beneficial parental relationship exception to adoption applied, and that the county and juvenile court failed to comply with the notice requirements of the Indian Child Welfare Act (ICWA). After review of the specific facts of this case, the Court of Appeal disagreed with the parents’ first contention, but conditionally reversed and remanded the matter for further ICWA compliance. United Keetoowah Band of Cherokee Indians in Oklahoma v. FCC
Petitioners challenged one of the FCC's orders paring some regulatory requirements for the construction of wireless facilities. The Order exempted most small cell construction from two kinds of previously required review: historic-preservation review under the National Historic Preservation Act (NHPA) and environmental review under the National Environmental Policy Act (NEPA). Furthermore, the Order effectively reduced Tribes' role in reviewing proposed construction of macrocell towers and other wireless facilities that remain subject to cultural and environmental review.The DC Circuit granted the petitions in part because the Order did not justify the Commission's determination that it was not in the public interest to require review of small cell deployments. In this case, the Commission did not adequately address possible harms of deregulation and benefits of environmental and historic-preservation review pursuant to its public interest authority under 47 U.S.C. 319(d). Therefore, the Order's deregulation of small cells was arbitrary and capricious. The court denied the petitions for review on the remaining claims. Agua Caliente Tribe of Cupeño Indians of the Pala Reservation v. Sweeney
The Ninth Circuit affirmed the district court's order refusing to compel the Assistant Secretary of Indian Affairs to place the Aqua Caliente Tribe of Cupeño Indians on a list of federally recognized tribes published in the Federal Register.The panel held that the Tribe failed to exhaust the regulatory process under 25 C.F.R. 83 to obtain federal recognition. Instead, the Tribe argued that the Part 83 process did not apply because they sought "correction" of the list, not recognition. However, the panel held that framing the issue as one of "correction" was unsupported by the applicable regulations and case law. In regard to the Tribe's equal protection and Administrative Procedure Act claims, the panel held that Interior had a rational basis for not making an exception to the Part 83 process for the Tribe. The panel concluded that it was rational for the Interior to ask the Tribe to demonstrate through the Part 83 process how they are a "distinct Community" from the Pala Band of Mission Indians and "politically autonomous" so that Interior may make the federal-recognition determination, and Interior's explanation for treating the Tribe differently from other tribes passed muster. Kodiak Oil & Gas (USA) Inc. v. Burr
Suits over oil and gas leases on allotted trust lands are governed by federal law, not tribal law, and the tribal court lacks jurisdiction over the nonmember oil and gas companies. This appeal involved a dispute over the practice of flaring natural gas from oil wells, and at issue was the scope of Native American tribal court authority over nonmembers. The Eighth Circuit affirmed the district court's grant of a preliminary injunction enjoining the tribal court plaintiffs and tribal court judicial officials and held that the district court correctly rejected the tribal court officials' argument that this suit was barred by tribal sovereign immunity.The court also held that the district court did not abuse its discretion in granting the preliminary injunction because the oil and gas companies are likely to prevail on the merits. In this case, the district court correctly concluded that the oil and gas companies exhausted their tribal court remedies by moving to dismiss the case for lack of jurisdiction and appealing the issue to the MHA Nation Supreme Court; the district court correctly concluded that the tribal court lacked jurisdiction over the oil and gas companies; and the balance of the remaining preliminary injunction factors, along with the oil and gas companies' strong likelihood of success on the merits, showed that the district court did not abuse its discretion by granting the preliminary injunction. Navajo Nation v. San Juan County
In 2012, the Navajo Nation and several of its individual members sued San Juan County, Utah alleging that the election districts for both the school board and the county commission violated the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution and the Voting Rights Act (VRA) of 1965. The district court denied the county’s motion to dismiss, found that the election districts violated the Equal Protection Clause, and awarded summary judgment to the Navajo Nation. It later rejected the county’s proposed remedial redistricting plan because it concluded the redrawn districts again violated the Equal Protection Clause. The district court then appointed a special master to develop a proposed remedial redistricting plan, directed the county to adopt that remedial plan, and ordered the county to hold special elections based on that plan in November 2018.
On appeal, the county challenged each of the district court’s decisions. Finding no reversible error, the Tenth Circuit affirmed. View "Navajo Nation v. San Juan County" on Justia Law
Paquin v. City of St. Ignace
Plaintiff Fred Paquin served the Sault Ste. Marie Tribe of Chippewa Indians (the Tribe), a federally recognized Indian tribe whose territory was located within the geographic boundaries of Michigan, in two capacities: as the chief of police for the tribal police department and as an elected member of the board of directors, the governing body of the Tribe. In 2010, plaintiff pleaded guilty to a single count of conspiracy to defraud the United States by dishonest means in violation of 18 USC 371, for which he was sentenced to a year and a day in prison. The underlying conduct involved the misuse of federal funds granted to the tribal police department. In both 2013 and 2015, plaintiff sought to run for a position on defendant’s city council in the November general election. Plaintiff was rebuffed each time by defendant’s city manager, who denied plaintiff’s request to be placed on the ballot. In each instance, defendant’s city manager relied on Const 1963, art 11, sec. 8 to conclude that plaintiff’s prior felony conviction barred him from running for city council. Plaintiff brought the underlying declaratory action in the Mackinac Circuit Court, seeking a ruling that his position in tribal government did not constitute employment in “local, state, or federal government” under Const 1963, art 11, sec. 8. The Michigan Supreme Court determined that tribal government did not constitute "local...government." Accordingly, the Court reversed the Court of Appeals and remanded this matter back to the circuit court for further proceedings. View "Paquin v. City of St. Ignace" on Justia Law
